Conflict Victims Common Platform (CVCP) issuing a press release in the Capital, Kathmandu said that Commission of Investigation on Enforced Disappeared Persons (CIEDP) is forwarding complaints regarding the missing persons to the Truth and Reconciliation Commission (TRC) without carrying out investigations, reports The Himalayan Times. CVCP said that CIEDP has sent around 400 such files to TRC. On the basis of the claims made by various authorities and organizations, CIEDP has pronounced the missing as dead without investigating properly. The Prime Minister’s Office (PMO) has prepared directives and by-laws for running provincial parliaments and Governments, defining the role of provincial chiefs (Governors), reports Kathmandu Post. According to the rules, the Governor administers the oath to the Chief Minister who swears in his/her Cabinet members in turn. The provisions are not final, said Mahendra Man Gurung, secretary at the PMO, aimed at facilitating the works of the provincial chiefs. Sources said that the Government is set to appoint Governors and announce the temporary capitals of the seven provinces in a Cabinet meeting on January 4.

CPN-Maoist Centre leaders during the headquarters meeting of the party Centre on January 2 urged the party leadership to ensure that Pushpa Kamal Dahal becomes a powerful chief of the unified party if CPN-UML Chairman KP Sharma Oli is appointed the Prime Minister, reports Kathmandu Post. With a section of CPN-UML leaders advocating joint-leadership, Maoist members are vocal about Dahal’s full-fledged command after the parties unite. Maoist leaders argue that as the larger party in the alliance the CPN-UML should get to choose whether it wants the PM’s post or the unified party’s chair. Maoist leader Devendra Poudel said after the meeting that his party wants full-fledged leadership of the unified force if the CPN-UML goes for the PM’s post and vice-versa.

Government is preparing to hold National Assembly (NA) election on February 8 as per the recommendation of the Election Commission (EC), reports The Himalayan Times on January 2. “The government will most probably announce NA election date as per the EC recommendation, which is February 8,” said Prime Minister Sher Bahadur Deuba’s Press Coordinator Govinda Pariyar. The Government is doing groundwork to fix NA election date, appoint province chiefs, fix the number of ministers in provincial cabinets and ready temporary headquarters of provinces, according to NC leader and Minister for Labour and Employment Farmullah Mansoor.

Minister for Law, Justice and Parliamentary Affairs Yagya Bahadur Thapa said preparations are underway to introduce an ordinance to extend the terms of Truth and Reconciliation Commission (TRC) and Commission for the Investigation of Enforced Disappeared Persons (CIEDP), reports Republica on January 4. "There have been demands to extend their terms for two years. I am personally in favor of extending their terms for a year. We are preparing to extend the terms of both the mechanisms soon," Minister Thapa said. The Government had last extended the terms of these two transitional justice mechanisms for a year on February 9, 2017 after their original two-year terms expired without even commencing their mandated tasks.

Reiterating its position, the Election Commission (EC) on January 3 said that it cannot announce the results of the House of Representatives elections under the Proportional Representation (PR) category before the National Assembly (NA) elections, reports Kathmandu Post. Amid criticisms from leaders of the left alliance and street protests from their sister organizations, the EC clarified its stance through a statement, saying that constitutional and legal hurdles prevent it from announcing the Lower House election results under the PR category despite its wish to do so at the earliest. “As per the Article 84 (8) of the constitution and Clause 60 (4) of the Act on Elections to House of Representatives, the EC is unable to announce the seats obtained by the political parties under PR category and write to the political parties to recommend candidates to be elected before the elections to the Upper House are held,” the EC said in the statement.

Speaking at a press meet jointly organized by Press Chautari Nepal, Chitwan, and Press Centre, Chitwan, at Bharatpur airport, Dahal claimed that the CPN-UML and CPN-Maoist Centre would be unified before formation of the new Government. “Discussions on party unification are under way and are moving in a positive direction. Truth and Reconciliation Commission (TRC)’s office in Province-1 has failed to meet its target in investigating the complaints related to the serious human rights violation during the Maoist insurgency, reports The Himalayan Times on January 5. The provincial office of the commission set up seven months ago was supposed to probe over 1,000 complaints. Investigation expert Mina Sedain at the office, however, attributed the below-expectation progress to the two elections. “The Commission had been entrusted with the investigation of 1,207 cases in the first phase but as there were elections one after another, we have so far investigated only 285 cases and sent them back to the commission’s central office,” she said, adding that they had, however, completed primary investigation of all conflict-era human rights violation cases.

The Government on January 5 decided to extend the tenure of Commission of Investigation on Enforced Disappeared Persons (CIEDP) and Truth and Reconciliation Commission (TRC) by a year, reports The Himalayan Times. A decision to this effect was taken in a meeting of the Cabinet. According to Minister of Supplies Bahadur Bishwakarma, the Government would send an ordinance to the President proposing to extend the term of the two transitional mechanisms by a year. Both the single transferable voting (STV) and first-past-the-post systems (FPTP) will be adopted to elect 56 members of the NA by an electoral college comprising Provincial Assembly (PA) members and chiefs and deputy chiefs of the local federal units. According to the constitution, the NA has 59 members - three of them appointed by the President on the Government’s recommendation. Polling has been scheduled for February 7. According to the EC, only 42 members will be elected under the STV system while 14 are elected directly. Of the eight members to be elected from each province, six including three women are elected under the STV system while one each from Dalit and disabled or minority community is picked from the FPTP system.

Senior leaders of the FSF-N and RJP-N said they are in informal negotiations with top leaders of CPN-UML for the formation of new Government. "We will support any party that assures us constitutional amendment. Parliamentary arithmetic after the election is such that bringing any amendment to the constitution is not possible without CPN-UML support," said RJP-N General Secretary Keshav Jha. Stating that TRC was getting more perpetrator-centric rather than victim-centric, they said the members should come clean as to why they could not even investigate a single complaint in the past three years. “You give various reasons such as earthquakes, political situation in the country and internal feuds for your failure to investigate our complaints, but we are not here to listen to your complaints,” said Anita Gyawali of Arghakhanchi who lost her father during the Maoist insurgency. In a meeting between TRC officials and conflict victims in Kathmandu on January 9, she said, “If you can’t do your job, you do not have the right to continue holding the position.” The victims also said they felt that the TRC members were more concerned about their jobs rather than convincing the victims that they would get justice one day. “I have lost faith in TRC,” said Chandra Kala Adhikari of Gorkha whose husband was murdered during the armed conflict. “We’ve already faced a lot of trouble. And, it’s frustrating to know that you [TRC members] are enjoying your jobs selling our names.”

The Election Commission (EC) has received a total of 114 complaints related to violation of the election code of conduct during the period of the House of Representatives (HoR) and State Assembly elections, reports The Himalayan Times on January 10. Commission’s spokesperson Nawaraj Dhakal said of these complaints, the EC cleared 81 complaints after studying into all the complaints while no action was required regarding the remaining 33 complaints. The highest number of complaints was related to the use of vehicles in violation of the election code. Thirty-nine such complaints were filed with the EC, followed by 31 complaints related to the transfer and deputation of employees, 11 complaints related to conduction of examinations for appointing new employees or employees on contract basis in various bodies, five complaints related to the violation of the code by the employees mobilised on election works, five complaints concerning appointment of office-bearers in various bodies, and holding the town or village assemblies by the local bodies, and one complaint related to expansion of the Council of Ministers. The election code of conduct was in force from August 30 to December 12, 2017 in view of the HoR and State Assemblies elections held in two phases on November 26 and December 7.

The meeting ended with an understanding to pick Chief Ministers (CMs) for six provinces and select candidates for the upper house based on consensus. A joint taskforce comprised of leaders from both the parties has been directed to submit a detailed report on power-sharing based on the consensus reached between the two parties. Leaders said that the 60:40 percent divisions in organization will make it much easier to find a settlement on organization. But they pointed at a possible challenge in resolving the number of office bearers and other key positions due to a large number of aspirants. Though, the exact model of power-sharing remains unclear, the cross-party leaders said that there would be 60/40 division in leadership, party organization and other key positions. Both parties will have to select a handful of leaders from among multiple candidates for key positions. Powerful leaders from both the parties have been pressing their chairmen to secure them appropriate positions in the unified party.

With the ruling, disbursement of funds worth around Rs10 billion to 240 retired lawmakers will be halted. Of the Rs10 billion allocated under the two programmes in total, Rs30 million was released to each constituency for projects under the CISP and Rs5 million each to lawmakers to implement projects under the CDP. As per preliminary consultations, the CIEDP and the NEFAD will jointly work to investigate complaints by reaching out to the victims, lobby for policy reforms, devise a complete reparation policy, and pressure the government and political parties to amend the Act in line with the Supreme Court’s verdict which struck down the amnesty provision in the act and ordered criminalization of torture and disappearances. According to discussions, the CIEDP will come up with a detailed one-year work plan by the second week of February, and the progress will be monitored quarterly. To monitor the progress, the two organizations plan to form a 20-member team — including 11 representatives from NEFAD, eight from CIEDP and one independent observer.

Amid criticism for failing to investigate war-era cases of disappearance, the Commission of Investigation on Enforced Disappeared Persons (CIEDP) has proposed NR 2 million for the families of persons who have yet to be traced since they disappeared during the Maoist insurgency, reports Kathmandu Post on January 24. The commission has written to the Ministry of Peace and Reconstruction to provide additional compensation to the victims as a measure of reparation. Families of the people disappeared and those killed in the decade-long rebellion have received Rs1 million as compensation in installments so far. According to CIEDP member Bijul Biswokarma, the sum of money was recommended as part of a relief package for the victims. The proposal needs Cabinet endorsement for effect. The commission formed in 2015 has recorded 3,093 cases. After preliminary investigation, it segregated 2,258 cases to be “genuine” and thus eligible for compensation. It will cost the state-coffers NR 4.51 billion if the additional payments are made. “We believe this will provide some relief to the victims,” he added.

Nepali Congress (NC), Rastriya Janata Party-Nepal (RJP-N) and Federal Socialist Forum-Nepal (FSF-N) on January 23 forged an alliance for the upcoming election of National Assembly (NA) scheduled for February 7, reports Republica. In a meeting held at Baluwatar with the NC, the leaders from RJP-N and FSF-N have agreed to make the alliance for the election. According to Keshav Jha of RJP-N, all three parties have agreed to claim for 2-2 seats in Province 2 out of eight seats of the Province. Though the three parties seem to be on one stand, Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) will claim one-one seat from the Province.

With 17 candidates elected unopposed, there will be contests among 66 candidates for 43 seats. However, the Election Commission (EC) said it will announce the winners on January 29 at the time of publishing the final list of candidates. The voters will elect 56 members in the 59-member NA through a secret ballot, while three are appointed by the President on the recommendation of the Government, according to the constitution. We initiated it with the first amendment. We are of the view that there must some convincing reasons and justification for amending the constitution. Following the Commission of Investigation on Enforced Disappeared Persons (CIEDP) decision to seek a one-year term extension, the Truth and Reconciliation Commission (TRC) on January 28 started consultations among its stakeholders before requesting the Government for similar extension, reports Kathmandu Post. Manchala Jha, a TRC member, said “Completing investigation of 60,298 cases is extremely challenging even in the favorable condition. If the non-cooperation from the government and parties continues, there won’t be any significant process no matter how many times the term is extended.” The commission received 60,298 complaints from the conflict victims, has hardly completed preliminary investigation into 827 cases so far. It has yet to initiate detail investigation into a single case. Given the huge number of complaints, it is highly unlikely that the TRC could complete the investigation in the extended period.

The Election Commission (EC) announced the final list of candidates for the upper house. The 24 candidates were elected unopposed as no other contender filed nominations for those seats or some of the contenders withdrew their nominations. According to EC, 52 candidates will contest for the remaining 32 NA seats. Six candidates in Province-1, eight candidates in Province-2, one candidate in Province-4, three candidates in Province-5, six candidates in Province-7 were elected unopposed. The election will be held for all eight seats in Province-3, and 6. The NA election will be held on February 7. Of the 59-member NA, three members will be nominated by the President on the recommendation of Government. Meanwhile, Presidium Member of Rastriya Janata Party Nepal (RJP-N) Rajendra Mahato at an interaction programme organized in the capital, Kathmandu on January 29 said that his party would not join the Government of the left alliance, reports The Himalayan Times. “The CPN-UML was against the constitution’s amendment even in the past and it is even today. There is no chance of RJP-N joining the left government in such circumstances,” Mahato said.

Nine days before the end of their three-year tenure, the transitional justice bodies Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) on January 29 requested the Government for another extension of their term, reports Kathmandu Post. The three-year term of the TRC and the CIEDP expires on February 7. Both the commissions have blamed non-cooperation from the Government and the political parties for their poor performance in looking into the war-era cases of human rights violations. Lack of resources and mandate to spend, coupled with inadequate staff and non-cooperation from political parties, are the reasons the commissions have cited for failing to investigate into a single case completely since their formation in February 2015.

There are 2,055 NA election voters — 1,505 chiefs and deputy chiefs of 753 local levels and 550 provincial assembly members. EC Spokesperson Navaraj Dhakal said the poll panel had printed four types of ballot papers required for the NA election. Each voter will use four types of ballot papers. “We have completed printing of ballot papers required for NA election,” said Dhakal, adding that those ballot papers will be transported to the respective provinces by February 4.

Following assurances from top political leaders that they will ‘extend every possible support’ in the investigation process, the Commission of Investigation on Enforced Disappeared Persons (CIEDP) on January 31 wrote to the Ministry of Peace and Reconstruction, seeking extension of its tenure by one year as provisioned in the ordinance authenticated by President Bidhya Devi Bhandari on January 19, reports The Himalayan Times. The ordinance provisions that the Government can extend the tenure of the Truth and Reconciliation Commission (TRC) and the CIEDP by one year, if the two transitional justice mechanisms request for the same, stating valid reasons for their failure to complete their jobs in the stipulated time. The CIEDP took a decision to seek extension after consulting Prime Minister Sher Bahadur Deuba, Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Chairman KP Sharma Oli and Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) Chairman Pushpa Kamal Dahal in the past week. The commissions were formed in 2015 with a two-year term to investigate conflict-era human rights violations. They were awarded the first one-year extension in February 2017. Their extended tenure is set to expire on February 10. Of the total 3,093 complaints received, the CIEDP has recommended 2,258 complaints for detailed investigation after completing preliminary investigation. Detailed investigations have begun into around 200 complaints.
