A couple was injured when Pakistani Rangers directly targeted the civilians violating ceasefire on the International Border at forward village of Chalariyan near Chechwal in Samba sector of Samba District in the afternoon of October 1, reports Daily Excelsior. Official sources said that Pakistani Rangers started firing at 5.15pm targeting civilians, who were working in their fields in the forward areas. Two persons were injured in the firing. The Border Security Force (BSF) retaliated after which firing stopped from Pakistan side.

The Kashmir Valley's Urdu dailies carried advertisements of 40-odd panches (member of Panchayat) and sarpanches (head of Panchayat) in which they announced that they had resigned after a series of attacks on the village officials in the Valley. "We, the elected panches and sarpanches of halqa Hardozanam Rafiabad (Baramulla), announce our resignation and we won't have any affiliation with any political party to join the election process," read the advertisement issued by the sarpanches.

Security Forces (SFs) killed five militants belonging to Hizb-ul-Mujahideen (HM) in Ganderbal District on October 1, reports Daily Excelsior. Ganderbal Superintendent of Police (SP), Shahid Meraj, said that four out of five were identified as Abu Bakar, Abu Khalid, Murtaza and Abdul Gazi. "The identification of fifth one is being ascertained. The group belonged to Hizb-ul-Mujehieen and all its members were foreigners", he added. He said that five AK 47 rifles, 15 magazines, 2UBGLs and scores of bullets were recovered from encounter site.

Police busted a Lashkar-e-Toiba (LeT) module in the Budgam District by arresting six militants, reports Daily Excelsior reported on October 2. The arrestees, identified as Zahoor Ahmad Khan alias Zubair, Barkat Ahmad Malik alias Abu Talha, Assadullah Dar alias Assad, Aijaz Ahmad Dar alias Imran, Rouf Ahmad Dar alias Rafeeq and Farooq Ahmad Mir, as per investigations, were found involved in the burning of Baba Hanief-ud-din shrine at Ratsuna in Beeru on July 15, 2012, and a Masjid (mosque) in Narbal Magam, both in Budgam District. Police said Farooq Ahmad Mir confessed before the Budgam Judicial Magistrate that he was directed by the LeT militants in Pakistan to burn the religious places to ignite an agitation like that of 2010. Mir had travelled to Pakistan's Faisalabad in early 2012 and met LeT men there. His travel was facilitated by Zahoor Ahmed of Arth of Budgam District, Police added. Mir told his interrogators that the LeT militant Waleed (in Pakistan), wanted to start an agitation similar to that in 2010 by targeting Masjids and Shrines in Kashmir valley. On Mir’s tip-off, five others were arrested and they are being interrogated.

The Jammu and Kashmir (J&K) Government on October 3 said that at least 117 Kashmiris have returned home from Pakistan via Nepal in last three years in the wake of ‘rehabilitation policy’ announced by the State Government, reports Kashmir Watch. In a written reply to the State Assembly, Chief Minister Omar Abdullah, who is also Minister in-charge Home, said out of these 117 persons, 34 have brought their families along with them. As reported earlier, the State Government had announced the ‘rehabilitation policy’ in November 2010 for the youth who had crossed over to Pakistan occupied Kashmir (PoK) from 1989 to 2010 for arms training and now want to return home after abjuring violence. Daily Excelsior reported that Chief Electoral Officer (CEO) Umang Narula, the Election Authority under Panchayati Raj Act announced election to the posts of chairpersons of 143 Block Development Councils (BDCs), including 77 in Kashmir Valley and 66 in Jammu region, which would be held on November 7. Counting of the votes shall start immediately after the elections and results will be declared by the evening. The elections will be held on non-party basis, like the Panchayat elections. This is going to be the first ever elections to the BDCs. The Electoral College for the BDCs comprised 33,500 Sarpanches and Panches. Out of a total of 4098 Sarpanches, 2145 were in Kashmir division and 1953 in Jammu division while out of 29,402 Panches, 15,767 were in Kashmir divisional and 13,635 in Jammu division.

Principal Sessions Judge (Jammu), Jang Bahadur Singh Jamwal on October 4 acquitted alleged militant of Khalistan Zindabad Force (KZF) as prosecution failed to prove its case, Daily Excelsior reported. According to the Police case, KZF militant, Tej Paul Singh, was arrested by Gandhi Nagar Police (Jammu) as soon as he entered the State for carrying out terrorist activities. During interrogation, he disclosed that he had kept concealed AK 56 rifle, five magazine, 109 cartridges in his house. Accordingly, the arms and ammunition were recovered and after completion of investigation challan was presented in the Court of law. After hearing both the sides, Principal Sessions Judge observed, "There is no evidence on record to connect the accused with the commission of offences and the prosecution has failed to prove its case", the Court observed and acquitted the accused of the charges leveled against him.

General Officer Commanding (GOC) of Baramulla based 19th Division of Army, Bipin Rawat, said that the Army has started day as well as night patrolling in Baramulla District. He added that the night patrolling was stopped in the District after the improvement in the situation but now recent killing and insecurity has forced SFs to sanitize these areas. "We shall make sure that there are no untoward incidents during the conduct of polls to 143 Councils in the State and all the Panches (member of Panchayat, village level local self Government institution), Sarpanches (head of Panchayat) are able to exercise their franchise without any trouble", he said. The 143 BDCs included 77 in Kashmir valley and 66 in Jammu region. "The State Government had also successfully completed the Panchayat polls in July, 2011 despite militants' threat and the polling percentage was more than 80%. Therefore, there is no doubt that we shall be able to conduct the polls for electing this second tier of Panchayati Raj System without any difficulty", he added. As per the latest rolls, the Electoral College for the BDC polls comprised 29402 Panches and 4098 Sarpanches in the State. Out of a total of 4098 Sarpanches, 2145 were in Kashmir division and 1953 in Jammu division while out of 29,402 Panches, 15,767 were in Kashmir division and 13,635 in Jammu division. This would be the second tier of the Panchayats after the election of Panches and Sarpanches. The elections will be held on non-party basis, like the Panchayat elections. The chairperson of these BDC would be the members of the District Development Boards.

"As per the inputs furnished by the concerned District Development Commissioners, 2,305 persons have been declared missing," Abdullah said in a written reply to a question in the State Legislative Assembly. Omar also said FIRs have been registered in 182 cases while "missing reports" have been lodged in most of the remaining cases. He said all out efforts are being by the concerned agencies to trace the missing persons. On the setting up of Truth and Reconciliation Commission, Omar said he had shared the idea of having such a commission with the House during the Budget session of the Assembly in 2011. I think the situation has dramatically improved over the last two years. It’s still some way to go and I think the State Government must address the issue of law and order very firmly. Only a very small section continues to talk about secession and freedom and that kind of thing. There is no resonance for that among the people... The people are looking to jobs, to investment, to growth, to opportunities, to goods and to services… I agree that more investment should flow into Jammu and Kashmir." Zee News reported that 2916 youth, almost half of them hailing from different areas of Srinagar, got employment in Police during 16 special recruitment rallies conducted since 2010. Chief Minister Omar Abdullah informed the State Legislative Assembly, "As many as 2,916 youth were recruited as constables during the recruitment drives conducted in Police department since 2010." As per the information, the highest number of 1,378 youths were recruited in the seven recruitment rallies conducted in the different constituencies of Srinagar between January 12, 2011, to May 6, 2012. Four more such drives were conducted at Akhnoor, Nagrota, Reasi and Udhampur in Jammu region in 2012, recruiting a total of 494 youth in the Police department. The special recruitment drives at the level of constables are being conducted in the Police department, pursuant to the cabinet decision taken on December 4, 2009. As per the cabinet decision, the State Police would undertake special recruitment drives in the under-represented areas in the state, for completing the recruitment process at the level of constabulary in the time bound manner.

Police have come across with revelations made by three militants, including a woman from Pakistan occupied Kashmir (PoK), who had returned from Pakistan via Nepal, that they had been plotting to target Baglihar hydro-electric power project at Chanderkoot in Ramban District. Official sources said that three militants, who have been charged with plot to target Baglihar project, were Ghulam Ali alias Muzammil, Seeraj Ahmad alias Shakeer and Faizal, originally a resident of Jamaan Chanka in Mansera area of PoK, presently putting up at Shopian with Shakeer. The plot to target Baglihar project was hatched in PoK by top Lashkar-e-Toiba (LeT) ‘commander’ Abu Faraar with the help of Pakistan Army and Inter-Services Intelligence (ISI). All three militants including the PoK woman had been sent to India with the purpose of executing the plot along with their other associates. They had been assured that some officials posted in Baglihar project would also assist them. Sources said all three were provided with passports and visa to fly to Kathmandu in Nepal from Karachi in Pakistan by the Army and ISI officials. On reaching Kathmandu, the militants traveled to Uttar Pradesh from Nepal border and boarded a train to reach Jammu Railway Station, where they were arrested by a team of Shopian Police, which had developed prior information of the militants’ movement.

The Jammu and Kashmir Government said that 824 youth who were reported missing have joined the militant ranks, Hindustan Times reported. In a written reply to the State Legislative Council, the Government said on October 9 that 123 persons have returned from Pakistan occupied Kashmir (PoK) from Nepal and other routes in the wake of the Government’s rehabilitation policy. “Of 123 persons who returned, 90 have brought their families along with them,” said the Government report, which declined to disclose any details of such persons. The Government confirmed that it received 1,082 application from youth stuck in PoK who intended to return. “The security agencies have cleared 219 cases so far and the rest of the requests are under various stages of scrutiny and verification,” said the Government. The Government also said that there are still 3,084 youth in PoK who had gone for arms training 1990s. As reported earlier, the Government on October 8 had informed the State Legislative Assembly that 2305 persons were missing in Jammu and Kashmir since 1989 when the turmoil broke out in the State. It had also been reported that the Rehabilitation Policy has been announced under the Cabinet decision No. 253/23/2012 dated November 22, 2010, and vide Government order No. Home-1376 (ISA) of 2010 dated November 23, 2010.

Minister of State for Home Nasir Aslam Wani informed the house that the Government has received 1,082 applications from Kashmiris stranded in PoK since they crossed over for arms training in the 1990s. Wani said 66 people, some of them along with their families, have returned via Nepal and other routes. The Minister, however, said that none of the youth, who had gone to PoK for arms training, had returned through identified routes as part of the rehabilitation policy, adds Zee News. He said the Government, in consultations with the Union Home ministry, had identified Wagah border, PCP Attari, Salamabad (Baramulla), Chakandabagh (Poonch) and Indira Gandhi International Airport New Delhi as routes for the return of such youth. The minister further said none of the 66 returnees were in jail but added a woman named Aseema, wife of one Mohammad Latief of Chadoora in Budgam District, was presently lodged in Poonch District jail as she had crossed the border in May 2012, much before the policy was implemented. Around 5,000 Kashmiris are believed to be there (in PoK) and most of them want to return having abjured violence.

The Government informed the Legislative Council that 323 persons were booked under TADA in 63 cases within the jurisdiction of the State. In Kashmir, 278 persons were charged in 59 cases under the said law. In Jammu, the number is less as 45 persons have been charged in seven cases under TADA. As many as 31 persons were charged under POTA. According to the information furnished by the Government, 15 persons were charged under POTA in seven cases in Kashmir. The Government also informed that 10921 AK rifles were recovered in last two decades in Kashmir with 4452 lying in possession of Police and remaining 6469 under the custody of Army and paramilitary forces. “About 28009 AK magazines were recovered with 11061 and 16948 lying in possession of police and Army/paramilitary forces respectively,” the Government said. According to the information, 5020 pistols and five anti-tank mines were recovered in the Valley during the past two decades. “As many as 13 pencils bombs were also recovered in the Valley,” the Government said.

The Centre rushed additional 7,000 Central Reserve Police Force (CRPF) personnel to the State and will deploy more paramilitary forces in near future if required, The Times of India reported on October 12. The fresh deployment — made during the past fortnight on the State Government's request — will increase the strength of the CRPF to the extent of 75,000 personnel. "We have rushed additional CRPF personnel to the state in two batches for law and order duties. The State Government wanted fresh deployment in view of growing need of security to panches [member of Panchayat, village level local self Government institution] and sarpanches [head of Panchayat] in vulnerable areas," said an unnamed Union Ministry of Home Affairs official. He said though the government had decided to gradually decrease the footprints of paramilitary personnel in the State, the recent incidents of attacks on panchayat members and growing demand to provide them security at the earliest had resulted in "reversal of the plan for the time being". As reported earlier, as part of decreasing the strength of the paramilitary forces in the State, the Government had withdrawn two battalions (nearly 2,000 personnel) in August, reducing the CRPF's presence from 70, 000 to 68,000 personnel.

General Officer Commanding (GOC) of Baramulla based 19-Division of Army, Major General Bipin Rawat, said that at around 10:30am Pakistani troops from across the Line of Control (LoC) fired around 7-8 rounds of mortars that fell in Churanda village hardly 100 meters from the LoC in Haji Peer sector. The General said that one of the shells fired by Pakistani troops fell on a residential house leading to the death of three civilians - Mohammad Liaquat son of Nazir Ahmad, 15, Mohammad Shafiq son of Iman Bin, 32 and Shaheena daughter of Ismael, 20. He added that firing stopped at around 12:30pm. This is for the first time that civilians have been killed in the LoC firing since India and Pakistan signed a ceasefire agreement in 2003.

A message to kill Malik had been passed on to Saroori and Haafiz by HM leadership after they managed to develop inputs that Junaid Akram Malik was going to surrender before Police, Police sources said. Junaid carried a reward of INR 2 million on his head –INR 1 million each by the NIA and State Government. Chotta Haafiz, Junaid Akram Malik and Aamir Kamal were three HM militants, who were wanted by the NIA in connection with blast. The NIA had declared a reward of INR 1 million on each of them. The State Government had also announced an equal amount on their head. Army and Police shot dead Aamir Kamal in an encounter in Kishtwar forests along with Mohammad Shaffi on August 6, 2012. Their associate, Rezwan was arrested after the gun-battle. With Junaid also reportedly dead, Chotta Haafiz was the only surviving militant, who was wanted by the NIA in connection with blast, sources said. Three other militants from Kishtwar, including Wasim Akram Malik, elder brother of Junaid who had been studying medicines at Dhaka (Bangladesh), have been arrested by the NIA. Charges have been framed against Wasim in connection with the blast. Two Pakistani militants, who had transported explosives from Kishtwar to New Delhi and planted the IED outside Delhi High Court, have also remained untraced.

The 3-4 militants came in a car and targeted an Army convoy outside Silver Star hotel at around 4:20 pm. Inspector General of Police (IGP, Kashmir Range), S M Sahai, said that the initial reports suggested that around 3-4 militants tried to launch an attack on the highway. "After the attack they tried to force their entry into the hotel which they couldn't and fired indiscriminately killing a hotel employee and injuring two others," he added. "There was minor damage to one of the Army vehicles and it seems that they failed to carry out the attack as was planned by them", the Security Agencies said. "It was an Army truck that was targeted by the militants", they said, adding that they feel their target might have been the Army bus which was behind the truck. The militants fled towards the hotel after the attack and forced their way into the lobby. One of the owners of the hotel, Waseem Abbas, said the militants fired just outside the main gate of the hotel and then entered the ground floor of the hotel. "Few shots were fired inside the premises. We are not sure where our staffer was killed but it seems he was taken hostage and later shot dead behind the hotel," said Abbas.

The revelations were made by dozens of militants who returned to Jammu and Kashmir (J&K) via Nepal and other routes during de-briefing by the Police and Indian intelligence agencies, sources said. “More than 150 Kashmiri militants have been sent to Waziristan and other tribal areas to fight alongside the Taliban against NATO troops. Kashmiri militants are being handled by Yousuf Baloch and Bakht Zaman – two Al Badr commanders – in Waziristan,” an unnamed senior intelligence officer stated. A Hizb-ul-Mujahideen (HM) militant, who recently surrendered before the State Police, revealed that he opted to return after he was forced to go to Waziristan. “The militant told his chief that he will go to Kashmir instead of Waziristan as he feared death there. On arriving, he surrendered,” the officer added. In August, a Kashmiri militant ‘commander’ Ahsan Aziz was one of several terrorists killed in a US drone strike in the Shawal Valley in North Waziristan Agency of Federally Administered Tribal Areas (FATA). “After the killing of Aziz, most of the Kashmiri militants based in PoK are hesitant to go to Waziristan and other tribal areas to fight against NATO troops,” sources said and added that most of them belong to North Kashmir. Intelligence sources said there are about 3,000 to 4,000 Kashmiri militants stranded in and around Muzaffarabad.

The other slain militant was identified as Abdullah Shaheen, a Pakistani resident. Inspector General of Police (IGP, Kashmir), S M Sahai said that Muzamil was involved in hatching a conspiracy to bomb Delhi markets. With the two killings, the operation that was launched on October 20 ended. On October 20, SFs had launched a search operation in the area after a tip off about the presence of two top LeT ‘commanders’. The militants opened fire from a house resulting into an encounter. One Central Reserve Police Force (CRPF) trooper was injured in the initial fire. SFs later rescued about 60-70 civilians, including women and children, who were trapped in the encounter and halted the operation in the night. The operation was resumed in the morning of October 21 as SFs tried to storm the target house, triggering an encounter. An Army trooper and Policeman were injured during the initial gun battle in the morning. The intermittent firing continued till afternoon in which both the militants were killed. He further said that "There is no intrusion (from Chinese side). I have studied it very minutely. They come and go. They stay there (near border) for an hour or so... But we have got our people (troops) there. They are all prepared." The UMHA was speaking at the occasion of 51st Raising Day of Indo-Tibetan Border Police (ITBP) force. ITBP personnel are deployed in border guarding duties from Karakoram Pass in Ladakh (J&K) to Jechap La in Arunachal Pradesh covering 3,488 Km of Indo-China border and are manning border outposts at altitudes ranging from 9,000 feet to 18,600 ft. The force will also increase its strength by 12,000 men from the existing over 77,000 personnel by 2015.

Principal Sessions Judge, Ramban District, M. A. Chowdhary on September 29 awarded 14 years imprisonment and fine of INR 20,000 to two Jaish-e-Muhammad (JeM) militants, reports Daily Excelsior. The Judge observed, "Having due regard to the facts and circumstances of the case, court is of the considered opinion that the interests of justice shall be served with a sentence of imprisonment for a period of seven years and fine of INR 10,000 under Section 307 read with Section 34 RPC and Rigorous imprisonment for a period of seven years and fine of INR 10,000 for the commission of offence punishable under Section 27 (2) Arms Act". The Court clarified that both the sentences will run concurrently. According to the Police case, these two militants namely Mohd Shaheen code Aarif, son of Abdul Gani Naik of Manjoos in Banihal and Badar Din code Umar, son of Nazir Ahmad Wani of Tanta in Thathri surrendered before the Security Forces following a gun battle in Dheda under the jurisdiction of Gool Police Station on April 4, 2005. Subsequently, a case was registered and after completion of investigation, challan was presented in the Court of law.

According to the Police, around 18 youths from the Jammu and Kashmir have joined different militant groups during the year 2012, reports Greater Kashmir. Most of these young persons have joined Hizbul Mujahideen (HM) or Lashkar-e-Toiba (LeT), two key militant outfits operating in the State. Among these, two have been killed in encounters and one has been arrested. Sources said, “They (local militants) know the topography and have a good network of friends and relatives who act as couriers.” They are also used to garner support of the local population. Sources further add, three belonged to the South Kashmir area, six are residents of Batamoloo (Srinagar District) in Central Kashmir. Muzamil, one of the two, from Sopore District was killed in an encounter. Remaining seven are from Kishtwar and Doda Districts in Jammu region. “One among the seven was killed in an encounter in Kishtwar,” sources said. However, unconfirmed reports put the number of Kashmiri youth who have taken up gun in the past one year at more than 40, including those who lost their near ones in Central Reserve Police Force (CRPF) or Police firing in the 2008, 2009 and 2010 agitations. Most of them are in their late teens or early 20s.

Principal Sessions Judge, Poonch, Kishore Kumar has awarded life imprisonment to one Mohd Nayeem Anwar alias Shahzad alias Asaf Safadar alias Abu Maz, a resident of Lahore (Pakistan), for his involvement in murder and attempt to murder cases, reports Daily Excelsior. The accused was facing trial for the commission of offence under Sections 302/307 RPC and 7/25, 26, 27 Indian Arms Act, since 2003. He was found guilty for his involvement in killing of a Jammu and Kashmir Police personnel Rajesh Kumar and causing injuries to two other at Mohalla Pathana in Poonch District on July 11, 2003. As reported earlier, the Police was patrolling the area in the forest near Pathana Mohalla when the militants opened fire. The court however rejected the plea of death penalty as the case does fall in the category of rarest of the rare case.

Three persons were arrested on October 30, along with a total of INR 65,000 Fake Indian Currency Notes (FICN) from Jewel Chowk and Roop Nagar areas in Kupwara District, reports Daily Excelsior. The arrestees were identified as Manu Karwal son of Ragunath Bhat, a resident of Roop Nagar, Sharief-ud-Din son of Ghulam Mohammad Malik resident of Aain, Kupwara, and Lal Din son of Nizam Din resident of village Khanabal, Kupwara. Manu Karwal was arrested from Jewel Chowk after he was found roaming there in his Maruti Zen car under mysterious circumstances. Police seized INR 45,000 worth FICN from his possession which he was to hand over to some persons. During the interrogation he revealed the names of his two associates, who were later arrested from Roop Nagar and Kupwara city. A total of FICN INR 65,000 in the denomination of INR 1,000 has been seized so far. As reported earlier, three persons were arrested along with FICN worth INR 45,000 in their possession from Poonch District. Sources said that, “In some cases, it was just meant for minting money while in some other cases, the currency was being used for anti-national motives''.

A major infiltration bid was foiled by the Army in Hajipeer sector in Baramulla District on October 31, reports Daily Excelsior. The militants managed to cross the Line of Control (LoC) taking cover of thick forest and dense fog and were spotted by the Army personnel some 400 meters inside the Indian territory. They fled towards LoC back to the Pakistan occupied Kashmir (PoK) when Army challenged and fired upon them. Brigadier G S Rawat of Rampur brigade said, “However, they were critically injured and Army noticed trail of blood upto the LoC but could not chase them beyond that as they entered PoK.” Fleeing infiltrators left behind three AK Rifles, some magazine and grenades. Army sources said that thermal imaging devices of the forward Army posts had also picked up the suspicious movement of the infiltrators in the morning. Sources said that the two injured infiltrators died across the LoC. Their death was confirmed as around 100-150 locals of the PoK gathered near the LoC to take part in the funeral of the two militants.

The Central Reserve Police Force (CRPF) on October 31 has decided to permanently withdraw one more battalion from Jammu and Kashmir as a gesture of Confidence Building Measure (CBM), reports Greater Kashmir. Confirming the news Inspector General of CRPF Operations SS Sandhu said, “The Battalion (18th Battalion) from Kulgam is being moved permanently. I have written to the Director General of Police to relieve the unit as early as possible.” CRPF is gradually reducing its footprints in the State. As reported earlier, CRPF withdrew one battalion and removed 50 bunkers from Srinagar (Srinagar District) as CBM.
