Janatha Vimukthi Peramuna (JVP) Central Committee Member and Attorney-at-Law Sunil Watagala, on January 2 said that rulers have lost ability to govern, reports The Island. He said that the Government has proved to be a failure and it should hold elections so that the people could elect a party or an alliance which could rescue the nation from the present crisis. He said that an election can be conducted after dissolving Parliament by passing a resolution with a simple majority under the 20th Amendment. He claimed 20th Amendment contained provisions enabling the dissolving of Parliament and the forming of a new government at a time like this.

The main Opposition Samagi Jana Balawegaya (SJB) on January 3 urged the Government to summon Parliament immediately to discuss the burning problems people were beset with, reports The Island. Addressing the media at the Opposition Leader’s Office in Colombo, Chief Opposition Whip Kandy District SJB MP Lakshman Kiriella said Parliament should be summoned without further delay as the country was facing massive foreign reserve crisis. “The government is trying to sell off national assets. Between 15 and 20 lands in Colombo are up for sale. Seven acres of prime land in Bogambara playground is to be sold. The government is trying to sell the Trincomalee oil tank farm. The agreements are to be signed while Parliament is closed. We need parliament open to debate the country’s problems,” Kiriella said.

Tamil National People’s Front (TNPF) on January 4 condemn the decision to involve Government representatives in the historic Jaffna Kite Festival, reports The Sunday Morning. In a media statement, the TNPF said that they condemn the decision taken to invite Government representatives and officials to the Jaffna Kite Festival as they claim that it is this same Government that is contributing to the erasure of Tamil culture and history. The TNPF has noted that this is a move to ‘destroy the Tamil tradition. The kite festival in Jaffna is an annual event, held in concurrence with the Thai Pongal festival every January. Hundreds of participants are usually seen at the event.

In a public statement, the Tamil National People's Front (TNFP) on January 9 demanded self-determination and opposed the 13th Amendment, reports Tamil Guardian. In their statement, the TNPF slammed the Tamil National Alliance (TNA) for its support of the 13th Amendment maintaining they were contravening decades of successive mandates of the Tamil nation. They further highlighted that the Provincial Councils were widely pilloried, rejected and boycotted by Tamil people, and considered not even a starting point to Tamil political aspirations of nationhood and self-determination. “We have dedicated ourselves to campaign to defeat the move to implement the 13th Amendment and Provincial Councils, and have commenced a campaign communicate to our people the grave dangers of the Provincial Councils” they conclude.

The main suspect involved in setting up a hand grenade inside the All-Saints’ Church in Borella of Colombo District was identified on January 12 as a 56-year-old who was associated with the church for nearly 16 years, reports Ada Derana. Following the discovery of the explosive material at around 4.40 p.m. on January 11, four suspects in total were taken into custody over the incident. According to the Police spokesman SSP Nihal Thalduwa, the hand grenade had been placed using sellotape, matchsticks, and incense sticks for it to catch fire and explode. Investigations have uncovered that the suspects had used a 13-year-old boy, who resides close to the church and frequents the premises, to place the hand grenade inside the church. Reportedly, the main suspect had been serving the church and residing at the premises over the past nine months. The investigators have managed to find parts of sellotape, matchsticks and incense sticks, which were used to set up the hand grenade, inside his living quarters. The Police are yet to uncover the reason for the suspect to place an explosive material inside the church, how he managed to obtain it and the individuals who aided and abetted him.

Human Rights Watch (HRW) in its World Report 2022 released on January 13 said that the Sri Lankan Government in 2021 suppressed minority communities, harassed activists, and undermined democratic institutions, reports The Island. It alleged that the Government of President Gotabaya Rajapaksa failed to carry out legal reforms promised to its international partners and blocked accountability for grave violations, including past war crimes. The Rajapaksa Government has disregarded its own pledges of reform and continued to target minority Tamils and Muslims. The Government uses the Prevention of Terrorism Act, the country’s long-abused counterterrorism law, and policies that threaten religious freedom and minority land rights. Human Rights Watch South Asia Director Meenakshi Ganguly said “President Gotabaya Rajapaksa seems determined to reverse past rights improvements and protect those implicated in serious abuses. While promising reforms and justice to deflate international criticism, his administration has stepped up suppression of minority communities.”

Whilst rejecting the information revealed by the Police on the recovering of a hand grenade at All Saints Church Borella in Colombo District on January 11, Archbishop of Colombo His Eminence Cardinal Malclom Ranjith at a press conference on January 13 called for a transparent probe on the incident, reports Daily Mirror. Cardinal Ranjith said “Police only viewed the CCTV footage in the church for some reason. The Sanchristian (caretaker) of the church was arrested only by viewing the video clips which were recorded after 3:00 pm on that day. I requested the parish priest to view the video clips recorded the whole day. It is revealed by the CCTV footage that a suspicious man enters the church and keeps something on the ground. Then he wears the traditional ‘sign of the cross’ which is a religious tradition practiced by the Catholics when entering the church and worshiping. However, this person does it in the wrong way. It could be concluded that through this man's action, he was not a catholic. Also, this person came in limping and when going back from the church he was walking in a stable manner. In such circumstances, we appeal to the police to conduct a proper investigation. One should not wear the uniforms if he cannot do his job in a proper manner.”

Inspector General of Police (IGP), C.D. Wickramaratne on January 14 said that the Police have recorded statements from 14 individuals with regard to the recent recovery of a hand grenade from inside All Saints’ Church in Borella of Colombo District, reports Ada Derana. The Police chief said the footage obtained from the CCTV at the church is used in this probe, which is still in its preliminary stages. The investigating officers are examining pieces of scientific, technical, exploratory and personal evidence with the assistance of experts in related fields, he added. A comprehensive investigation is being conducted to uncover the perpetrator who brought the explosive material into the church, the purpose of setting it up and those who aided and abetted him, IGP Wickramaratne stressed. The Police chief pledged to bring all those who are linked to the said incident to book without delay.

Defence Secretary General (Retd) Kamal Gunaratne on January 15 dismissing allegations made by the Colombo Archbishop on the Police investigations into the discovery of a hand grenade at the Borella All-Saints’ Church said that Criminal Investigation Department (CID) will conduct thorough probe into Church grenade incident, reports Daily News. Speaking to the media after meeting with Chief Prelates of Malwatta and Asgiriya Chapters, Defence Secretary Gunaratne said the CID has a good knowledge of the investigation and he hopes that they would conduct a proper investigation beyond the expectations of the Cardinal to capture the suspects and bring justice. DIG Tennakoon made this assertion before the three judges of the trial-at-bar giving evidence, led by Deputy solicitor General Dileepa Pieris. DIG Tennakoon further said that on the day the suicide attack took place he was on leave. Several Government institutions, including those set up under the reconciliation process of the previous Government, will be conducting two-day mobile clinics. The participating institutions include the Legal Aid Commission, Office for National Unity and Reconciliation (ONUR), Office for Reparations, Office on Missing Persons (OMP), Department of Debt Conciliation Board and the Vocational Training Authority, to mention some of them. Ian Seiderman, ICJ’s Legal and Policy Director said “The Government of Sri Lanka is once again scrambling to do its bare minimum ahead of another UN Human Rights Council session, in an attempt to deflect focus away from its failing human rights record. The petitioner seeks the apex court to declare that certain provisions of the proposed bill are unconstitutional and a two-thirds majority in Parliament and a referendum are required to pass any provisions. According to the petitioner, a number of clauses in the bill adversely affect fundamental rights against arrest, torture and detention and that those rights are being restricted.

In a media release issued on the briefing of the Diplomats on the Road Map of the HRCSL for 2022 held at the Human Rights Commission Headquarters, the Commission said it believes that the offence of terrorism should be included in the Penal Code with a new definition for terrorism. “It is explicitly for those who threaten or use violence unlawfully to target the civilian population by spreading fear thereof to further a political-ideological or religious cause. Addressing the UNHRC's 49th session in Geneva via video, Cardinal Ranjith also called on the UNHRC to help in devising a methodology to find out the truth behind the attack. He said although the attack, which killed 269 including 47 foreign nationals from 14 countries, was initially appeared to be the work of a group of Islamic extremists, but subsequent investigations revealed that it was part of a ‘grand political plot’. Speaker Mahinda Yapa Abeywardena informed Parliament March 8 that the Supreme Court (SC) has determined that several clauses in the Prevention of Terrorism Amendment (PTA) Bill are inconsistent with the Constitution and need to be amended before passing it as a law, reports Ceylon Today. The determination read out by Speaker Mahinda Yapa Abeywardena is as follows: Clause 2 of the Bill is not inconsistent with any provision of the constitution. Clause 3 of the Bill cannot be enacted into law unless the number of votes cast in favor amounts not less than 2/3 of the whole number of members, including those not present, as per the constitution. Clause 4 of the Bill, the SC states that be that as it may, the learned Additional Solicitor General had informed the court that the Attorney General would be advising the Minister to insert article 141 into the body of the proposed section 10 in Clause 4 of the Bill and the Minister would move that amendment at the Parliament Committee stage to address the concerns of the petitioners. Clause 5 of the Bill, for the reason mentioned in the determination of the SC, the SC holds that Clause 5 is not inconsistent with any provision of the constitution. Clause 6 of the Bill, the SC holds that it cannot inquire into pronounce upon or in any manner called into question, the validity of section 11 of the PTA on any grounds whatsoever, in terms of article 83 of the constitution. Clause 10 of the Bill, the Sc holds that if amended as set out in the determination of the SC would cease to be inconsistent with any provision of the constitution. Clause 11 of the Bill, the SC had stated that there is no basis to hold Clause 11 of the Bill is inconsistent with the constitution. Clause 12 of the Bill, the SC is of the view that proposed section 26 (2) of Clause 12 in that form would be inconsistent with article 12 (1) of the constitution.

The countries of the Global South have expressed support for the Government’s significant efforts towards reconciliation and reiterated the importance of objective and constructive cooperation as the fundamental basis for multilateral engagement. Of the 45 countries that spoke at the Interactive Dialogue, 31 spoke in support of Sri Lanka, the Foreign Ministry said. Sri Lanka received cross-regional support from a broad spectrum of states of South, South East and Central Asia and the African Group. The youths protesting at the Galle Face Green in Colombo say that there is no other solution to their struggle except the resignation of the President, and the whole Rajapaksa family including the Prime Minister in the government. The Prime Minister on April 13 said he hopes to discuss the views expressed by the protesters to overcome the current challenges faced by the country and invited them to hold discussions. The annual Country Reports on Human Rights Practices for 2021 said the Government took minimal steps to identify, investigate, prosecute, and punish officials who committed human rights abuses or corruption, and there was impunity for both. The US State Department’s Bureau of Democracy, Human Rights and Labor published its annual Country Reports on Human Rights Practices for 2021 and US Secretary of State Antony Blinken on April 12 released the report to the public. The Country Report said there were several reports that the Government or its agents committed arbitrary or unlawful killings and added that during the year there was no significant progress on cases against officials accused of arbitrary, unlawful, or politically motivated killings. Lack of accountability for conflict-era abuses persisted, particularly regarding Government officials, military, paramilitary, Police, and other security-sector officials implicated and, in some cases, convicted of killing political opponents, journalists, and private citizens. Civil society organizations asserted that the government and the courts were reluctant to act against security forces, citing high-level appointments of military officials credibly accused of abuses and pardons of convicted murderers. While there were no reports of disappearances by or on behalf of government authorities, disappearances during the war and its aftermath remained unresolved.

Speaking at a media at the JVP head office at Pelawatta JVP leader brought three main issues to the attention of the people. They are the resignation of the President, the resignation of the Prime Minister and the establishment of an interim Government and the holding of a general election shortly afterwards. The JVP leader said the two major crises in the country, the political crisis and the economic crisis do not seem to be moving forward toward any solution today. The Presidential Media Division further stated that the State of Emergency was imposed to protect the welfare of the country and to maintain essential services. The extraordinary gazette notification declaring the State of Emergency was issued by the Secretary to the President Gamini Senarath on the President’s command. The Gazette notification says the President is of opinion that by reason of a public emergency in Sri Lanka, it is expedient, so to declare emergency, in the interests of public security, the protection of public order and the maintenance of supplies and services essential to the life of the community. The President has declared the State of Emergency by virtue of the powers vested in him by Section 2 of the Public Security Ordinance (Chapter 40), as amended by Act, No. 8 of 1959, Law No. 6 of 1978 and Act, No. 28 of 1988. The provisions of Part II of that Ordinance, will come into operation throughout Sri Lanka with effect from May 6, 2022.

Thousands of Sri Lankans are participating in a hartal campaign and unprecedented action trade union by the workers island wide has disrupted services in many sectors including health, postal, transport and education. The Ceylon Teachers’ Service Union (CTSU) stated that due to the strike school activities will not be held today. Its General Secretary Mahinda Jayasinghe said that teachers and principals will not come to schools on May 6. Protests had also begun in several areas. The entrance to the Katunayake Export Processing Zone has been blocked at Averywatta Junction due to a protest initiated by the employees of the Katunayake Free Trade Zone. Transport sector unions stated that they had stopped operating trains and private buses since midnight yesterday in support of the Hartal movement. However, the Chairman of the Sri Lanka Transport Board (SLTB) Kingsley Ranawaka said all SLTB buses are operating today (May 6). Trade Unions of banks, Ceylon Electricity Board (CEB), SLTB, as well as teachers and principals, are also set to participate in the hartal. All Ceylon Government Medical Officers’ Association also stated that they would support the hartal campaign to be held on Friday (May 6). Due to this all the doctors in their union working in all the hospitals and offices except the cancer, maternity and pediatric hospitals will go on strike on that day. The President, addressing the Nation on May 11 evening in a televised speech said he is working to form a new government to control the current situation and to maintain the current state of affairs in order to prevent the country from becoming anarchic. “This week I am working to appoint a Prime Minister and a Cabinet of Ministers who will win the confidence of the majority in Parliament and can ensure the confidence of the people of the country,” he said. The President also said that after appointing the new Prime Minister and the cabinet he will work to move a constitutional amendment to re-enact the contents of the 19th Amendment in a manner that gives it more powers to the Parliament. “The new Prime Minister will be given the opportunity to present a new program and take the country forward,” he said. The President requested the public to support him to maintain the state mechanism without allowing to collapse. “At this critical juncture I request your support to continue the functioning of the state mechanism to protect the lives of the people and their property and to provide all the necessities for the people without allowing the country to collapse,” he appealed, adding, “Therefore, I earnestly urge all Sri Lankans to act peacefully and prudently at this juncture.”

Social activist Manuri Pabasari said that the people’s protest at Galle Face Green is a symbolic moment and has placed Sri Lanka on the world map. “Some claim that this struggle hasn’t gone to the outskirts of Colombo and that all people are not being represented here. But that’s not the case. We have discussed with member organizations and after a series of around eight meetings with around 60 other civil society organisations and after having debates and discussions with over 200 people we have listed a set of people-centric demands.” Some of the demands are as follows: 1.The Rajapaksa regime headed by President Gotabaya Rajapaksa must relinquish power immediately. Post resignation, the members of the regime should refrain from exerting any undue influence on the governance and rule of law in Sri Lanka. 2.An interim government must be established for a predetermined period (no greater than 18 months) to steer the nation onto the path of recovery. 3.Essential amendments to the Constitution to be enacted as soon as possible, such as the abolishment of the 20A. 4.The government must take urgent measures to manage the current crisis and all processes shall be transparent. The prevailing social, economic and political crises have transformed into a humanitarian crisis, therefore, short, medium, and long term solutions are required to resolve the prevailing crises at hand. 5.All elected and appointed officials should declare their assets and investigations should be carried out to apprehend and recover unlawfully acquired assets through lawful means. 6. Rule of law must be re-established immediately to respect the rights of all citizens and visitors to the country. 7. The PM has sent this letter in response to a letter sent by the two MPs stating that they would make a decision on supporting a future Government according to the action taken on eight demands, including the action to be taken inside and outside Parliament, to make Gota Go Gama demand of all the people a reality. The AG informed his stance to the apex court when the petitions filed against the 21st and 22nd Amendments were taken for hearing on May 26. The petitions seek the apex court to rule that some of the provisions contained in the private resolutions of the 21st and 22nd Amendments to the Constitution presented to Parliament by the General Secretary of the Samagi Jana Balawegaya (SJB) Ranjith Madduma Bandara and Minister Wijeyadasa Rajapakshe are unconstitutional and must be approved by a two-thirds majority in Parliament and a public referendum. The petitions seeking a verdict were taken up for hearing today (May 26) before a three-judge bench comprising Chief Justice Jayantha Jayasuriya, Justices Janak de Silva and Arjuna Obeysekera. In a special Statement by the Prime Minister Ranil Wickremesinghe, he said, “Today, the main issues in our country are not limited to the economic sphere. There are also two major issues in the political sphere. The re-introduction of the 19th Amendment is one of these issues. We, as party leaders, are now preparing the 21st Amendment in this regard. The second issue is to work towards the abolition of the Executive Presidency. The timing and methodology must be decided by the Party Leaders. The functioning of the Parliament has been paralyzed due to the weakening of the Parliamentary powers by the 20th Amendment. The Executive has been given more powers. The main allegation today is that the Parliament has not acted to prevent the economic crisis. There is an allegation that even though the ruling party had a majority in Parliament they neglected the work of the Parliament. Everything was systematically controlled by the Cabinet Ministers.” He further said, “Now we need to change the structure of Parliament and create a new system by combining the existing system of Parliament or the Westminster system and the system of State Councils. In those cases, Parliament can participate in governing the country”.

PM Wickremesinghe said he proposes to appoint four youth representatives to each of the 15 Committees of Parliament and the youth organizations can decide how to choose these representatives. “Through this work, young people will be able to learn about problems and provide solutions to them on their own. They will be able to contest elections if they wish to do so,” the Prime Minister said. Meanwhile, United National Party (UNP) General Secretary Palitha Rangebandara says that success cannot be achieved without winning over the youth community. He points out that whenever the confidence of the youth could not be won, there were political and social breakdowns in the country. Rangebandara said the youth are by nature protesters and their behavior could not be described as unjust and unfair. "Currently, there is a comprehensive program in place to strengthen Parliament. The Prime Minister's aim is to build that structure by passing the 21st Amendment. This is not a person's process. This is a comprehensive program for the country. However, in this process about 15 Committees will be established in Parliament. The Prime Minister has proposed to give youth representation to these committees. The Janatha Vimukthi Peramuna-led National People’s Power (NPP) has presented a set of proposals to be considered for the 21st Amendment to the Constitution, reports Daily News on June 9. NPP, Member of Parliament (MP), Vijitha Herath has written to Justice Minister Dr. Wijeyadasa Rajapakshe explaining the Party’s 9-point proposal. Under these proposals, Parliamentarians will be unseated from their seats if they leave the Party they were elected to Parliament. The NPP has also underlined that the President should not hold any Cabinet portfolio and that Cabinet should be limited to 25. The number of Deputy Ministers should also be 25, and there should not be any other ministerial portfolios, including State Ministries. The number of Cabinet Ministers should not be increased when a National Government is formed. The portfolios of the Ministries and their subjects should be included in the Constitution. There should be provisions to create new Ministries based on contemporary and future requirements. The NPP has also fixed a maximum age of 70 for candidates contesting the Parliamentary Election. It has stated that the Ninth Parliament should be dissolved within six months of the enforcement of the 21st Amendment.

"We are not insisting that an election should be held but it should be considered if that is the only option available," Harsha said. "Some people hold a wrong idea about finding funds for a general election. However, Vérité Research Pvt Ltd has revealed that only Rs 5.7 billion has been spent for the 2020 general election even with the COVID 19 safety protocol. However, a sum of Rs 19.1 billion has been allocated for ministry of defence construction projects in 2022 while Rs.12 billion is allocated for Defense Headquarters in 2022. These funds could be used if an election is held," he added. "We propose forming of a proper multi party government for a short period and then one could hold a general election. The relevant proposal was presented to the Cabinet by the Minister of Justice, Prison Reforms and Constitutional Affairs, Dr. Wijeyadasa Rajapakshe, and accordingly, the Cabinet has decided to present the relevant draft Bill to Parliament expeditiously. Participating in an international panel discussion focused on "Preventing Global Hunger and Famine", Sri Lanka’s Acting President Ranil Wickremesinghe said the island nation’s political turmoil is a result of the global food shortage and fuel crisis brought on by the Russia- Ukraine war, reports Colombo Page on July 17. “The issues we have in Sri Lanka regarding hunger is partly self-made and partly due to external events. A global crisis and an internal crisis both have come together and brought us to a level where many estimate that as much as 6 million people are facing malnutrition,” he said, adding, “First reason is the ban on chemical fertilizer and that has caused severely. We have grown 24 million metric tons of rice every year and we were self-sufficient. Today as a result of not using chemical fertilizer the output is about 16 million MT. One-third of our requirements have to be met from abroad at a time when the country does not have foreign exchange to meet these demands.” Acting President Wickremesinghe said the shortage of 800,000 MT of rice makes a difference between hunger and living comfortably. At the moment Sri Lanka has rice sufficient for eight months and for the next four months the government has to put in other substitutes. The government is planning a food security program and also preparing for the long season of paddy cultivation, which begins in September. “If we can provide fertilizer and seed for the 2023 Maha season then we can be self-sufficient in rice and get the real economy functioning as far as agriculture is concerned.”

The members of Sri Lanka Parliament, on July 20, voted to elect acting President and Leader of the United National Party (UNP), Ranil Wickremesinghe as the 8th Executive President of Sri Lanka, reports Colombo Page. The Secretary-General of Parliament Dhammika Dassanayake announced to the House that Ranil Wickremesinghe has been elected as the Succeeding President by Parliament by a majority vote. The returning officer Secretary-General of parliament Dassanayake announced that 223 members of Parliament voted for the three candidates Acting President Ranil Wickremesinghe, Member of Parliament (MP), Dullas Alahapperuma and MP, Anura Kumara Dissanayake, while two MPs abstained from voting. Four votes were considered invalid. Wickremesinghe received 134 votes against the 82 votes received by Dullas Alahapperuma. The Leader of National People’s Power Anura Kumara Dissanayake received 3 votes. Accepting the Presidency, UNP leader thanked the MPs who supported him as well as the MPs who participated in the democratic process.

An Extraordinary Gazette has been issued by President Ranil Wickremesinghe calling in all the members of the Armed Forces to maintain public order island-wide, reports Colombo Page on July 22. The notification was issued on July 21 by the President in accordance with the Public Security Ordinance. The order covering the entire island and its territorial waters will be effective from July 22 (today). “By virtue of the powers vested in me by Section 12 of the Public Security Ordinance (Chapter 40), I, Ranil Wickremesinghe, President, do by this order call out with effect from July 22, 2022 all the members of the Armed Forces specified in the First Schedule hereto, for the maintenance of public order in the areas specified in the Second Schedule hereto,” the gazette notification said.

The President expressed this stance to the Colombo based Diplomats on the removal of the protesters who had been illegally occupying the Presidential Secretariat at a meeting held on July 22. President Wickremesinghe stated that both Article 21 of the International Covenant on Civil and Political Rights, and Article 14 (1)(b) of the Constitution of Sri Lanka, which governs the rights of peaceful assembly, would be upheld by the Government. The President further explained that the instructions given by the American Civil Liberties Union stated that protesters were not permitted to block government buildings and interfere with other purposes the property was designed for.

NFF Leader Member of Parliament (MP), Wimal Weerawansa in a letter to the President Ranil Wickremesinghe says that a program according to a strategic approach as well as the presentation of a road map to the country with common agreement of all parties can gain public confidence. Responding to the President’s request to all parties to jointly implement a national all-party program to create economic and social stability, Weerawansa said an all-party conference is important to gain public confidence by presenting the vision, strategic plan and accordingly the program as well as a road map to the country with common agreement. It will also be important to neutralize the political weapon in the hands of fake protesters or imperialist operatives, the NFF leader said. The person who was hacked to death at Mattakkuliya on November 28 had conducted Undial transactions to India and Dubai with drug smugglers for money laundering purposes, Police investigations have revealed, reports Daily News. The Colombo Crime Division (CCD) had arrested this person and his brother last year for conducting an Undial transaction with Rs.5 million of cash owned by notorious drug smuggler Panadura Kudu Salindu. A court case in this regard was going on by the time of his death and the Criminal Investigation Department (CID) was also conducting another investigation against him on the charges of money laundering, Police sources said. He was hacked to death by a group of unidentified persons while he was on his way back home from the court on November 28.
