The Transitional Justice (TJ) bodies are likely to be left without any commissioners, at least for a certain period after mid-April, given the Government’s delay in forming a recommendations committee as provisioned by law, reports My Republica on March 16. It is mandatory to form a five-member recommendations committee headed by a former chief justice, in order to appoint members of the TJ bodies. But the Government has not formed the committee so far although less than a month remains for the expiry of existing terms. Former members of the recommendations committee and the conflict victims say the recommendations process may take at least a month even if the committee is formed right away. The appointment process will get prolonged further if the parties fail to agree on the names recommended by the committee. The recommendations committee headed by former chief justice Om Bhakta Shrestha and formed in September 2013 took six months to conduct the consultations process and prepared a roster of prospective candidates. “Once the committee is formed it has to follow certain international norms such as mandatory consultations with the victims, the stakeholders and the political parties. It will surely take at least one or one and half months to complete this process,” said PradipPokharel, a former member of the recommendations committee, “It seems the leadership vacuum at the commissions will remain even if the appointment process is started right away.”

Lawmakers of the Rastriya Janata Party-Nepal (RJP-N) have obstructed the meeting of the House of Representatives (HoR), Lower House of the Federal Parliament, on March 18, demanding that the Government make public the Lal Commission Report, reports The Himalayan Times.A probe commission led by former Supreme Court justice Girish Chandra Lal had submitted the report to the Government on December 15, 2017. The commission was formed to investigate the cases of Human Rights violations during Madhes and Tharuhat movements in 2015 and 2016.RJP-N lawmaker Ani Kumar Jhademanded that Speaker Krishna Bahadur Mahara issue a ruling to the Government to make the Lal Commission’s Report public in the next meeting of the House.This is the third time the party has obstructed the House for the same reason.Previously, the party had obstructed HoR proceedings on March 13 and March 17.

A high-profile province level security meeting of Gandaki Province,on April 6 and 7, has concluded that the Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand)is a major security threat in the province, report My Republica. The high-level meeting reached the conclusion that CPN-Maoist-Chand ranks first in the list of security threats despite being small in size. Chief District Officers (CDOs) of all 11 Districts of the province accepted CPN-Maoist-Chand as the major threat in the province, according to a security personnel who participated in the meeting."Despite being a major security threat, it won't be difficult to control the government-banned party as it is small in size," on conditions of anonymity security official said. Besides that, the monopoly of contractors and mafias in the extraction of resources has also been reported as a threat to security in the province. Not just that, the disputes and controversies in the universities, protests staged by teachers, students and doctors among others have also been seen as threats to provincial security.Home Secretary Prem Kumar Rai urged all to discourage the activities of the CPN-Maoist-Chand outfit as much as possible. "CPN (CPN-Maoist-Chand) must not be allowed to carry out its activities as stated by the government," a source quoted Rai as saying. It is to be noted that more than 15 leaders and cadres of CPN-Maoist-Chand have been arrested in Gandaki so far, adds My Republica. Reportedly, the presence of CPN-Maoist-Chand's outfit is comparatively low in Mannang and Mustang.

The first meeting of the committee to recommend new members and chairpersons of two Transitional Justice (TJ) mechanisms — Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) — on April 7, endorsed their selection process, reports The Himalayan Times. The tenure of existing members of the commissions expires on April 13.As per the selection process, the committee led by former chief justice Om Prakash Mishra will first publish a notice in a national-level newspaper seeking applications from people aspiring for the aforementioned posts. Committee member SharmilaKarki said the notice would be published tomorrow (April 8) in Gorkhapatra national daily.Aspirants need to fill an application form, a sample of which will also be published along with the notice, and submit it to the committee’s secretariat housed at the Ministry of Law, Justice and Parliamentary Affairs within seven days of the publication of the notice.

A total of 60 persons have so far applied for the posts of members and chairpersons of two Transitional Justice (TJ) mechanisms — the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEPD), reports The Himalayan Times on April 26. Of the 60 applications, 49 aspirants got their applications registered at the secretariat of the committee personally, while the rest applied through e-mails. The extended deadline to file applications personally at the secretariat ended at 5:00pm on April 25, while through e-mail the deadline was until 12:00 midnight. Of the 49 applications registered with the secretariat personally, 11 have applied for both – chairpersons and members, four have applied only for chairpersons, and 34 for members.

Conflict victims and civil society members on April 29, staged a demonstration at Maitighar Mandala, demanding amendment to the Transitional Justice Act, reports The Himalayan Times.The agitating conflict victims have demanded that the act be amended in line with the verdicts issued by the Supreme Court at different times. They have also urged the Government to equip the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) with necessary resources — human and financial.The Supreme Court ruled that there should not be amnesty for grave human rights violations such as extra-judicial killing, enforced disappearance, torture, rape and other acts of sexual violence; the statute of limitations for grave offences must be removed; cases recommended by the TRC and the CIEDP must be prosecuted; torture and enforced disappearance must be criminalised through enactment of laws; cases before the court cannot be transferred to the TRC or the CIEDP; dignified and respectable reparation for victims; and no reconciliation without the consent of victims.The conflict victims also demanded that the members and chairpersons of both Transitional Justice (TJ) bodies be appointed only after amending the act.The Government has formed a five-member committee led by former chief justice Om Prakash Mishra to recommend members and chairpersons of both the TJ body.Moreover, the victims have demanded their meaningful representation in both the TJ bodies.

National Human Rights Commission (NHRC) could withdraw its representative from a recommendation committee formed to select new officials for the two transitional justice bodies as a last resort to put pressure on the Government to revise the amendment bill to the National Human Rights Commission Act 2012 and to initiate the process to amend the existing transitional justice Act, reports Kathmandu Post on May 3. A member of the commission said Prakash Osti, who is representing the commission in the recommendation committee, could be recalled if the Government did not promptly take positive steps to address the commission’s concerns. Govinda Sharma Paudyal, who heads the publicity department at the commission, said the constitutional watchdog’s decision will depend upon the move of the Government. “Voices to call our member Osti back from the recommendation committee are getting stronger. If the government doesn’t correct its mistake, a decision to that effect is possible,” he told the Post.

A recommendation committee formed by the Government has started shortlisting the candidates to appoint them to the two commissions, which have been without officials since April 13. Conflict victims and human rights defenders charged the government with backtracking on its earlier commitment to moving the transitional justice process by amending the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act-2014 in line with the Supreme Court ruling and international practices. “The government has tried to fool the victims by forming the recommendation committee without consulting with the victims. The people selected by the committee led by former chief justice Om Prakash Mishra-led cannot deliver in the absence of an appropriate Act. The previous leadership, which was picked despite our reservations, did nothing and wasted four crucial years,” argued SumanAdhikari, former chairperson of the Conflict Victims Common Platform.

The delay in appointment has been caused by ongoing negotiations among political parties or senior leaders. “The delay in recommending officials for the transitional justice bodies is aimed at allowing time for political parties for negotiations,” a source familiar with the ongoing development told the Post on condition of anonymity, citing the sensitivity of the matter. The top leaders of the ruling Nepal Communist Party (NCP) and the opposition Nepali Congress (NC) are said to be in talks to share chairmen and members in the two commissions between the two parties. They have already held at least two meetings attended by NCP Co-chair and Prime Minister KP Sharma Oli, party’s another Co-chair Pushpa Kamal Dahal and NC President Sher Bahadur Deuba. The NCP wants its sympathisers to lead both the commissions, though it is flexible about accommodating a maximum number of members to the NC. The main opposition, however, is adamant that it should have a person of its choice to lead one of the commissions. “This is the main bone of contention,” said the source.

Human rights activists on May 20 urged the Government to sign the Optional Protocol to the Convention Against Torture (OPCAT) to enable an independent body to effectively monitor rights compliance in jails and detention centres across the country, reports The Himalayan Times. This, they say, will deter law enforcement officers from torturing detainees and inmates. Article 1 of OPCAT provisions regular visits by independent international and national bodies to jails and detention centres to prevent torture and other cruel, inhuman or degrading treatment or punishment. Signing OPCAT will place a moral obligation on the Government to form an independent mechanism to monitor rights compliance in jails and detention centres across the country.

Speaking at Parliament on May 20, RJP-N lawmaker Chanda Chaudhary urged the Government to make the report public. “We have been asking the government to make the Lal commission report public for long. However, it has not made the report public despite an instruction for the same by the Speaker,” lawmaker Chanda said. RJP-N has been mounting pressure on the government to publicise the report although the governments formed after the political change of 2006 have never made public the reports submitted by similar commissions. This incident was earlier reported by South Asia Terrorism Portal (SATP) on May 22. In a simultaneous operation, three Pakistani and three Nepali nationals were arrested in Kathmandu with Rs 7.6 crore in fake Indian currency notes (FICN) of Rs 2000 denomination. “Those arrested included FICN kingpin Yunus Ansari,” said a senior DRI official. Ansari is known to have links with India’s most wanted don Dawood Ibrahim and Pakistan intelligence agency ISI (Inter-Services Intelligence) and has been responsible for running FICN network from Nepal. He is also suspected to have links with proscribed Pakistani terror outfit Lashkar-e-Taiba (LeT) that has been responsible for several bomb blasts in India. Son of a former Cabinet minister of Nepal Saleem Mia Ansari, Yunus was arrested twice earlier in 2010 and in 2014 based on DRI information for circulating FICN. “In the last few months, maritime route in the Indian Ocean has been exploited by the international organised narcotic smuggling syndicates for trafficking drugs. The other sensitive route has been India-Pakistan border in J&K where DRI had made seizure of heroin and arms and ammunition in a joint operation with Indian army last year,” a senior DRI official said.

According to a press statement issued by CVCP, the two commissions – the Truth and Reconciliation Commission (TRC) and the Commission on the investigation of Enforced Disappeared Persons (CIEDP) – failed to discharge their duties in accordance with the principles of transitional justice, goals of the Comprehensive Peace Accord and sentiment of the victims. “We demand that the commissions be staffed by competent, independent and qualified TJ expert. We demand that the government should postpone the recommendation process and start consultation on amendment of the law. The National Human Rights Commission should recall its representative from the recommendation committee. The CVCP believes that the process of selecting new commissioners is a part of conspiracy to divert its attention from making an amendment to the TJ Act. This is not acceptable for conflict victims. If the former TRC and CIEDP commissioners are reappointed, the conflict victims will reject the commissions outright. The CVCP has been closely watching the unfolding events,” it stated.

Though no one has claimed responsibility for the blasts, Nepal Police suspects the hand of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand). A pressure cooker bomb went off in a barber’s shop at Sukedhara, Kathmandu killing three persons and injuring four others. Their identities had not been established. However, Police suspect two of the deceased were CPN-Maoist-Chand cadres. Those injured in Sukedhara blast are Hari Khadka, Surendra Maharjan, Jeet Kumar Thakur and Chhotu Thakur. Maharjan is the chairperson of CPN-Maoist-Chand-aligned Newa Mukti Morcha in Kathmandu. Police claimed that the group led by Maharjan was using a room rented by the barber to make bombs. Meanwhile, a cadre of CPN-Maoist-Chand was killed on the spot and another was injured after a powerful bomb went off on the ground floor of a rented house in Ghattekulo, Kathmandu. The deceased has been identified as Prajjwal Shahi. He was reportedly making a bomb when it accidentally went off. Rabin KC of Rukum, who was a room-mate of Shahi, sustained severe head injuries. A Police source told that Shahi and KC were making improvised explosive devices to be planted at a public place. In yet another incident, two persons were injured when a bomb they were carrying on a motorcycle exploded in Nagdhunga, Kathmandu. They have been identified as CPN-Maoist-Chand cadres Akash Lama and Buddha Lama. Meanwhile, Police arrested seven persons in possession of four pressure cooker bombs, pamphlets of CPN-Maoist-Chand and other explosive materials from Koteshwor, Kathmandu.

Lenin Bista, a former Maoist child soldier, on June 6 petitioned the United Nations Office of the High Commissioner for Human Rights in Geneva demanding justice for the thousands of former child soldiers who have been largely left out of the transitional justice process, reports Kathmandu Post.The petition seeks UN support to asking the Nepal Government to prioritise justice for former child soldiers, recalling that a serious crime was committed against the thousands of minors forced to fight on behalf of the Communist Party of Nepal-Maoist during the 10-year armed insurgency.Thousands of Maoist fighters like Bista had been disqualified for being minors during the verification process conducted by United Nations Mission in Nepal (UNMIN) in 2007. Among the 4,008 disqualified combatants, 2,973 were minors while the remaining 1,035 had joined the Maoist People’s Liberation Army after the first ceasefire of May 26, 2006 — six months before the peace deal was signed. The Government had provided between Rs 500,000 and Rs 800,000 for the combatants who chose voluntary retirement. However, those who were disqualified didn’t receive any substantial support, except for a few thousand rupees from the United Nations.

The National Human Rights Commission (NHRC) has urged the Government to initiate action against the perpetrators of torture, reports The Himalayan Times on June 26. In a press statement released by the rights body coinciding with the International Day in Support of Victims of Torture on June 26, the NHRC said besides compensating the victims, the Government had done very little to bring perpetrators to book. Though some of the victims have been compensated by the Government, perpetrators categorically pointed out by the NHRC have yet to be booked. According to the NHRC, it has registered nearly 1,910 complaints related to torture. The rights body completed its inquiry into 1,000 complaints. Of the complaints settled by the rights body, 179 cases are related to recommendations for compensation to the victims and legal action against the perpetrators.

Former Maoist combatant Tilak Pun, district chairman of Dalit Liberation Front Suraj BK, member Hit Prasad Roka, and Rolpa district committee members Posta Man Gharti, Dal Bahadur Khatri, Bal Krishna Sharma, Jit Chhetri, Ramesh Acharya, Bishnu Thapa and Kul Bahadur Oli are also among those arrested. Police have also recovered six pistols, five rifle bullets and explosives, among other things, from those arrested. According to Provincial Police Office, Tulsipur, a total of 192 leaders and cadres of CPN-Maoist-Chand have been arrested from Province 5 so far. Of those, 44 were arrested from Dang alone. Likewise, a total of 28 cadres have been arrested from Rolpa, 19 from Nawalparasi, and 16 each from Bardiya, Pyuthan and Kapilvastu, according to the Provincial Police Office. Similarly, Police have also arrested 11 leaders and cadres of CPN-Maoist-Chand from Banke, 10 from Arghakhanchi, six from Rukum, and five each from Palpa and Gulmi.

Nepal is currently the biggest hub for the India-based terrorist group Indian Mujahedeen, claimed the US State Department claimed, reports Republica on November 5. Releasing a country report on terrorism, the State Department stated "IM’s stated goal is to carry out terrorist actions against Indians for their oppression of Muslims. IM has also expanded its area of operations into Nepal, which is now the biggest hub for IM operatives." In its report, the State Department said that the IM maintains ties to other terrorist entities including Pakistan-based Lashkar-e- Toiba (LeT), Jaish-e-Mohammed (JeM) and Harkat-ul-Jihad-al-Islami (HuJI).
