Locals of Tikapur have expressed deep dissatisfaction after lawmaker-elect of Madhes-based Rastriya Janata Party Nepal (RJPN) from Kailali constituency-1, Resham Chaudhary, the main accused in the Tikapur carnage, was sworn in as a Member of Parliament on January 3, reports My Republica.The victims criticized the oath-taking ceremony and the preparations for Chaudhary’s release from Dillibazar jail prior to the court verdict in the case, calling it a serious violation of the law. Eight people including a Senior Superintendent of Police (SSP) and a two-year-old toddler were killed after agitating Tharuhat activists clashed with Police while attempting to breach a prohibited zone in Tikapur Municipality on August 24, 2015.

Ruling coalition partner Federal Socialist Forum Nepal (FSFN), on January 5, drew the attention of Prime Minister (PM) K P Oli in initiating the constitution amendment process as demanded by the Madhes-based political parties, reports My Republica. Deputy Prime Minister Upendra Yadav took such move after mounting pressure from another Madhes-based party - Rastriya Janata Party Nepal (RJPN) - and the main opposition Nepali Congress (NC) drawing the Government’s attention on the issue.Submitting an 11-point memorandum to the PM at his official residence in Baluwatar, FSFN Chairperson Yadav demanded endorsement of the constitution amendment bill from the ongoing parliament session. Reminding the prime minister that the Government has a comfortable position in parliament with two-thirds majority for statute amendment, the party has sought Oli’s initiative to push forward the amendment process. “The formation of a progressive government in Nepal was itself an achievement,” reads the memorandum submitted to the prime minister. The second point of the 11-point memorandum has demanded immediate homework for the constitution amendment and its endorsement within the ongoing House session to institutionalize the political achievements including federalism, democracy, republic and proportional inclusion. “The prime minister was positive toward our demands and he also assured us of amending the constitution if it is necessary,” said FSFN General Secretary Ram Sahaya Yadav.

Kathmandu-based diplomatic missions including the United Nations (UN) have urged the Government to clarify to the public regarding its plans to take the transitional justice process forward in 2019, reports My Republica.In a press release on January 24, Kathmandu-based diplomatic missions of Australia, Germany, European Union, Finland, France, Norway, Switzerland, United Kingdom, United States of America, and United Nations said "Noting the looming expiration of the mandates of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP), as well as the upcoming fourth anniversary of the 2015 Supreme Court ruling that affirmed certain requirements for transitional justice processes, we encourage the government to clarify to the public its plans to take the transitional justice process forward in 2019." Further, saying that they support a number of principles for transitional justice in Nepal, the diplomatic missions stated "We support a Nepali-designed, Nepali-led process that is consistent with the 2007 and 2015 judgements of Nepal’s Supreme Court and the country’s obligations under international law."The international community have also stressed on the broad public trust in the transitional justice process. "Nepal will not be able to bring closure to the wounds and grievances that persist from the conflict era, nor be able to complete the peace process," the release said. The international community also urged the government to engage in broad-based, meaningful consultation with conflict victims, civil society and wider stakeholders that allows space and time to discuss and address issues raised before action is taken, and helps shape a course of further action that reflects the will of the people."These members of the international community are also united in the view that any solution should have the needs of victims at its heart," the release said.The diplomatic missions, in their release, are of the view that only the peace process move forward on a strong foundation if the needs of the victims are properly addressed."Supporting Nepal in establishing a credible transitional justice process and ensuring the stability and prosperity of Nepal remain priorities for the international community. We are committed to working with the Government of Nepal and all other stakeholders to advance a transitional justice process that engenders broad public confidence," the release stated.

The Nepali Congress (NC),on January 24, termed the decisions made by the Constitutional Council (CC) in absence of main opposition party leader ‘anti-democratic’ after the council recommended names of five individuals for chairperson posts in constitutional commissions in NC President Sher Bahadur Deuba’s absence, reports The Himalayan Times. According to NC Spokesperson Biswo Prakash Sharma, as an opposition party leader is statutory member of the council, decisions made in absence of main opposition leader breach the established procedure and culture. Likewise, the agenda of expiry of the extended tenure of incumbent working committee of its student wing, Nepal Student Union (NSU), was also discussed in a working committee meeting held by the party on January 24.

Angered by the decision of the ruling coalition parties to endorse the disputed National Medical Education Bill by force in Parliament amid its objection, the NC, has decided to intensify protests against the Government across the country, reports My Republica on January 28.A Central Working Committee (CWC) meeting of the party on January 27, decided to hold protests in all district headquarters on February 4. The meeting decided to take such a step against the Government’s move to endorse the disputed medical education bill with force and for going back on the agreements reached in the past with medical reforms crusader Govinda KC. The CWC meeting denounced the Government move to endorse the bill with force, “undermining the voice of the main opposition party in parliament.”“While taking serious note of the move of endorsing the bill on Friday (January 25) against established parliamentary practices and norms using marshals, the meeting strongly denounces such step,” said a press statement issued by the party after the meeting.

Prime Minister (PM) KP Sharma Oli speaking on the occasion of 18th Armed Police Force Day, said that the meeting of the Council of Ministers on January 28, had declared 2,807 security personnel of Nepali Army, Armed Police Force (APF), Nepal Police and National Investigation Department ‘martyrs’, reports The Himalayan Times. The PM said that the Cabinet decision of declaring Police personnel martyrs has developed the culture of respecting all and also the culture of reconciliation as well as given priority to the need to respect and provide relief to martyrs’ families. Praising the progress made by APF in a short period, the PM said, that since some issues of the peace process were still to be resolved, it was high time the wounds of conflict were healed, and “Activities that disrupt peace, spread violence in society, terrorise people and hamper national integrity would not be allowed.”

In a briefing to the Kathmandu-based diplomatic community on the Government’s major policies, priorities and diplomatic engagements here on February 1, Minister for Foreign Affairs Pradeep Gyawali said that the peace process in Nepal had been “fundamentally concluded” — something the international community, mainly the major Western countries and the United Nations (UN), say remains “incomplete.” The briefing comes a week after major Western countries and the UN urged the Government to clarify to the public its plans for taking the TJ process forward in 2019. “While we have noticed concerns expressed in certain quarters for the expeditious conclusion of this process, we believe that this internal matter can be resolved with our commitment and efforts,” said Minister Gyawali. Those issuing the joint statement to urge the Government to clarify its plans to resolve TJ cases included Australia, Germany, the European Union, Finland, France, Norway, Switzerland, the United Kingdom, the USA and the UN. Civil society members have urged the Government to protect complaints and testimonies collected from victims and families of those who were killed or disappeared during the Maoist insurgency, reports My Republica on February 7. Issuing a joint statement on February 6, hours before the parliament debated a new bill to extend the terms of the Truth and Reconciliation Commission (TRC) and the Commission for Enforced Disappeared Persons (CIEDP) for the third time, civil society members called on the stakeholders concerned to hand over complaints, evidences and documents gathered from victims of atrocities to the National Human Rights Commission (NHRC) so as to ensure the privacy of victims and their families. The human rights groups and civil society members have taken a strong exception to the plan saying it could infringe on privacy of the victims. In their complaints, several hundred victims have identified their perpetrators. So far, the CIEDP has conducted detailed investigations into 2,100 cases, while TRC has gone through 3,000 of the 61,000 registered complaints.

Through an amendment to the Transitional Justice Act, the Government has extended the tenure of members of the two commissions till April 13, and tenure of the commissions by one year, with provisions for another one-year extension.As per the act, a five-member recommendation committee headed by former Supreme Court chief justice will recommend members of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP). The recommendation will then be approved by the Cabinet. Even if the Government wants to continue the existing members, which is against the victims’ demand for restructuring the commissions, the act needs to be amended again.Against this backdrop, the victims said it was already late for the formation of the recommendation committee, and any further delay would raise the chances of the commissions existing without members after April 13. Moreover, the victims have demanded their meaningful participation in the process of selecting new TRC, CIEDP commissioners. The international community has also been pressing the government to appoint competent members in the two mechanisms in a transparent manner.

Minister for Law, Justice and Parliamentary Affairs, Bhanu bhakta Dhakal said the committee shall pick new office-bearers to the two TJ commissions constituted to establish the facts and truth of the conflict-time incidents. "The committee will select the persons to be nominated to the two commissions. The high-level meeting reached the conclusion that CPN-Maoist-Chand ranks first in the list of security threats despite being small in size. Chief District Officers (CDOs) of all 11 Districts of the province accepted CPN-Maoist-Chand as the major threat in the province, according to a security personnel who participated in the meeting."Despite being a major security threat, it won't be difficult to control the government-banned party as it is small in size," on conditions of anonymity security official said. Besides that, the monopoly of contractors and mafias in the extraction of resources has also been reported as a threat to security in the province. Not just that, the disputes and controversies in the universities, protests staged by teachers, students and doctors among others have also been seen as threats to provincial security.Home Secretary Prem Kumar Rai urged all to discourage the activities of the CPN-Maoist-Chand outfit as much as possible. "CPN (CPN-Maoist-Chand) must not be allowed to carry out its activities as stated by the government," a source quoted Rai as saying. A member of the commission said Prakash Osti, who is representing the commission in the recommendation committee, could be recalled if the Government did not promptly take positive steps to address the commission’s concerns. Govinda Sharma Paudyal, who heads the publicity department at the commission, said the constitutional watchdog’s decision will depend upon the move of the Government. “Voices to call our member Osti back from the recommendation committee are getting stronger. If the government doesn’t correct its mistake, a decision to that effect is possible,” he told the Post.

A recommendation committee formed by the Government has started shortlisting the candidates to appoint them to the two commissions, which have been without officials since April 13. Conflict victims and human rights defenders charged the government with backtracking on its earlier commitment to moving the transitional justice process by amending the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act-2014 in line with the Supreme Court ruling and international practices. “The government has tried to fool the victims by forming the recommendation committee without consulting with the victims. The people selected by the committee led by former chief justice Om Prakash Mishra-led cannot deliver in the absence of an appropriate Act. The previous leadership, which was picked despite our reservations, did nothing and wasted four crucial years,” argued SumanAdhikari, former chairperson of the Conflict Victims Common Platform.

The delay in appointment has been caused by ongoing negotiations among political parties or senior leaders. “The delay in recommending officials for the transitional justice bodies is aimed at allowing time for political parties for negotiations,” a source familiar with the ongoing development told the Post on condition of anonymity, citing the sensitivity of the matter. The top leaders of the ruling Nepal Communist Party (NCP) and the opposition Nepali Congress (NC) are said to be in talks to share chairmen and members in the two commissions between the two parties. They have already held at least two meetings attended by NCP Co-chair and Prime Minister KP Sharma Oli, party’s another Co-chair Pushpa Kamal Dahal and NC President Sher Bahadur Deuba. The NCP wants its sympathisers to lead both the commissions, though it is flexible about accommodating a maximum number of members to the NC. The main opposition, however, is adamant that it should have a person of its choice to lead one of the commissions. “This is the main bone of contention,” said the source.

This, they say, will deter law enforcement officers from torturing detainees and inmates. Article 1 of OPCAT provisions regular visits by independent international and national bodies to jails and detention centres to prevent torture and other cruel, inhuman or degrading treatment or punishment. Speaking at Parliament on May 20, RJP-N lawmaker Chanda Chaudhary urged the Government to make the report public. “We have been asking the government to make the Lal commission report public for long. However, it has not made the report public despite an instruction for the same by the Speaker,” lawmaker Chanda said. RJP-N has been mounting pressure on the government to publicise the report although the governments formed after the political change of 2006 have never made public the reports submitted by similar commissions. The party began exerting pressure mainly after its lawmaker Resham Chaudhary, who was convicted in the 2015 Tikapur massacre and has been serving a life term, was sworn in as a member of the House of Representatives (HoR) in January 2019.

This incident was earlier reported by South Asia Terrorism Portal (SATP) on May 22. In a simultaneous operation, three Pakistani and three Nepali nationals were arrested in Kathmandu with Rs 7.6 crore in fake Indian currency notes (FICN) of Rs 2000 denomination. “Those arrested included FICN kingpin Yunus Ansari,” said a senior DRI official. Ansari is known to have links with India’s most wanted don Dawood Ibrahim and Pakistan intelligence agency ISI (Inter-Services Intelligence) and has been responsible for running FICN network from Nepal. He is also suspected to have links with proscribed Pakistani terror outfit Lashkar-e-Taiba (LeT) that has been responsible for several bomb blasts in India. Son of a former Cabinet minister of Nepal Saleem Mia Ansari, Yunus was arrested twice earlier in 2010 and in 2014 based on DRI information for circulating FICN. “In the last few months, maritime route in the Indian Ocean has been exploited by the international organised narcotic smuggling syndicates for trafficking drugs. The other sensitive route has been India-Pakistan border in J&K where DRI had made seizure of heroin and arms and ammunition in a joint operation with Indian army last year,” a senior DRI official said.

According to a press statement issued by CVCP, the two commissions – the Truth and Reconciliation Commission (TRC) and the Commission on the investigation of Enforced Disappeared Persons (CIEDP) – failed to discharge their duties in accordance with the principles of transitional justice, goals of the Comprehensive Peace Accord and sentiment of the victims. “We demand that the commissions be staffed by competent, independent and qualified TJ expert. We demand that the government should postpone the recommendation process and start consultation on amendment of the law. The National Human Rights Commission should recall its representative from the recommendation committee. The CVCP believes that the process of selecting new commissioners is a part of conspiracy to divert its attention from making an amendment to the TJ Act. This is not acceptable for conflict victims. If the former TRC and CIEDP commissioners are reappointed, the conflict victims will reject the commissions outright. The CVCP has been closely watching the unfolding events,” it stated.

In a press statement released by the rights body coinciding with the International Day in Support of Victims of Torture on June 26, the NHRC said besides compensating the victims, the Government had done very little to bring perpetrators to book. Though some of the victims have been compensated by the Government, perpetrators categorically pointed out by the NHRC have yet to be booked. According to the NHRC, it has registered nearly 1,910 complaints related to torture. The rights body completed its inquiry into 1,000 complaints. Of the complaints settled by the rights body, 179 cases are related to recommendations for compensation to the victims and legal action against the perpetrators.

Accountability Watch Committee (AWC) has appealed to the Government to amend the Transitional Justice Act before appointing members of two transitional justice mechanisms, Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP), reports The Himalayan Times on July 9. The Government has formed the committee led by former Chief Justice Om Prakash Mishra to appoint members and chairpersons of the commissions. Issuing a statement, the AWC said the commissions would remain ineffective if they were formed without the amendment of the act, in line with the Supreme Court verdicts and by incorporating suggestions from international community. “AWC once again appeals to the government to expedite the process of consultation and amendment of the legal framework, ensuring its ownership by the conflict victims and human rights community, without further delay. Provincial Ministers have expressed serious concerns over the provisions that allow the federal Government to mobilise provincial Police Chief, Deputy Inspector General (DIG), reports Kathmandu Post on July 16. Besides, Senior Superintendent of Police (SSP) and Superintendent of Police (SP) will also be under the federal Government until a provincial Police official appointed by the provincial Government is promoted to the post of SSP. Registered at the House of Representatives on March 13, the bill on adjusting Nepal Police and Provincial Police was endorsed by the Parliamentary State Affairs and Good Governance Committee on July 13. As it was endorsed unanimously by the committee, the bill is set to pass both Houses of federal Parliament without any hindrance. The provinces have also been objecting to the federal Government’s plan to give continuation to Chief District Officers (CDOs) as the federal Government’s contact persons. The provincial Ministers believe that the federal Government is bent on keeping CDOs as the Home Ministry’s liaison officials. “Who will mobilise the DIGs, SPs and SSPs? The federal government? This is nothing but a ploy to keep the CDOs in districts and empower them, thereby robbing the provinces of their right,” said Shalikram Jamarkattel, Internal Affairs and Law Minister of Province 3. Meanwhile, Gyanendra Yadav, Internal Affairs and Law Minister of Province 2, said “The constitution has enlisted ‘peace and security’ as provincial governments’ explicit authority. I don’t know what the federal parliament is preparing. All I know is that the police administration of provinces must be under the provincial governments. In a memorandum submitted to the Minister for Law, Justice and Parliamentary Affairs Bhanu Bhakta Dhakal, the organization of Maoist conflict victims said that a broader roadmap with a deadline for completion of the transitional justice process be formulated after a meaningful consultation with the key stakeholders be held before the recommendation committee can do its job. “The recommendation committee led by a team selected without political interference and based on a clear and transparent public selection process must have a full authority to recommend the office-bearers for the two commissions," it said.

A meeting between top three leaders — Prime Minister KP Sharma Oli, Nepal Communist Party (NCP) Co-chair Pushpa Kamal Dahal and Nepali Congress (NC) President Sher Bahadur Deuba — had last week decided to retain old members at the Commission on Investigation of Enforced Disappeared Persons (CIEDP). The meet had also decided to make two new appointments at the Truth and Reconciliation Commission (TRC), Ganesh Datta Bhatta as chair and Gangadhar Adhikari as member, while retaining rest of three old members. The committee then published a list of candidates in line with the same agreement. As per the political understanding, the TRC will have Ganesh Datta Bhatta as its chairperson and Gangadhar Adhikari, Madhavi Bhatta, Shree Krishna Subedi and Manchala Jha as members. Madhavi Bhatta had filed her application at the recommendation of institutions for the post while names of Ganesh Datta Bhatta, Adhikari, Subedi and Jha were added to the list by the committee itself in line with its working procedure. Former TRC chairperson Surya Kiran Gurung and member Lila Udasi Khanal had already resigned. The TRC will have Lokendra Mallick as its chairperson and Bishnu Pathak, Bijul Kumar Bishwakarma, Nara Kumari Gurung and Aai Bahadur Gurung as members. While Pathak and Bishwakarma have filed their applications for the post, the committee has added Mallick, Nara Kumari Gurung and Aai Bahadur Gurung to the list. The committee had received a total of 57 applications for the posts, of which three were rejected due to inadequate documents, said the committee’s Spokesperson Sharmila Karki. The committee then added seven new names, taking the tally to 61. The conflict victims and rights organisations opposed the move, stating that the commission members should have been appointed on the basis of process and criteria and not on the basis of political understanding.

Issuing a joint press statement, four rights organizations - the International Commission of Jurists, Amnesty International, Human Rights Watch, and TRIAL International – on November 26 said Nepal has made no substantial progress on questions of justice, truth, and reparations for victims of gross human rights violations and abuses during its 10-year conflict, reports The Himalayan Times. They were particularly concerned about the recent moves that suggest the Government would move ahead and appoint commissioners without making necessary legal reforms to framework. “It is deeply disappointing that the government had repeatedly attempted to appoint commissioners without adequate consultation and transparency. The commissions will not gain trust of the victims and the international community if the political parties continue to interfere in the appointment process,” said Biraj Patnaik, South Asia Director at Amnesty International.

National Human Rights Commission (NHRC) on November 26 set conditions for continuing to be part of the recommendation committee to pick members of two transitional justice bodies, reports The Himalayan Times. The conditions put forth by the NHRC were amendment of the Transitional Justice Act as per the Supreme Court verdicts and international standards, consideration of victims’ sentiments, neutrality of the recommendation committee, fairness, transparency and credibility. It will continue to be part of the committee only if its conditions are met, said the NHRC. The NHRC issued the statement after the recommendation committee on November 18 published the list of aspirants for members and chairpersons of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP).

The victims of the decade-long insurgency on November 28 demanded an immediate dissolution of the recommendation committee formed to recommend office-bearers in the two transitional bodies, reports Kathmandu Post. Organising a press meet in the Capital Kathmandu, they asked the Government to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act 2014 first before starting a new selection process based on the revised Act. “It is evident that no competent people will get appointed in the transitional justice commissions unless the government and the political parties stop their interference. The current selection process should be immediately stalled,” said Suman Adhikari, founding chairperson of the Conflict Victims Common Platform (CVCM). Bhagi Ram Chaudhari, chairperson of the platform “No one can stop the conflict era cases from getting internationalised if the government and the parties don’t correct themselves.” He reminded the Government that around 9,000 cases related to severe human rights violations had been filed at the United Nations which could be tried in the international courts if Nepal fails to conclude the transitional justice process. Under the principle of universal jurisdiction, states may make it possible for their domestic criminal justice system to investigate and prosecute crimes such as torture, committed by any person, anywhere in the world.

Former Maoist child combatants who were disqualified from the Army integration process during verification by the UN on November 29 threatened to launch a legal battle against the Government for their rights, reports Republica. Speaking at an interaction entitled “Use of child soldiers in war: international practices and domestic remedy”, former child soldier, Asim Limbu, who now leads the Discharged People’s Liberation Army Nepal (D-PLAN) Struggle Committee said they are working to take the Nepal government to the Supreme Court. “We have been fighting for our rights for several years now, and will continue to do so. This event is a first step toward filing public interest litigation at the Supreme Court,” said Limbu. In 2007, over 4,008 ex-child soldiers were disqualified by the United Nations in course of integrating and rehabilitating the then Maoist combatants.

The letter written by CVCP to the Parliament read, “The committee has even recommended those names, who were dismissed by the lower House on the ground of their incapacity and inefficiency. Continuity of the old faces already deemed incompetent to hold the position of commissioners has played with the sentiments of the conflict victims. It is also in contravention of the Transitional Justice Act passed by this Parliament. Therefore, we want the House of Representatives to call a meeting of the concerned Parliamentary Committee and seek clarifications from the committee members in this regard, besides directing them not to act contrary to the existing law.”

Amid confusion over how the transitional justice process moves ahead, Pushpa Kamal Dahal’s proposal to set up mechanism for transitional justice raises alarm, reports Kathmandu Post on December 19. In his political paper presented for discussion at the Nepal Communist Party (NCP)’s Standing Committee meeting on December 16, Dahal proposed setting up a political mechanism - a body with leaders from the ruling and opposition parties - to support the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP). “In order to strengthen political stability, special attention should be paid towards concluding the remaining works of the peace process. It is necessary to decide on forming a suitable political mechanism to support the commissions” reads the paper. Conflict victims say it would be unfortunate if the parties form the political mechanism that directs the functioning of two commissions. Suman Adhikari, former chairman of Conflict Victims Common Platform (CVCP) said “We want a mechanism that decides the course of the transitional justice process before the commissions get their leadership. We stand against any mechanism that dictates the commissions’ work.” Ram Bhandari, an adviser to Conflict Victims National Network (CVNN), another umbrella body of the victims’ organizations, said the hidden interest in the political mechanism is to drive the transitional justice process the way the parties want. “This is unacceptable. There will be no credibility of the transitional justice process that works under political influence.” Gauri Pradhan, a former member of the National Human Rights Commission (NHRC) said “Every attempt to influence the works of the commissions, be it by forming the mechanisms or without them, is unacceptable. I believe the parties won’t take any steps that put the credibility of the entire process at stake.”
