On January 1, a court declared 23 terrorists from Kishtwar District of Jammu and Kashmir, who are operating from Pakistan and Pakistan-occupied Jammu Kashmir (PoJK) as proclaimed offenders and process to attach their properties will be set in motion if they don’t surrender before the court within 30 days, reports Daily Excelsior. Chief Justice of Pakistan (CJP) Qazi Faez Isa underscored the Supreme Court's resolve on January 2 to conclusively address the issue of missing persons and enforced disappearances, and said that it should be solved "once and for all", reports The Express Tribune. However, he cautioned against politicising the matter. "We cannot grant you permission to make the matter political." The hearing was presided over by CJP Isa with Justice Musarrat Hilali and Justice Muhammad Ali Mazhar completing the three-member bench. The proceedings were broadcast live on the apex court's website and national news channels. As the hearing commenced, Justice Isa emphasised the importance of collective responsibility, the CJP said “This country belongs to all of us, even those who may have other points of view”. “This matter will only be resolved when we all work together and take responsibility. Let’s make Pakistan strong from within. If Pakistan is strong from within, no outside forces can touch it.” Petition Khushdil Khan Malik prayed to the court for instructions to the Government to enact legislation on the issue of missing persons. Justice Mazhar stated that a commission related to enforced disappearances has been formed. The petitioner argued that the Commission of Inquiry on Enforced Disappearances was formed under the chairmanship of Justice (retd) Javed Iqbal, but has not made much headway so far. He further prayed that a notice should be issued to the Government regarding its lack of action in enacting the said legislation. The chief justice observed that the court does not have the authority to order the parliament to enact legislation and inquired under which article of the Constitution can the court take such a step. He maintained that all institutions of the country need to stay within their constitutional limits. Justice Mazhar added that the court does not have the power to legislate and can only declare enacted legislation null and void if they are contrary to the Constitution.

The Supreme Court (SC) on January 3 directed the Commission of Inquiry on Enforced Disappearances (COIED) to submit a “comprehensive report” on missing persons, along with the details of all production orders issued, reports Dawn. While hearing a case on the chronic malaise of enforced disappearances, the SC instructed the commission to prepare a report on all the missing persons cases and provide production orders issued “in each of the cases” to the Attorney General for Pakistan within 10 days. The orders were passed as a three-member bench comprising Chief Justice of Pakistan (CJP) Qazi Faez Isa, Justice Muhammad Ali Mazhar and Justice Musarrat Hilali heard a set of pleas. Among the petitioners was Barrister Aitzaz Ahsan who highlighted how the unlawful practice of enf¬orced disappearances continued unabated, haunting generations upon generations.

The National Investigation Agency (NIA) on January 9 filed a supplementary charge sheet against three terror operatives including a Pakistani national of ‘The Resistance Front’ (TRF) – an offshoot of proscribed Lashkar-e-Toiba (LeT) – for conspiring to unleash terrorist attacks in Jammu and Kashmir (J&K) including Rajouri and Poonch districts, reports Daily Excelsior. The charge sheet was filed against Habibullah Malik alias ‘Sajid Jutt’, hailing from Kasur District in Pakistan’s Punjab Province, and two South Kashmir residents Hilal Yaqoob Deva alias “Sethi Soab” and Musiab Fayaz Baba alias “Shoaib Zarar” of Shopian before the NIA Special Court. Malik, who is known by various other names like Saifullah, Noomi, Numan, Langda, Ali Sajid, Usman Habib and Shani, has been found to have been involved in various terrorist attacks in Poonch and Rajouri districts of Jammu region, the official said. The supplementary charge sheet follows investigations in the case registered suo-motu by the NIA on June 21, 2023. The case relates to a conspiracy hatched “physically as well as in cyberspace” by various proscribed terrorist organisations to spread fear and terror and disrupt peace in J&K by carrying out attacks using sticky bombs, Improvised Explosive Devices and small arms.

The National Investigation Agency (NIA) on January 15, filed a chargesheet against one of the two members of the Islamic State (IS) Jharkhand module arrested last year, as part of the agency’s crackdown on the proscribed global terrorist organization, reports India Today. As per the chargesheet filed before the NIA Special Court in Ranchi under various sections of the Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code (IPC), the accused, identified as Faizan Ansari alias Faiz, was involved in propagating IS propaganda and in the recruitment of individuals. "Ansari created and administered multiple 'ISIS-aligned' cyber groups on social media platforms such as Telegram and Instagram for dissemination of terrorist propaganda materials, including ISIS magazines 'Voice of Hind’ and 'Voice of Khorasan' to influence and recruit youngsters to carry out violent attacks in India," the chargesheet added. "The accused had taken an oath of allegiance (Bayath) to the self-styled Khalifa (leader) of the ISIS," it said.

Islamic State (IS) sympathiser from India, Mehdi Mosroor Biswas, who gained notoriety as a propagandist on social media for the terrorist outfit in 2014, was convicted on January 16, by a Bengaluru court on charges of terrorism, waging war against an Asiatic ally and promoting enmity, reports The Indian Express. Biswas, who went by the name @shamiwitness on X (formerly Twitter), used the social media handle to sympathise with the outfit during the rise of the IS in Syria in 2014. Biswas, now 34, was arrested when he was 24-year-old in Bengaluru on December 13, 2014. His arrest came after the UK’s Channel 4 revealed that he was behind the @shamiwitness handle that was helping British IS recruits join ISIS (then Islamic State of Iraq and Syria) in Syria. He has also been convicted under Section 125 of the Indian Penal Code (IPC) for attempting to wage a war against an “Asiatic Power in alliance or at peace with the Government of India” which also entails seven years in prison and under IPC Sections 153 A for promoting enmity between groups and 505 for statements conducing to public mischief. The court has posted the hearing on sentencing in the case to January 19, 2024.

The 15, who belong to PFI and its political wing Social Democratic Party of India (SDPI), were given the maximum penalty by judge Sreedevi VG of the Mavelikkara Additional District Sessions Court-1. Apart from the death sentence, the convicts have also been given life sentences and awarded fines for various offences. The Mavelikkara court on January 20 found the 15 guilty of various offences including murder, criminal conspiracy, unlawful assembly, and trespassing, wrongful restraint, and criminal intimidation. The charges were framed in connection with a blast at the forest gate in Agumbe and a robbery at Bidaragodu in Thirthahalli taluk. He would be presented in court again on February 1 in connection with setting ablaze a Karnataka State Road Transport Corporation (KSRTC) bus at Agumbe in July 2007. Krishnamurthy faces charges under various sections of the Unlawful Activities Prevention Act (UAPA), the Arms Act, and the Explosive Substances Act. The charge sheet has been filed against Gora Yadav alias Anil Yadav of Aurangabad in Bihar under various sections of the Indian Penal Code (IPC), the Arms Act, and the Unlawful Activities Prevention Act (UAPA) in the abduction and murder of Naresh Singh Bhokta, according to an official release. Yadav, arrested by the NIA on August 4, 2023, was allegedly directly involved in the killing. He was found to be a dreaded Maoist cadre, with 18 cases registered against him in various Police Stations in Aurangabad and Gaya districts of Bihar. Bhokta was abducted by Maoists at the direction of their top leadership. He was taken to a so-called ‘jan adalat’ in the Aurangabad area, where a kangaroo court led by one Naval Bhuiya, ‘sub-zonal commander’, CPI-Maoist, ordered his killing, the release said, adding that Bhokta was murdered on the night of November 2, 2018 near village Badhai Bigha. The NIA, in its original charge sheet filed on February 25, 2023, had named one accused. This was followed by the filing of charges against three more persons in June 2023. The charge-sheet against the accused was filed in the NIA Special Court in Ranchi in Jharkhand, a NIA spokesperson said. The official said this is the first charge-sheet filed in the case relating to a criminal conspiracy by the proscribed organisation to expand, revive and propagate its violent ideology in Jharkhand, Bihar, Chhattisgarh and other states. The five charge-sheeted accused along with other top leaders of the CPI-Maoist were actively engaged in recruitment, raising funds for terrorist acts, procuring arms and ammunition, and providing training in weapons handling, field craft and Improvised Explosive Device (IED) fabrication, the spokesperson said. A special prosecutor said the case probed by the National Investigation Agency (NIA) found that three of the convicts—Kawasi Joga, Mahadev Nag, and Mani Ram Madiya—were residents of Bastar, while the fourth convict, Dayaram Baghel, was a resident of neighbouring Sukma district. They were convicted under multiple sections of the Indian Penal Code (IPC), the Unlawful Activities Prevention Act (UAPA), the Explosives Act, and the Arms Act by the special judge, D. R. Dewangan. On March 11, 2014, a joint team of the Central Reserve Police Force (CRPF) and state Police encountered an armed Maoist attack near Tahakwada village that falls under Tongpal Police Station in Sukma district. On February 27, a district court in West Bengal convicted 23 suspects in connection with the attack on a camp of the Eastern Frontier Rifles (EFR) at Silda in West Midnapore District on February 15, 2010 by armed cadres of the Communist Party of India-Maoist (CPI-Maoist) that killed 24 EFR personnel, reports socialnews.xyz. Initially, the trial was going on against 24 accused Maoists. However, the number came down to 23 after the demise of the prime accused and CPI-Maoist leader Sudip Chongdar. On Tuesday, the remaining 23 accused, including nine who were released on bail, were produced before the district court, which convicted them in the case. The judge said the arguments of all the convicted individuals will be heard on Wednesday (February 28), following which the punishment will be pronounced. In the attack in February 2010, as many as 23 EFR personnel were killed. Five most-wanted Maoist guerrillas were also killed in counterfire by the security forces. On February 27, the National Investigation Agency (NIA) Special Court in Kolkata in West Bengal sentenced one accused identified as Akramul of Malda District of West Bengal to five years Rigorous Imprisonment (RI), and INR 10,000 fine under sections 489C & 120B of Indian penal Code (IPC), as well as seven years RI and INR 10,000 fine under 16 &18 of Unlawful Activities Prevention Act (UAPA) in the 2021 Fake Indian Currency Note (FICN) seizure case, taking the total number of convictions in the case to three, reports NIA. All sentences will run concurrently. A special task force at Lalbazar Street Police station in Kolkata had initially registered a First Information Report (FIR) in the case on January 22, 2020 against Akramul and Senaul Sk alias Senaul, following the seizure of huge quantity of high quality FICNs in the denomination of INR 500. Subsequent questioning of Senaul led to the arrest of the third accused, Enamul Hoque, on February 1, 2020, along with seizure of more FICN. The case was taken over and re-registered by NIA in March 2020, and investigations by the agency led to the arrest of the four accused. NIA found that all the four accused had hatched a criminal conspiracy for procuring and circulating FICNs with the intention to use the same for unlawful gains.

NIA investigations revealed that the accused had shared photographs of sensitive, tactical and strategically important installations & places in India, as well as details regarding the movements of the Indian Army and paramilitary forces, along with photographs of insignia clicked from his mobile, with agents across the border. It was also found during investigations that the accused had aided and abetted a conspiracy hatched by Pakistani ISI agents for commission of terrorist acts. Officials said Sanjoy Deepak Rao alias Sanjay Deepak Rao alias Vikas alias Anand alias Aravind, was a ‘central committee (CC)’ member of the CPI-Maoist. He has been chargesheeted in the NIA Special Court of Hyderabad. “Our probe revealed that the accused had actively recruited and radicalised other individuals to join the CPI(Maoist) in a systematic process and manner to carry [out] acts related to terror and violence, in conspiracy with other Maoist cadres,” an official release said. It added that he also raised funds to further the activities of the proscribed terrorist organisation, including the procurement of arms and ammunition. The case was initially registered by the KPHB police of Telangana following his arrest from the Malaysian Township Area in KPHB on September 15, 2023. A revolver with ammunition, multiple forged Aadhaar cards, a laptop and cash were seized from his possession at the time of his arrest. The NIA took over the investigation and re-registered the case on January 3, 2024.

In its third supplementary chargesheet filed before the NIA Special Court, Ranchi accused Mone Tiyu alias Mone Dada alias Mone Tiyu Angariya, hailing from West Singhbhum District, of being charged under various sections of the Indian Penal Code (IPC), the Unlawful Activities Prevention Act (UAPA), and the Arms Act. The case (RC 03/2022/NIA/RNC) relates to the January 4, 2022, attack on former MLA Gurucharan Nayak at the High School Jhilurua in West Singhbhum District. The probe agency filed its original charge sheet in the Munchingput conspiracy case in Andhra Pradesh in May 2021. Ramakkagiri Chandra is the eighth accused to be charged in the case related to the radicalization of "vulnerable youths towards the Maoist ideology and extension of support to the banned CPI (Maoist)," it added. He has been charged under the Indian Penal Code (IPC), the Arms Act, and the Unlawful Activities Prevention Act (UAPA) by the agency in its first supplementary charge sheet filed before the special NIA court in Visakhapatnam, it said. Chandra was a state committee member of the Pragathisheela Karmika Samakhya (PKS), a frontal outfit of the proscribed CPI (Maoist), the NIA said in the statement. On April 9, a special National Investigation Agency (NIA) court in Kochi in Ernakulam District of Kerala found four Communist Party of India-Maoist (CPI-Maoist) cadres guilty of allegedly threatening a Police officer after trespassing into his house at Vellamunda in Wayanad in 2014, reports onmanorama.com. Maoist leader Roopesh, his accomplices Shyam, Kanyakumari, and Ibrahim are the four accused who were found guilty in the case. They were charged under Indian Penal Code (IPC) sections related to criminal conspiracy, sedition, provisions of the Arms Act, and anti-terror law. As per the case, the accused had formed an unlawful assembly with prohibited weapons and trespassed into the house of the Kerala Police officer at Mattilayam in Thondernadu, Wayanad District of Kerala, on April 24, 2014. The agency said the accused also threatened to kill the Police officer, alleging that he was helping in anti-Maoist operations. They (the Maoists) had asked the officer to resign from his job and also set fire to his motorcycle. They also threatened the officer's mother at gunpoint. The accused then left pamphlets of CPI-Maoists inside the house of the Police officer and pasted posters on the front wall of the house, calling for an armed revolution against the government. The National Investigation Agency (NIA) on April 12, chargesheeted two accused, including the main conspirator identified as Seiminlun Gangte alias Minlun and another accused identified as Mohammad Noor Hussain alias Tomba alias Mohammad Nur Hasan, in the June 2023 Kwatka (Manipur) vehicle borne improvised explosive device (IED) blast case, in which three persons were injured and several public and private properties were damaged, reports NIA. The duo was found involved in the blast that took place on a culvert/bridge, adjoining the area of Phougakchao Ikhai Awang Leikai and Kwakta in Bishnupur District of Manipur. The explosion triggered by a bomb-fitted Mahindra Scorpio SUV, caused significant damage to the bridge, electric poles, electrical assets, and nearby houses. NIA’s investigations revealed that Noor Hussain, who was arrested on October 16, 2023, confessed to driving the IED-laden vehicle and parking it on the Kwatka bridge. His accomplice, whose identity was disclosed as Seiminlun Gangte, was arrested on November 2, 2023, and identified as the mastermind behind the attack.

On May 3, the National Investigation Agency (NIA) filed a charge-sheet against four cadres of Communist Party of India-Maoist (CPI-Maoist) in a case relating to firing at the commandos of the Special Operations Group (SOG) of Kerala Police in Thalapuzha area of Wayanad District in 2023, reports latestly.com. According to the NIA, the firing incident had occurred on November 7, 2023, when the SOG team of Kerala Police was on a combing operation in Perya, Wayanad, to track and arrest armed cadres of the CPI-Maoist. The team came under attack as it zoomed in on the cadres present in a house. "In the ensuing operation, two CPI (Maoist) members, identified as Thiruvenkidam alias Chandru and Shreemathi alias Unnimaya were apprehended. Three others, including Latha alias Meera and Sundari alias Jenny, however, fled the scene of the encounter," said the agency. It added that the NIA, which took over the investigation from Kerala Police on February 10, 2024, filed its charge-sheet today against Thiruvenkidam, Shreemathi, Latha and Sundari in the case RC-01/2024/NIA/KOC under relevant sections of IPC, UA(P)A and Arms Act. The accused persons have been identified as Sadiya, Nabeel Siddiqui Khatri, Jahanazaib Sami Wani, Hina Bashir Beigh and Abdullah Basith. The NIA had on July 12, 2020 arrested Sadiya along with another Pune resident Nabeel Siddiqui Khatri in the terror case. According to the NIA, Sadiya and Nabeel were found to have links with a Kashmiri couple Jahanazaib Sami Wani and his wife Hina Bashir Beigh, who were arrested initially by the Delhi Police Special Cell on March 8, 2020 for their affiliation to IS-KP. NIA re-registered the case against Wani and Beigh on March 20, 2020. During the course of the investigation, Abdullah Basith, who was arrested in another IS terror offence, was also named as an accused in the IS-KP case as he was found to be associated with Wani and Beigh. The NIA then arrested Abdur Rahman, alias Dr Brave, in August 2020.

On May 7, National Investigation Agency (NIA) filed a chargesheet against three more cadres of the Communist Party of India-Maoist (CPI-Maoist) in Nampally court in Hyderabad District of Telangana in the case of alleged supply of explosives and drones to CPI-Maoist, reports The Times of India. NIA officials said most wanted and absconding Maoists Hidma, Chokka Rao alias Damodar and Kamala were chargesheeted. A case was registered on June 5, 2023, by the Cherla Police after they arrested alleged couriers Nageswara Rao, Mallikarjun, Umashankar. They bought the explosives from one S Kumaraswamy, who was in possession of explosive license. Later, NIA took over the case and filed the first chargesheet against the arrested accused in September last. Now, a supplementary chargesheet has been filed in Nampally court.

The chargesheet filed in a Guwahati court on March 7 against five accused persons who were arrested in July 2023, in Manipur, said the accused “criminally conspired with intent to carry out violent terror attacks targeting the rival Kuki-Zo community with prohibited arms and ammunition.” The NIA said that one of the accused identified as Anand Singh mobilised local youth for armed training to escalate the ethnic strife and in July 2023 participated in a weapons training camp organised in Selloi Langamai Ecological Park near Keikhu by PLA cadres where around 80-90 young men received training in handling firearms.

The accused, identified as Hilal Ahmed Sher Gojri, an overground worker (OGW) of HM, Bikram Singh, Maninder Singh, Ranjit Singh, Jaswant Singh, Gurjant Singh alias Ashish, Ranjeet Singh alias Rana, Gagandeep Singh, Gursant Singh alias Gora, and Manpreet Singh, are charged under various sections of the Indian Penal Code (IPC), Narcotic Drugs and Psychotropic Substances (NDPS) Act, Unlawful Activities Prevention Act (UAPA), and the Arms Act. Earlier, this case was registered on April 25, 2020, at Police Station Sadar, Amritsar District, in connection with the arrest of Hilal Ahmad Sher Gojri, along with recovery of INR 29,00,000. Aghnu Ganjhu alias Agnu Ganjhu, and Khudi Munda, both residents of the state, have been named in the charge sheet filed on May 21 in a Special NIA Court in Ranchi, it said. The charge sheet has been filed under the Indian Penal Code (IPC), the Arms Act, the Explosive Substances Act, and the Unlawful Activities Prevention Act (UAPA), the statement issued by the NIA said. This brings the total number of people charged in the case to 31. Initially, nine people were charged by the Jharkhand Police in the case registered in 2022. After taking over the investigation, the NIA filed three supplementary charge sheets against 20 people between August and December last year. The members of the proscribed outfit, CPI-Maoist, had conspired to execute an attack on SFs in the Bauxite mines area in Jharkhand to take revenge against the arrest of their top ‘commander’, Prashant Bose, the statement said.

"No one has any objection to the work of the [spy] agencies, the objection is [only limited] to the unlawful work," Justice Kayani said while hearing a case pertaining to the implementation of the recommendations of the commission on Baloch missing persons. Justice Kayani stressed that the court does not want to prevent judges, lawyers, journalists, parliamentarians and spy agencies from operating as per the law, but only objects to them working unlawfully. The judge's remarks come a day after he, while hearing a case relating to the recovery of missing Kashmiri poet and journalist Ahmed Farhad Shah, was irked by authorities' failure to recover the poet and had questioned whether spy agencies would run the country or the law. "Now the matter has gone beyond the jurisdiction of the Inter-Services Intelligence (ISI) and the Military Intelligence (MI). They are talking about their failure," Justice Kayani had said in response to the Ministry of Defence's remarks saying that Shah wasn't in ISI's custody. The remarks then warranted a strong response from the Federal Government with Law Minister Azam Nazeer Tarar stressing that the court didn't have the mandate to drag senior military officers and Government officials to the court in the case of a missing person. "This is not the mandate of the court, the court is a platform for providing justice in line with the law and Constitution," Tarar had said during a press conference in Islamabad, as the rift grows between institutions.

All three accused were found to be involved in the group’s criminal conspiracy related to the abduction of six civilians from Morkhnadi village in Kanker District in Chhattisgarh, an NIA statement said. Three of them were later killed after labeling them as ‘police informers’ at a self-styled ‘jan adalat’ (people’s court of the Maoists) and their associates in Modemarka Forest on November 1, 2023, it said. The three accused have been identified as Sannu Ram Atlami alias Sunil, Suresh Katlami alias Kachlami, and Sanker Nureti alias Shanker, the NIA statement said. In its charge sheet filed before a special court in Jagdalpur, the NIA charged the trio under various sections of the Indian Penal Code (IPC) and the Unlawful Activities Prevention Act (UAPA). The National Investigation Agency (NIA) on May 29, filed a charge sheet against Paresh Baruah, the ‘chief’ of United Liberation Front of Asom-Independent (ULFA-I), and five others in connection with the attack on an army camp located at Kakopathar in Tinsukia District of Assam on November 22, 2023, reports NIA. The other accused named in the charge sheet as key conspirators and executors of the attack are Arunodoy Dohutia, Saurabh Asom, Abhijit Gogoi, Porag Bora and Bijoy Moran. Bora and Moran were arrested in December 2023 from the Tinsukia District while the other accused are absconding. NIA investigations stated that Baruah and Dohutia had masterminded the conspiracy and had deputed two of the outfit’s cadres to carry out multiple attacks on army camps in Assam. It was further revealed that Abhijit Gogoi had coordinated the entire planning, preparation and execution of the attack in the case. He had conspired with Bijoy Moran an Over Ground Workers (OGW) of ULFA-I, and recruited local youth to help in executing the terrorist attack.

On June 3, National Investigation Agency (NIA) chargesheeted 17 Islamic State (IS) operatives in NIA Special Court in Patiala House in New Delhi for their involvement in the conspiracy of recruitment and radicalisation of youth and fabrication of Improvised Explosive Devices (IEDs) in the Delhi-Padgha IS terror module case, reports NIA. Out of the 17 IS operatives, 15 are from Maharashtra and one each belongs to Uttarakhand and Haryana. During the investigation, NIA found that they had been sharing files related to IEDs fabrication with their contacts, raising funds for terror plans as part of IS agenda and had taken bayath (pledge of allegiance) from an arrested accused Saquib Nachan, an offender in many terror cases for IS in India. In its chargesheet filed on December 11, 2023, in the Special Court, Jaipur, the NIA has charged all 12 identified accused, belonging to Rajasthan, Haryana and Punjab, under various sections of the Indian Penal Code (IPC), Arms Act and the Unlawful Activities Prevention Act (UAPA). “Investigations have revealed that accused Rohit Godara was the mastermind who had hatched the murder conspiracy along with accused Virendra Charan, Goldy Brar and others. Godara and Brar accepted responsibility of the murder and used it to threaten and extort money from other individuals,” the NIA said.

National Investigation Agency (NIA) attached the property of Popular Front of India (PFI) operative, identified as Subair, involved in the murder case of C. Sasikumar, Spokesperson of Hindu Front, Coimbatore, on September 22, 2016, at Chakra Vinayaka Temple in Coimbatore District in Tamil Nadu, reports NIA on June 7. The property is attached by the orders of NIA Special Court, Poonamallee, Chennai. NIA said it found during investigation that Subair had, in 2020, transferred his property, purchased in 2012, to his mother via a gift settlement deed. Since the transfer took place after the commission of the crime and post filing of the chargesheet, it was seen by the NIA as an attempt to thwart legal action against Subair.
