Police and cadres of the Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) exchanged fire at Hongla village of the remote Silichong Rural Municipality in Sankhuwasabha District of Province No. 1 on July 1, reports Kathmandu Post. There were no casualties in the crossfire. According to Police, the CPN-Maoist-Chand cadres opened fire at a joint patrol team of Nepal Police and Armed Police Force at around 9am. The armed men fled after Police fired in retaliation.

Rights activists on July 2 warned that the issue of use of child soldiers during the decade-long Maoist conflict could reach International Criminal Court (ICC), if the Government and political parties continued to ignore it, reports The Himalayan Times. They suggested that domestic issues should be addressed internally, by addressing concerns about disqualified child soldiers through reparation and rehabilitation process. Advocate Om Aryal said although Nepal was not a party to the ICC based in Hague, the Netherlands, there were ample grounds on which a case could be filed, as the use of child soldiers in armed conflicts is considered ‘war crime’ internationally. He said this by referring to case of Myanmar in relation to Rohinga refugees.

Unidentified assailants vandalized and set ablaze the ward office of Tyamkemaiyung Rural Municipality-1 in Bhojpur District of Province No. 1 in Nepal late on July 2, reports My Republica. The assailants entered into the ward office by breaking the padlock and damaged the furniture and set ablaze important documents of the office. A computer, printer, internet kits, table and other important documents inside the office of the ward chief were damaged by the group, Inspector Pandav Rajbanshi said. The assailants also took away a laptop from the ward office with them.

Police confiscated 110 rounds of bullets, one Self-Loading Rifle (SLR) and one Light Machine Gun (LMG) with its magazines in Sankhuwasabha District of Province No. 1 in Nepal on July 4, reports My Republica. During a raid, a team of Police seized the arms allegedly possessed by the cadres of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) outfit from Mewa Khola area in the District, Superintendent of Police (SP), Ramesh Thapa said. Meanwhile, the Police team also arrested Nim Dorji Lama, a local-level cadre of the CPN-Maoist-Chand outfit from the same place, SP, Thapa added.

Co-chair of ruling Nepal Communist Party (NCP) Pushpa Kamal Dahal on July 5 said Nepal’s peace process was one of the most successful of its kind in the world, but reactionary forces were not happy with that, reports The Himalayan Times. Referring to recent Europe visit of former child soldier Lenin Bista, without mentioning his name, Dahal said the reactionary forces were sponsoring Europe visits for some people in their desperate bid to derail Nepal’s peace process that had been established as a global success story. Dahal said derailing the peace process might benefit a section of people, but would be detrimental for national interest and national unity. “The reactionary forces are trying to revive wounds of conflicts that have already healed,” he said at an event at the NCP headquarters in Kathmandu.

Accountability Watch Committee (AWC) has appealed to the Government to amend the Transitional Justice Act before appointing members of two transitional justice mechanisms, Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP), reports The Himalayan Times on July 9. The Government has formed the committee led by former Chief Justice Om Prakash Mishra to appoint members and chairpersons of the commissions. Issuing a statement, the AWC said the commissions would remain ineffective if they were formed without the amendment of the act, in line with the Supreme Court verdicts and by incorporating suggestions from international community. “AWC once again appeals to the government to expedite the process of consultation and amendment of the legal framework, ensuring its ownership by the conflict victims and human rights community, without further delay. It also appeals to the recommendation committee not to recommend names to the TJ bodies prior to the amendment of the TRC Act, 2014, in line with the decision of the Supreme Court and international standards,” read its statement.

Two persons were killed in an exchange of fire that took place between Police and cadres of the Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) in Bhojpur District of Province No. 1 on July 10, reports Republica. A Police Constable Sanjiv Rai and the CPN-Maoist-Chand cadre Nir Kumar Rai were killed in the exchange of fire. Nir Kumar Rai is the eighth member of the CPN-Maoist-Chand to die since March when the Government declared it a criminal outfit.

The Government has initiated backchannel negotiations to bring the outlawed Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) to save the country from the brink of another war, reports Republica on July 15. “Sources said that Chand is likely to accept talks offer if the Government agrees to lift the ban on the outfit, withdraw court cases against its leader and release its imprisoned leaders. More than 600 leaders and cadres of the outfit are currently in jail, while many other face criminal charges. Eight of its cadres have lost their lives since the crackdown started in March. Efforts are under way to bring the outfit to the negotiating table. I have nothing substantive to share now, but you will hear good news soon,” said Som Prasad Pandey, former Coordinator of a talk’s team formed by the Government.

Besides, Senior Superintendent of Police (SSP) and Superintendent of Police (SP) will also be under the federal Government until a provincial Police official appointed by the provincial Government is promoted to the post of SSP. Registered at the House of Representatives on March 13, the bill on adjusting Nepal Police and Provincial Police was endorsed by the Parliamentary State Affairs and Good Governance Committee on July 13. As it was endorsed unanimously by the committee, the bill is set to pass both Houses of federal Parliament without any hindrance. The provinces have also been objecting to the federal Government’s plan to give continuation to Chief District Officers (CDOs) as the federal Government’s contact persons. The provincial Ministers believe that the federal Government is bent on keeping CDOs as the Home Ministry’s liaison officials. “Who will mobilise the DIGs, SPs and SSPs? The federal government? This is nothing but a ploy to keep the CDOs in districts and empower them, thereby robbing the provinces of their right,” said Shalikram Jamarkattel, Internal Affairs and Law Minister of Province 3. Meanwhile, Gyanendra Yadav, Internal Affairs and Law Minister of Province 2, said “The constitution has enlisted ‘peace and security’ as provincial governments’ explicit authority. I don’t know what the federal parliament is preparing. All I know is that the police administration of provinces must be under the provincial governments. The federal government must act according to the constitution.” The Internal Affairs and Law Ministers of the seven Provinces, according to Jamarkattel, are considering moving the court to challenge the federal Government’s attempt to impose its control through legal frameworks.

In a memorandum submitted to the Minister for Law, Justice and Parliamentary Affairs Bhanu Bhakta Dhakal, the organization of Maoist conflict victims said that a broader roadmap with a deadline for completion of the transitional justice process be formulated after a meaningful consultation with the key stakeholders be held before the recommendation committee can do its job. “The recommendation committee led by a team selected without political interference and based on a clear and transparent public selection process must have a full authority to recommend the office-bearers for the two commissions," it said.

Three months after the United Nations’ special rapporteurs expressed serious concerns over the selection process of new leadership in the transitional justice commissions, four international human rights groups on July 29 asked the Nepal Government to stall the ongoing nomination process until the existing Transitional Justice Act is amended, reports Kathmandu Post. In a statement, Amnesty International, International Commission of Jurists (ICJ), Human Rights Watch (HRW), and TRIAL International asked Nepal to adopt a consultative and transparent appointment process, ensure the amendment is in line with international human rights standards and with the Supreme Court ruling, and come up with a plan to take the transitional justice process forward. In their statement, the international rights groups accused the KP Sharma Oli-led Government of failing to take concrete measures in providing justice to the thousands of victims who have been living in hope for more than a decade.
