Hearing the case, Justice Chaudhry censured the Federal Government and Security Agencies over their lack of progress and the Provincial Government’s apparent helplessness. “It has been observed that the Federal Government is not cooperating for the recovery of ‘missing persons’, while the Provincial Government appears to be helpless,” he said, adding, “Where are the missing persons? Has the earth or the sky swallowed them up?” “Balochistan is burning, while the Chief Minister along with his Cabinet members is busy attending luncheons in Islamabad,” Justice Chaudhry said. “People are being subjected to enforced disappearances; mutilated bodies are found dumped; targeted killings are multiplying and incidents of kidnapping-for-ransom are also increasing,” he added.

Chief Justice Iftikhar Muhammad Chaudhry sought an assurance from Chief Minister Nawab Aslam Raisani and Home Minister Zafarullah Zehri that they will protect the life and property of the people under Article 9 of the Constitution.

A SCBA Executive Committee member said that Balochistan needs a good administrator to resolve its issues, as the incumbent provincial Government had failed to resolve people’s problems. He said the committee believed there were three main issues in Balochistan: target killing, missing persons and kidnapping for ransom, but Police were too scared to take steps to resolve these issues. He also said some authoritative persons in the province had told them if Police were empowered and FC were withdrawn then the Province’s situation could stabilise.

He expressed this during a meeting with the Supreme Court Bar Association’s Executive Committee, including SCBA President Yasin Azad, who called on him at the Supreme Court Quetta Registry. The CJP said it was not completely true that no one was safe in Balochistan as all office-bearers met their relatives, friends and lawyers in Quetta, which shows the situation was not bad enough that people could not move freely. While hearing missing persons’ case; Chief Justice of Pakistan (CJP) Iftikhar Chaudhry gave a two-week deadline to the Balochistan Chief Secretary, the Inspector General of Police (IGP) and the Frontier Corps (FC) Deputy Inspector General (DIG) to produce the missing persons before the court. Prime Minister Yousaf Raza Gilani on May 9 said that Pakistan is the part of solution, not problem on fighting terrorism, reports Indian Express. According to Gilani, Pakistan was "part of the solution, not part of the problem" when it came to the "global issue" of fighting terrorism. He alleged that the US had fuelled the problem by abandoning its ally Pakistan once the Soviets had been driven from Afghanistan. "The vacuum was filled by militants," he said. Insisting that Pakistan had no role in providing shelter to Osama bin Laden, Prime Minister Yousaf Raza Gilani has attributed presence of the slain al Qaeda leader in his country to universal intelligence failure. Gilani, who is on a five-day visit to Britain, denied in an interview to The Guardian that bin Laden's presence in Abbottabad was secretly known. He said: "There is no complicity. I think it's an intelligence failure from all over the world," and denied suggestions that elements within Pakistan's military may have been aware of bin Laden's hideout, by saying: "Why should we do that? The Supreme Court on May 14 said that there existed evidence that the Frontier Corps (FC) were involved in abducting people in Balochistan, reports Daily Times. A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry, and comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain, hearing Balochistan target killings’ case, told the FC Inspector General (IG) that respect for the force was waning gradually, as 95 percent of the people in Balochistan had alleged that FC was involved in the picking up of civilians in the province. The Chief Justice said that missing persons are the key issue of the province, and the court cannot shut its eyes to it since there was evidence suggesting FC involvement.

The committee, which met under the chairmanship of Prime Minister Yousaf Raza Gilani, also reiterated Pakistan’s stance that only non-lethal cargo will be allowed to transit the country. It decided that the military authorities should negotiate fresh border ground rules with NATO/ISAF to ensure that Salala-like incidents do not reoccur. “The new terms and conditions should incorporate a clause, as recommended by parliament, to the effect that only non-lethal cargo would be allowed to transit through Pakistan to Afghanistan,” it emphasised.

Islamabad Police Chief Bani Amin said that embassies had received small packets containing black powder, which had been sent for laboratory analysis. The letters said "poison" would be hidden in the NATO supplies should Pakistan decide to lift a nearly six-month blockade on supplies for American and NATO troops in Afghanistan. General John Allen told Reuters he was confident a deal would eventually be struck but “whether it’s in days or weeks, I don’t know”. Many US officials had hoped for an agreement in time for the Sunday-Monday summit that would end a nearly six-month ban prohibiting trucks in Pakistan from carrying supplies to Afghanistan. Asked if he would be disappointed if Pakistan didn’t strike an agreement before the end of the Chicago talks, Allen said, “No”, “I don’t need the (ground supply lines) to be open to support the campaign. But they’re helpful to us in sending home our equipment,” Allen said. “We don’t want an agreement fast. we want an agreement that’s right. So we’re going to take the time to get it right.”

The court had on May 21 summoned these officials, along with principal secretaries to the Governor and the Chief Minister of Balochistan, to explain why the court’s orders had not been complied with so far.
