In the past, Pakistan has waived normal extradition procedures to deliver two men Ramzi Yousef and Mir Amal Kansi wanted by the US for terrorist crimes there. But, Pakistan Foreign Minister Abdus Sattar said, on January 1, that the 20 suspects would be handed over to India under the South Asian Association for Regional Co-operation’s (SAARC) Regional Convention on Suppression of Terrorism, that too, only if India met the necessary "legal obligations''. Sattar also said that India should initiate a case against each person in its own courts, indict them and then ask for their extradition. At that point, he clarified, "Pakistan will consider the request and if the person is genuinely required for the prosecution, (he) will be handed over''.

Speaking at a public meeting in Lucknow, on January 2, Prime Minister Atal Behari Vajpayee criticised Pakistan’s demand for proof that its nationals were involved in the December 13, 2001, attack on Parliament in New Delhi. The Prime Minister said the bodies of the terrorists slain during the attack and documents recovered from their possession were enough proof to establish their identity as Pakistani nationals. The Prime Minister also said that religious fundamentalism was the driving force behind terrorism, which he described as the biggest threat to the world after the cold war. Terming the attack on Parliament as an attack on the heart of Indian democracy, Vajpayee said it was important to see whether it was one organisation or an entire government that had masterminded the incident.

Vajpayee said, ‘‘In our national and global battle against terrorism we look to scientists and technologists for help. We know that terrorist networks have been trying to master advances in science and technology to pose new threats to the civilised world.’’ ‘‘The only way we can stop them in their tracks is by building even more powerful collaborative network among all those governments, agencies and non-governmental institutions committed to defending peace and human values,’’ the PM added.

Prime Minister Atal Behari Vajpayee, addressing a news conference prior to his departure for Kathmandu, expressed dissatisfaction with steps taken by Pakistan against terrorist outfit. He said that the recent steps taken by Pakistan against terrorist outfits were just not enough and showed that Pakistan was not willing to act in a decisive manner. The PM said Pakistan’s demand for evidence against terrorists living on its soil and wanted by India in connection with the December 13 attack on Parliament and other subversive activities was nothing but a ‘cruel joke’. ‘‘I am at a loss to understand what evidence Pakistan wants when it is a well-established fact that our neighbour is responsible for the terrorist activities in India,’’ he added. The PM said: ‘‘If Pakistan is at all sincere in curbing terrorism, it should tell us about the action taken by it and clear all doubts in our minds.’’ He opined that there was no point in a dialogue with Musharraf unless he showed willingness to end cross-border terrorism.

Speaking in New Delhi on January 7, he said there are similarities between India and Israel in terms of threat perceptions emanating from terrorism and since "Israel has unfortunately become an experienced country in this domain (countering terrorism), we can offer our expertise to India". He added, "The world is not divided between East and West…. The world has a new division now, the countries that harbour terrorism and the countries that fight terrorism". Delhi Police Commissioner Ajai Raj Sharma, while speaking to the media on January 8 said, "We arrested 42 terrorists in 2001, and most of them were Pakistani or trained in Pakistan". Three Pakistanis were caught for terrorist activities and smuggling. Five men who were arrested on charges of trying to set off bombs in the city were accused of receiving military training in Pakistan, he said. West Bengal on January 8, was put on special alert following the arrest of some Pakistani Inter Services Intelligence (ISI) agents from Siliguri and its vicinity. Chief Minister Buddhadev Dasgupta, while speaking to the media in Kolkata, said, "These ISI arrests from Siliguri and its surrounding areas in the last two days had provided a lot of vital information about their spying network in North Bengal". These were important developments and fresh arrests followed in the region to bust the network, he said. Police sources said under the special alert in North Bengal, police posting had been made in vulnerable areas and more forces deployed in West Bengal’s border with neighbouring countries. Police has also been directed to step up extra vigil and keep watch on vital installations prior to the Republic day celebrations.

National Security Advisor Brajesh Mishra, while addressing the 38th Munich conference on security policy on February 2, said the disappearance of Taliban and Al-Qeada leaders and activists after the US military campaign in Afghanistan is "a matter of immediate security concern" and made it clear that New Delhi would de-escalate only after seeing "concrete evidence" of decreasing terrorism from across its borders. He said, "Where are thousands of foreign fighters and advisors of Taliban who were trapped in Kunduz in the final phase of the military campaign, but found a providential and mysterious aerial escape route?" Stating that those were questions of long-term relevance to the international campaign against terrorism, Mishra said "anyone who looks on the map of the region would understand why for India, this a matter of immediate security concern. Speaking to the media in Kolkata on February 8, a senior BSF official said representatives of a US consultancy firm would be taken to the border area later in February 2002, where they would give a demonstration of the device. He said the device would set off an alarm if an attempt was made to make an illegal crossing by cutting the barbed wire fencing along the border. He added that after the growing activities of Pakistan’s Inter Services Intelligence (ISI) and Islamist extremist groups along the Indo-Bangladesh border, the BSF was now changing its orientation from an "anti-smuggling" force to an "anti- infiltration" force. He was reportedly using this money to establish a terrorist network across the country. As reported earlier, Ansari was arrested in the United Arab Emirates (UAE) and brought to New Delhi on February 9 by a Central Bureau of Investigation (CBI) team. Ansari has also reportedly admitted to the CBI about his involvement in the January 22 attack and said that he had links with terrorist groups in Pakistan, especially, with Al Qaeda cadre Omar Sheikh, one of three terrorists released by India to end the hijacking of an Indian Airlines air craft IC-814 in Kandahar, Afghanistan in December 1999. Media reports have indicated that the CBI mentioned this in its application seeking Ansari's transit remand for taking him to Gujarat where he is a prime accused in an arms case. Duty Magistrate Kamini Lau permitted a seven-day transit remand and asked the CBI to produce Ansari in a Gujarat court on or before February 16. The CBI has claimed that Ansari had planned the abduction of Anand Aggarwal, a coal merchant of Benaras in 1998-99, Bhaskar Parekh, a diamond merchant of Rajkot, Partha Pratim Roy Burman of Kolkata in 2000-01 and diamond merchant Niranjan Shah of Mumbai. As per Ansari's disclosure, he reportedly earned more than Rs 50 crore through these abductions. He also admitted to having earned Rs 55 crore through the smuggling of arms. The CBI told the court that Ansari during his interrogation also admitted to forming a countrywide network of arms and narcotics smugglers for carrying out illegal activities in India. Investigators suspect that Ansari was funneling the money made from these illegal activities to terrorist groups.

In his statement before the investigating agencies, he reportedly said that ISI operators contacted him, a few months after he jumped bail in India and fled to Pakistan in 1999. "They used to meet me under pseudonyms at designated places," he said. He has also reportedly named seven ISI officers who he had met. In a fresh verbal demarche issued to the Pakistani Deputy High Commissioner, Jaleel Abbas Jilani on February 11, India regretted that Pakistan was yet to take action on the list of terrorists that had been handed over to it. Official sources said that India, citing the UAE precedent, said that the fight against terrorism should take recourse to extensive political co-operation as well. Aftab Ansari, was deported by the UAE authorities on the basis of a political understanding and not extradited as that would have involved time-consuming legal procedures, said official sources.

Delhi Police Commissioner Ajai Raj Sharma while talking to the media on February 19 said that the Crime Branch of Delhi Police have destroyed an elaborate terrorist module, which was planning to carry out subversive activities across the country. The inter-state cell of Crime Branch was working to expose this well-entrenched module ever since it arrested Asif Reza Khan, a member of the Aftab Ansari gang, on October 29, 2001. He was arrested from the Lodhi Gardens in New Delhi, where he was waiting to assassinate prominent personalities of the Capital. The subsequent arrest of his accomplices Anita Das and Arshad, (the latter is a resident of Multan, Pakistan), led to a series of raids. In these raids, 13 terrorists were arrested and two killed since October 2001. A large cache of arms, ammunition and explosives was also recovered. The terror module, being run at the behest of Pakistan's Inter Services Intelligence (ISI), was spread across Uttar Pradesh, West Bengal, Gujarat and Maharashtra. Sharma said the module, which was being run by Sheikh Omar, was entrusted with the task of abducting national cricket team members Sachin Tendulkar and Saurav Ganguly. As ransom, they planned to seek the release of Mohammad Amir Khan, alias Abu Aksha, a core member of the Lashkar-e-Toiba (LeT), presently lodged in Tihar jail. The Police Commissioner said that the Pakistan-based ISI backed terrorist-criminal network active in India has been using Delhi as junction to facilitate flow of finance and logistics to carry out their activities in other parts of the country.

Talking to the media in Godhra on March 4, the Deputy Inspector General of Police (DIGP) (Anti-Terrorist cell), Vipul Vijay referred to the possibility of ISI's involvement in the attack but refused to give details. He said the cases of those among the 28 persons who have been travelling abroad will be pursued vigorously without relying only on the local police. "We have certain names who have been travelling abroad. They are very prosperous. They are carrying duplicate papers and we will pursue these cases vigorously", he said. He also said some of the arrested persons have links with the Ahmedababd-based underworld don, Abdul Lateef.

According to media reports, Mumbai Police Commissioner MN Singh, who returned from a 12-day visit to London and New York on February 6, is believed to have gathered corroborative evidence to establish Muhammed Afroze’s links with the Al Qaeda terrorist network. Afroze was arrested by Mumbai police on October 2, 2001. During interrogation he had reportedly told the police that he was part of the pilot’s squad, which was supposed to hijack a London-Manchester flight from Heathrow airport in London on September 11, 2001 and ram it to British Parliament. The plan was, however, called off at the last moment. Police sources said Singh had visited several places in London, including hotels and homes where Afroze reportedly stayed in September last year. He also met the police chiefs of London and Washington, besides interacting with several officers from the Federal Bureau of Investigation (FBI) and the London police. A senior police official said, "Singh’s visit has been a hectic one, but it was successful. He has brought information, which will make the case stronger". Earlier, the Mumbai police had sent a team to Australia to visit places where Afroze had reportedly stayed between August 1997 and December 1998. The officers had returned after conducting a detailed inquiry at the pilot training school where Afroze had enrolled for a course in flying.

Meghalaya DGP L Sailo, speaking to the media, expressed serious concern at the presence of terrorist camps within Bangladesh and assured that, with the assistance of West Bengal police, the movement of terrorists, especially that of the United Liberation Front of Asom (ULFA) from Bhutan to Garo Hills through the North Bengal corridor, can be effectively controlled. The Prevention of Terrorism Ordinance (POTO) was passed by Lok Sabha (Lower House of Parliament) on March 18 with 261 of the members present supporting it and 137 opposing it. Accused by some members of legislating a harsh law to curb basic liberties, the government said that without POTO the war against terrorism would have no meaning. Responding to the criticism of the Bill, Union Law Minister Arun Jetley said an effective law was required to blunt the edge of the terrorist campaign which had claimed more lives than the four full-scale wars the country had fought since Independence. Giving details, he said that while 45,468 lives were lost in the four wars, terrorism in the past 15 years claimed 61,031 lives. He added that 600,000 people had been rendered homeless by terrorism in different parts of the country. The cost of fighting cross border terrorism, according to the Minister, was an estimated Rs. 450 billion. The volume of explosives seized by the security forces from terrorist elements in recent years was 48,000 tonnes. “With that kind of explosives in terrorist hands every inch of India would have been taken care of “, Jetley said, claiming an extraordinary situation requires an extraordinary response. Earlier, moving the Bill for consideration, Union Home Minister LK Advani said the shortcomings of the Terrorist and Disruptive Activities (Prevention) Act TADA had been eliminated in the proposed Bill removing scope for abuse and violation of human rights. He said the government had incorporated all the inputs from the Supreme Court’s judgement of TADA as well as suggestions from the National Human Rights Commission (NHRC) in an effort to minimise potential abuse.

Reiterating its support for Nepal’s fight against insurgency, India on March 21 offered ‘ equipment and training’ to Nepal for combating Maoist insurgents. This assurance came during the ongoing visit of Nepalese Prime Minister Sher Bahadur Deuba. While the details of the offer have not been disclosed, official sources indicated that both the countries have agreed for co-operation in intelligence sharing and border surveillance. Both the countries have also agreed to conclude their ongoing negotiations on a revised extradition treaty as also a treaty on mutual legal assistance. The treaties are expected to help India take action against Maoist leaders and sympathisers based in India. India has also reportedly conveyed its concern to Nepal on the activities of Pakistan’s Inter Services Intelligence (ISI) directed against India on Nepalese soil and ISI infiltration into India through Nepal. These concerns were conveyed to Deuba when Union Home Minister L K Advani called on him on March 21. Deuba also met the President, Vice President, Prime Minister, External Affairs Minister, the Commerce Minister and the Defence Minister. The move has been necessitated after the bill was defeated in the RS by a margin of 15 votes, the reports also said. A Joint Sitting is being held after 24 years and will be the third in the history of the Indian Parliament. Two such meetings took place in 1961 and in 1978. Meanwhile, Trinamul Congress, one of the constituents of the ruling National Democratic Alliance (NDA), has announced its decision not to attend this session, said separate reports. Party chief whip in the LS Sudip Bandopadhaya said, "We have not participated in the debate [on POTO] in the Lok Sabha and there is no question of changing our stand." A Lok Sabha, the Lower House, Secretariat release said the Inter-Parliamentary Union (IPU) has resolved that every country has the duty to take steps to refrain from organising or instigating terrorist acts in another and condemned terrorism as a "threat to democracy, human rights and civil society". A resolution to this effect was adopted by the IPU at its 107th Conference in Marrakesh (Morocco) on a proposal moved by India in the aftermath of the December 13, 2001 attack on its Parliament and supported by many other nations. "Every state has the duty to refrain from organising, instigating, assisting or participating in terrorist acts in another State, or acquiescing in terrorist activities on its territory," the resolution said. It also stated that terrorist acts could not be justified under any circumstances and drew an explicit link between terrorism and the undermining of democracy and the rule of law.

However the official denied that the King had attended any feast with the ULFA terrorists. He said ,"feast was a figment of imagination and baseless." However, Indian intelligence sources dispute this statement. His visit was necessitated by the consistent Indian pressure on Bhutan to ask the terrorist outfits, including the National Democratic Front of Bodoland (NDFB) and the Kamtapur Liberation Organisation (KLO) besides ULFA, who maintain training camps in the Kingdom, reports added. He said, "It was revealed during interrogation that Hasib Raja, one of the prime members of SIMI’s central advisory committee, was working as a brain for the organisation". Raja was arrested on March 18 in Kolkata by a special police squad and half a kilogram of RDX was seized from his possession. It was with this RDX that Raja reportedly planned to blow up the Howrah bridge, but his plan was foiled. She said, "Since the State government are also empowered to implement POTA, Tamil Nadu government will take appropriate action against such parties (supporting the cause of the LTTE)". Pointing out that the LTTE was a banned organisation in the country under the Unlawful Activties (Prevention) Act, 1967, Jayalalithaa said she had already written to the Prime Minister on April 10 requesting that the ban be extended for two more years. The Chief Minister added that the State Assembly would pass a resolution on April 16 demanding extradition of V Prabhakaran to India facing trial in the Rajiv Gandhi assassination case in which the LTTE chief is the prime accused. At a meeting, Union Defence Minister Georgfe Fernandes, on June 25, briefed visiting Nepalese King Gyanendra about the exisitng agreement between the two countries on training Nepalese army officers and personnel in counter-insurgency tactics at specialised Army institutions. On Nepal’s plea for supply of specialised equipment like helicopters, utility vehicles and mine-proof combat vehicles, the Minister reportedly assured the King that these would either be given at cost price or at reduced prices. Under the ongoing military cooperation agreement, India has agreed to train more Nepalese army personnel at the Counter Insurgency School in Mizoram. Nepal, on its part, assured India of its cooperation to prevent the misuse of its territory by anti-India elements. King Gyanendra assured Union Home Minister L K Advani that he would not allow his country’s soil to be used for anti-India activities. Advani had reportedly raised concerns over reports of activities of Pakistan’s external intelligence agency, the Inter Services Intelligence (ISI), and had sought Nepal’s cooperation to prevent infiltration of terrorists into India. Replying to clarifications sought by members on the ground reality on the border with Pakistan, Advani said, "There has been some decrease in infiltration but it has not totally stopped". He also charged the Pakistan High Commission in New Delhi of being a channel to fund terrorists in India. Observing that Pakistan was spending several crores of rupees annually to fund terrorist and secessionist activities in India, he said the channel of funding "is through trans-border smugglers, infiltrating mercenaries, through the Pakistan High Commission in New Delhi, through Hawala operators and also charitable organisations". Stressing that the funding channels used by Pakistan need to be blocked, the Home Minister said Pakistan is funding these terrorist organisations by remunerating cadres, maintaining infrastructure, supplying weapons, logistics and providing maintenance to families of killed terrorists. Speaking to media in New Delhi, an External Affairs Ministry spokesperson said, "obviously there is some basis on which one can infer and draw the conclusion that the fulcrum of Al Qaeda operations have shifted from Afghanistan and into Pakistan…All these reports seem to suggest that the epicentre of terrorism in our region has shifted from Afghanistan to Pakistan". The spokesperson while referring to the close connections and interlocking relationship between the erstwhile Taliban regime and Al Qaeda cadres also pointed out that the military regime in Pakistan had reportedly provided an easy exit to these terrorists into that country in the wake of the US-led operations against them in Afghanistan.

He said Al-Qaeda cadres were not visible in Kabul or anywhere nearby, but there was a danger of their regrouping in the peripheral areas and the Afghan leadership was fully aware of it. Asked whether Al-Qaeda elements were moving towards Jammu and Kashmir, he said, "I was not really on an intelligence-gathering trip but in various conversations this was pointed out. Some of the people who were captured after the Taliban was defeated had confessed to operating even in Jammu and Kashmir....'' He cautioned the international community against determined attempts by Al Qaeda terrorists to regroup in parts of Afghanistan and once again spread terror.

The meeting called for redoubling efforts to combat the problem in all its manifestations. In his opening speech, Nepalese Prime Minister Sher Bahadur Deuba said, "Terrorism has been the latest menace to the region and the world at large. Its resurgence in new forms and viciousness in the region and beyond is indeed a matter of great concern to all of us." He stressed that SAARC Ministers should deliberate on the mechanism of strengthening the implementation of the SAARC Convention on the Suppression of Terrorism and "enhance the effectiveness of cooperation in line with the changing demands of the day." Rejecting Pakistan’s fresh offer for resumption of dialogue without pre-conditions, Indian Foreign Minister Yashwant Sinha said, "Infiltration is continuing. The KLO is an outfit responsible for various terrorist attacks in West Bengal while operating from Bhutan's territory. The outfit's activities are allegedly a result of its close 'cooperation' with the Assam-based United Liberation Front of Asom (ULFA) that has training camps in Bhutan. Wangchuk's statement that reportedly appeared in Kuensel, a Bhutanese daily, indicated his unawareness of KLO's presence in Bhutan. He said the Lankan government was proceeding incremental steps and was trying to build trust with the Liberation Tigers of Tamil Eelam (LTTE).
