Justice Karamat Nazir Bhandari of the Lahore High Court allowed, on January 1, a petitioner-lawyer to amend his petition against the ban on the Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) to confine it to the detention of their chiefs. Advocate M D Tahir pointed the importance of Jehad in Islam in his arguments against the ban. The Judge observed that he had disjoined a number of aspects and had sought a variety of relief measures, which could only be considered separately. While demanding withdrawal of the ban imposed on the two Pakistan-based terrorist outfits, the petitioner had sought disbandment of India's Rashtriya Swayamsevak Sangh (RSS) and the Shiv Sena and the trial of their leaders.

A majority of them belonged to the Lashkar-e-Toiba LeT), Jaish-e-Mohammad (JeM), Tehrik-i-Jaferia Pakistan and Sipah-i-Sahaba Pakistan (SSP). Reports also said an anti-terrorism court (ATC) in Lahore, on January 4, sent 17 activists of militant groups on judicial remand. Of the over-80 arrested, 18 were taken into custody from Lahore and the suburbs. 20 more were held from Faisalabad and the remaining from other places in the province.

Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM) and Hafiz Muhammad Saeed, the former Chief of the Lashkar-e-Toiba (LeT) have been detained for three months under the provisions of the Maintenance of Public Order (MPO) Ordinance for making provocative speeches against government policies. Assistant Advocate General Amin Lone disclosed this while making a statement in Lahore before Justice Karamat Nazir Bhandari, on January 10. The order issued on December 25, 2001 seeking the arrest of Maulana Azhar was also presented to the Court. The order Maulana Azhar with instigating the general masses to rise against the government. The order declared that his speeches, presence, or other activities promote feelings of hatred and ill-will among various sects and thus constitutes a serious threat to national security and the solidarity of Pakistan.

The Lahore High Court (LHC), on January 11, upheld the three-month detention of Maulana Masood Azhar, Chief of the Jaish-e-Mohammed (JeM), and Hafiz Mohammad Saeed, ex-Chief of the Lashkar-e-Toiba (LeT). The LHC rejected a petition that contended that the detentions were illegal. Azhar has been detained since December 25, 2001 under the Maintenance of Public Order law, and since early January 2001 has been held in the Mianwali district jail, about 250 km south west of Lahore. Saeed was being detained in the Sihala rest house within a Punjab police training camp, about 40 km east of Rawalpindi.

The Lahore High Court, Multan Bench on February 21, ordered the release of two suspected activists of a proscribed sectarian outfit, declaring that the detention order was passed in violation of the Maintenance of Public Order (MPO) Ordinance 1960. Earlier, the petitioners, Maulvi Syed Nasir Hussain Shah and Syed Sibtul Hussain Sajjid had challenged their detention on the reports of intelligence agencies. The court has declared that the detention order passed on mere report of an agency was without lawful authority and jurisdiction. The court indicated that no evidence has been produced by the respondents to show that the detainees were members of the banned Tehreek-e-Jaferia Pakistan (TJP).

The Lahore High Court on March 6 observed that the Federal government had blindly arrested the cadres of defunct religious and terrorist groups following their proscription on January 12. "What sort of threat the government felt to the solidarity of the country that it blindly arrested the workers by using one order of arrest," said Justice Shahid Siddiqui. He made this observation while hearing 10 petitions filed against the arrest of cadres of the banned religious outfits. He expressed dissatisfaction over the secret agencies' reports, which led to the arrests. These reports were submitted after the judge had sought them despite the government's stance that the Court could not examine secret documents.

A review board comprising three judges of the Lahore High Court (LHC) accepted the Punjab government’s plea for continued detention of Maulana Masood Azhar, chief of the proscribed Jaish-e-Mohammed (JeM), but ordered that he be lodged in his house in Bahawalpur, which should be declared a sub-jail. According to a report in Dawn, a Pakistani daily, the government would pay the detainee’s dependants Rs 10,000 per month for their subsistence. According to the Constitution, the government is bound to produce a person before a High Court's review board if it wants an extension in his detention period beyond 90 days. A lawyer representing Hafiz Mohammed Saeed, chief of the Lashkar-e-Toiba (LeT) group, filed a petition in the Lahore High Court (LHC) on August 2 seeking his client’s release, saying that he had been held illegally by the government. Hafiz Saeed was allegedly detained in May 2002 by intelligence agencies. Saeed's wife had filed an application at the LHC this week seeking information about her husband. His lawyer Nazeer Ahmad Ghazi filed another application demanding "that stern action be taken against all those who are responsible for the illegal, unlawful and unjust arrest and detention of the husband of the petitioner at a secret place." Saeed was first detained in December 2001 but subsequently released in April 2002 after the LHC refused a government request to extend his detention. As reported earlier, officials of the Federal and Punjab governments have informed the LHC on July 31 that Saeed was not in their custody.

Minister Qadri had recently said in a newspaper interview that the LeT chief was reportedly healthy and was detained by the Punjab Home Department. However, his statements were negated by the Deputy Attorney General’s statement in Court that the government did not know Saeed’s whereabouts.

The Lahore High Court (LHC), on November 18, declared that the detention of Hafiz Muhammad Saeed, chief of the proscribed Lashkar-e-Toiba (LeT), is unlawful and ordered his immediate release, if not required in any other case. The Court order was in reply to a petition filed by Mamoona Saeed, wife of Hafiz Saeed. Lawyers for the petitioner submitted before the court that Saeed was earlier detained on December 30, 2001 and later a Review Board of the LHC had refused to extend his detention and had ordered his release on March 30, 2002. They submitted that Saeed was re-arrested and shifted to an unknown place on May 15. The court was approached in this context and in reply the Federal and Punjab governments said Saeed was not in their custody. According to a media report, the counsel had maintained that the petition was filed again after making the Inter Services Intelligence (ISI) a party, but was withdrawn later on the agency's assurance to release Saeed.

The report quoted unnamed police officers as saying that they were yet to receive a directive from the Home department in this regard. They also said the detention period of Azhar would expire on December 17, today. The Lahore High Court (LHC), on December 24, barred the immediate extradition of three Al Qaeda suspects arrested during a raid involving US agents on December 19. LHC judge Mohammad Javed Buttar ruled that the three suspected terrorists, all possessing dual citizenship, could not be removed from the court's jurisdiction or sent abroad. The ruling added that the detainees "could not be sent abroad in any illegal manner." The three, identified as Omar Karar, Khizer Ali and Muhammad Usman, are sons and a nephew of Dr Ahmed Javed Khawaja, whose residence was raided by police and US Federal Bureau of Investigation (FBI) agents in their hunt for Al Qaeda and Taliban fugitives. Meanwhile, official sources said they believe Khawaja ran a vast "relief network" that provided treatment and financial support to terrorists around Pakistan. They added he was closely linked to the proscribed Lashkar-e-Toiba (LeT).
