Official sources clarified that 36 people were killed while 70 more were injured in the October 1-suicide (fidayeen) terrorist attack on the Jammu & Kashmir State Legislature Complex in Srinagar. Earlier reports had placed the toll at 13 killed and 40 more injured. The Jaish-e-Mohammed (JeM) has claimed responsibility for the attack. As reported on October 1, a bomb-laden vehicle exploded outside the main gate. In the confusion that followed, some terrorists in security force (SF) uniforms stormed into the complex and began firing and lobbing grenades. Two terrorists were later killed while attempting to escape. The building within the complex that houses the Upper House of the State Legislature, and in which the terrorists had barricaded themselves, was destroyed in SF operations. The Speaker of the Legislative Assembly and eight other Legislators who were trapped inside the complex when the attack was launched were evacuated to safety. SF sources said the vehicle used in the suicide bombing belonged to the Department of Telecommunications (DoT) and had been lifted by the terrorists earlier in the day. Describing the sequence of events, SF sources said three persons wearing SF uniforms stopped the DoT vehicle for a lift. After two engineers, who were the only passengers in the vehicle, disembarked at their respective destinations, the terrorists forced the driver to take the vehicle to a pre-determined location where two more terrorists boarded with three large milk cans, apparently filled with explosives. Near the Assembly Complex, the four terrorists and the driver disembarked while the fifth terrorist, identified by a Jaish spokesman as an Pakistani mercenary of his outfit, rammed the vehicle in and set off the explosion. There is confusion on how many terrorists wearing SF uniforms stormed into the complex after the blast. While some news reports said tha two terrorists were killed in encounters inside the complex other news reports, citing official sources, said that a total of four terrorists including the one who drove and exploded the bomb laden vehicle were killed. Chief Minister Farooq Abdullah and his Ministerial-colleagues had left the complex before the attack commenced. SF sources said that civilian traffic is barred from using the road in front of the gate between 9000 hrs and 1330 hrs, the period during which the Assembly is in session. The attack was launched at 1358 hrs. Armoured bunkers were used by SFs to evacuate about 100 civilians trapped inside the complex, even as they engaged the terrorists. An SF personnel was killed when he went to examine the body of one of the slain terrorists that was booby trapped with a timed explosive. Among those killed are eight SF personnel, four terrorists and 24 others which includes Legislature employees and other civilians.

The Cabinet Committee on Security (CCS), with Prime Minister Atal Behari Vajpayee in the chair, met on October 1 to evaluate the prevailing security situation in Jammu and Kashmir in the wake of the storming of the State Legislative Assembly complex. The meeting issued a virtual ultimatum to Pakistan to stop aiding and abetting terrorism in the State. After the meeting, a statement issued by the Ministry of External Affairs said, "India cannot accept such manifestation of hate and terror form across its borders. There is a limit to India's patience''. The statement described Pakistan President Gen. Pervez Musharraf's declarations, that the offices of the Harkat-ul- Mujahideen (HuM) had been closed, as a ‘cosmetic step’ taken under international pressure. Pakistan, it said, "Continues to be a country that aids, abets and sponsors terrorism and terrorist networks.''

Indian Prime Minister Atal Behari Vajpayee, in the wake of the suicide terrorist attack by Pakistani mercenaries on the Jammu and Kashmir (J&K) State Assembly, wrote to Unite States President George Bush, that India was running out of patience and asked him to restrain Pakistan from backing international terrorism. The Prime Minister said such attacks directly impinged on the country’s security that India can simply not ignore the terrorist acts. He also pointed that the attack came just a day after Pakistan President Pervez Musharraf claimed that there were no terrorists operating from his country’s soil. Vajpayee wrote in his letter, "I write this with anguish at the most recent terrorist attack in our State of Jammu and Kashmir... A Pakistan-based terrorist organisation, Jaish-e-Mohammad, has claimed responsibility for the dastardly act and named the Pakistani national, based in Pakistan, as one of the suicide bombers involved.''

He added, "We are against terrorism, this clearly was an act of terror." He went on to say that "We are going after terrorism in a comprehensive way, not just in the present instance of Al-Qaida and Osama bin Laden, but terrorism as it affects nations around the world to include the kind of terrorism that affects India."

The Jaish-e- Mohammed (JeM), on October 2, denied any involvement in the October 1-suicide (fidayeen) terrorist attack on the Jammu & Kashmir State Legislature Complex in Srinagar, in which 38 persons were killed and 70 more injured. Jaish spokesperson Rana Farooq Tahir said, in Muzaffarabad, it was a ‘conspiracy’ to defame terrorist outfits. According to him, "We have nothing to do with that action. It has been carried out under a grave conspiracy against the Mujahideen… We firmly believe that this has been done by the Indian army to malign the Kashmiris' noble struggle for freedom from New Delhi's tyrannical rule." He also added that none of the outfit's cadres had claimed responsibility for the attack. However, in Srinagar, on the same day, a spokesman of the outfit released a statement claiming that three mercenaries of the outfit had participated in the attack. He also clarified that while one died, the other two escaped from the complex after the attack. Quoting Jaish ‘commander’ Abu Hijrat, the spokesman alleged that civilians were killed in the retaliatory action by the security forces.

In another incident, the bodies of two Special Police Officers (SPOs) abducted a day earlier were recovered from Sogam, Kupwara. The Jamiat-ul-Mujahideen (JuM) reportedly claimed responsibility for the killings.

British Prime Minister Tony Blair, on October 3, called up Indian Prime Minister Atal Behari Vajpayee and conveyed his sympathies and condolences to the victims of the suicide attack on the Jammu and Kashmir State Legislative Assembly Complex by Jaish-e-Mohammad (JeM) fidyaeen (suicide) terrorists, on October 1. Official sources said Blair told Vajpayee, "This is the kind of terrorism the governments should cooperate in rooting out". The British Prime Minister also backed India’s position that terrorism has to be tackled globally and should be fought strongly at different levels. The two leaders also agreed that their governments would exchange views on the evolving situation following in the September 11-terrorist attacks in the United States. The JeM, which has claimed responsibility for the suicide attack, is proscribed in the UK under the Terrorism Act, 2000. France has also strongly condemned the attack in Srinagar, saying the ‘‘terrorists have clearly shown that their target is Indian democracy’’. In a statement issued in Paris, and circulated by the French Embassy in New Delhi, French foreign ministry spokesman Francois Rivasseau recalled that France and India have already begun to cooperate in fighting terrorism. The first meeting of the Indo-French working group on terrorism was held in Paris in September 2001 and both sides agreed on the need to embark on joint efforts to combat the scourge.

Germany has strongly condemned the terrorist attack on the Jammu and Kashmir State Legislative Assembly Complex. Chancellor Schroder, at a meeting with External Affairs Minister Jaswant Singh, on October 4, in Berlin, said, "India should be rest assured that Germany does not at all differentiate between victims of terrorism, be they in New York or in Kashmir. Germany's condemnation is equal in both cases." Both the leaders exchanged views on building a global coalition against terrorism and discussed situation following the September 11-terrorist attack in the United States. They emphasised the need for all countries to assess the true dimension of the threat posed by terrorists. They also discussed issues relating to post-Taliban structure in Afghanistan.

India’s Ambassador in the United States Lalit Mansingh, said in Washington, on October 11, that the US would place terrorist outfits operating in Jammu and Kashmir on a separate terror list soon. He said, while the groups will not be included on the US State Department list of terrorist organisations, they will be on the list maintained by the Treasury for the ostensible purpose of freezing their assets and blocking their source of funds in the country. He said, "In the State Department they require a certain degree of proof and they require inter-governmental consultations, so it's a long-drawn-out procedure to declare a particular terrorist organisation a foreign terrorist organisation…that is why there has been a delay in the State Department." He added that the issue would not be discussed during the forthcoming visit of US Secretary of State Colin Powell.

US Ambassador in India Robert Blackwill, in an interview to a news agency on October 11, said the United States clearly recognises that the problem of terrorism in Kashmir is part of the global war against the menace and that it must be rooted out. He said, "Terrorism in Jammu and Kashmir is exactly the kind of terrorism that must be condemned and must be rooted out. War against terrorism must include terrorism against India." Citing the speeches made by President George W Bush and Secretary of State Colin Powell, Blackwill said, "There are no exceptions with respect to countries that harbour terrorism. There are no exceptions to terrorism as it exists in camps funded, trained and so forth. We will accept no nation that harbours terrorism. He ruled out the US becoming a mediator between India and Pakistan on the Kashmir issue.

Prime Minster Atal Behari Vajpayee, on October 15, termed as a ‘serious challenge’ Osama bin Laden’s Al Qaeda dragging Kashmir into its current conflict with the United States. He said, "If this (Al Qaeda's appeal to the US not to help Hindus against Muslims in Kashmir) is true, then it is a serious challenge. We will have to combat it together". Asked whether the government was planning to enhance security operations in Jammu and Kashmir, he said the issue was under constant consideration of the government and a decision would be taken whenever needed. Besides, he disagreed with the view that Pakistan was benefiting from the situation arising out of the US attacks on Afghanistan. "In fact, Pakistan is in trouble. India's diplomacy is going in the right direction", he added.

Defence Minister George Fernandes said, on October 16, India would deal with infiltrators ruthlessly in Jammu & Kashmir. The Minister was speaking to the media in the aftermath of Indian troops killing 30 infiltrating terrorists on October 15. Firing by Indian troops also resulted in several Pakistani border posts being destroyed. Fernandes explained, "The Army took the initiative to throw back (the infiltrators) and in the process used fire on terrorists trying to infiltrate. Their desire was to prove they can still infiltrate while our action was in retaliation''. Replying to a question if there was plans to strike at terrorist training camps across the border, Fernandes said such plans were never discussed in public.

Pakistan controlled Kashmir (PcK) Premier Sardar Sikandar Hayat said, in Muzaffarabad, on October 16, that ‘freedom movement’ in Jammu and Kashmir could not be termed as terrorism as the issue has repeatedly been addressed in United Nation's (UN) resolutions and was also presented on the international body's forum. He said that it is the UN's responsibility to resolve the issue in accordance with Security Council's resolutions as "self-determination is the legitimate right of the people of Kashmir." Sikandar Hayat opined that the Kashmir issue could only be resolved politically and called upon western countries to play their role in solving the issue peacefully. While denying that any terrorist outfit was operating from PcK, he added that it was a base camp for Kashmiri ‘freedom fighters’ that had nothing to do with terrorist activities.

It says," There is a growing number of Kashmiri Muslims who are wary of the conflict and wish to reach an accord with India". The report further says, "[India] wants to cut down on its constant and heavy military commitment in Kashmir, which is a drain on resources that could be better directed to the military-modernisation plans".

Indicating tough measures against terrorists, Union Defence Minister George Fernandes said, on October 21, that the government was finalising a ‘specific plan’ to deal with Pakistan-sponsored proxy war in Jammu and Kashmir (J&K). He said, "I have discussed with the senior Army commanders as to how to give a greater momentum to our fight against Pakistan-exported terrorism in the state." Asked whether this amounted to 'hot pursuit' as advocated by certain quarters in the government, Fernandes said, "Hot pursuit is not action specific, and is only a general statement. What we have been discussing is specific action. Already steps in this direction have been taken and we hope to see the implementation of the specific action plan soon."

Jammu and Kashmir Chief Minister Farooq Abdullah, speaking at the Police Commemoration day in Srinagar, said the war against terrorism should be fought in the enemy’s court and terrorist training camps should be smashed. He said, "We can’t lie low for long. The US could not wait for a twinkle and we have been facing the brunt for 12 years". The Chief Minister added that, after wrapping up global campaign in Afghanistan, the next step would be directed against terrorism in this part. Pakistan, he said, is engaged in cross-border terrorism and is training mercenaries from various parts of the world. Unless these camps are uprooted, peace would be a distant dream, he added.

The Director General of Border Security Force (BSF), in an interview to a news agency in Delhi, said despite having vowed to work against terrorism along with the world community, Pakistan continues to send mercenaries into J&K. It has increased cross-border firing along the Line of Control (LoC) and the International Border, apparently to provoke Indian troops, he said. He further said, the September 11 terrorist attack in the US and the subsequent developments in the world have had no impact on Pakistan’s activity vis-à-vis Kashmir. There is no indication of mercenaries leaving J&K in response to the call of Afghanistan’s Taliban regime to join them in the fight against US, he said.

Maulana Fazlur Rahman, Chief of his own faction of the Jamaat-Ulema-e-Islam said in an interview with Pakistani Urdu daily Jang that the Kashmiri ‘movement’ cannot be termed as Jehad as Pakistan was only fighting for a piece of land and not for the self-determination of Kashmiris. He opined that the objectives in Afghanistan and Jammu and Kashmir were different and cannot be equated. According to him, "I have reservations in regard to Jehad in Kashmir as Kashmir has been an issue of right of self-determination. Kashmiris are fighting for their right of self-determination… Pakistanis are not fighting the war in Kashmir in this context. On the contrary, Pakistan is fighting a war for capturing a piece of land. Therefore, objectives of those, who are fighting war in Kashmir and those, who are fighting in Afghanistan, are entirely different. The war in Afghanistan is undoubtedly a Jehad and it has a preference over fighting in Kashmir." While stating that the Kashmir issue should not be linked with Afghanistan, Rehman added "the Kashmir issue should be resolved through better means and if it is not done, Kashmir would also have to face an anarchy like Afghanistan."

The Intelligence Chief of the Border Security Force (BSF), while speaking to the media in Srinagar on October 23, indicated that it was unlikely India would mount an offensive against terrorist training camps in Pakistani territory. He said, "Crossing over the Line of Control is not an option. We can deal with the militants very well once they enter our land." He added that Jaish-e-Mohammed (JeM) had links with Osama bin Laden’s Al Qaeda network and before the US bombing of Afghanistan commenced had trained at a camp in Kandahar. While observing that the JeM had not called on its cadres to defend the Taliban, he said, "The Jaish leadership in Pakistan has categorically told the Jaish militants in Kashmir not to move out of Kashmir, not to go to Afghanistan. There are sufficient forces in Pakistan to be sent to Kabul."
