In a setback to the National Investigation Agency (NIA), the Chhattisgarh High Court on March 2 dismissed the probe agency’s appeal to quash or transfer the second First Information Report (FIR) registered in connection with the 2013 Maoist attack in Jheeram valley that had killed 29 persons, including several senior Congress leaders, reports The Indian Express. The FIR in question was filed by slain Congress leader Uday Mudliar’s son Jitendra Mudliar in 2020. A division bench of justices RCS Samant and Arvind Chandel passed the order, clearing way for the State Police to carry on with the investigation into the alleged conspiracy behind the attack. The central probe agency had moved the High Court after a special NIA court in Jagdalpur had rejected its plea. Reportedly, on May 25, 2013, Maoists ambushed and killed 29 persons, including senior leaders Nand Kumar Patel, Vidya Charan Shukla and Mahendra Karma, during a poll campaigning tour in Bastar. The Congress had alleged “a bigger political conspiracy” behind the attack, demanding an independent inquiry. The case was transferred to the NIA the same year and the Congress party termed the agency’s 2016 probe report “more of a cover-up than an investigation”.

On April 21, Union Home Minister (HM) Amit Shah stated that fighting terrorism can’t be contradictory to the protection of human rights as nothing violates human rights like terrorism, reports The Indian Express. Speaking at the 13th Foundation Day of the National Investigation Agency (NIA), HM said, ‘Terrorism is a curse for any civilised society. And no one has suffered due to it as much as our country. I have had my differences with human rights organisations about the angle they take on the issue. Whenever there is a counter-terror operation, these organisations come up with the issue of human rights. But I believe there is nothing that violates human rights as much as terrorism. So, fighting terrorism cannot be contradictory to protection of human rights. To end terrorism from its roots is a necessity for protection of human rights’. Adding more, Amit Shah stated that as the Modi government had adopted a “zero-tolerance policy” on terrorism, since 2014, it has taken many steps to strengthen the NIA to be recognized as an international agency which included strengthening of the NIA Act and the UAPA Act. The NIA was given the task of creating a database on psychotropic substances, hawala transactions, arms smuggling, fake currency, bomb blasts, terror funding, and terrorism. In 2020-21, the NIA registered several cases against over-ground workers (OGWs) of terror groups and has been successful in destroying many sleeper cells.

The National Investigation Agency (NIA), on September 12, launched a crackdown on “organized terror gangs” that are involved in large scale criminal activities such as smuggling of arms and weapons, narco-terrorism, targeted killings, extortion, and abductions in North India and have links with similar entities in other countries including Pakistan, reports Hindustan Times. The agency raided at least 50 locations in Punjab, Haryana, Rajasthan and Delhi National Capital Region (NCR) including residences, hideouts, prisons and places of operations belonging to gangsters Goldy Brar (currently hiding in Canada) and Lawrence Bishnoi — the two are believed to be behind the killing of singer Sidhu Moosewala on May 29 — Jaggu Bhagwanpuria, Varinder Pratap alias Kala Rana, Kala Jathedi, Vikram Brar, Gaurav Patyal alias Lucky Patyal (who was earlier arrested in Armenia), Neeraj Bawana, Koushal Chaudhary, Tillu Tajpuria, Amit Dagar, Deepak Kumar alias Tinu, Sandeep alias Bandar, Umesh alias Kala, Irfan alias Cheenu Pahalwan, Ashim alias Hashim Baba, and Sachin Bhanja. In a statement, NIA said the raids were carried out “to dismantle and disrupt the emerging nexus between terrorists, gangsters and drug smugglers/traffickers based in India and abroad”. The NIA is looking at a “larger conspiracy” as these smalltime gangs have morphed into large organized syndicates and specialize in high-profile contract killings, smuggling of drugs from Pakistan and other countries, extortion, possess dangerous automatic weapons such as AK47s and grenades, and easily run their operations from inside the prisons, as was once seen in 90s in Mumbai, when the underworld gangs sparred with each other, said an officer at the agency who didn’t want to be named.

A bench of justices K M Joseph and Hrishikesh Roy said it will pass the order Thursday after hearing the ASG. "He is a 70-year-old man. We don't know how long he will live. Certainly, he is going towards the inevitable. It's not that we are going to release him on bail. He is not going to enjoy the default bail that comrade Sudha (Bharadwaj) got. We are conscious that we have to tread carefully. We agree that house arrest as an alternative has to be used carefully." "We are concerned about what restriction would you like to place. Place whatever restrictions. It's not that he is going to destroy the country. At least let him remain under house arrest for a few days. Let's try to work it out," the bench said.

The National Investigation Agency (NIA) on December 19, filed a chargesheet against five people before the NIA Special Court in Vijayawada of Andhra Pradesh in a case related to the radicalisation and recruitment of youth to the Communist Party of India-Maoist (CPI-Maoist) cadres, a proscribed organisation, reports The Indian Express. According to NIA, the case was initially registered by the Pedabayalu Police Station of Visakhapatnam and was later reregistered by NIA on June 3 this year. “The case was registered based on the complaint filed regarding the recruitment of one Radha to the cadres of CPI (Maoist). The allegation in the complaint indicated that the accused persons Dongari Devendra, Dubasi Swapna, and Chukka Shilpa motivated Radha to join the Chaitanya Mahila Sangham (CMS) and subsequently radicalised and recruited her to the proscribed organisation, CPI(Maoist), under the leadership of underground Maoists, R K (since deceased), Uday, and Aruna,” a spokesperson of NIA said. “Investigation has revealed that the accused persons; Dongari Devendra, Dubasi Swapna, and Chukka Shilpa had indeed attracted gullible young girls to CMS on the pretext of social work. Later, depending on their dedication to the organisation, such girls would be identified and sent to the proscribed organisation CPI (Maoist). The investigation has also revealed that the accused persons had recruited a few other girls to the CPI (Maoist) and had attempted to recruit many others,” the spokesperson added. “The investigation has also revealed that the accused Devendra had taken Radha to the forests under the pretext of rendering medical assistance to someone and that Uday and Aruna coerced the missing girl Radha to join the proscribed organisation. The role of the CMS, an organisation, and other leaders of CMS, in the larger conspiracy, is being probed into. Further investigations in the case are in progress,” the spokesperson said.
