Three special courts were formed on January 1 in accordance with the Protection of Pakistan Act (PPA) to preside over cases relating to terrorism,reports Daily Times. Five special courts are to be formed in total. The three courts have been formed in Peshawar (Khyber Pakhtunkhwa), Lahore (Punjab) and Quetta (Balochistan) in accordance with the PPA passed by parliament in order to curb rising militancy in the country. Judge Mukarrab Khan will head the special court in Lahore, Judge Zafar Khosa in Quetta and judge Anwar Ali Khan will preside over the court in Peshawar. As many as five special courts are to be formed whereas the next phase will focus on establishing special courts in Islamabad and Sindh.

At least four militants were killed and one was injured on February 4 in a clash between Security Forces (SFs) and militants in Jani Khel area of Bannu District in Khyber Pakhtunkhwa, reports Dawn. Meanwhile, the Peshawar High Court (PHC) was told on February 4 that the oversight board has declared six more missing persons as ‘black’ or hardcore militants, reports The News. AAG Mujahid Ali Khan submitted the oversight board report in the division bench comprising Chief Justice Mazhar Alam Miankhel and Justice Muhammad Daud Khan. The report was about five missing persons who had been shifted to the internment centre in Ghallanai, headquarters of Mohmand Agency, of Federally Administered Tribal Areas (FATA). The oversight board headed by the FCR commissioner had declared four missing brothers — Zar Shah, Akbar Shah, Amir Shah and Zahir Shah — as hardcore militants. All the four missing brothers were active members of the Mohmand Agency chapter of Tehreek-e-Taliban Pakistan (TTP).

Judge Saleem Jan Khan of a local Anti-Terrorism Court (ATC) on March 10 acquitted two suspected militants, Naeemullah Khan and Niaz Mohammad, arrested by local Police for possessing explosives and intending to carry out terrorist activities, reports Dawn. He pronounced the order observing that the prosecution didn’t prove charges against Naeemullah Khan, a resident of Bajaur Agency of Federally Administered Tribal Areas (FATA) and Niaz Mohammad, a resident of Peshawar in Khyber Pakhtunkhwa. The prosecution alleged that the accused were arrested by the police on November 6, 2014 in Achini area in the jurisdiction of Sarband Police Station, Peshawar. It added that the Police recovered six hand grenades during the body search of the two. An FIR was registered against them by the CTD under Section 5 of Explosive Substance Act and Section 7 of the Anti Terrorism Act (ATA). Shabir Hussain Gigyani, lawyer for the defence, said his clients were falsely implicated in the case and that the two were taken into custody by an Intelligence Agency few weeks before the registration of the case against them.

The Peshawar High Court (PHC) on April 11 refused bail to six terror suspects belonging to the Tehreek-e-Taliban Pakistan (TTP) charged with attacks on Security Forces, reports The News. A single bench of Justice Waqar Ahmad Seth dismissed the writ petition of the six terror suspects. The Peshawar High Court (PHC) was informed on April 15 that 22 more missing persons shifted to internment centre in Lakki Marwat were declared black or hardcore militants) and five as grey (terror suspects), reports The News. Additional Advocate General (AAG), Khyber Pakhtunkhwa, Mian Arshad Jan, submitted to a division bench the list of 27 missing persons shifted to internment centre in Lakki Marwat. The bench comprised of Chief Justice Mazhar Alam Miankhel and Justice Muhammad Daud Khan. As per the list issued by in-charge of the internment centre, Sabz Ali Khan, 22 missing persons shifted to internment centre had been declared hardcore militants. The black declared internees were Akbar Ali, Mian Anwar, Abdullah, Mulazim Hussain, Muhammad Asif, Imdad Hussain, Asghar Shah, Qadir Shah, Yousaf Shah, Rahmat Zada, Idrees, Nisar Ali, Ashiquddin, Rasool Niaz, Rahmatullah, Akhtar Ali, Daulat Khan, Zakirullah, Asghar Hussain, Muhammad Ayub, Abdullah and Noor Muhammad. Five internees were also declared grey. They included Inamullah, Asghar Khan, Muhammad Hayat, Zamir Gul and Abdul Khaliq. It was stated in the report that the internees had been picked up in the years 2009, 2010, 2011 and 2012. They were shifted to the internment centre after one or two years under the special law called Action (in Aid of Civil Power) Regulation, 2011 for Federally Administered Tribal Areas (FATA) and Provincially Administered Tribal Areas (PATA).

A local Anti-Terrorism Court (ATC) on April 18 cleared the chief of the Tehreek-e-Nifaz-e-Shariat Muhammadi (TNSM), Sufi Muhammad, in 16 more terrorism cases, reports Daily Times. Sufi Muhammad was acquitted due to lack of evidence against him in the cases, all of which were registered under the anti-terrorism act. Judge Abdul Rauf of the ATC, who conducted proceedings inside the Peshawar Central Jail, also issued orders to transfer the remaining three cases against the TNSM chief to courts in Swat. The trial of Sufi Mohammad in different terrorism cases has been conducted inside the maximum-security Peshawar Central Jail for security reasons.

Swat Police spokesperson Muhammad Rehman said, “The convicts have been identified as Waheedullah, Hassan Khan and Muhammad Karim,” adding, “The men were arrested in a raid carried out during 2014 by Law-Enforcement Agencies. Chief of Army Staff (CoAS) General Raheel Sharif approved the death sentences of nine ‘hardcore terrorists’ involved in heinous terrorism activities, said a statement issued by the Inter-Services Public Relations (ISPR) on September 21, reports Daily Times. The ISPR said that some of those convicted were involved in sectarian attacks in Mastung District of Balochistan, killing of civilians and security personnel in Khyber Pakhtunkhwa (KP) and suicide attack in Nowshera District in KP. One terrorist was awarded life imprisonment, the ISPR said. The nine were identified as active members of Harkat-ul-Jihad-al-Islami (HuJI) and Tehreek-e-Taliban Pakistan (TTP). Said Zaman Khan, Jamshed Raza and Obaid Ullah were active members of HuJI. Mehmood, Qari Zubair Muhammad, Rab Nawaz, Muhammad Sohail, Aslam Khan and Jameel ur Rehman were members of TTP. Another convict, identified as Muhammad Imran, was an active member of an unnamed proscribed organisation. He was found involved in sectarian killings in Mastung District.

Annoyed over their failure to comply with orders in missing persons cases, Chief Justice of Peshawar High Court Mazhar Alam Khan Miankhel summoned the Federal Interior Secretary and Khyber-Pakhtunkhwa (KP) Home Secretary on September 29, reports The Express Tribune. The officials were told to appear on the next date of hearing. The division bench of Chief Justice Mazhar Alam Khan Miankhel and Justice Irshad Qaiser, while hearing 20 cases related to missing persons, observed that departments working under the KP Chief Secretary failed to perform their duties. “The additional PHC registrar issued notices on several occasions, but departments under the provincial and federal governments failed to submit their replies despite being given several chances,” the chief justice remarked. He asked representatives of the government departments to present themselves in court and explain their failure to comply with orders. Miankhel observed that court orders were being blatantly ignored.

The Peshawar High Court (PHC) on October 14 upheld the convictions and death sentences awarded to two militants including a juvenile by the military courts after conducting in-camera hearing into their cases. Official sources said that a bench comprising Chief Justice Mazhar Alam Miankhel and Justice Irshad Qaisar dismissed two petitions filed by mothers of the convicts including Haider Ali and Qari Zahir Gul against their children’s conviction by military courts for involvement in acts of terrorism. Lawyer for the petitioners Malik Ajmal Khan confirmed to the media that the bench had dismissed both the petitions. He said after detailed judgments were issued, it would be clear whether the petitions were dismissed on the ground of being non-maintainable or they’re decided on merit. The court had earlier stayed the execution of both the convicts and with the dismissal of these petitions they said stay order also stood vacated.

Four convicted terrorists were sent to the gallows in Kohat prison of Khyber Pakhtunkhwa on December 2 for their involvement in the Army Public School (APS) massacre in Peshawar on December 16, 2014, reports The News. "Four militants involved in the attack on the APS school were hanged this morning in Kohat prison," said a Peshawar security official. On November 30, Chief of Army Staff General Raheel Sharif had signed the death warrants of the four convicted terrorists, who included Maulvi Abdus Salam, Hazrat Ali, Mujeeb ur Rehman alias Ali alias Najeeb Ullah, and Sabeel alias Yahya. Hazrat Ali was convicted of involvement in collecting funds to carry out the APS attack. Mujeeb ur Rehman alias Ali alias Najeeb Ullah was found involved in transporting 10 suicide bombers for the attack on a PAF Base in Peshawar and abetment in the APS attack. Sabeel alias Yahya also found guilty of involvement in the PAF base Peshawar attack as well as abetment in the APS massacre, while Maulvi Abdus Salam was found guilty of harbouring suicide bombers who were later used in the APS attack.

The development came as the prosecution told the court that enough evidence were not available against them. The prosecutor produced applications under Section 4 of the KP Prosecution Service (Constitution, Functions and Powers) Act, 2005, requesting the court to discharge the two cases due to lack of evidence against suspects.
