Press Trust of India reports that Pakistan’s Election Commission has amended rules that bar Government servants from contesting Presidential polls, a move that has paved the way for President Gen. Pervez Musharraf’s re-election to the top post. Secretary to the Election Commission Kunwar Irshad said on September 16 that the poll panel has amended Presidential election rules, so that Article 63 of the Constitution that has a clause to bar Government servants from participating in elections unless they have been retired for at least two years, no longer applies to the President. Irshad said the rule of Article 63 (K) stating that "if he (the candidate) has been in the service of Pakistan or of any statutory body or any body which is owned or controlled by the Government or in which the Government has a controlling share or interest, unless a period of two years has elapsed since he ceased to be in such service" has been amended to exempt Musharraf who continued as Chief of Army. Irshad said the EC will announce the schedule of Presidential election within next two to three days.

The judge was responding to the plea of Hamid Khan, counsel for Tehrik-e-Insaaf Chairman Imran Khan, asking that the court strike down recent amendments to the presidential election rules made by the EC. The notification said that polling for the election will be held on October 6 from 10 am (PST) to 3 pm (PST). General Pervez Musharraf, whose five-year term as President expires on November 15, will be the government candidate for another term in office as head of State. According to the Constitution, a person cannot become President for more than two consecutive terms.

The Supreme Court on September 28 cleared the way for President Pervez Musharraf to contest the October 6 presidential election while remaining Army chief, by dismissing as "non-maintainable" all petitions challenging his eligibility, according to The Hindu. The 6-3 majority verdict of the nine-judge Bench did not, however, touch upon the substance of the petitions. Nor did the Bench make any observation on the recent changes to the election rules made by the Election Commissioner, favouring President Musharraf. The verdict said the petitions, which pleaded for the court’s intervention as an issue of public importance relating to fundamental rights was involved, could not be maintained on these grounds. Among the three dissenting judges was Rana Bhagwandas, who headed the Bench. The Opposition parties and the legal community denounced the verdict, and called into question the independence of the judiciary. Government spokesmen said justice and the rule of law had prevailed. Attorney-General Malik Qayyum denied that there was any government pressure on the Bench and reiterated that President Musharraf would step down as Army chief after his election.

President General Pervez Musharraf returned victorious as the President of Pakistan for another five-year term in a smooth presidential election held on October 6, reports The News. However, a formal notification of his success was not issued as validation of his candidature is yet to be decided by the Supreme Court. Musharraf bagged 98 per cent (671) of the total votes polled (684), and overall he got 57 per cent out of total 1,170 votes of parliament and four provincial assemblies. According to the unofficial count, 257 senators and Member of National Assemblies (MNAs) polled votes in the 100-member Senate and the 342-member National Assembly. Musharraf secured 252 and Justice (retd) Wajihuddin Ahmed bagged two votes while three votes were declared invalid as announced by Chief Election Commissioner Justice (retd) Qazi Mohammad Farooq. In the 371-member Punjab Assembly, 257 members polled their votes out of which 253 voted for Musharraf. Ahmed got three votes while one vote was declared invalid. In Sindh, 104 votes were cast out of a total 168. Musharraf secured 102 votes and two votes were polled for Ahmed. In the 124-member North West Frontier Province (NWFP) Assembly, 34 votes were polled and 31 members cast their votes for Musharraf. One member voted for Ahmed and two votes were declared invalid. In the 65-member Balochistan Assembly, all the 33 votes were cast in Musharraf's favour.

Talking to a group of newsmen at the Prime Minister secretariat, Aziz said the National Assembly session has been convened for November 7 while the federal cabinet will meet on November 6, reports The News. He said the National Assembly will adopt certain resolutions pertaining to the present situation in the country, including imposition of emergency. He said the federal cabinet will take stock of the situation, besides discussing legal and relevant aspects of the presidential election and other issues of national importance.

Her statement negated a government claim that a three-day detention notice was served on her by City Magistrate Rana Akbar Hayat, but she refused to receive it. She rejected President Musharraf’s announcement that the elections would be held before February 15, 2008 and demanded that the elections be held by January 15, 2008 as required by the Constitution. Strict security measures were taken in Islamabad and Rawalpindi to stop the PPP from holding a rally in defiance of a ban on public gatherings.

The Supreme Court on November 19 dismissed all petitions - except one which does not appear to be of much significance - which had been filed before the proclamation of the state of emergency to challenge General Pervez Musharraf’s eligibility to contest the election for presidential term, according to Dawn. These petitions were being heard earlier by an 11-judge bench, but most of its members stood deposed on November 3 after they refused to take the oath under the Provisional Constitution Order. The decision taken by a 10-member bench on November 19 leaves way for allowing the Election Commission to notify Gen. Musharraf’s re-election after the only pending petition is decided on November 22.

The Election Commission (EC) announced on November 20 that polling for the national and provincial assemblies would be held on January 8, 2008, according to Dawn. Chief Election Commissioner, Justice (retd) Qazi Mohammad Farooq, announced the schedule which in effect means the beginning of the seven-week election process with nomination papers to be filed from November 21 to 26. The scrutiny of the papers will take place from November 27 to December 3, appeals against acceptance or otherwise of the nomination papers may be filed by December 7 and decisions on such appeals will be taken by December 14. The nomination papers can be withdrawn by December 15 and the final list of candidates will be published on December 16. After the publication of the list, candidates will have 22 days of electioneering in accordance with a ‘code of conduct’ prepared by the EC.

The Election Commission of Pakistan on November 24 formally confirmed President General Pervez Musharraf's October 6 election for another five-year term by sending the return of election to the Cabinet Division. "The Chief Election Commissioner Justice (Retd) Qazi Muhammad Farooq has sent the return of presidential election to the Cabinet Division on Saturday," said the Commission's Secretary Kanwar Muhammad Dilshad while talking to The News. Former premier Nawaz Sharif returned to Pakistan on November 25 after eight years of exile and vowed to contest the general elections, Daily Times reported. Talking to the media after arriving in Lahore from Medina at 6.25pm (PST), he said all decisions regarding participation in elections would be made on the All Parties Democratic Movement (APDM)’s platform. He said the APDM would participate in the elections if General Pervez Musharraf withdrew the emergency declaration he issued on November 3 and released opposition members who had been jailed. “Everything that was done must be reversed and drawn back completely… You must have a level playing field for fair elections,” he said. He said the Pakistan Muslim League-Nawaz (PML-N) would never welcome ‘turncoats’, adding that he wanted to unite the PML and the PML-N. He said he had made no deal with President Musharraf. “I haven’t met any Pakistani government functionary over the last eight years, although there were a lot of overtures from the Pakistani side to meet me and to talk to me,” he claimed. On Gen. Musharraf, the former Prime Minister stated that “He is not a legitimate president of the country. I do not accept that, not at all.” He added that there was “no question” to him ever agreeing to a power-sharing deal with Gen Musharraf as president and himself as prime minister. A spokesman for Gen. Musharraf told CNN on November 25 that there was no agreement or understanding with Nawaz Sharif. Thousands of PML-N workers and leaders had earlier broken through police barricades at the airport and welcomed Nawaz Sharif and his family. Nawaz said the arrested PML-N workers were proof that he had no deal with General Musharraf.
