Recoveries made from the hideout included one Light Machine Gun (LMG) with two magazines and 300 rounds, one Pakistan made Under Barrel Grenade Launcher (UBGL) with five grenades, two Chinese stun grenades, 300 rounds of PIKA gun, one round of RPG, one 12 bore muzzle loading rifles and a large quantity of ration items.

Separately, Police arrested a computer engineer with links to the Lashkar-e-Toiba (LeT) for allegedly “planning and executing” the car bomb explosion near Bijbehara town in Anantnag District on March 22 that left his accomplice, Mohammad Abbas Dar, dead and 20 others injured, The Hindu reports. The arrestee was identified as Mohammad Iqbal Bhat alias Mudasir from Awantipora town. The IED was prepared by Bhat in the Junglenar area of Awantipora. Investigations revealed that Dar, who was working as an overground worker for militants seven years ago but had been lying low till recently, was an accomplice of Bhat and got killed when he went to check the IED after it did not explode with the mobile phone trigger. Senior Superintendent of Police (Anantnag) R.K. Jalla said, “They had tried to explode the IED twice using the mobile phone detonator which failed. Dar went to check the battery connection of the device, which exploded due to his fiddling.” Jalla said Dar was working for the LeT and he had brought the IED-laden vehicle to the spot. He said the module was working under the command of Lateef Kachru, a ‘commander’ in the Awantipora area.

Worried over the massive flow of hawala money to Kashmir separatists, some individuals, militant ‘commanders’ and organisations, supporting the cause of militancy, the Union Ministry of Home Affairs (MHA) has assigned the task to block illegal financial channels of militants to a high level expert committee comprising top brass of Intelligence Bureau, Enforcement Directorate, Income Tax Department, security agencies involved in operations in Jammu and Kashmir and Director General of Police (DGP), reports Daily Excelsior. Official sources said that it was not only Ghulam Nabi Fai, the head of Kashmir American Council (KAC), who has been sentenced to two years jail term by a Virginia Court in United States, but many other individuals and organisations, which had funded the terror network in Jammu and Kashmir using different modus operandi. "Though the hawala channels involving businessmen of New Delhi, Mumbai, Uttar Pradesh and some other States were used commonly to provide funds to separatist leaders, terror outfits, various other individuals and their organisations, the worrisome factor for the security and Intelligence agencies had been the use of banking transactions for funding militancy. Numerous instances have come to the fore wherein the hawala money reached Kashmir through banking transactions, not directly but from New Delhi. The transactions had been made from Pakistan, Saudi Arabia and various European nations by some individuals and organisations,” sources said. Police and Intelligence agencies have discovered that hawala money running into hundreds of crores of rupees has been diverted to Kashmir not only from Pakistan and Saudi Arabia but various European nations through banking transactions and private routes over the past few years.

Daily Excelsior reports that a Central Reserve Police Force (CRPF) bunker, constructed at the onset of militancy in 1991 in old city area of Srinagar, was removed on April 2. The bunker was removed from Gudoodbagh area of the old city on Nai Sarak and CRPF is planning to remove two more security pickets from old city. The CRPF started reducing bunkers from Srinagar in 2010 after improvement in the security situation in Srinagar city. More than 40 CRPF bunkers were removed from the city so far since 2010.

Meanwhile, the State Government sanctioned an amount of INR 10.4 million for rehabilitation of 26 surrendered militants in Bandipora District, reports Indian Express. "Rs 1.04 crore [INR 10.4 million] has been sanctioned in favour of 26 surrendered militants for their rehabilitation in district Bandipora during the last financial year," District Magistrate of Bandipora, Manzoor Ahmad Lone, said at a review meeting on April 2. Lone said the administration also sanctioned an ex-gratia relief of Rs 31.6 million in favour of 79 cases of militancy-related deaths and damage to property in the District during the same period. "The amount included Rupees one lakh [INR 100,000] each, sanctioned in favour of 23 death cases related to militancy incidents," he said.

The decision has come at a time when LeT has changed its strategy and shifted control and command structure to Rawalpindi and the Pakistan occupied Kashmir (PoK), in a bid to directly control and guide the militants operating in Jammu and Kashmir (J&K). An unnamed Police officer said, “Mostly, the [LeT] commanders based in Pakistan use latest technology like SKPE and VOIP to communicate with their men in J&K. Five Lashkar-e-Toiba (LeT) militants were killed in an encounter with the Security Forces (SFs) in the Kramhoora forest area of Handwara in Kupwara District on April 5, reports Daily Excelsior. Superintendent of Police (SP, Handwara), Choudery Aslam said that SFs launched a joint operation early in the morning in the Kramhoora forests. The SP said that during the operation militants fired upon the SFs resulting in a fierce encounter that lasted for several hours. The identity of the militants is being ascertained; he said adding that five AK rifles were recovered from the dead militants. The SP said that firing has stopped but the operation is going on and it may continue tomorrow (April 6, today) also as the SFs apprehend that there are few more militants in the area. The SP said that the five militants killed today were part of the same group which was killed on March 28. The SP said that these militants were operating from the forests at least for last one year. He said that SFs were planning operation against the militants operating in these dense forests for last few months. The protests broke out after the chairman of the hardline faction of Hurriyat Conference, Syed Ali Shah Geelani, addressed a gathering in the Main Chowk of the town. Some of the people from the gathering attacked the police station Baramulla with stones resulting in the ding dog battles between Police and the stone pelting protesters. Around six Policemen were injured in the stone pelting while Police resorted to baton charging and tear-smoke shelling at the protesters. At least 14 protesters were injured as Police chased them in the township. The Government on April 8 today expanded the Special Investigating Team (SIT), constituted on April 7, to investigate links, hawala transactions, terror funding and other activities of Kashmiri American Council (KAC) founder-chairman, Sayyid Ghulam Nabi Fai, by adding two more senior members to it including one from the Intelligence wing of State Police and another from prosecution, reports Daily Excelsior. Sources said that the Intelligence officer would share information gathered by Intelligence agencies of other States and the Central agencies about Fai’s network in Jammu and Kashmir and other parts of the country while the prosecution officer would assess extent of involvement of the accused and evidence against them. "The SIT would interrogate all those persons, whose names have figured during questioning of Fai in the United States and all those, who had been in frequent touch with him in the United States’’, sources said. They added that the SIT has been asked to gather details from all Intelligence agencies of the country mainly the Intelligence Bureau pertaining to links of Fai. Sources said in addition to unraveling the nexus of Fai’s agents in Jammu and Kashmir, the SIT has also been asked to go into details of cases registered against Fai, including a Public Safety Act (PSA) warrant pending against him. The PSA warrant had been issued against Fai in 1980 by the then Deputy Commissioner, Badgam for his involvement in anti-national activities. However, Fai had deserted Kashmir after issuance of PSA warrant against him in 1980 and settled in Saudi Arabia for sometime before finally settling in the United States, where he had floated KAC. Fai was recently sentenced to two years imprisonment by a Virginia court in the United States.

"There are different figures of different agencies as far as terrorist camps, launching pads and militants (operating across the border) are concerned. But launching pads are there, militants and their training camps are still there. The intention in the capability of our neighbouring country (Pakistan) to continue terrorism in our State—that continues.” As far as infiltration is concerned, he said the reports are that there is no change in the intention—whether it is training camps or launching pads, adding, "there is no report of successful infiltration with us in the entire State." He further said that "this year militancy-related incidents have decreased. In the first three months of 2012, 26 militancy-related incidents took place as compared to 48 last year, showing a 45 percent overall decrease". Khoda said there was 47 percent dip in militancy during first three months of 2011, as compared to the same period in 2010. Civilian killings this year [2012] have decreased by 50 percent and there was no killing of Security Force or Police personnel this year [2012] as compared to last year’s [2011] figure of three troopers, the DGP said. To another question about the number of militants operating in the State, he said "our figures suggest they are in the range of 85-90". "The presence of militants is decreasing in the State due to better operational capabilities of the forces and we are sure that we will be able to ensure peace in the summer", Khoda said. Answering a question about stone-pelters being brought under the ambit of youth clubs set up by Police, the DGP said "we do not discriminate for sports activities. The focus is on youth. We have got positive results in those areas where we have set up youth clubs. Those areas witnessed peace. We will open more youth clubs and the focus this time would be those areas, which were not attended to last year including that of Jammu.”

The three Interlocutors, appointed by the Ministry of Home Affairs (MHA) in October 2010, had submitted their report to Chidambaram on October 12, 2011. He also said that his Ministry has proposed three amendments in Armed Forces Special Powers Act (AFSPA), which would be placed before CCS for implementation wherever AFSPA was applicable if they were cleared by the CCS. “If the amendments were approved by the CCS, they would be implemented wherever AFSPA was applicable’’, he said. The amendments proposed by the MHA in AFSPA included making it mandatory for armed forces to take arrest warrants in advance before conducting searches for arrests of any person, taking away the power of the armed forces to open firing causing deaths and setting up of a Grievance Redressal Cell. At present, AFSPA was applicable in Jammu and Kashmir and most of the North Eastern States.

The number of infiltration attempts from Jan-Dec 2011 is 247 compared to 489 during the same period in 2010, a decline of 49.5 per cent,” it states. “In 2004, 537 infiltration attempts were reported followed 597 bids in 2005. Nearly 573 attempts were carried out in 2006 and in 2007 as many as 535 attempts were reported. In 2008 at least 342 attempts were carried out with 485 bids in the year 2009. At least 489 attempts were reported in 2010 while as rate in 2011 decreased to 247,” the report added. The Central Government in coordination with State Government had adopted a multi-pronged approach to stop cross-border infiltration by adopting various strategies. “The strategies include strengthening of border management and multi-tiered and multimodal deployment along international border and Line of Control [LoC].” According to the report other strategies include: “Construction of border fencing, improved technology, weapons and equipments for forces, improved intelligence and operational coordination; and synergizing intelligence flow to check infiltration and pro-active action against militants within the state.” The report further said that Central Government has spent INR 35.83 billion in Jammu and Kashmir for security related expenditure from 1989 to 2011.

The panel of Interlocutors on Jammu and Kashmir (J&K) has out rightly rejected the options of autonomy, self-rule and Azadi (freedom), Daily Excelsior reported. Asserting that a pure and simple return to the pre-1953 situation would create a dangerous constitutional vacuum in the relationship between the Centre and Jammu and Kashmir, the report has recommended "case-by-case review of all Central laws and Articles of the Constitution of India extended to the State" since 1952. It has proposed setting up of a Constitutional Committee that would review the applicability of Central statutes extended to J&K after the July 1952 Delhi Agreement. "The Constitutional Committee should be future-oriented and it should conduct its review solely on the basis of the powers the State needs to address the political, economic, social and cultural interests, concerns, grievances and aspirations of the people in all the three regions—Jammu, Kashmir and Ladakh, and all the sub-regions", the report said, adding "the Committee will also need to reflect on the quantum of legislative, financial and administrative powers that the State Government should delegate to the three regions at all levels of governance". The review process — once ratified by Parliament and the State legislature — would eventually end the extension by Presidential order of further Central laws to the State. About harmonization of relations across the Line of Control (LoC), the report noted that no permanent solution can be achieved unless it applies to those parts of the former princely State that are now under Pakistani administration. "Any attempt at harmonization of Centre-State relations and devolution of powers at the regional, district and panchayat/municipality levels across the LoC, therefore, will necessitate wide-ranging constitutional change in Pakistan-occupied Jammu and Kashmir. If agreed, such harmonization will permit the development of joint institutions across the LoC for development, resource generation and other common matters," the report said while recommending that these issues should be discussed with the representatives on the other side of the LoC.

"This had a direct bearing on the situation in the Valley and levels of incidents of terrorist violence had declined from 488 in year 2010 to 340 in 2011". The Government of India in tandem with the State Government has adopted a multi-pronged approach to contain cross border infiltration, which, inter-alia includes strengthening of border management and multi-tiered and multi-modal deployment along the International Border / LoC and near the ever changing infiltration routes, construction of border fencing. Appreciating efforts of the State Government in conducting Panchayat elections, the MHA report says, "the 17 phase Panchayat elections, which were conducted after nearly two decades were landmark elections and overall, the elections were peaceful". In 2011, there was a perceptible decline in the number of terrorist incidents and civilian and SFs casualties compared to the last year. The year witnessed a 30% decrease in the number of terrorist incidents and 34% and 52% decrease in civilian and SFs fatalities respectively to the year 2010. Since the inception of militancy in J&K, 13,846 civilians and 4807 SF personnel have lost their lives. The number of SFs killed declined from 69 in 2010 to 33 in 2011 while the number of terrorist killed declined from 232 in 2010 to 100 in 2011. One hundred terrorists were also neutralized during the year 2011.

The Indian Express reports that the Cyber Crime Cell of Jammu and Kashmir Police claimed to have uncovered a network of youths who used social networking sites to foment trouble in the State during the last few years. “We have identified the persons who have been indulging in trouble mongering over the past couple of years by using the social networking sites,” Inspector General of Police (Kashmir Zone) S M Sahai said. Some of the youths have already been questioned, but no arrest has been made so far in the case. Police sources said investigators had identified 24 persons who were operating over a dozen “anti-national pages”. Sources, however, said four youths, most of them in their early 20s and hailing from Srinagar city, have been questioned in this regard till now. They were operating pages like ‘Freedom of Dawn’, ‘Balai Khuda’, ‘Aalov’ and ‘We love Syed Ali Shah Geelani’ on Facebook, which allegedly supported separatist agenda and stone-pelting incidents during the summer unrest of 2010. In fact, these pages had become reliable sources of information about incidents during the five months of unrest that year as Internet users from various parts of the Valley posted latest events on these pages, they claimed. Against the 488 terrorist-related incidents in the year 2010, there were only 340 such incidents in 2011 and as against 47 civilians killed in 2010, 31 civilians were killed during 2011. “About 45.26 per cent decline has been registered in Net Infiltration during 2011. The Net Infiltration during 2010 was 95 as against 52 in 2011," he added. Underscoring the need for enhancing honorarium of Special Police Officials (SPOs), the Chief Minister said that SPOs have been playing an important role in assisting the Police in fighting militancy in the State. He declared, "As many as 12 battalions of BSF [Border Security Force] and CRPF [Central Reserve Police Force] have been withdrawn from the state since 2009. 24 bunkers are being removed from Srinagar city in the coming months in addition to the 39 bunkers which have already been removed". He stressed that reconciliation and dialogue will always remain the best medium for seeking a solution to all contentious issues. "I am hopeful that peace dividends achieved in the year 2011 will continue to percolate to the people, and usher in a new era of peace and development in the State," he said. The Chief Minister spoke about Rehabilitation Policy announced in 2010 and said that 1034 applications have been received from the parents and relatives of the prospective returnees under the Policy. "Of these, 67 cases have been recommended in high level committee meetings. A decision on these is required to be taken at the earliest", he said. On cross-Line of Control (LoC) trade between two sides of Kashmir, Omar said, "There is a need for restoration of telephonic links between Jammu and Kashmir and PoK and putting in place a proper institutional arrangement by replacing the current barter system of trade which will also address the security concerns". Speaking on the issue of Armed Forces Special Powers Act (AFSPA), he said he was of the firm belief that the Act had played a useful role in providing much-needed legal protection to the Army and paramilitary forces while dealing with insurgency. "However, now that there is a distinct change in the security environment in the State, there is a good case for reviewing the continuation of AFSPA. I am not advocating the withdrawal of AFSPA from districts and areas which are still infested with militancy, but a beginning can be made by withdrawing AFSPA from areas and districts which are not affected by the insurgent and terrorist activities." He also sought a proper mechanism for surrender and rehabilitation of militants currently camping in Pakistan-controlled territory. He flagged that off late, some youth were using Nepal route to return to their homes, adds DNA. He expressed fear that they may again join militancy, in the absence of any proper mechanism. Sources in State Government say around 65 youth have returned using Nepal route. Amongst these, reports say, at least five from Sopore region have re-joined militancy.

A Delhi court on April 17 commenced the trial of a close aide of All Party Hurriyat Conference-Geelani (APHC-G) leader Syed Ali Shah Geelani, Ghulam Mohd Bhat, and three others, for allegedly running a hawala (illegal money transfer) racket to fund Hizb-ul-Mujahideen (HM) in Jammu and Kashmir (J&K). The three other accused include Mohammad Siddiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga. The court had framed charges against all the four accused under various sections of the Unlawful Activities (Prevention) Act on March 3, 2012. The National Investigation Agency (NIA) in 2011 had filed the charge sheet against the four, indicting them for procuring over INR 45.7 million from Pakistan through hawala channels within three years after 2008 for funding the terrorist activities in the Valley. Detailing their modus operandi, the NIA had said Ganai developed a close relationship with Delhi-based Raj Kumar and his brother-in-law Rajeev Nankani and motivated them to collect money on their behalf from hawala operatives in New Delhi. "Between November 2008 to October 2010, Raj Kumar alone collected Rs 2.25 crore [INR 22.5 million] in various instalments from hawala operators here," the charge sheet had said. The Special Cell of Delhi Police on January 22, 2011, had arrested Srinagar-based lawyer Bhat, Ganai, Liloo and Dagga from J&K on a tip-off that they were carrying hawala money, allegedly meant for the HM. It had also recovered INR 2.12 million 1 from them.

Times of India reports that the Centre on April 22 decided to depute Jammu and Kashmir Police along with Sashastra Seema Bal personnel to help identify Kashmiri militants using the Indo-Nepal border to re-enter the Valley and former militants will be assisting them in this task. Report said that the Jammu and Kashmir Government will soon deploy former militants as "spotters" along the India-Nepal border to stop infiltration. The personnel, besides being deployed at 15 points from where the people from India and Nepal enter, will also be part of patrolling parties to man areas used for illegal infiltration, the sources said. The State Government announced the Rehabilitation Policy in 2010, under which former militants, who crossed over to Pakistan-occupied Kashmir (PoK) between 1989 and 2009, were being considered for safe return. Government identified four entry points – Poonch-Rawalakote (Poonch), Uri-Muzaffarabad (Uri), Wagah (Punjab) and Indira Gandhi International Airport, New Delhi, from where the youth, given clearance, can enter the State. However, during the past few months, there were some cases detected of militants holed up in PoK entering the Valley through Nepal and claiming they had returned according to the 2010 policy. Some of these youth were later found involved in militant activities. In fact, the Indo-Nepal border has been increasingly used as an entry route ever since the announcement of the Rehabilitation Policy in 2010. Notably, while favouring a mechanism to ensure safe return of former militants to the State to facilitate their transition for leading peaceful lives, rejoining the national mainstream and contributing towards peace, Chief Minister Omar Abdullah had said that there are reports that some youth are using Nepal route for returning to Jammu and Kashmir. "There is a growing concern about the possibility of the recycling of the surrendered and released militants as well as these prospective returnees from PoK. This needs attention of the Government," Omar had said.

Geelani had gone to North Kashmir on April 6, where he addressed a gathering after offering Friday prayers. The Police First Information report (FIR) said that during his speech, Geelani "provoked and instigated people against the State". "Soon after the Friday prayers, Geelani and his close confidantes addressed a gathering of around 500 people. They provoked people against the State and their speech was anti-State," the Police said. According to the Police, Geelani stated: "Indian occupation of Jammu and Kashmir is illegal and we will continue with our struggle for freedom." "He has been booked under section 307 for an attempt to murder a Policeman and section 336 for involvement in stone-pelting," Police said. The Police said his speech caused hatred among masses against the State. An unnamed senior official informed that the case has been filed about a particular incident in which a Policeman was assaulted that day and the mob pelted stones. Since then Geelani has not been allowed to address any gathering. Geelani, who arrived in Kashmir in March after three-month stay in New Delhi, had gone to Baramulla on April 6 to address people, adds Hindustan Times.

"The recoveries included a Chinese Pistol, four under barrel grenade launchers (UBGL), two Pistol Magazines, two PIKA magazines, two Improvised Explosive Device (IED) standard boxes, three radio sets with Antenna, two Circuit IEDs, nine rounds of PIKA gun, 210 rounds of AK-47 rifle and a Pouch," said Police officials. "The forest range of Handwara in Kupwara has seen some of the bloodiest encounters and recently there were at least two major encounters in which around 10 militants were killed. Since the militants are on run we suspect that they have left behind the arms and ammunition. A manhunt has been launched to arrest the militants and we are hopeful that the operation would be successful very soon," added the Police. No arrests were made so far.

SFs have once again stepped up searches for three most wanted militants in Kishtwar District, who remained elusive even after more than seven months of being declared as wanted in a powerful blast outside Delhi High Court on September 7, 2011. The three militants, identified as Shakeer Ahmed alias Chotta Haafiz, Aamir Kamal alias Kamran and Junaid Akram Malik, all residents of Kishtwar, are wanted by the National Investigating Agency (NIA) and carry head money of INR 1 million each. Another militant, Mohammad Shaffi, who was being searched in upper reaches of Kishtwar though not being involved in Delhi blast, was reportedly accompanying the wanted trio, sources said. As reported earlier, three militants from Kishtwar have already been arrested by the NIA and Kishtwar Police in connection with Delhi blast. However, sources said, the three militants of Kishtwar and two Pakistanis still remained untraced. While three Kishtwar militants were involved in conspiracy, the Pakistanis had transport and planted explosive device triggering blast on the morning of September 7, 2011.
