Speaking at a public function in Lalitpur, Uttar Pradesh on December 1, Congress President, Sonia Gandhi said that her party was opposed to the Prevention of Terrorism Ordinance (POTO) as it could be used against innocent people. She also alleged that the POTO was introduced by the ruling Bharatiya Janata Party (BJP) to cover up its failures. She added that "the country did not required POTO to fight terrorism. What it need was a government with a strong will to deal with terrorism". Reiterating the opposition to POTO, a senior Congress functionary, Ambika Soni, said in Hoshiarpur, Punjab, that the party rejected any form of the POTO. Ambika Soni, General-secretary of the All India Congress Committee while speaking to journalists on December 1 added that POTO was not acceptable in any form and that no changes in it would satisfy the Congress as it was totally undemocratic and against the very principles of the Constitution.

The all-party meeting convened by the Prime Minister Atal Behari Vajpayee on the Prevention of Terrorism Ordinance (POTO) failed to evolve a consensus. With major opposition parties sticking to their stand and criticising the government for attempts to rush through the legislation on POTO, the two-hour meeting ended in a deadlock. However, the Prime Minister made it clear that the government would go ahead to enact the proposed law in the Lok Sabha (Lower House of Parliament) next week. He said, "There is no question of withdrawing the Ordinance and Government intends to turn it into law". Parliamentary Affairs Minister Pramod Mahajan quoted the Prime Minister as saying that the Government would seriously consider the amendments suggested by various political parties and come before Parliament.

The police, on December 6, arrested two suspected Hizb-ul-Mujahideen (HM) terrorists from Adarsh Nagar area in Northwest Delhi. A suspected hawala (illegal money transfers) operative, who was said to be funding the terrorists, was also arrested from the Jama Masjid area. The police also seized 1.8 kg of explosives, four live electronic detonators, three mobile phones, five phone cards and Rs 67,000 in cash from the two alleged terrorists, both residents of Baramulla in Jammu & Kashmir. An additional Rs 1.48 million of hawala money was seized in subsequent raids. During interrogation, the terrorists reportedly told the police that they were working for the HM Chief Syed Salahuddin and had come to Delhi to collect hawala money and pass it on to terrorist outfits in Jammu and Kashmir. They were also reportedly instructed to deliver explosives to contacts in Delhi.

Initial reports said 11 people, including all the five terrorists were killed and 30 injured. Among the dead are six security force personnel, including a woman constable. The Prime Minister and all Members of Parliament are safe. The Cabinet Committee on Security (CCS) is meeting at 400pm this evening to review the security situation. The Army and the elite National Security Guard (NSG) have taken control of the Parliament complex. The Defence Minister is in constant touch with the Chief of Army Staff. Besides, Law Minister Arun Jaitly, who was inside the Parliament Complex at the time of the attack, said the terrorists hurled eleven hand grenades and entered Parliament precincts but could not gain entry into the building. News reports speculated that terrorist outfits active in Jammu and Kashmir were responsible, though no outfit has yet claimed responsibility. Responsibility for a similar attack on the J&K State legislature complex in Srinagar on October 1 was initially claimed by the Jaish-e-Mohammed (JeM) though, this claim was subsequently withdrawn. Another Pakistan based terrorist outfit, the Lashkar-e-Toiba (LeT) too has carried out several attacks where high security targets were stormed by the outfit’s suicide terrorists, fidayeen, including the storming of the Poonch police station in J&K on August 23. There have also been repeated threats by these groups, claiming that the Parliament, the Prime Minister, the Minister of Defence and the Minister of Home Affairs would be targeted.

Delhi Police Commissioner Ajai Raj Sharma said the December 13-terrorist attack on Parliament was carried out by Pakistani nationals belonging to the Jaish-e-Mohammed (JeM) with possible support from the Lashkar-e-Toiba (LeT) under the guidance of Pakistan’s external intelligence agency, the Inter Services Intelligence (ISI). He said in Delhi on December 16, the interrogation of the four arrested persons revealed that the ISI was ‘clearly connected’ for last three to four months with the conspiracy and the Pakistan government was aware of it. He said the four arrested persons were trained by the ISI in Pakistan occupied Kashmir (PoK). Sharma added, "But if the ISI was involved then the Pakistan (government) must be aware of the plot". Central Reserve Police Force (CRPF) Director General Trinath Mishra, while speaking at the 62nd anniversary of the CRPF in New Delhi, on December 25, said the CRPF is poised to take charge of internal security all over the country by the year 2005, as per the recommendations of the Group of Ministers (GoM) on security. He said this would relieve other paramilitary forces like the Border Security Force (BSF), Central Industrial Security Force (CISF), Indo-Tibetan Border Police (ITBP), Assam Rifles and the National Security Guard (NSG) from internal security tasks. The GoM observed that the BSF, CISF and ITBP were created for specific tasks and not for internal security, which is the exclusive area of the CRPF, he added. Reports said the Mumbai police suspect that a former scientist with the Indian Space Research Organisation (ISRO), IS Mudaliar, and his associate Umang Dave, a software engineer, are linked with terrorist outfits such as the Lashkar-e-Toiba (LeT), the Jaish-e-Mohammed (JeM) and the Al Qaeda. They were arrested on October 31 from Ahmedabad for allegedly sending a threatening e-mail to the Department of Atomic Energy (DAE), earlier on September 21, 2001. Police sources said Mudaliar sent the threatening e-mail to the DAE stating that it was from the LeT. The e-mail said, all the important government installations would be attacked in the next seven days. The police have been trying to establish the Internet link of the accused with terrorists, but sources admitted they had not found any clinching evidence, though they had checked the e-mail correspondence of the accused. Both the arrested persons have been charged with sedition under section 124 of the Indian Penal Code (IPC).

It also banned Pakistani flights from over-flying Indian airspace from January 1, 2002, accusing Pakistan of not doing enough in curbing cross-border terrorism sponsored by it. The Cabinet Committee on Security (CCS) met with Prime Minister Atal Behari Vajpayee in the chair and also decided that the staff and the families of the Pakistani mission in New Delhi would not be allowed to move beyond the municipal limits of Delhi. Briefing the media after the CCS meeting, External Affairs Minister Jaswant said Pakistan had not done enough to curb the activity of terrorist groups based in that country. Asked about the possibility of a war between the two countries, the Minister said, "There is no need for anyone to worry. We are fully prepared". A red alert has been sounded in Delhi, following the arrest of two suspected terrorists, on December 28, and investigations and intercepts, which reportedly revealed that terrorists of the Lashkar-Toiba (LeT), the Jaish-e-Mohammed (JeM) and Al-Umar Mujahideen had sneaked into the national capital to carry out more terrorist attacks. These terrorists have reportedly been assigned for suicide attacks on VVIPs and important government installations. Security at all the important installation has been tightened. Meanwhile, following a directive from the Union Home Ministry, security at all 76 government installations will be handed over to Central Industrial Security Force (CISF) as a follow up to the December 13-Parliament attack. He said, "We have already been facing a proxy war for almost two decades. But after the December 13 attack on Parliament, we felt that terrorism has crossed the ‘Lakshman rekha (limits)". The Home Minister clarified that the war was not against one person, one organisation or country, but was against the mindset which crops up from fundamentalism and spread by those who do not hesitate in killing innocents. The Union Cabinet on December 29, decided to re-promulgate an amended anti-terrorist ordinance after reducing the life of the proposed law from five to three years and dropping a provision with a view to protecting freedom of the press. The Prevention of Terrorism Ordinance (POTO), promulgated on October 24, could not be passed by Parliament during ht ejust-concluded session. The Ordinance would lapse on December 31. Announcing the decision after the Cabinet meeting, Parliamentary Affairs Minister Pramod Mahajan said the legislation would remain in force for three years instead of five years from the date it comes into force. On the provision objected to by the media, Mahajan said sub-clause (8) of clause 3, under which a journalist was required to divulge to the police any information that he knows or believes could be of material assistance in preventing commission of a terrorist act, has been omitted.

He said the international community was aware of India’s anger in the wake of the December 13-attack on its Parliament, which India has blamed on Pakistan-based terrorist outfits operating at the behest of Pakistani military intelligence. The Prime Minister added, "I firmly believe this will put sufficient pressure on Pakistan and it will be forced to act against the terrorist groups". Member countries of the South Asian Association for Regional Cooperation (SAARC), on December 31, agreed to make major changes to the SAARC Convention on Suppression of Terrorism to make it more relevant to the present situation.Meeting ahead of the seven-nation summit beginning January 4, 2002 in Kathmandu, SAARC Foreign Secretaries discussed the draft declaration that favoured immediate enactment of enabling legislation by member countries for implementing the 1987 Convention within a time frame. The Joint Secretary (SAARC) in the Indian External Affairs Ministry said in New Delhi that the grouping accepted India's suggestion that the Convention be referred to legal experts for updating it and to make it more effective in implementation at the regional level. Pakistan, which along with Bangladesh, has still not implemented the mandatory provisions of the Convention did not oppose the Indian proposal, he said.
