In third major arrest in Delhi High Court blast case (September 7, 2011), the National Investigating Agency (NIA) on October 7 arrested a Kashmiri youth, who was pursuing studies at Dhaka in Bangladesh from New Delhi soon after he alighted from a flight at IGI airport in the capital. The arrestee, identified as Wasim Akram Malik, a resident of Kishtwar District in Jammu and Kashmir was arrested following clues gathered during investigations by the NIA that he was a key conspirator in the blast along with his brother, Junaid Akram Malik, a ‘commander’ of the militant outfit Hizb-ul-Mujahideen, who was absconding.

The National Investigation Agency (NIA) has launched a manhunt to trace Kashmiri medical student Wasim Akram Malik's younger brother Junaid Akram, a Hizb-ul-Mujahideen (HM) militant , for his direct involvement in the Delhi High Court blast on September 7, according to The Times of India. The agency had arrested Wasim on October 7. The NIA has sensitized all the States, border forces and immigration authorities as intelligence inputs suggest that Junaid, who has been missing since November last year, is in India and may try to sneak out of the country following Wasim's arrest.

A HM militant, identified as Azad Hussain (code name Waseem), was eliminated in Marmat area of Doda District on October 9. Sources said the militant lobbed two grenades towards Army and police after observing their movement to prevent them from advancing towards his hideout. SFs had a narrow escape in the grenade blasts. Police claimed that with the killing of Hussain, a Pakistan trained militant surviving since 1998, Doda District has been free of militancy now. "With the killing of Waseem, Doda District is free of militancy. However, some of the militants from Doda were camping in Pakistan and PoK or other parts of the State’’, Police official said. Recoveries made from the site of encounter included one 7.62 mm Chinese pistol, two pistol magazines, 11 rounds and one FM radio set.

At least two to three Harkat-ul-Jehad Islami (HuJI) militants of Bangladesh were reported to have visited Kishtwar, Jammu and New Delhi prior to September 7 blast outside Delhi High Court along with Wasim Akram Malik alias ‘Doctor Sahib’, who was arrested in New Delhi on October 7 by the National Investigating Agency (NIA). A NIA team camping in Kishtwar is understood to have shared names of three militants with local police, who were wanted in connection with the Delhi blast from Kishtwar. They included Junaid Akram Malik, younger brother of Wasim and a ‘commander’ of HM, Aamir Kamaal alias Akram and Jehangir Saroori.

The Security Forces (SFs) on October 9 killed two Hizb-ul-Mujahideen (HM) militants in the forests of Kangan in Ganderbal District, reports Daily Excelsior. Identify of the two militants whose aliases were Obaid and Tahla could not be ascertained. The Superintendent of Police (Ganderbal) Shahid Mehraj said that SFs after receiving information about the presence of militants in the area launched an operation. After the family members were rescued from the house in which the militants had taken shelter, the operation against the two hold up militants was launched. The house caught fire during which the bodies of both the militants were charred. SF recovered two bodies, an AK 47 rifle, six magazines and one pistol from the debris of the house. Earlier, the SFs had heard a radio communication between two holed up militants and their handlers across the Line of Control (LoC) in Pashto, a language spoken in Afghanistan and Federally Administered Tribal Areas (FATA) of Pakistan. SFs are ascertaining the nationality of the two deceased militants but sources said they might be from the group of Taliban who surrendered in Swat Valley two years ago after Pakistani army launched a major offensive against them.

With increase in the presence of militants across the Line of Control (LoC), the Army has deployed additional troops in priority areas to counter infiltration in the State ahead of snowfall, reports Daily Excelsior. "According to Intelligence reports, strength of militants across (the LoC) has crossed all proportions. At present, opposite Shamsabari (range) and Uri, there are 600 militants," said General Officer Commanding (GOC) of Srinagar-based 15 Corps Lieutenant General Syed Ata Hasnain on October 11. He added, "Attempts will be made everywhere. There is a window of two months before winter. This is a dangerous window." However, he said, the counter-infiltration grid has been redoubled to meet the challenge of infiltration putting the number of militants killed this year 80. He said 30 to 40 militants have managed to infiltrate. He said forces have an opportunity to "break the back of militancy" in the State as 19 top militant ‘commanders’ of Lashkar-e-Toiba (LeT) and Hizb-ul-Mujahideen (HM) have been killed so far this year. "There is a realisation that 2011 is an important year. We can actually break the back of militancy this year... If they cannot bring militants in (to Kashmir) by next year, I can assure you we have turned the tables in Kashmir," he added. IBN Live reports Chief Minister Omar Abdullah has asked the Union Home Minister not to plan Armed Forces Special Powers Act (AFSPA) withdrawal from entire state, but from sections where army is no longer required. "Would want Disturbed Areas Act [DAA] and AFSPA to go," said Abdullah. "We have to see the areas where the footprints of Army was minimal and then go for revocation of DAA and subsequently AFSPA'', Omar said, adds Daily Excelsior.

Security Forces (SFs) in an ongoing operation eliminated Hizb-ul-Mujahideen (HM) ‘district commander’, Mushtaq Khan alias Mushtaq Janghi alias Mushtaq Killer, in an operation in Gutlibagh forests of Ganderbal District on October 12, reports Daily Excelsior. An associate of Mushtaq Killer was also killed in the encounter but he has not been identified as yet. Another fleeing militant, identified as Muzaffar, was arrested by the SFs. He was recently recruited by Mushtaq Killer. Two AK 47 rifles, four AK magazines and one Chinese grenade were recovered from the killed militants. Operating in Ganderbal for past 13 years, Mushtaq, an A++category militant carrying a cash reward of INR 1 million on his head, was nick named as "Killer" after he allegedly killed around 40 civilians in Ganderbal area. Of late, he had started recruiting youth into HM ranks.

The GOC said that Mushtaq was involved in the killing of 31 civilians and was longest surviving militant in Kashmir. The GOC further said that there are 7-8 militants still operating in the Ganderbal District. He said that the recently killed Pashto speaking militants were from Pakistan and not Afghanistan. The arrestee identified as Muzaffar Ahmad Mir revealed that he had acted on the behest of the LeT ‘operational commander’ Furqan based in Pakistan occupied Kashmir (PoK) who had directed him to kill Policeman in and around Hazratbal in order to unnerve the Jammu and Kashmir Police, who are on the forefront of fighting militancy in the State and have killed the top ‘commanders’ of LeT in recent months. He also revealed that Furqan directed him to choose Policemen who are without arms in busy markets. "He also revealed that the pistol was delivered to him by LeT militant operating from Sopore Muza Molvi. Muzaffar Mir is also a close associate of slain LeT ‘commander’ Abdul Rehman", Police said. According to estimates available, there is hardly over two dozen active militants left in HM, the biggest indigenous militant group ever in Kashmir. The National Investigating Agency (NIA), investigating the September 7 Delhi blast, seized five mobile telephones of Wasim Akram Malik, a Medical student, his two relatives and two associates from Kishtwar and Jammu but another mobile telephone and a laptop used by him at Dhaka, Bangladesh remained untraced, reports Daily Excelsior. Two other seized mobile telephones belonged to Abid Hussain and Hafiz Aamir Abbas Dev, two Kishtwar students, who have already been arrested by the NIA in connection with Delhi blast and terror emails sent thereafter. Abid and Dev were arrested from Kishtwar while Wasim was arrested from IGI Airport, New Delhi soon after he landed in the capital from Dhaka. Three more accused in the blast—Junaid Akram Malik, brother of Wasim, a Medical student at Dhaka, Aamir Malik alias Akram and Jehangir Saroori, all three HM militants—were on hit list of the NIA but they couldn’t be traced. Police and NIA had reports that Aamir Malik and Saroori had left for inaccessible heights of Kishtwar while there were doubts over the movement of Junaid, who could be anywhere. The recovery of three mobile phones and some documents related to exchange of money indicates involvement of Jaish-e-Mohammed (JeM) in the terror attack.

"I appeal to both factions of Hurriyat Conference and other separatists groups to remain away from bilateral dialogue process with New Delhi. As Government of India was never sincere to solve Kashmir through dialogue," he was quoted as saying. He advised the separatist forces in the State to unite. "Re-unification of Hurriyat has become inevitable in the larger interests of the movement. We will continue our efforts to see Hurriyat becoming one again," he added. While probing the Delhi High Court blast case (September 7, 2011), the National Investigation Agency (NIA) has seized three mobile phones and some documents, including papers relating to money transaction, from residence of one of the accused Wasim Ahmed Malik in Jammu and Kishtwar Districts in Jammu and Kashmir, The Times of India reported. According to NIA officials these seizures could lead them to the culprits who had planted the bomb. Meanwhile interrogation of Wasim threw conflicting versions before them about the involvement of terror group. The accused is learnt to have told the NIA that the blast was carried out by someone who is associated with Jaish-e-Mohammed (JeM), contradicting his earlier version when he had told them about his associates' linkages to Hizb-ul-Mujahideen (HM) and Harkat-ul-Jihad-al-Islami (HuJI). Close coordination of all these groups at different levels in carrying out the blast is, however, not ruled out by the investigators.

"We take our own decisions here and dictations are not taken by us," he said while reacting to Salah-ud-Din's statement. Geelani said his Hurriyat faction would accept the Centre's talks offer only after a formal invitation. "The talks offer in that case will be discussed in the advisory council of (his Hurriyat faction),'' he told reporters. The National Investigation Agency (NIA) disclosed for the first time terror outfit HM’s role in the September 7, 2011 Delhi High Court Blast incident and issued a 'wanted' notice for three of its cadre - all residents of Kishtwar, reports Times of India. Through the notice, it sought public help to trace them, saying they played a "crucial role" in the conspiracy. The fugitives include 19-year-old Junaid Akram Malik, younger brother of Wasim Akram Malik, Shakir Hussain Sheikh alias Chota Hafiz (26) and Amir Ali Kamal (25). Wasim, a medical student in Bangladesh, is presently in NIA custody in Delhi. While Sheikh has been active in the Kashmir Valley since 2005, Kamal has been operating since 2008. The NIA also announced a cash reward of INR 1 million each for any information leading to their arrest. The agency also said that the three were involved in "several terrorist related cases in Kishtwar region". Sources said the names of these three HM terrorists had first surfaced during the questioning of the outfit's over ground cadre Azhar Ali, who is presently in Kotbalwal jail in Jammu for his alleged role as 'financier' and 'recruiter' for the terror group. It was subsequently corroborated by Wasim who was arrested by the NIA.

According to sources, Wasim identified the two DHC bombers as Saifullah and Bilal, both Lahore residents. Although Wasim feigned ignorance about the affiliations of the two bombers with terror groups, the National Investigative Agency (NIA) team and the Jammu & Kashmir (J&K) Police handling the case suspect that the two could be linked with either Lashkar-e-Toiba (LeT) or Jaish-e-Mohammed (JeM). Sources said that the chief conspirator was encouraged by the lax security arrangements at the HC. Leaders of the groups, including Muttahida Jihad Council chairman Syed Salahuddin, told a gathering of hundreds of supporters at Aabpara Chowk in Islamabad about their movement to "liberate" Jammu and Kashmir. "We will continue our struggle on the political, diplomatic and, most important of all, jihadi fronts till the last Indian soldier leaves Kashmir. We will continue till Jammu and Kashmir becomes independent," said Salahuddin, who is also the chief of the Hizb-ul-Mujahideen. A spokesman who addressed the gathering on behalf of LeT ‘commander’ Iftikhar Haider said his group would take "revenge" for the killing of Muslims in Gujarat in 2002 and the 2007 bombing of the Samjhauta Express cross-border train. "The relationship between Pakistan and India is one of guns and bullets, not of trade," the LeT spokesman said while opposing the granting of MFN-status to India by Pakistan. The gathering was held in a market located less than two kilometres from the headquarters of the Inter-Services Intelligence (ISI) in the heart of Islamabad. Jihadi leaders, including Salahuddin and Al Badr Mujahideen leader Bakht Zameen, too opposed Pakistan’s decision in principle to grant MFN-status to India.
