Meanwhile, the CPDCC of the CA has finalized provisional arrangements for the transitional period that will follow the promulgation of the new constitution, reports Republica. The committee has proposed that the existing CA, which also functions as parliament, will be given continuity even after the promulgation of the new statute and until such time as a new parliament is elected as per the new constitution. “We have decided to give continuity to the existing parliament so that there should not arise a situation of the country being without a parliament,” said CPDCC Chairman Baburam Bhattarai, emerging from the committee meeting at Singha Durbar, Kathmandu, on September 1.

On September 1, the Constituent Assembly (CA) Constitutional-Political Dialogue and Consensus Committee (CPDCC) Chairperson Baburam Bhattarai has said that the political parties are nearing a consensus regarding the adoption of an inclusive and socialism-oriented economy, reports Nepal News. Bhattarai claimed that it was agreed at the political level that socialism-oriented capitalistic economy would be the main base for the country's economic policy. “Political parties have accepted the fact that the State should establish education, health, employment and food security as fundamental rights of the citizens and invest in these sectors.” It must be realised that classical capitalism is not enough to address the problems of poverty and unemployment, he added.

Meanwhile, on September 2, Constituent Assembly (CA) Chairperson Subash Nembang has said that if the parties fail to reach consensus on the disputed issues of the constitution by September 6, a decision will be reached through the regular process of the CA, reports Nepal News. “If the parties fail to reach an agreement by the stipulated time, I have already instructed to present the draft constitution in the full House along with the points of disagreement,” Nembang said. “The issues will then be resolved through the CA process,” he said indicating that the process of majority-vote will be applied in such a case. A consensus has to be reached by September 6 (Bhadra 21) in the interest of Nepali citizens and as per the commitment made by the political parties, Nembang added.

The meeting of Constitutional Political Dialogue and Consensus Committee (CPDCC) ended inconclusively at Singha Durbar, Kathmandu on September 2, as the political parties could not come to a consensus on various contentious issues like forms of governance and state restructuring, among others, reports Nepal News. Nepali Congress (NC) Vice-Chair Ram Chandra Paudel said that although there were discussions on various issues in the meeting, the parties could not reach a consensus, and the parties will try and reach an agreement by the stipulated time. Leader of Unified Communist Party of Nepal-Maoist (UCPN-M) Narayan Kaji Shrestha said that although the parties have not deferred from their previous stands, attempts will be made to reach a consensus.

Major parties have come up with flexible positions on forms of governance and federalism in the ongoing backdoor negotiations raising hope of possible compromise, cross-party leaders said in Kathmandu on September 3, reports Ekantipur.com. Reaching a consensus by the September 6 deadline may appear difficult, but the parties are making progress towards forging consensus, the leaders claimed. A source privy to the development said that all parties seem ready to make compromise, mainly on forms of governance and federalism. According to a leader, Unified Communist Party of Nepal-Maoist (UCPN-M) leaders have hinted that they could accept an eight-province model of federalism from their current position of 10 if the ruling parties agree to address the issue of ethnicity-based federalism. The ruling parties, which are pushing for seven provinces, may ultimately agree on eight provinces, the leaders said. The Madhesi parties have already agreed on two provinces in Madhes.

On September 4, three major parties, the Nepali Congress (NC), the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), and the Unified Communist Party of Nepal-Maoist (UCPN-M) agreed to hold national political conference to forge consensus on fundamental issues of the constitution drafting process, addressing the key demand of the Communist Party Nepal-Maoist (CPN-Maoist) that boycotted the Constituent Assembly (CA) elections last year, reports Ekantipur.com. A meeting of the three parties and CPN-Maoist formed an eight-member taskforce to finalise the modality for holding the conference, said leaders. The team has been assigned to set the date, venue and agenda for the talks. Krishna Prasad Sitaula and Narahari Acharya of the NC, Bhim Rawal and Agni Kharel of the CPN-UML, Krishna Bahadur Mahara and Khim Lal Devkota of the UCPN-M and Dev Gurung and Pampha Bhusal of the CPN-Maoist are the taskforce members.

On September 7, a committee of the Nepal Constituent Assembly (CA) asked for extension of deadline to settle disputes related to the new Constitution, reports The Hindu. Chairman of the Constitutional Political Dialogue and Consensus Committee (CPDCC) Baburam Bhattarai handed over the committee’s reports to CA Chairman Subas Nembang - one dealt with issues that claimed agreement between the political parties and the other on issues the parties failed to reach consensus by the deadline of September 6. Bhattarai requested Nembang to extend the deadline for the committee to reach consensus on contentious issues of the statute. The move comes after Nepal’s three major political parties, the Nepali Congress (NC), the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and the Unified Communist Party of Nepal-Maoist (UCPN-M), failed to forge consensus on the contentious subjects in the new Constitution - federation, governance system, electoral system and judiciary.

The Baburam Bhattarai faction of the Unified Communist Party of Nepal-Maoist (UCPN-M) has set up a separate office and into operation in Gorkha District on September 8, claiming to be the official group, reports Nepal News. The Bhattarai faction alleged that the faction within the party's district committee close to chairman Pushpa Kamal Dahal aka Prachanda tried to sideline them and hence they felt the need to establish a separate party office. Although the two opposing factions led by Bhattarai and Dahal agreed to resolve the ideological differences between them, conflicts still remain between the two groups in the District.

In a meeting with Prime Minister Sushil Koirala at the Prime Minister's (PM) residence in Baluwatar on September 9, Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda urged the PM to take initiative to build an environment for an all-party national assembly before leaving for the forthcoming United Nations General Assembly, reports Nepal News. Dahal emphasised on the need for an all party assembly as per the agreement made to include an integral force of the peace process outside the Constituent Assembly (CA) - the Communist Party Nepal-Maoist (CPN-Maoist) - in the constitution making process, Dahal's aide Shiva Khakurel said. In response, Koirala said the government was preparing for the national assembly to build consensus at the earliest and that he expected support from the main opposition party for the same. Dahal also suggested that the PM take the implementation of the four-point agreement seriously as a delay was obstructing proceedings of CA.

On September 24, the Constitutional-Political Dialogue and Consensus Committee (CPDCC) of the Constituent Assembly (CA) started deliberations to speed up discussions on contentious issues touching on the new constitution, reports Nepal News. The committee started deliberations on suggestions rendered by various concerned sides, says Committee member and Sadbhawana Party leader Laxman Lal Karna. The deadline for the committee to forge agreement on the disputed issues is September 30. Committee chair Baburam Bhattarai was looking into issues pertaining to federalism while the Dispute Resolution Sub-committee was working on issues other than federalism. According to Karna, Bhattarai will brief them about the discussions held on federal issues on September 26.

The CPDCC decided on making provisions for four categories of citizenships -- hereditary, naturalized, honorary and special citizenship for Non-Resident Nepalis - thus, resolving existing disputes on citizenship issuance. According to the latest agreement, a person can be issued citizenship in the name of either the father or the mother. The agreement also made provisions to grant various social, cultural and economic rights to the Non-Resident Nepalis (NRN) through a ‘special citizenship’.

On September 27, leaders at the Constitutional Political Dialogue Committee (CPDCC) of the Constituent Assembly (CA) in a meeting at Singha Durbar, Kathmandu, decided to go for seven constitutional bodies in the new constitution, whereas there are only five such institutions at present, reports Republica. The CPDCC decided to increase the number of constitutional bodies to seven, giving constitutional status to the existing National Women´s Commission (NWC) and National Dalit Commission (NDC). The NWC and NDC were established in March, 2002 but neither of these has so far been given constitutional status.

On September 28, Chairman of the Constitutional Political Dialogue and Consensus Committee (CPDCC) of the Constituent Assembly (CA) Baburam Bhattarai said that he is no longer optimistic about promulgation of a new constitution by the January 22 deadline, reports Republica. Bhattarai said the CA failed to make tangible progress in constitution making due to non-cooperation by top leaders of major political parties. Bhattarai expressed his dismay as top leaders from major political parties didn’t even attend his committee, let alone hold concerted negotiations to settle major contentious issues. “I worked hard to make top leaders cautious about time constraints and the urgency for settling disputes. But I am disappointed. Now we have two more days. Let’s hope for a miracle,” CPDCC member Atahar Kamal Musalman quoted Bhattarai as saying at the meeting held in Kathmandu. Bhattarai said he was frustrated as the top leaders cold-shouldered his request to immediately settle disputes related to state restructuring, system of governance, judiciary and the electoral system.

On September 29, Chairman of the Constitutional Political Dialogue and Consensus Committee (CPDCC) Baburam Bhattarai said he will step down if the parties disregard consensus while drafting the new constitution, reports ekantipur.com. In a CPDCC meeting, Bhattarai stressed that the constitution should be drafted on the basis of consensus among the parties. The senior UCPN-M leader wants minimum consensus on key contentious issues of the new constitution even if the disputes are to be settled through a vote in the Constituent Assembly (CA). Bhattarai's statement comes at a time when the ruling parties are pressing for vote to settle contentious issues as rounds of talks have been unproductive. He also warned that he would not submit reports to the CA if consensus is flouted.

The meeting of three major political parties, the Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), and the Unified Communist Party of Nepal-Maoist (UCPN-M) ended inconclusively in Kathmandu on September 29, reports ekantipur.com. The meeting was scheduled to discuss about the formation of High Level Political Committee (HLPC) and its leadership and resuming the obstructed legislature-parliament. The meeting was positive and serious to reach an agreement on the disputed issues of the new constitution among other issues, but ended inconclusively, said NC joint general secretary Purna Bahadur Khadka. "The ruling parties should be serious to reach an agreement on the form of governance, restructuring of the state, resuming the house and drafting a new constitution on time," UCPN-M vice-chair Narayan Kaji Shrestha said.
