A terrorist of the Jaish-e-Mohammed (JeM) was killed in encounter at Sardhar outpost, 28 kilometers from Rajkot, on December 7. The incident took place when the terrorist, who was arrested, attempted to escape by snatching a security force personnel’s gun and opening fire. In the retaliatory firing, the arrested terrorist was killed. Earlier, during preliminary questioning he had reportedly revealed that the JeM was responsible for smuggling in RDX and arms seized by the Central Bureau of Investigation (CBI) from Patan in October 2001. The Patan case was the third instance of RDX smuggling by the JeM in the State, he reportedly revealed.

Based on intelligence information, security forces (SFs) laid an ambush at Sogam in Kupwara district on December 8, anticipating the movement of terrorists in the area. Later, after the presence of some terrorists was discovered, SFs engaged them in an encounter killing all four terrorists. Two of them have been identified as Pakistani mercenaries while the others were Kashmiris. Each belonged to a different outfit and included a ‘district commander’ of the Al Badr. The others were from the Tehreek-ul-Mujahideen (TuM), Jaish-e-Mohammad (JeM) and Harkat-ul-Mujahideen (HuM).

In Poonch district, a group of terrorists attempting to infiltrate through the Shahpur sector of the Line of Control (LoC) were intercepted by security forces (SFs) on December 10. In the encounter that followed at Barhut, four suspected foreign mercenaries of the Jaish-e-Mohammed (JeM) were killed. In the same district, an SF officer was killed when a patrol party was ambushed by unidentified terrorists at Harni. The terrorists managed to escape after the ambush. In a third incident in the district, five JeM terrorists, including three Pakistani mercenaries, were killed in an encounter at Tola Mumtaz. SFs are yet to identify two of the slain terrorists.

An unconfirmed news report from Kashmir on December 13, citing an intercepted wireless messages from a Pakistan based Jaish-e-Mohammed ‘commander’ to his cadre in Kashmir, said the outfit’s members were responsible for the attack. It has been learnt from the intercepts that six JeM suicide terrorists, fidayeen, were involved in the attack on Parliament of which, four were residents of New Delhi. The intercepts also claimed that while four fidayeen were killed, one managed to escape and another was missing. The ‘commander’ added, in his wireless message, that he had received the information from his Delhi based cadre on telephone.

Security agencies arrested six persons on December 14 in connection with the terrorist attack. Media reports quoting official sources said, a Delhi-based academic was arrested from his residence following investigations and was being questioned by joint team of various intelligence agencies on the details of mobile phones found in the bags of five slain terrorists. The intelligence agencies also reportedly laid their hands on intercepts of communication between the academic and terrorists and between the terrorists and the Jaish-e-Mohammed (JeM) headquarters in the days just preceding the attack. Five others were arrested from Prashant Vihar area. Two more persons, said to be Pakistani nationals, were also reportedly picked up from a New Delhi hotel minutes before they were to depart for Cananda and the United States.

He said all the five terrorists were Pakistani nationals and were acting under the guidance of Ghazi Baba, the JeM’s India commander. Ghazi Baba had authorised Mohammed to do plan the attack and report to him. Baba reportedly told Mohammed, "We have not achieved much in Kashmir in the last ten years. So now we have to attack Delhi to get results". Afzal said the attackers had instructions to kill Members of Parliament (MP) and ‘whoever comes their way’ in order to reach Parliament. According to Afzal, the terrorists did a reconnaissance of Delhi Assembly and the diplomatic enclave in Chankya Puri. "But their ultimate target was Parliament. When I returned to Srinagar, Ghazi Baba told me to convey to Mohammed that without wasting time he should focus on his target. I asked Mohammed who is the target, he told me that Indian Parliament is the ultimate target," he added. According to Afzal, Mohammed was the same man who had hijacked the Indian Airlines flight IC-814 to Kandahar in December 1999.

According to media reports, a group of unidentified terrorists appeared at Poshkreeri village, in Anantnag, and opened indiscriminate gunfire on a cluster of houses. Members of the minority Sikh community have been living in these houses, protected by police. Three women were killed in this incident. Around the same time, another group of unidentified terrorists attacked a cluster of houses occupied by the minority Hindu community in the adjacent Hugam village. One woman was killed while two of her daughters were injured in this incident. A police personnel was also injured in the same incident. Security force personnel have launched a combing operation in the area to arrest the terrorists. Ministry of External Affairs spokesperson Nirupama Rao, while speaking to the media, said the LeT was saying that it was moving towards Kashmir. "It clearly shows they have not abandoned their ways and not decided to abstain from further acts of terrorism against India", she said, adding that Pakistan’s assertion "does not seem to go far enough to address our (India’s) concerns". Speaking on the same issue, External Affairs Minister Jaswant Singh, said, "I must make it clear that a kind of trickery, that is simply changing names, shifting headquarters from one part of Pakistan to another or to indulge in cosmetic seizure of assets is really to make a mockery of the gravity of the situation and the enormity of the issues that we confront". Reports said the Mumbai police suspect that a former scientist with the Indian Space Research Organisation (ISRO), IS Mudaliar, and his associate Umang Dave, a software engineer, are linked with terrorist outfits such as the Lashkar-e-Toiba (LeT), the Jaish-e-Mohammed (JeM) and the Al Qaeda. They were arrested on October 31 from Ahmedabad for allegedly sending a threatening e-mail to the Department of Atomic Energy (DAE), earlier on September 21, 2001. Police sources said Mudaliar sent the threatening e-mail to the DAE stating that it was from the LeT. The e-mail said, all the important government installations would be attacked in the next seven days. The police have been trying to establish the Internet link of the accused with terrorists, but sources admitted they had not found any clinching evidence, though they had checked the e-mail correspondence of the accused. Both the arrested persons have been charged with sedition under section 124 of the Indian Penal Code (IPC).

US Secretary of State Colin Powell said in Washington that he had added the two Pakistan-based outfits to the State Department's terrorism blacklist. Powell said he was designating the LeT and the JeM as foreign terrorist organisations under US law. He said in a statement that the move was "another important step in our campaign to eliminate the scourge of terrorism." He added, "These groups, which claim to be supporting the people of Kashmir have conducted numerous terrorist attacks in India and Pakistan." He further said, "The United States looks forward to working with the governments of both India and Pakistan to shut these groups down." The designation of both groups as terrorist outfits makes it illegal for supporters in the United States to provide them with material support and requires US financial institutions to block their assets. US authorities are also authorised to deny visas to group members. Another outfit active in Jammu and Kashmir, the Harkat-ul-Mujahideen (HuM), is already on the US list of designated terrorist outfits.
