Khyber Rifles commandant Colonel Tariq Hafeez while addressing tribal elders at Jamrud Jirga Hall of Khyber Rifles on December 1 said that “Operation Khyber-1” is successfully under way in Bara tehsil (revenue unit) and most of the militants from various groups have surrendered, reports The News. He said that most of the areas had been cleared of militants and the rest would be cleared soon. The official said the forces were committed to flushing out all anti-state elements from their soil. He urged the elders and Maliks to unite against anti-state elements and form a peace committee to help restore peace. Colonel Hafeez said the military operation might affect the other areas in Khyber Agency as the militants were taking refuge in Jamrud or Landikotal tehsils. “I request all elders and Maliks to cooperate with the Government in establishing peace,” he said, adding that it was not the responsibility of Security Forces alone but every locals should play his role in maintaining law and order.

Security Forces (SFs) successfully repulsed a pre-dawn militant attack on a check post they were manning in the Sherin Dara area of Orakzai Agency on December 2, reports The Express tribune. Security forces said they retrieved seven bodies after the attack. Tribal sources, however, said that 15 militants were killed in the clash and that the fleeing militants took away eight bodies with them. Orakzai Agency shares a border with Khyber Agency where a security operation has been ongoing since mid-October. It was the 4th militant attack on the Sherin Dara check post.

Four soldiers and 12 militants were killed while four troops sustained injuries when militants attacked a bunker of Security Forces (SFs) in the Akakhel area of Tirah Valley in Khyber Agency on December 7, reports The News. Sources said that dozens of Lashkar-e-Islam (LI) and the Tehreek-e-Taliban Pakistan (TTP) militants stormed the bunker from two directions with heavy weapons in the Akakhel area. They said four soldiers were killed on the spot while four others sustained injuries. The soldiers repulsed the attack and killed 12 militants, sources said, adding that several other militants were injured in the action.

The targets were Gul Bahadur and his deputy Maulvi Sadiq Noor and we succeeded in killing 20 to 30 militants,” a senior military official said in Miranshah, the headquarters of NWA.

After receiving the Police report, Chief Justice Nasirul Mulk, heading the three-judge bench seized with the issue, separated the case of Zaheer Gondal and set it for hearing on January 13, 2015. Zaheer Gondal’s alleged kidnapping by unidentified militants from Rawalpindi District in July 2013 had also come up before a bench headed by the former Chief Justice Iftikhar Mohammad Chaudhry in October 2013 when the Punjab Government had told the court that the cellular data recovery (CDR) of the missing person led the Police to a safe house owned by the Inter-Services Intelligence (ISI). The seventeen recommendations of working group emphasized strong military, administrative, legal measures spanning from military courts in Federally Administered Tribal Areas (FATA) to reforms in religious seminaries to banning of hatred material in the country. However, during the committee meeting, opinions differed on various issues. Members from FATA in the committee objected to setting up the military courts in the area by excluding the others. The representatives of religious political parties showed concerns over the reforms in religious seminaries. According to sources, Jama'at-e-Islami (JI) opposed establishment of the military courts. The party representative argued that the existing judicial system has punished the culprits and opposed formation of military courts in presence of the constitution and the law. JI leader also argued that the military courts will bypass the existing judicial system. The working group recommendations proposed formation of the Anti-Terrorism Council (ATC) to be chaired by the Prime Minister and represented by Federal Ministry for Interior, the Army, the Inter-Services Intelligence (ISI), Intelligence Bureau (IB) and other organizations as well as strengthening the National Anti Counter Terrorism Authority (NACTA) and formation of a Special Task Force (STF) to combat terrorism. It proposed that militants included in schedule fourth of the Anti-Terror Act be arrested and a ban be imposed on the militant organizations and their leaders as well as ban on hate speech and literature and underscored the need for reforms in the religious seminaries. It also called for action through monitoring internet activities of terrorists by the Federal Investigation Agency and also suggested that protection to religious minorities and cancelling all the licenses for explosive material. It also suggested the ban on glorifying the terrorist’ elements on national electronic and print and urged that it should be considered as criminal offence. It was also recommended that act of praising terrorists through electronic and print media should be considered as a crime.

The sources said that last week, the Civil Secretariat (Federally Administered Tribal Areas (FATA) withdrew the notification, which was issued some years ago to declare most parts of Khyber Agency’s Bara tehsil conflict zone, after the SFs restored peace there by eliminating militants. They said the FATA Disaster Management Authority (FDMA) had sought PKR 3.5 billion from the Federal Government for the repatriation of Internally Displaced Persons (IDPs) to Khyber Agency. An official said the FDMA had asked the finance division to release the required amount of money immediately to start repatriation of IDPs from January 15, 2015.

The missing person’s cases and decisions of provincial and national importance remained the focus of the Peshawar High Court (PHC) during 2014 as 1,990 people were traced out and 12 of them got released through political administration and Police, The News reported on December 29. As per record of the PHC, the law enforcing agencies submitted a list of 934 missing persons in the court in October, who had been traced and shifted to various internment centres being run under the Home Department Khyber Pakhtunkhwa and Federally Administered Tribal Areas (FATA) Additional Chief Secretary under the special law called Action (in Aid of Civil Power) Regulations 2011, for FATA and Provincially Administered Tribal Areas (PATA). The law enforcing agencies also submitted another list of 80 missing persons the same month in the court, who were shifted to various internment centres. In the list of missing persons submitted to the court in September, 42 such people were traced out. Similarly, the agencies also submitted a list of 96 missing persons in the same month, who were shifted to the interment centres. A list of 130 missing persons was submitted in June this year to the court and of 708 missing persons in May 2014, who were traced out and shifted to different interment centres.

Olson also discussed the agenda for the scheduled visit of US Secretary of State John Kerry to Pakistan in January 2015. The Finance Ministry didn’t clarify when the money will be disbursed nor did it explain the sectoral breakup of the financial assistance. It said the money would be given under the civilian assistance package, Kerry Lugar Act of 2010 which expired in September 2014. Ambassador Olson said the USD 532 million aid would be given for energy, counter-terrorism, economic growth, community building, education and health. “The government of Pakistan should spend a large amount of this assistance for the rehabilitation of the temporarily displaced persons (TDPs) of North Waziristan Agency,” Finance Minister Dar said. A militant was killed in a clash with the Security Forces (SFs) in Ghundi area of Jamrud tehsil (revenue unit) in Khyber Agency on December 31, reports The News. Sources said that a group of militants attacked a checkpost in Ghundi area. The SFs repulsed the attack and killed a militant identified as Fazlur Rehman in the ensuing clash. The sources said that another militant, who sustained injuries in the clash, managed to escape from the scene.

The Government’s infrastructures worth one billion rupees have been turned into rubble in the conflict-stricken North Waziristan Agency (NWA) of Federally Administered Tribal Areas (FATA),Dawn reported on January 1 quoting a damage need assessment report. The Line Departments of Civil Secretariat, FATA have carried out damage need assessment survey of the Government owned properties in Mir Ali and Miranshah sub-divisions of NWA. Survey of the damaged infrastructure was conducted after security forces cleared these areas of militants. The report said that 115 facilities including education and health and 102 kilometres roads had been either completely or partially damaged in the affected areas. Officials said that assessment was carried out in August 2014.Militancy and disproportionate use of force have caused massive collateral damage to the properties in other tribal agenciestoo. Earlier, damage need assessment survey carried out under the supervision of Fata Disaster Management Authority (FDMA) revealed that over 60,000 houses had been damaged in Orakzai, Khyber, South Waziristan and Kurram agencies.The report said that reconstruction of the damaged facilities required Rs1.79 billion. Sector-wise breakup is that total 31 educational institutions (six 100 per cent, nine 50 per cent and 16 20 per cent), eight health facilities, two buildings of the works and services department, 13 facilities of livestock, seven agriculture, eight public health engineering, 35 municipal committee including 21 shops, two sport facilities and 19 irrigation department have been damaged.In addition, according to the report, 102 kilometres road have been damaged in different areas and repair cost is PKR 229 million. The report said that estimated cost of the reconstruction of educational institutions was PKR 67.135 million, facilities of irrigation department PKR 181 million, buildings of works and services PKR 200 million and health facilities PKR 288 million.
