The Supreme Court on January 28 ordered the release of Ahmed Omar Saeed Sheikh, the main convicted of beheading United States journalist Daniel Pearl, reports Daily Times. Ahmed Omar Saeed Sheikh, who was the main suspect in the 2002 kidnapping and murder of Wall Street Journal Reporter Pearl, was released by a bench of three judges. “By a majority of two to one, they have acquitted all the accused persons and ordered their release,” Provincial Advocate General Salman Talibuddin said. “The court has come out to say that there is no offence that he has committed in this case,” Mahmood Sheikh, who represented Sheikh, said. He added that the court had ordered that three others, who had been sentenced to life in prison for their part in Pearl’s kidnapping and death, also be freed. A Sindh High court (SHC) division bench on April 2, 2020, had commuted the death sentence of Ahmed Omar Saeed Sheikh to seven years and acquitted three others who were serving life terms. The Sindh Government had swiftly challenged the April 2 order in the Supreme Court. The Sindh Government had also immediately detained the four men under Section 3 (1) of West Pakistan Maintenance of Public Order (MPO) Ordinance, 1960. “The decision is a complete travesty of justice and the release of these killers puts in danger journalists everywhere and the people of Pakistan,” the Pearl family said in a statement released by their lawyer.

A Peshawar High Court bench on June 22 directed the Federal Government to produce a detailed report on landmine explosions in the erstwhile Federally Administered Tribal Areas (FATA), especially South Waziristan, within three weeks, reports Dawn. Chief Justice Qaiser Rashid Khan and Justice Syed M Attique Shah issued the directions to Additional Attorney General Amir Javed after holding preliminary hearing into the joint petition of Sajjad Ahmad Mehsud and four other lawyers against the frequent landmine blasts in tribal Districts. The petitioners sought the demining of the tribal region, especially South Waziristan, by the Federal and Provincial Governments and compensation of the affected families. The date of next hearing will be fixed later. The petitioners claimed that the landmine explosions were killing and injuring more and more residents but the relevant authorities were unmoved. The petitioners requested the court to direct the respondents, including Federal and Khyber Pakhtunkhwa Governments, to remove landmines, especially in South Waziristan District, and highlight the affected areas as Red Zone. The petitioners also sought orders for the Government to pay compensation under the Shuhada Package to the legal heirs of landmine blasts and to the residents, who suffered injuries or whose houses were damaged. They also demanded the registration of landmine blast cases by the Police in their daily diaries to check ‘discrimination’ against the residents of the erstwhile FATA.

A sessions court in Lahore on September 27, handed down death penalty to a Muslim woman on blasphemy charge under section 295C of Pakistan Penal Code (PPC), reports Dawn. “It is proved beyond reasonable doubt that accused Salma Tanveer wrote and distributed the writings which are derogatory in respect of Holy Prophet Muhammad (PBUH) and she failed to prove that her case falls in exception provided by section 84 of PPC,” rules Additional District and Sessions Judge Mansoor Ahmad Qureshi in his 22-page verdict. The section 84 deals with the offences committed by a person of unsound mind. Earlier on September 23, 2013, Nishtar Colony Police had registered the FIR against the woman on the complaint of Qari Iftikhar Ahmad Raza, a prayer leader of a local mosque. The Lahore high court on November 6 set aside a trial court's conviction and acquitted six senior leaders of Jamaat-ud-Dawah (JuD) in a terror financing case, reports The Times of India. The Lahore Anti-Terrorism Court (ATC) in April this year had handed nine-year imprisonment each to JuD senior leaders – Prof. Malik Zafar Iqbal, Yahya Mujahid (JuD spokesperson), Nasarullah, Samiullah and Umar Bahadur - and six months' jail term to Hafiz Abdul Rehman Makki (brother-in-law of Saeed) after an FIR was registered by the Counter Terrorism Department (CTD) of the Punjab Police. The trial court had found these leaders guilty of terror financing. They had been collecting funds and unlawfully financing the proscribed organisation Lashkar-e-Taiba (LeT). It had also ordered the confiscation of assets made from funds collected through terrorism financing. “On Saturday LHC's division bench comprising Chief Justice Muhammad Ameer Bhatti and Justice Tariq Saleem Sheikh set aside the trial court's decision in the CTD's FIR 18 of 2020 against the six JuD leaders after the prosecution failed to prove the charge against the appellants beyond reasonable doubt,” a court official said. The official said the division bench allowed the petition of the JuD leaders, observing “the statement of the ‘star prosecution witness' is not reliable as there is no corroboratory evidence.”

The Supreme Court on November 10 grilled Prime Minister (PM) Imran Khan over the Government's inaction against those responsible for the Peshawar Army Public School (APS) attack in 2014 and the ongoing talks with the Tehreek-i-Taliban Pakistan (TTP), reports Dawn. A three-judge bench — headed by Chief Justice of Pakistan (CJP) Gulzar Ahmed, and comprising Justice Qazi Mohammad Amin Ahmed and Justice Ijazul Ahsan — summoned the PM in connection with the case around 10am. He arrived at the court roughly two hours later, just before noon. During the hearing, Justice Amin reminded the PM that Pakistan is not a small country. "We have the sixth largest army in the world," he said. With regards to media reports regarding negotiations with the TTP, Justice Amin questioned whether "we are bringing them [TTP] back to the negotiating table instead of taking action against them?" "Are we going to surrender once again?" Justice Amin asked the premier. As the three-member bench continued to grill the premier, at one point the latter asked for a chance to speak, given that he had been summoned for the hearing. But the judges continued to fire questions at him. CJP Gulzar said, "You are in power. The government is also yours. What did you do? You brought those guilty to the negotiating table." "The satisfaction of the parents [who lost their children in the APS attack] is necessary," said Justice Ahsan addressing the PM. The Supreme Court directed the Government to submit its report within two weeks, but Attorney General Khalid Jawed Khan requested the court to grant additional time. Accepting the plea, the court granted four weeks to the Government. The court inquired from Prime Minister Imran what action had been taken in the case. Chief Justice Gulzar then picked up the Constitution book and said it guaranteed security to every citizen.

The Islamabad High Court (IHC) Chief Justice Athar Minallah remarked on November 1 said that the responsibility of missing persons falls on the Prime Minister (PM) and members of the Federal Cabinet, reports Dawn. Justice Minallah made the remarks while hearing a petition filed by Rana Mehmood Ikram, father of journalist Mudassar Mehmood, who had reportedly gone missing on August 19, 2018. Human Rights Minister Shireen Mazari and Interior Secretary Yousuf Naseem Khokhar appeared for today's hearing. Additional attorney general Qasim Wadud and deputy attorney general Syed Tayyab Shah were also present in the courtroom. Advocate Usman Warraich appeared on behalf of the missing journalist's father. However, Advocate Imaan Mazari was not present as she was unwell. During today's hearing, Justice Minallah told the minister that she had been summoned because the state was not "visible" in tackling the issue of enforced disappearances. "A person going missing is a crime against humanity. The prime minister and members of the cabinet are there to serve the people of the country. The state's response towards recovering missing persons is pathetic," he remarked.
