President Gotabaya Rajapaksa on April 1 issued a special gazette notification declaring a public emergency in Sri Lanka with effect from April 1, reports Colombo Page. On President’s command, Secretary to the President Gamini Senarath has issued the Extraordinary Gazette Notification. The emergency law enables all Sri Lankan state authorities to detain people without warrants, seize property, enter and search any premises, suspend laws and issue orders that cannot be questioned in court. Officials who issue such orders are also immune from lawsuits.

The Sri Lankan Government on April 2 declared a nationwide curfew for 36 hours in order to prevent a massive protest planned for April 3 to protest Government’s failure to provide solutions to the shortages of food, fuel, gas and medicine and power crisis, reports Colombo Page. The Government informed that a 36-hour curfew has been imposed across the country from 06.00 pm of April 2 to 06.00 am of April 4 in accordance with the powers vested in the President under the provisions of the Public Security Ordinance.

Members of several opposition parties led by the Leader of the Samagi Jana Balawegaya Sajith Premadasa marched from near the Nelum Pokuna Theater to hold a peaceful rally at the Independence Square in Colombo on April 3, reports Colombo Page. However, they were prevented from entering the Independence Square by Armed Police who had set up barriers and roadblocks to block all entrances to Independence Square, causing a heated situation between Members of Parliament, including the Leader of the Opposition, and the Police.

The drivers of vehicles passing the protesters honked their horns and distributed water bottles to the protesters. At a media briefing, SJB leader, Sajith Premadasa said that the SJB is not ready for any agreement or governing with the Government led by President Gotabaya Rajapaksa. Sri Lanka President Gotabaya Rajapaksa on April 5 lifted the State of Emergency declared by him last week, reports Colombo Page. Secretary to the President Gamini Senarath on the President’s command has issued an Extraordinary Gazette Notification revoking the President’s earlier proclamation of State of Emergency issued on 01.04.2022 with effect from midnight Tuesday, April 5, 2022. the Gazette Extraordinary said, “I, Gotabaya Rajapaksa, President of the Democratic Socialist Republic of Sri Lanka do hereby with effect from mid night of April 05, 2022, revoke the proclamation issued by me in terms of the powers vested in me by Section 2 of the Public Security Ordinance (Chapter 40) proclaiming the operation of the provisions of Part II of the aforesaid Ordinance throughout Sri Lanka with effect from April 01, 2022.” President Gotabaya Rajapaksa declared the State of Emergency and the subsequent 36-nour curfew over the past weekend to suppress the public protests against the government, but the measures failed to achieve the intended result and instead intensified the public anger.

An extraordinary gazette has been issued by the Secretary to the President Gamini Senerath indicating the resignation of 26 cabinet ministers, reports Daily Mirror on April 8. Meanwhile, another gazette notification has also been issued notifying the appointment of four ministers Dinesh Gunawardene, Prof. G.L. Peiris, Johnston Fernando and Ali Sabri, as Ministers of Education, Foreign Affairs, Highways and Finance from the President respectively, to maintain the affairs of Parliament and other functions of the country legitimately and in a stable manner until a full Cabinet is appointed, adds Daily News. However, another fresh gazette notification has to be made as Ali Sabri who was appointed Finance Minister, has resigned from the post, barely a day after the appointment.

Some 735 suspects have been arrested in connection with the Easter Sunday attack, Defence Secretary Kamal Gunaratne said on April 12, reports Daily Mirror. Addressing a media briefing at the Government Information Department, he said that 196 of those arrested have been remanded while 493 persons were released on bail so far. He said charges have also been filed against 81 suspects in various High Courts. The youths protesting at the Galle Face Green in Colombo say that there is no other solution to their struggle except the resignation of the President, and the whole Rajapaksa family including the Prime Minister in the government. The annual Country Reports on Human Rights Practices for 2021 said the Government took minimal steps to identify, investigate, prosecute, and punish officials who committed human rights abuses or corruption, and there was impunity for both. The US State Department’s Bureau of Democracy, Human Rights and Labor published its annual Country Reports on Human Rights Practices for 2021 and US Secretary of State Antony Blinken on April 12 released the report to the public. The Country Report said there were several reports that the Government or its agents committed arbitrary or unlawful killings and added that during the year there was no significant progress on cases against officials accused of arbitrary, unlawful, or politically motivated killings. Lack of accountability for conflict-era abuses persisted, particularly regarding Government officials, military, paramilitary, Police, and other security-sector officials implicated and, in some cases, convicted of killing political opponents, journalists, and private citizens. Civil society organizations asserted that the government and the courts were reluctant to act against security forces, citing high-level appointments of military officials credibly accused of abuses and pardons of convicted murderers. While there were no reports of disappearances by or on behalf of government authorities, disappearances during the war and its aftermath remained unresolved.

Speaking at a media at the JVP head office at Pelawatta JVP leader brought three main issues to the attention of the people. They are the resignation of the President, the resignation of the Prime Minister and the establishment of an interim Government and the holding of a general election shortly afterwards. The JVP leader said the two major crises in the country, the political crisis and the economic crisis do not seem to be moving forward toward any solution today. Sumanthiran has prepared a No Confidence Motion (NCM) against President Gotabaya Rajapaksa, which will be submitted to Parliament when the House convenes next, reports Daily Mirror on April 28. The United National Party (UNP) has already expressed its support for this motion and moves are now underway to collect signatures from other opposition parties as well. If 113 signatures are collected on the NCM, there will be no legality to remove the President but this will clearly show that the Parliament has lost the trust in the President, which will further pressurize Gotabaya Rajapaksa to resign. Senior sources said that in the event the President resigns, Parliament will then appoint a new President - a candidate who they will believe is the most suitable for the position. It is learnt that even the Janatha Vimukthi Peramuna (JVP) is likely to sign this NCM against the President and Sri Lanka Podujana Peramuna (SLPP) Members of Parliament (MPs) are also being approached. The 11 party alliance members including Wimal Weerawansa and Udaya Gammanpila will be approached to sign the NCM, as Wimal Weerawansa was one of the first to publicly say he will not accept any portfolio under President Gotabaya Rajapaksa. The NCM against the Prime Minister which was initiated by the opposition Samagi Jana Balawegaya (SJB) has failed to get the required numbers and even though MPs such as Gammanpila are voicing for it with the ruling parliamentarians, the signatures are yet to be placed on paper.

The President made this call at a discussion held at the President's House in Colombo Fort this April 29 with party leaders and representatives of the political parties who were elected under ruling party at the 2020 General Elections and now have left the government becoming independent in parliament. Attention was drawn to the need to form a National Consensus Government to continue the process of government and as a first step to appoint a National Council with the participation of the leaders of the political parties represented in Parliament. The President stated that he would agree to the common resolution presented by the party representatives if all political parties supported it. It was also decided to nominate five delegates to the discussion to take forward the process of forming an all-party government.
