The Union government is yet to formally announce the process of talks with Jammu and Kashmir's secessionists. The Union Home Minister had informally indicated such a proposal when commenting on the release of prominent Kashmiri secessionist leaders. Meanwhile, the responses from J&K's secessionist groups to the Minister's statement too is mixed. The Home Minister had indicated that the release of these leaders was part of a larger plan for resolving the Kashmir issue. The apex body of Jammu and Kashmir's separatist groups, the Hurriyat Conference is likely to consider with an open mind, the Union government's formal proposal for a dialogue to solve the Kashmir issue. This was indicated by its Chairman Syed Ali Shah Geelani on April 6. However, a section of the Hurriyat has ruled out the possibility of talks within the framework of the country's Constitution. A Pakistan based militant outfit, Hizbul Mujahideen has rejected the informal offer for talks. The outfit insisted that security forces must be withdrawn from the State and detainees released, to created an atmosphere conducive for talks. The group also asserted that the proposed talks should involve Pakistan. Pakistan has officially dismissed, on April 8, the reported talks offer by India's Home Minister as "propaganda".

In a surprise move, the Hizb-ul Mujahideen has announced a conditional three-month cease-fire and expressed its willingness to enter into a dialogue with the India’s union government to end the insurgency in Jammu and Kashmir. The announcement was made by "chief commander (Operations)" Abdul Majeed Dar, at a press conference in Srinagar. Flanked by three top local commanders, Dar laid down three conditions for observing the cease-fire. They are: "…no use of force against mujahidin, human rights violations on the Kashmiris will end and people even with different political convictions will be allowed free expression".

The Prime Minister's Secretariat also stated that the US President had talked to Prime Minister A B Vajpayee on the August 1-2 massacres and said that he would speak to leaders of Pakistan and "do everything possible to contain such activities." The Secretariat added that Vajpayee responded by saying that in these circumstances, there was no basis for a "meaningful dialogue" with Pakistan. On the political front, the first round of negotiations between the Union government and representatives of the Hizb-ul Mujahideen were conducted on August 3, in Srinagar. The government delegation was led by the Union Home Secretary, Kamal Pande and the Hizb delegation was led by the deputy chief of the outfit, Abdul Majeed Dar, and four other top leaders. The chief of the Peoples Political Front, Fazal-ul-Haq Qureshi, who was earlier nominated as the Hizb's representative, was also present. Immediately after the meeting, Kamal Pandey said that the government team for future talks would be led by Special Secretary, Home, M B Kaushal, while the Hizb team would be headed by senior functionary of the outfit, Khalid Saifullah. He added that the Jammu and Kashmir State Home Secretary, C Phonsung, would assist the government team.

On the political front, a top Hizb-ul Mujahideen leader, Abdul Majid Dhar is reported to have said that efforts were underway to eliminate bottlenecks in the way of the resumption of talks with the Indian Government and that a fresh cease-fire would again come into force within two months. Majid Dhar had earlier announced a unilateral Hizb cease-fire, on July 24, which was later withdrawn by the Hizb supreme commander, Syed Sallaudin. Majid Dhar was quoted as having said that the "Hizb is fully aware of the wishes and aspirations of the people (of the State) and that is why it is desirous of resumption of talks with the Centre".

The Communist Party of India-Marxist (CPI-M) has urged the Union Government to announce an ``unconditional and unilateral cease-fire in Kashmir to create an atmosphere conducive for the peace process to go forward.'' News reports cite this as the first instance where a mainstream Indian political party, with a base outside the State, has suggested a unilateral cease-fire. Speaking in New Delhi on October 7, a party politburo member said that an " unilateral cease-fire (by the Indian Government) may create an atmosphere of goodwill and confidence among the people of the state who are eager to respond to any positive initiative''. On the same day, in Srinagar, the party's state unit general secretary and state legislator, Yusuf Tarigami told the media that ``India needs to take a bold initiative to save Kashmiris''. He added that India must not compare itself with Pakistan and rather should take " a step forward and initiate a process. If Government of India declares a unilateral ceasefire, it is bound to create an atmosphere of goodwill and confidence''.

On the political front, the People's Conference, a constituent of the separatist front All Parties Huriyat Conference (APHC), adopted a resolution, on October 8, asking India and Pakistan to involve the people of Pakistan occupied Kashmir (PoK), along with those of Jammu and Kashmir, in any proposed talks. The chairman of the outfit, Abdul Ghani Lone, is reported to have remarked during the front's convention in Srinagar, the first in 11 years, that the Kashmir policies in both Pakistan and India were being framed and implemented by the intelligence agencies and the respective political leaderships were not associated with them. In an interview to BBC on October 16, the Hizb-ul-Mujahideen(HM) chief Syed Salahuddin claimed that internal pressure is mounting on India for a cease-fire to pave the way for talks with the terrorist outfits on the Kashmir issue. He added that there was no need for a cease-fire call from the Hizb if India agreed to hold talks. While putting the onus on India to call a cease-fire, he pointed out that the process of dialogue could proceed even during the current terrorist phase. The Hizb chief denied reports about a split in the rank and file of the Hizb on the issue of withdrawal of cease-fire on August 8. He also denied that orders have been issued for the killings of those who favour a dialogue with India. The Hizb chief claimed that the 'chief commander(Operations)' Abdul Majeed Dar and other terrorists were in the Kashmir valley, and carrying out attacks on Indian targets. He said Dar had led the recent attacks in Baramulla, Pattan, Udhampur, and Jammu-Srinagar highway. Clarifying on reports that India may agree to include Pakistan in the talks, he said that the outfit had provided an opportunity to India for the solution of Kashmir issue by announcing a unilateral cease-fire, but India had adopted delaying tactics.

Speaking in Islamabad on October 21, the spokesman said the Hizb rejects any offer of talks which requires laying down arms as a condition. The spokesman was reacting to the recent statement of Indian Home Minister that his government is willing to talk to the Mujahideen if they give up arms and come to the negotiating table. He claimed the offer indicated the frustration of the Indian government. While reiterating the position that it had provided an opportunity to the Indian government in July when it announced a unilateral cease-fire, the Hizb spokesperson said that any further talks can take place only in the presence of an international guarantor. The spokesman also claimed that India had sought the assistance of Israel in fighting terrorism in Kashmir. He added that his outfit had killed some Israelis in Kashmir recently. He also described as a blatant lie the statement of Indian Home Minister that Indian security force personnel have gained more success against terrorists in Kashmir. He claimed that civilians killed by Indian security forces were being described as terrorists.
