The central government should decide within eight weeks on the extradition and repatriation of a woman from Kerala who is detained in Afghanistan with her child on charges of joining the Islamic State (IS) terror outfit, the Supreme Court ruled on January 3, reports Hindustan Times. The court was hearing a petition filed by VJ Sebastian Francis, a resident of Ernakulam District in Kerala, who requested repatriation of his daughter Sonia, alias Ayisha, and granddaughter. The two are at Pul-e-Charkhi prison in Kabul since 2019, before the Taliban takeover in Afghanistan.

As many as 829 villages in Gadchiroli District of Maharashtra have no Internet connectivity was revealed by the Department of Telecommunications (DoT) in an affidavit filed before the Nagpur bench of the Bombay High Court (HC) on January 19 when hearing on a suo motu Public Interest Litigation (PIL) (No7/2020) took place, reports telecom.economictimes.indiatimes.com. The PIL was based on letters by 10 school students, hailing from remote villages in the Naxalite [Left Wing Extremist, LWE]-infested District, to the HC Chief Justice and senior administrative judge at the Nagpur bench, where Firdos Mirza was appointed as amicus curiae. Upset over the information by the DoT, a division bench comprising justices Sunil Shukre and Anil Pansare expressed concern over the future of schoolchildren from the tribal-dominated district.

On February 9, (today) a special court in Gujarat pronounced its judgment on the 2008 Ahmedabad serial bomb blasts, as 49 were convicted and 28 acquitted, reports The New Indian Express. Those convicted include Safdar Nagori, Javed Ahmed and Atikur Rehman. All 49 were convicted under Section 16 of the Unlawful Activities (Prevention) Act- UAPA, which deals with terrorism, as well as Indian Penal Code (IPC) Sections 302 (murder) and 120-B (criminal conspiracy).

On February 9, a special National Investigation Agency (NIA) court convicted a Jamaat-ul-Mujahideen Bangladesh (JMB) terrorist in connection with a blast at the Mahabodhi Temple complex in Bodh Gaya in 2018, reports News 18. The Bangladeshi terrorist, Jahidul Islam, was convicted under sections of the Indian Penal Code, the Unlawful Activities (Prevention) Act, the Explosive Substance Act and the Foreigners Act. On January 19, 2018, a low-intensity bomb exploded just hours after Tibetan spiritual leader the Dalai Lama finished a sermon at Bodh Gaya. Security personnel later found two live bombs in boxes – one near gate Number 4 of the Mahabodhi temple and another near a Sri Lankan monastery.

On February 10, a National Investigating Agency (NIA) court sentenced a Bangladeshi Al-Qaeda terrorist to seven years' rigorous imprisonment (RI) in Kolkata City (Kolkata) of West Bengal, reports The Hindu. The terrorist, Samad Myan alias Samsad alias Tushar Biswas, was arrested in November 2016 along with three other Bangladeshis for plotting an attack in Kolkata city. The other three Bangladeshi terrorists had been convicted and sentenced five years ago. Samad Myan was also slapped a fine of ₹15,000 and an additional six months in prison in case of non-payment.

A National Investigation Agency (NIA) Special Court in Kolkata sentenced Samad Mia alias Tanvir alias Saifur alias Tusar Biswas an operative of Bangladesh-based terror module Ansarullah Bangla Team (ABT) to seven years of imprisonment for allegedly planning terror activities in India, reports, The Indian Express reports on February 12. As per records, the accused was a Bangladeshi resident. He was charged under section 120 B (criminal conspiracy), 121 A (Conspiracy to commit offences punishable by section), 125 (Waging war against any Asiatic Power), 468 (forgery for purpose of cheating), 471 (using as genuine a forged document) of the Indian Penal Code and under various sections of the Unlawful Activities Prevention Act- UAPA and the Foreigners Act. He was also fined INR 16,000. On November 21, 2017, the Special Task Force unit of Kolkata Police arrested five members of ABT, including Mia, in the city for suspectedly conspiring to carry out terror activities in India.

A special court in Gujarat on February 18, sentenced 38 people to death and 11 others to life imprisonment for serial bomb blasts that killed 56 people and injured 200 more in Ahmedabad on July 26, 2008, reports Hindustan Times. The 49 convicts included former Students Islamic Movement of India (SIMI) ‘chief’ Safdar Nagori. In the 7,000-page judgment, judge AR Patel said it was a rarest of rare case, according to public prosecutor Amit Patel. As per Section 368 of the Code of Criminal Procedure, the entire record of the proceedings will be now sent to the Gujarat high court for confirmation of the death sentences, the court said in its 59-page order on Friday. Till the high court decides on the case, all the accused will remain in jail, the order said.

Special Judge Parveen Singh sent the accused persons to jail till March 24 after they were produced before the court on expiry of their custodial interrogation by the NIA. The agency had arrested Negi, a former SP of the NIA, for allegedly leaking secret documents to an Over Ground Worker (OGW) of the banned terror group, Lashkar-e-Toiba (LeT). The case was filed under various sections of the Indian Penal Code (IPC) and the stringent Unlawful Activities Prevention Act (UAPA), including those related to terrorism and terror funding. The NIA had alleged that the accused had been running a network of OGWs of LeT and recruited persons across India. In pursuance to conspiracy, the accused were in contact with their foreign based handlers and upon their directions were engaged in gathering intelligence on vital installations, security forces as well as identification of target locations for launching of terrorist attacks, the NIA said.

In a setback to the National Investigation Agency (NIA), the Chhattisgarh High Court on March 2 dismissed the probe agency’s appeal to quash or transfer the second First Information Report (FIR) registered in connection with the 2013 Maoist attack in Jheeram valley that had killed 29 persons, including several senior Congress leaders, reports The Indian Express. The FIR in question was filed by slain Congress leader Uday Mudliar’s son Jitendra Mudliar in 2020. A division bench of justices RCS Samant and Arvind Chandel passed the order, clearing way for the State Police to carry on with the investigation into the alleged conspiracy behind the attack. The central probe agency had moved the High Court after a special NIA court in Jagdalpur had rejected its plea. Reportedly, on May 25, 2013, Maoists ambushed and killed 29 persons, including senior leaders Nand Kumar Patel, Vidya Charan Shukla and Mahendra Karma, during a poll campaigning tour in Bastar. The Congress had alleged “a bigger political conspiracy” behind the attack, demanding an independent inquiry. The case was transferred to the NIA the same year and the Congress party termed the agency’s 2016 probe report “more of a cover-up than an investigation”.

Special Judge (NIA Act) Vinod Kumar Dewangan passed the order on March 14. Besides Sori, the court also acquitted her activist nephew Lingaram Kodopi, construction contractor B.K. Lala and then Essar company official D.V.C.S. Verma, citing that the prosecution has failed to prove the charges against the accused. Therefore, in the absence of corroborative evidence, the accused are acquitted, the court said in a 76-page order. Sori and Kodopi were arrested on charges of acting as Communist Party of India-Maoist (CPI-Maoist) conduits and allegedly receiving "protection money" for the rebels from the Essar company. They were booked under the Indian Penal Code (IPC) sections 124 (A) (sedition), 121 (waging or attempting to wage war against government) and 120-B (criminal conspiracy) and the Unlawful Activities Prevention Act (UAPA) and the Chhattisgarh Special Public Security Act.

The Kerala High Court on March 17 quashed the charges slapped under the Unlawful Activities Prevention Act (UAPA) and under section 124A (sedition) of the Indian Penal Code (IPC) against Communist Party of India-Maoist (CPI-Maoist) leader Roopesh in three cases registered in Kuttiadi and Valayam Police Stations in Kozhikode District of Kerala, reports The New Indian Express. A Division Bench comprising Justice K Vinod Chandran and Justice C Jayachandran issued the order while allowing the petition filed by Roopesh seeking to quash the cases. The authority headed by a retired high court judge had recommended charging the section against the petition based on the letter of the home department on February 7, 2018. The sanction of the State Government in the first two crimes was on June 6, 2018, and in the other crime on April 7, 2018; both delayed. In the UAPA and the Rules framed thereunder, a specific time of seven days is provided. The Authority has to make a recommendation, after which the appropriate Government also has to issue a sanction within another seven days from the receipt of the recommendation, argued the petitioner. "Amidst the raging controversy as to the retention of offence of sedition in the IPC; which the naysayers categorise as a relic of the colonial past; a symbol of British hegemony and the votaries support in the wake of rising anti-national feelings under the cloak of liberal thought, the Government sat over a sanction for six months, violating the time frame prescribed in the rules," observed the Bench. The Bench held that the sanction under the UAPA granted after six months from the date of receipt of the recommendation of the authority is not a valid sanction. "We find the sanction order of the UAPA to be not brought out in time, as statutorily mandated and bereft of any application of mind; both vitiating the cognizance was taken by the Special Court," observed the court.

The Chhattisgarh High Court on May 11 stayed the enquiry proceedings of a judicial commission newly reconstituted by the State Government, which added new terms of reference to an existing enquiry into the 2013 Jheeram Ghati Communist Party of India-Maoist (CPI-Maoist) attack that left 28 Congress leaders dead, reports Hindustan Times. A petition was filed by senior Bharatiya Janata Party (BJP) member of Legislative Assembly (MLA) and leader of opposition Dharamlal Kaushik questioning ‘constitutionality’ of the commission on April 13. Kaushik pointed out that the report of the Jheeram Ghati Inquiry Commission headed by Justice Prashant Kumar Mishra should have been tabled in legislative assembly within six months of its submission but without submitting the report, the state government reconstituted the judicial commission. The division bench of chief justice Arup Kumar Goswami and justice RCS Samant has also issued notices to the state government and the judicial commission and sought a reply. “The court after hearing the petition stayed the enquiry proceedings of the reconstituted judicial commission. The court has also sought reply from the state government and judicial commission on the next hearing which is scheduled on July 4,” said Vivek Sharma, Kaushik’s lawyer.

The chief of banned Jammu and Kashmir Liberation Front (JKLF) Yasin Malik was convicted by a Delhi court on May 19 under the stringent anti-terror law in a case related to funding of terror activities in Jammu and Kashmir (J&K), after he pleaded guilty to all charges framed against him, reports Daily Excelsior. Special Judge Praveen Singh posted the matter for May 25 to announce the quantum of punishment and also directed the National Investigation Agency (NIA) to assess Malik’s financial condition to determine the amount of fine that could be imposed. After the charges were framed in March, Malik on May 10 informed the court that he would not be contesting the charges levelled against him, including section 16 (terrorist act), 17 (raising funds for the terrorist act), 18 (conspiracy to commit terrorist act), and 20 (being a member of terrorist gang or organisation) of the Unlawful Activities (Prevention) Act (UAPA) and sections 120-B (criminal conspiracy) and 124-A (sedition) of the IPC. Malik faces the maximum punishment of a death penalty, while the minimum sentence for the offences committed by him is life imprisonment. The JKLF is a banned terror organisation under the UAPA. The case pertains to the conspiracy by Lashkar-e-Taiba (LeT) chief Hafiz Saeed and separatist leaders, including members of the Hurriyat Conference, who had acted in connivance with active members of banned terrorist organisations Hizbul Mujahideen, Dukhtaran-e-Millat and others to raise, receive and collect funds domestically and from abroad through various illegal channels, including hawala. The funds were for the purpose of separatist and terrorist activities in J&K to cause disruption in the Valley by way of pelting stones on security forces, systematically burning schools, damaging public property, and waging war against India.

The verdict is in connection to the conspiracy case hatched by IS operatives in Syria to radicalise Indian youth via internet. An Improvised Explosive Device (IED) was made at their instruction. On May 30, a special Central Bureau of Investigation (CBI) court in Mumbai of Maharashtra sent four accused involved in the 1993 Mumbai bomb blasts to judicial custody till June 13, reports India Today. The four accused identified as Abu Bakar, Sayed Qureshi Shoe Qureshi, Yusuf Bhatka alias Yusuf Bata were arrested by the Gujarat Anti-Terrorism Squad (ATS) on May 17 and later handed to CBI for further the blast case. All the four accused were involved in the smuggling and transporting RDX and other explosives used in the blasts and AK-56 rifles, bomb triggers and other weapons. On March 12, 1993, 12 coordinated bombs went off in the city, killing 257 and injuring 700 others. The Terrorist and Disruptive Activities (Prevention) Act court has convicted over 100 people in the attacks. Main accused Dawood Ibrahim and Tiger Memon are still at large.

Subahani Haja Moideen, a Tamil Nadu based Islamic State (IS) operative who was arrested by the National Investigation Agency (NIA) in October 2016, trained with Mohammad Ghani Usman, a former bomb-maker of Lashkar-e-Toiba (LeT) who later joined IS and had become his best friend during five months of training in Iraq in 2015. Moideen, 37, convicted by an Ernakulam court in September 2020 for joining IS told investigators that he met Paris bombers including Abdelhamid Abaaoud (killed during the bombing) and Salah Abdeslam on his way to Iraq. To gather more details, a team of French investigators came to Kochi (Kerala) in December 2018 to interrogate Moideen about the training and his links with the Paris attack squad of the IS. In return, a NIA team had travelled to Paris in to question Usman, who, in the past, was close to LeT leadership; Indian agencies wanted to get further information from him on 26/11 Mumbai attacks.

All five had confessed to their crimes on June 30 after which they were sentenced by the court. “The case relates to an explosion that had taken place in the house of Leelo Devi at Jatan Mohalla, Bijnor on September 12, 2014, and the criminal conspiracy hatched by members of banned organization SIMI to commit terrorist acts," an NIA spokesperson said in a statement on July 2.

A National Investigation Agency (NIA) court in Kochi (Kerala) on July 12, found three people, U K Hamsa, K V Abdul Razaq and M Midilaj, guilty of recruiting youth into the Islamic State (IS) with the intention of widening the terror outfit’s activities and wage war against the country, reports Hindustan Times. The quantum of sentence against the trio all from Kannur District of Kerala will be announced on July 15. The three were arrested by Police in Turkey while they were planning to cross over into Syria in 2016. They were extradited to India in November, 2016. According to the prosecution, Hamsa (60), acted as an ideologue and was involved in spreading IS ideology. NIA court judge Anil Bhaskar found the trio guilty under sections 38 and 39 of the Unlawful Activities Prevention Act (UAPA) (waging war against the country and supporting a terror outfit to weaken the country) and section 120 B (criminal conspiracy) of the Indian Penal Code (ipc). According to senior officials familiar with the probe, agencies had found that Hamsa, a professional cook popularly known as Biryani Hamsa, propagated IS ideology in north Kerala and helped radicalise at least 20 youth, whereabouts of some of whom are still unknown.

The inquiry of cases on both Maoists is transferred to District Court, and chargesheets on six cases under the limits of Shankaranarayana Police Station limits and one under Kollur Police Stations limits are already submitted to court. However, the criminal sections in these cases need to be inquired in District Court, hence, all the seven cases were ordered to be transferred to the District Court. B G Krishnamurthy submitted a written appeal to the court and requested to keep him in prison of Karnataka. In his appeal, Krishnamurthy stated that out of the four cases in Kerala, he has secured bail in one and he can go for inquiry from Karnataka for the remaining three cases. The Kerala Government is likely to withdraw the plea submitted before the Supreme Court to restore Unlawful Activities Prevention Act (UAPA) charges against alleged Communist Party of India-Maoist (CPI-Maoist) leader Roopesh, reports Mathrubhumi on August 23. It is learnt that the standing counsel for Kerala Government will intimate the decision to the Supreme Court bench chaired by justice MR Shah, when the court takes up the matter. The five persons included Athar Illahi Sheikh, an Over Ground Worker (OGW) of LeT who is lodged in Kot Bhalwal Jail; Mohammad Yousuf Dar alias Kantroo, LeT ‘commander’ who was killed; Faisal Hafeez Dar, the LeT militant who was killed; Hilal Ahmad Sheikh alias Hanzullah who was killed and active Pakistani militant Ghazi Bhai alias Pathan Bhai alias Usman Bhai of LeT. An unnamed spokesman said that on March 7, 2022, Police Station Khag received a complaint about missing of one in-service Army soldier Mohammad Sameer Malla on leave and accordingly search of the missing person was started. After three days on March 10, 2022, upon specific information, dead body of the missing Army personnel was recovered who was found buried in a ditch in fields of village Labran Khag. A formal case was filed then. During the course of investigation Ather Illahi Sheikh was arrested who upon questioning admitted that he along with other four accused militants of LeT abducted Mohammad Sameer Malla and they tortured him which resulted in death of Mohammad Sameer Malla in an orchard of Labran village and buried the dead body of the victim in a ditch in nearby field. Later, three militants involved in the crime were killed in anti-militant operation in Village Malwa Kunzar on April 21-22, 2022 while 5th accused Ghazi Bhai alias Pathan is still at large.

The Anti-Terrorism Squad (ATS) had arrested Bhelke and his wife Kanchan Nannaware, both hailing from Chandrapur in Vidarbha region, in September 2014. Bhelke and Nannaware were arrested from Kanhe Phata area in Pune Rural. Both were booked under various provisions of the Indian Penal Code (IPC) and UAPA. They were lodged in Central Jail, Yerwada. On January 24, 2021, Nannaware died after a prolonged illness. On December 14, Arun Bhelke was convicted under Section 420, 467, 468, 471, and 474 of the IPC and Sections 20 and 38 of the UAPA. Under the provisions of the IPC, he was sentenced to five years, seven years, five years, five years, and five years separately, with a fine of Rs 5,000/- in each provision. In default to pay the fine, his sentence included, simple imprisonment of one month under each of the cited sections of the IPC. Under the UAPA, he was sentenced to eight years with a fine of Rs 10,000-, in default of which simple imprisonment of two months. The Court convicted them under sections 120B of IPC, 18, 18B, 19, and 38 of the UA (P) Act and also imposed fine on them. During the course of the investigation, it was discovered that the accused had entered into a conspiracy to recruit members for raising a module of HM in Assam in order to strike terror in the minds of people through terrorist activities. The case was initially registered at Jamunamukh Police Station in 2018, and the investigation was later taken over by the NIA. The National Investigation Agency (NIA) filed the charge sheet in a special NIA court in Hyderabad on December 30 against 11 Popular Front of India (PFI) activists, who were arrested from Nizamabad in Telangana for suspectedly organizing terror training camps and recruiting people for carrying out terror activities, reports The Statesman. Those named in the charge sheet are Abdul Khader, Abdul Ahad, Abdul Saleem, Shaik Shadullah, Feroz Khan, Mohammad Osman, Syed Yahiya Sameer, Shaik Imran, Abdul Mubeen and Mohammad Irfan of Telangana, and Shaik Iliyas Ahmed of Andhra Pradesh as reported by Hindustan Times. According to NIA investigations, the accused were running training camps under the guise of Yoga classes or beginner’s course for physical education where the youths were trained to use everyday articles such as knives, sickles and iron rods to kill people by targeting vulnerable body parts such as throat, head or stomach and for committing acts of terror. The eleven arrested PFI members have been charged under UAPA for organizing terror training camps and recruitment of persons for terrorist acts. They were accused of radicalizing gullible Muslim youths and recruiting them through speeches filled with hatred and venom against the Government of India as well as other organizations and individuals.

On December 31, the Jammu and Kashmir State Investigation Agency (SIA) has filed a chargesheet against four Lashkar-e-Toiba (LeT) terrorists, identified as Talib Hussain Shah (commander), Faisal Ahmad Dar, Muhammad Qasim and Zia-Ul-Rehman for carrying out a number of militant attacks in Jammu and Kashmir (J&K), reports The Tribune. According to the investigation, Talib Shah recruited many youths in J&K and revived the militant ecosystem in the Chenab Valley and Pir Panjal areas of J&K on the instructions of Pakistan-based handlers. The accused are also involved in minority killings and instilling fear among the wider public. Two AK assault rifles, a pistol, seven grenades and a large quantity of ammunition were recovered from them.
