The Supreme Court’s decision had immediate restoration of opposition party’s majority in the People’s Majlis or the Parliament body of Maldives, reinstating 12 members who had been stripped of their seats. In a landmark ruling, the Supreme Court of the Maldives on February 01, has ordered an immediate release of Maldives’ former President Mohamed Nasheed and former Vice-President Ahmed Adeeb, reports Maldives Independent. After the court hearing, hundreds of people gathered onto the streets of the capital city Male with cheering, waving flags and saying, “The Government is over Allah Akbar”. Referring to the current President Abdullah Yameen, Mohamed Nasheed told Rajje TV that he believe that wisest decision for Abdullah Yameen could take, is to resign from the post of President. I will go to Male but not tonight, added Mohamed Nasheed. The prisoners are free to go until fair trials could be conducted without any undue influences, read a statement released by the Supreme Court of the Maldives.

The advisory also suggests the Indian expatriates in Maldives to take precautionary measures to ensure their safety and avoid attending public gatherings. In the fear over brink of Military rule in Maldives, the Supreme Court of Maldives approached India along with other democratic countries to intervene in the ongoing matter. The Embassy of India in Male, Maldives expressed its concern and communicated with the relevant agencies involved in the crisis. The Maldivian Police Chief and Chief of Maldives’ Defence Force have announced that they will obey the directions from the Attorney-General (AG) Mohamed Anil, not the Supreme Court of Maldives. The Supreme Court of Maldives had ordered the release of all political leaders, last week.

Amending and restricting the access to the Constitutional Rights, the Maldives’ President’s Office has amended the decision of a state of emergency, reports Rajje on February 6. The rights on arrests or detentions which is applicable under the Article 48 of the Maldives’ Constitution would be suppressed during the emergency in the State, said an unnamed Spokesperson of the President’s Office. The Maldivian Government did announced the state of emergency on the night of February 5, which is only applied through the declaration in the Government Gazette and Parliamentary approval, and neither of which had been followed. Despite suppression of the Supreme Court’s authority to be the final source of interpreting the Constitution, the Court is still charged with determining the validity of the declaration of state of emergency.
