Mohsen Rashid, counsel for the Election Commission (EC) said some provisions of the charter of JeI are contrary to Bangladesh’s constitution and the Representation of People Order (RPO). The counsel said the EC has given provisional registration to JeI as a political party in November 2008 as the party satisfied the commission by saying that they would submit an amended constitution after its council meeting. He was placing arguments before the High Court (HC) during a hearing on a writ petition filed by Rezaul Haque Chandpuri, secretary general of Bangladesh Tariqat Federation and 24 others challenging the legality of JeI’s registration as a political party. The petition was filed with the HC on January 25 in 2009.

The commission proposed amendments to Sections 9 and 13 of the Act. The commission proposed insertion of two sub-sections stating that no convict of any offence under the 1972 order or the 1973 act would be eligible to be a voter. The commission would send the proposed amendment to the law ministry who would place the bill in the cabinet and then, if approved, in parliament for enactment.

Around 15 Islamic parties affiliated with Hefajat-e Islam (HeI) are planning to form a new alliance to participate in the next parliamentary polls and highlight among voters its 13-point demand, including scrapping the education and women policies and building an Islamic state, reports Daily Star. The declaration came on August 26, at a views-exchange meeting organised by “Islami Dalsamuha” (alliance of Islamic parties) at the head office of Bangladesh Khelafat Andolon (BKA) in Dhaka’s Lalbagh area. “Our first target is to oust the ruling Awami League government and take steps so that the party cannot come to power in the next general election,” said Zafrullah Khan, secretary general of BKA and a member secretary of Islami Dalsamuha. Another leader said they might participate in the next polls under the banner of BNP-led alliance. Islami Dalsamuha Convener Shah Ahmadullah Asraf urged all Islamic parties to unite under one umbrella and form an alliance to participate in the next general polls to secure a win.

The Cabinet approved on September 2 a proposed amendment to the electoral roll law to bar convicted War Criminals from being registered as voters, reports The Daily Star. As per the proposed change, the name of a person will be excluded from the electoral roll or will not be included in it if he or she is found guilty under Bangladesh Collaborators (Special Tribunal) Order, 1972 and International Crimes Tribunal Act 1973. The Government will place a bill in the upcoming session of Parliament, which begins on September 12, seeking passage of the proposed amendment to the electoral roll law.

The ruling Awami League (AL) has kept all the key ministries like the Home, Public Administration, Law, Foreign, Local Government Division (LGRD) and Finance. Hasina holds the cabinet and armed forces divisions and the defence, public administration, information and communications technology and power and energy ministries.HM Ershad’s Jatiya Party, a major player in the upcoming election, has got six ministries namely, Commerce, Health, Civil Aviation and Tourism, Water Resources, Youths and Sports and Women and Children Affairs. Despite creating series of controversies, Shipping Minister Shahjahan Khan and State Minister for law Quamrul Islam retained their posts. Khaleda also urged the Election Commission to postpone the election schedule for the 10th parliamentary election to ‘save’ the country rather than being used as a ‘pawn’ by a ‘certain party’ for holding a unilateral election. Further, AL presidium member Mohammad Nasim while addressing a meeting at the party headquarters at Bangabandhu Avenue in Dhaka city on December 15 said that the ruling AL is taking a massive preparation to face the countrywide violence and attack on its leaders and workers by Bangladesh Nationalist Party (BNP)-JeI activists. Violence has gripped the country as Prime Minister Sheikh Hasina and her ruling AL press ahead with the January 5 vote. BNP leader Begum Khaleda Zia has called on Bangladeshis to march to Dhaka city on December 28 to protest against the elections, declaring "democracy is dead". The opposition says it will not take part unless an interim Government is installed and Hasina steps down. Hasina wants to do away with the practice of installing a caretaker Government. The army will be deployed until January 9.

Election Commission (EC) on December 27 started sending ballot papers under escort of paramilitary Border Guard Bangladesh (BGB) and Rapid Action Battalion (RAB) to the returning officers of 146 parliamentary constituencies where the January 5 elections would be held, reports New Age. A commission official engaged in sending the ballot papers told that the ballot papers and other election materials of several neighboring Districts were sent at one go for the security reasons. Following the declaration of candidates elected unopposed from 154 constituencies, the polls would now be held to only 146 constituencies for which a total of 386 candidates are vying and 4,36,85,670 out of a total of 9,19,65,977 voters have been enrolled to vote.
