National Human Rights Commission (NHRC) could withdraw its representative from a recommendation committee formed to select new officials for the two transitional justice bodies as a last resort to put pressure on the Government to revise the amendment bill to the National Human Rights Commission Act 2012 and to initiate the process to amend the existing transitional justice Act, reports Kathmandu Post on May 3. A member of the commission said Prakash Osti, who is representing the commission in the recommendation committee, could be recalled if the Government did not promptly take positive steps to address the commission’s concerns. Govinda Sharma Paudyal, who heads the publicity department at the commission, said the constitutional watchdog’s decision will depend upon the move of the Government. “Voices to call our member Osti back from the recommendation committee are getting stronger. If the government doesn’t correct its mistake, a decision to that effect is possible,” he told the Post.

Victims of the decade-long insurgency and human rights community at a press meet in Kathmandu on May 2 have built pressure on the Government to amend the Transitional Justice Act before taking forward the process to appoint officials to the two transitional justice bodies, reports Kathmandu Post. A recommendation committee formed by the Government has started shortlisting the candidates to appoint them to the two commissions, which have been without officials since April 13. Conflict victims and human rights defenders charged the government with backtracking on its earlier commitment to moving the transitional justice process by amending the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act-2014 in line with the Supreme Court ruling and international practices. “The government has tried to fool the victims by forming the recommendation committee without consulting with the victims. The people selected by the committee led by former chief justice Om Prakash Mishra-led cannot deliver in the absence of an appropriate Act. The previous leadership, which was picked despite our reservations, did nothing and wasted four crucial years,” argued SumanAdhikari, former chairperson of the Conflict Victims Common Platform.

Upendra Yadav-led Federal Socialist Forum-Nepal (FSF-N) and Baburam Bhattarai-led Naya Shakti Party-Nepal (NSP-N) officially merged on May 4, reports The Himalayan Times. The unified party will be christened Samajwadi Party Nepal (SPN). It will have 17 members in the House of Representatives (HoR), equal to that of Rastriya Janata Party-Nepal (RJP-N), the third largest party in the Parliament. The unification became possible after two months of intense negotiation between the two parties. According to NSP-N Publicity Department Chief Bishwadeep Pandey, Bhattarai, who will lead the Federal Council of the unified party, will be accorded first position in the party’s seniority list, while Yadav, who will chair the meetings of the Central Committee, will be accorded the second position. As per the understanding, all 16 office bearers of the FSF-N and all nine members of the NSP-N Secretariat will be office bearers of the unified party. Similarly, all members of the Central Committee of both the parties will be members of the unified party till the next general convention. A similar model will be followed for other committees from top to bottom.

The Informal Sector Service Center (INSEC), a NGO working in the human rights sector, urged the Government to revise the Bill to Amend the NHRC Act 2012 saying the bill forwarded to the House of Representatives for amendment process undermines established universal human rights principles including the Paris Principles, reports Republica on May 9. Issuing a press statement, the NGO said a provision in the bill that gives discretionary power to the Attorney General to decide on whether to file cases of human rights violations is the most objectionable part of the bill. “If it is left to the Attorney General whether or not to prosecute cases, questions will arise over the jurisdiction of the NHRC as well as its autonomy,” states the press statement issued by the INSEC Chairperson Indira Shrestha.

The two transitional justice mechanisms’ failure to achieve anything substantial in the last four years has largely been attributed to politics and political bickering, reports Kathmandu Post on May 9. The delay in appointment has been caused by ongoing negotiations among political parties or senior leaders. “The delay in recommending officials for the transitional justice bodies is aimed at allowing time for political parties for negotiations,” a source familiar with the ongoing development told the Post on condition of anonymity, citing the sensitivity of the matter. The top leaders of the ruling Nepal Communist Party (NCP) and the opposition Nepali Congress (NC) are said to be in talks to share chairmen and members in the two commissions between the two parties. They have already held at least two meetings attended by NCP Co-chair and Prime Minister KP Sharma Oli, party’s another Co-chair Pushpa Kamal Dahal and NC President Sher Bahadur Deuba. The NCP wants its sympathisers to lead both the commissions, though it is flexible about accommodating a maximum number of members to the NC. The main opposition, however, is adamant that it should have a person of its choice to lead one of the commissions. “This is the main bone of contention,” said the source.

The main opposition Nepali Congress (NC) on May 15 demanded that the Government withdraw from Parliament three bills that contradicted the constitution, reports The Himalayan Times. The NC also threatened to mobilise its power both in the Parliament and outside if the Government tried to pass the Media Council Bill, National Human Rights Commission Bill and National Security Bill without amendment. A meeting of the NC parliamentary party held at Singha Durbar in Kathmandu concluded that the three bills, if enacted as laws, would curtail the freedom of expression and freedom of press, undermine human rights, weaken civil rights and render National Security Council and Nepali Army ineffective.

Hearings on a petition filed by the Government seeking review of a landmark Supreme Court ruling of 2015 on a transitional justice-related case was scheduled for May 17 (today) after four years, reports Republica. The review petition filed by then Chief Secretary Lilamani Poudel on behalf of the Government requested to let the transitional justice bodies continue working as in the same situation as had been obtaining. In the 2015 ruling, a full bench of Justices Kalyan Shrestha, Baidhanath Upadhyay and Cholendra Shumsher JB Rana had asked the government not to formulate any law granting amnesty to those involved in cases of serious human rights violation such as rape, murder, torture and disappearance and to meet international standards while drafting transitional justice laws. Dissatisfied with the ruling, Poudel filed the review petition.

Human rights activists on May 20 urged the Government to sign the Optional Protocol to the Convention Against Torture (OPCAT) to enable an independent body to effectively monitor rights compliance in jails and detention centres across the country, reports The Himalayan Times. This, they say, will deter law enforcement officers from torturing detainees and inmates. Article 1 of OPCAT provisions regular visits by independent international and national bodies to jails and detention centres to prevent torture and other cruel, inhuman or degrading treatment or punishment. Signing OPCAT will place a moral obligation on the Government to form an independent mechanism to monitor rights compliance in jails and detention centres across the country.

Rastriya Janata Party-Nepal (RJP-N) has drawn the attention of the Government to make public a report prepared by a commission formed under the leadership of former Supreme Court Justice Girish Chandra Lal, to probe the violation of human rights during the Tarai-Madhes movement of 2015/16, reports My Republica on May 21. Speaking at Parliament on May 20, RJP-N lawmaker Chanda Chaudhary urged the Government to make the report public. “We have been asking the government to make the Lal commission report public for long. However, it has not made the report public despite an instruction for the same by the Speaker,” lawmaker Chanda said. RJP-N has been mounting pressure on the government to publicise the report although the governments formed after the political change of 2006 have never made public the reports submitted by similar commissions. The party began exerting pressure mainly after its lawmaker Resham Chaudhary, who was convicted in the 2015 Tikapur massacre and has been serving a life term, was sworn in as a member of the House of Representatives (HoR) in January 2019.

Speaking in Parliament, NC Chief Whip Pushpa Bhusal accused the Government of trying to control independent media and terrorize journalists through the bill. “The Government wants to silence critical voices and has tried to introduce a system where press is under government’s thumb. Stating that journalism was the pillar of democracy, Gautam expressed concern about controversial provisions in the bill that could prove detrimental to press freedom. “Independent journalists speak for those who cannot raise their voice. A multi-agency probe involving Directorate of Revenue Intelligence (DRI), Intelligence Bureau (IB), Customs and India’s external intelligence agency Research and Analysis Wing (RAW) has begun on suspicion of narco-terrorism soon after six Pakistan nationals were arrested in high sea off Gujarat coast from a fishing boat from Karachi, reports Times of India on May 25. This incident was earlier reported by South Asia Terrorism Portal (SATP) on May 22. In a simultaneous operation, three Pakistani and three Nepali nationals were arrested in Kathmandu with Rs 7.6 crore in fake Indian currency notes (FICN) of Rs 2000 denomination. “Those arrested included FICN kingpin Yunus Ansari,” said a senior DRI official. Ansari is known to have links with India’s most wanted don Dawood Ibrahim and Pakistan intelligence agency ISI (Inter-Services Intelligence) and has been responsible for running FICN network from Nepal. He is also suspected to have links with proscribed Pakistani terror outfit Lashkar-e-Taiba (LeT) that has been responsible for several bomb blasts in India. Son of a former Cabinet minister of Nepal Saleem Mia Ansari, Yunus was arrested twice earlier in 2010 and in 2014 based on DRI information for circulating FICN. “In the last few months, maritime route in the Indian Ocean has been exploited by the international organised narcotic smuggling syndicates for trafficking drugs. The other sensitive route has been India-Pakistan border in J&K where DRI had made seizure of heroin and arms and ammunition in a joint operation with Indian army last year,” a senior DRI official said.

A meeting of the Central Executive Committee of Conflict Victims’ Common Platform (CVCP) on May 26 adopted its special resolution on the current issues related to transitional justice demanding amendment to transitional justice act, reports The Himalayan Times. According to a press statement issued by CVCP, the two commissions – the Truth and Reconciliation Commission (TRC) and the Commission on the investigation of Enforced Disappeared Persons (CIEDP) – failed to discharge their duties in accordance with the principles of transitional justice, goals of the Comprehensive Peace Accord and sentiment of the victims. “We demand that the commissions be staffed by competent, independent and qualified TJ expert. We demand that the government should postpone the recommendation process and start consultation on amendment of the law. The National Human Rights Commission should recall its representative from the recommendation committee. The CVCP believes that the process of selecting new commissioners is a part of conspiracy to divert its attention from making an amendment to the TJ Act. This is not acceptable for conflict victims. If the former TRC and CIEDP commissioners are reappointed, the conflict victims will reject the commissions outright. The CVCP has been closely watching the unfolding events,” it stated.
