Supreme Court on January 2 cleared the decks for the Government to endorse the second Constitution amendment bill as it decided that an interim order should not be issued staying the bid, reports The Himalayan Times. A division bench of Chief Justice Sushila Karki and Ishwor Prasad Khatiwada issued the order that the Judiciary could not bar the Legislative from using its wisdom in the formulation of legislation on the basis of the principle of separation of powers. The bench was responding to two writs filed separately by advocate Tikadhwaj Khadka and five others including Bishnu Bahadur Raut.

Local Bodies Restructuring Commission (LBRC) on January 6 submitted its report to the Government recommending creation of 719 local bodies across the country, reports The Himalayan Times. The LBRC submitted a 1,718-page report to Minister of Local Development Hitraj Pandey in the presence of Prime Minister Pushpa Kamal Dahal at Singha Durbar. Of the 719 local bodies, 256 (35 per cent) are in 20 Districts of Madhes. As per the report, there will be four metropolitan cities, 12 sub-metropolitan cities, 241 municipalities and 462 village councils. The local bodies will be divided into 6,553 wards.

Ruling and the opposition Member of Parliaments (MPs) opposed Local Bodies Restructuring Commission (LBRC) report for restructuring the local bodies, reports The Himalayan Times on January 13. They also warned that mass protests would break out if the Government failed to correct the boundaries of the local bodies on time. Nepali Congress (NC) lawmaker Deepak Kuinkel said the LBRC report was not in sync with the ground reality. Tarai Madhes Sadbhawana Party-Nepal (TMSP-N) lawmaker Mahendra Ray Yadav said the LBRC office bearers had restructured local bodies sitting in the capital after they failed to do field work in Province 2. Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) lawmaker Panch Karna Rai said the LBRC recommended some places as local units even though local people had not resorted to such a demand.

Prime Minister Pushpa Kamal Dahal has expedited preparations to induct more Ministers in his cabinet in an apparent bid to garner support of more parties in favor of the Constitution amendment bill, reports Republica on January 14. Highly-placed sources said Prime Minister has already held talks with the top leaders of the Rastriya Prajatantra Party (RPP), Madhesi People's Rights Forum-Democratic (MPRF-D) and various fringe parties including the Janashakti Party Loktantrik, Nepal Family Party, Bahujan Shakti Party and Nepa Party to bring them on board the amendment bill. The Government is optimistic that it would be able to secure the required two-thirds majority votes in favor of the bill once the top leaders of these parties currently in the opposition rank are brought on board the Government.

The PM asked them what would be their reaction if the Government made preparations for election and announced election date after completing the process for constitution amendment. Likewise, Dahal asked the Madhesbased parties if they would participate in the elections even if the parliament rejected the amendment bill. The PM also asked them whether or not the agitating parties would be ready for local polls if some reasonable changes are made to the report of the local level restructuring commission in line with their demands. Similarly, the PM informed the Madhesbased leaders that the ruling coalition is ready to address their demand for making further changes to the amendment bill only on the issues of language of official business and removing village council chairperson, vice chairperson, municipality mayor and deputymayor from the Electoral College, which elects members of the National Assembly. PM Dahal also made it clear that the ruling coalition was not able to make any changes to the provincial delineation more than what has been proposed in the amendment bill but that he was ready to settle other delineation disputes through the Federal Delineation Commission. However, Madhesbased leaders insisted that the PM must ensure passage of the amendment bill before declaring the election date.

The Supreme Court scrapped the Truth and Reconciliation Commission (TRC) guidelines for putting insurgency-era rights violation cases on hold, reports The Himalayan Times. A division bench of justices Jagadish Sharma Poudel and Dipak Kumar Karki scrapped the TRC guidelines, stating they were against the provision of the TRC Act and Regulations. Nepali Congress leader and General Secretary of Conflict Victims National Society Binaya Dwaj Chand, along with other 15 conflict-victims organisations, had filed a petition against the guidelines on September 26, 2016. The apex court had earlier issued an interim order against the guidelines. The TRC had prepared the guidelines for putting on hold insurgency-era human rights violation cases on several grounds, including lack of evidence and inadequate details. Thousands of conflict-era cases were likely to be shelved without conducting any inquiry if the guidelines were followed.

LBRC member Neeraj Sah said LBRC received over 50 phone calls and multiple delegations everyday from across the country seeking changes in the report.”The government cannot make selective revisions. If the report is revised it will set a bad precedent and will become a never ending process,” said another LBRC member Sunil Ranjan Singh. He said the report was prepared keeping in mind both the geography and the population. He added that neither the government nor any task force had the authority to revise the document and the report could be revised only after its implementation. “It will be unconstitutional to revise the report,” said Singh. Meanwhile, Minister for Federal Affairs and Local Development Hitraj Panday, who is also the head of the government’s task force to study the LBRC report, said the task force would study the report thoroughly and recommend its revision, if needed. Expressing dissatisfaction with its contents, the government has refused to endorse the report saying further consultations were needed on the report among the political parties. The constitutional body had submitted its report on number and boundaries of local bodies to the government on January 6. Apart from determining the number and boundaries of local bodies, the LBRC is mandated to prepare a report on the special, protected and autonomous regions, their economic feasibility and structure of the public administration in the federal model by March 13.

'We are living under constant fear of the possible eventualities as we are not in a position to pay such hefty amounts in the name of donations,” said one businessperson on condition of anonymity. Not just businessperson, the Chandled Maoists have extended their extortion drive to various institutions also. A group of party cadres recently visited the office of the Pashupati Area Development Trust (PADT) and demanded money from Member Secretary Govinda Tandon as donation. “They came to me and said the PADT must provide money to the party,” Tandon said, adding that they did not mention any specific amount.

The opposition, which was against allowing deliberations on the amendment bill in parliament, said that the agitating Madhesi parties must commit to accepting the result of the parliamentary vote on the bill and participate in local elections. “We have become flexible in our previous stance following the government's request for creating an environment for local polls. But the UDMF (United Democratic Madhesi Front) must express its commitment to accepting the result of the voting on the bill in parliament and it must be ready to participate in local elections,” Bhanu Bhakta Dhakal, chief of the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), said. A meeting of the CPN-UML parliamentary party and a separate meeting of the nine-party alliance decided to demand that the Government and the UDMF express commitment to accepting the voting result in parliament and that the UDMF commit to participating in the local elections. “The government and UDMF must make it clear that they will accept the result of the vote in parliament. In Janakpur, educational institutions and marketplaces remained shut while vehicles stayed off the roads. Protesters vandalised at least three vehicles at Mujeliya and one hardware shop at Bramarpura. In Mahottari, RJP-N members vandalised a vehicle belonging to Deep Narayan Sah, a former state minister. Sah said he and his driver sustained injuries when protesters hurled stones at his vehicle. Protesters also obstructed a programme of an NGO being held at the Red Cross building in Jaleshwor. In Saptari, passengers were left in the lurch after buses were stopped at Rupani, Shambhunath, Kadmaha and Kalyanpur areas along the East-West Highway. In Sarlahi, RJP-N supporters burnt tyres and obstructed vehicular movement at Malangawa, the district headquarters. NC leader Ramesh Rijal suggested to Deuba to defer the polls as the agitating RJPN had started violent activities against the polls. Rijal was joined by former Home Minister Bimalendra Nidhi. Nidhi argued that the local polls in provinces 2 and 5 should be put off for a few days in order to bring the agitating RJPN on board. He argued that there was no restriction on increasing the number of local units if due constitutional process was followed. Nidhi suggested forming a constitutional commission to increase the number of local units in Tarai Districts and put off the polls in the two provinces until the increase is affected. A Cabinet meeting decided to defer the polls in Province 2 and change the election calendar in the three other provinces. “Elections in Province 2 will now take place on September 18 and the polling in the remaining provinces (1, 5 and 7) will be conducted as scheduled although the poll-related calendar has been revised without impacting the polling date,” said Minister for Labor and Employment Farmullah Mansoor after the meeting. This is the fourth poll deferral. Initially, the Government had fixed May 14 as the poll date across the country. Just ahead of nominations day, the Government decided to conduct the elections in two phases. Three provinces of the hill region went to polls in the first phase and June 28 was set as the poll date for the second phase. Provinces 1, 2, 5 and 7, which largely lie in the southern plains, would vote in the second phase.

Eighty percent of the eligible voters cast their ballots in Bajura, while the lowest turnout (61 percent) was recorded in Bhojpur. The second phase turnout is slightly less compared to 73 percent in the first round. Altogether 62,408 contestants contested 15,038 positions at 334 local units in the second phase local polls. The Government conducted the first phase elections in the 283 local units of Provinces 3, 4 and 6 on May 14. The election in Province 2 is set for September 18.

RPP was planning to vote against the bill. The party has 25 votes. The last effort to pass the bill had failed after around ten lawmakers of royalist RPP suddenly disappeared just before the voting process. The Government will need votes of two-thirds parliamentarians or 396 votes in the 593-strong parliament to pass the bill. The Government seems in control of 359 votes including NC’s 207 votes, Maoist Center’s 82 votes, RJPN’s 25 votes, Nepal Loktantrik Forum’s 17 and Federal Socialist Forum Nepal’s 15.

A three-year-old girl was killed in a clash occurred between the two neighbors in post-election violence in Rautahat District on September 30, reports Kathmandu Post. A dispute between two neighbors - families of Hulas Ray Yadav and Krishna Chaudhary - over the matter of drinking water later took a nasty turn as the issue was given a political color on the basis of political connection of both families to different political parties. The Yadav family is reportedly close to the Nepali Congress (NC) while the Chaudhary family is said to be the supporter of Communist Party of Nepal-Unified Marxist Leninist (CPN-UML). Yadav's three-year-old daughter Anjali Kumari was killed in the scuffle. With this four persons were killed in Rautahat District since the third phase of local-level elections took place on September 18. It may be noted that three persons were already murdered in the District since the September 18 elections. Sawmill proprietor Birendra Saha (45) of Balchanpur Baradewa of Chandrapur Municipality-10 was found dead in the morning of September 29 with serious head injuries resulted in from attacks by a sharp-edged weapon. Prior to this, Swayawa Akbar of Paroha Municipality and Ram Pukar Yadav of Katahariya Municipality were killed by unidentified groups. Such incidents have sent shockwaves to RJPN in most of the Districts of Province 5, from Nawalparasi to Banke. Not just within the RJPN, but the incident is expected to create ripples in the provincial politics as a whole. On October 2, member of the RJPN's presidium Hridayesh Tripathi, after quitting his party, signed an agreement with CPN-UML's General Secretary Ishwar Pokharel to vie in the election using the symbol of CPN-UML. Along with Tripathi and Mishra, BK Gupta, Jagdish Shukla and Ishwar Dayal Mishra of RJPN's presidium had signed the agreement with CPN-UML. “We raised voice for proper utilization of opportunity during the polls. Together, Qatar, Pakistan, and Afghanistan were elected from the Asia-Pacific region, as part of a total of 15 states elected from different geographical regions. The term of office of Nepal at the UNHRC begins on 1 January 2018, and ends on 31 December 2020. The National Security Council (NSC) has assessed that the Netra Bikram Chand-led Nepal Communist Party is a major security threat to the upcoming parliamentary and provincial elections scheduled on November 26 and December 7, reports The Himalayan Times on October 23. According to a ‘confidential’ report prepared by the NSC, Chand’s group has continued to use force against people in the name of ‘people’s action’, extorting money and issuing threats and intimidating locals. The report states that the Chand-led group has formed a parallel ‘People’s Government’ and ‘People’s Court’. The group has mobilised its National Volunteer Organisation, a youth wing of the party, which has decided to boycott elections. According to the NDC report, the Chand-led group has decided to launch various activities to disrupt elections in coordination with other forces who are opposed to the new constitution. The party has also decided to ‘expose’ both the left alliance and democratic alliance, who are in favour of parliamentary democracy through various activities. The group has been organising closed-door trainings and meetings, and has also expanded its organisational bases through conferences and cultural activities, the NDC report said. The Chand-led party’s spokesperson Khadga Bahadur Biswokarma, however, said his party was not a threat to national security and the real threats stemmed from political chaos, corruption, cross-border encroachment, and black marketeers. “We will urge people to exercise their rights without exerting any pressure on people. We will launch our ‘reject-the-Polls’ campaign,” he said.

The Election Commission (EC) had demanded more than NR10 billion. “We will be ready to provide additional amount if the EC seeks,” said Kewal Prasad Bhandari, chief of the budget division at the Finance Ministry. As the EC is holding federal and provincial elections together, expenditure are expected to run relatively higher compared to earlier elections considering the requirements of more ballot papers and temporary police personnel, among others. The EC, which printed around 16 million ballot papers for the local elections, is now printing over 34 million ballot papers for the upcoming polls.

Though 88 parties are contesting the polls, those submitting the PR lists number much lower as the parties need to secure at least three percent vote to claim seats in the federal parliament. The parties getting less than 1.5 percent PR votes will not be represented in provincial assemblies. In the federal parliament, 110 lawmakers will be elected in the PR category. Parties are required to field 50 percent women for proportional seats.

Communist Party of Nepal-Maoist Centre (CPN-Maoist Centre) on November 9 expelled leaders and cadres who filed their candidacies in the elections to the House of Representatives and State Assemblies and their supporters against party policy, reports Republica on November 10. The party has expelled them from party's general membership. Sending a letter to Province no 6, the party headquarters cancelled general membership of party's politburo members - Umakanta Sharma, Chhakka Bahadur Lama and Bhim Prakash Sharma, who had filed their candidacies against authorized candidates of the leftist alliance. Similarly, the party also expelled General Convention organizing Committee member Jit Bahadur Pun, local leaders of Salyan - Pramod Shrestha, Shalikram Bhattarai, Setiram Oli, harilal DC, Tanka Dhakal and Kirti Bahadur Rana from general membership.

Although a series of bomb blasts have taken place across the country targeting candidates contesting the provincial and parliamentary elections, the Ministry of Home Affairs (MoHA) has failed to check such incidents, reports The Himalayan Times on November 29. “The prime minister and home secretary are implementing the security plan devised by someone else. So the problem lies there. During critical time, immediate directions are needed. But the prime minister, who is not readily accessible, holds the home portfolio. As a result, security agencies have not been able to take swift action,” said a ministry source.

The group attacked Sushil Kumar Rai, who is contesting the provincial election from Damak-5 of the District. He, however, escaped the attack. The Bolero jeep suffered a minor damage in the attack that took place during an election campaign, said the vehicle driver Kul Bahadur Tamang. After the attack the attackers fled the scene.

Of them, 600 were associated with Biplav-led Maoist, 13 reportedly with CK Raut group and remaining 344 belonged to some other political parties.
