The Army Integration Special Committee (AISC) has decided to start voluntary retirement and rehabilitation of the former People’s Liberation Army (PLA) combatants within a week, reports Nepal News. A meeting of the AISC held under the chairmanship of the Prime Minister took the decision to this effect. The voluntary retirement and rehabilitation of combatants, who had chosen these options during the regrouping process, will conclude in 12 days, AISC member Ram Saran Mahat said. The combatants opting for voluntary retirement will receive cash according to their ranks while the Peace and Reconstruction Ministry will make arrangements for those choosing rehabilitation. Only six combatants are going for rehabilitation package.

As the Unified Communist Party of Nepal-Maoist (UCPN-M) leaders continue to present their views stressing on the need for keeping party unity intact in the Central Committee (CC) meeting, chairman Pushpa Kamal Dahal aka Prachanda showed his readiness to revise his political report to address the feeling of the rival faction led by vice chairman Mohan Baidya, reports Nepal News. Prachanda expressed his commitment to revise his political proposal for party unity, said the state-owned news agency RSS. While Prachanda said in his proposal that the party should go ahead prioritising peace and constitution writing in the present context, vice chairman Baidya who leads the hardliner faction in the party had presented a separate political paper stressing that the party should adopt the strategy of immediate revolt.

Venting frustration on the Government and its failing report card, Madheshi Janadhikar Forum- Nepal (MJF-N) led by Upendra Yadav on January 6 decided to withdraw its support to the Government coalition. The United Communist Party of Nepal- Maoist (UCPN-M) establishment led by Chairman Pushpa Kamal Dahal and hardliner Mohan Baidya faction have agreed to put aside their differences, at least for the time being, reports Nepal news. A meeting of the Maoist office-bearers held at party chairman Dahal's Naya Bazaar residence decided to put the proposals of both Dahal and Baidya on hold and start deliberations to prepare a common draft. With the agreement, the CC meeting is set to end without reaching any decision on the separate political papers. A meeting of 16 parties including the main opposition parties, Nepali Congress (NC) and Communist Party of Nepal-United Marxist Leninist (CPN-UML) on January 9 arrived at the conclusion that the UCPN-M has backtracked from previous agreements and that it is responsible for lack of progress in the peace process. Issuing joint press statement after the meeting held in Singh Durbar, the 16 parties said the Government and Maoist Party have gone back on past agreements on the peace process and constitution.

In the meeting held at PM's official residence, chairman Dahal dismissed media reports that he had agreed to change Government leadership. Dahal has assured Bhattarai that the present Government will continue for some time as the party lacks a credible plan B, while also trying to win over the hardliners by appearing to agree with their demands at least in principle. On January 11, Dahal dispatched a draft of the consensus proposal to Baidya. A meeting of the Constitutional Committee is underway at Singha Durbar on January 12 (today) in a bid to endorse the decisions taken by the Dispute Resolution sub-committee on the contentious issues in the new constitution, reports Himalayan Times. The dissenting Maoists have been keeping their reservations in several issues settled by the sub-committee and have also been demanding to overturn some of the decisions made earlier. As per the CA new calendar, the constitutional committee, which is mandated to prepare the first draft of the new constitution, has to settle all the disputed issues, except federalism by January 29. Though DR subcommittee under the CC has nailed down 75 disputable issues to 14, it has failed to settle some thorny issues such as forms of governance, electoral system, among others to be incorporated in the new constitution, whose final deadline is May 27.

The meeting was supposed to endorse the sub-committee’s decisions that a Nepali citizen above 18 years of age would not require to undergo compulsory military training as the state can call upon its citizens to serve the nation as and when required; nothing needs to be mentioned about rehabilitation, management and integration of Maoist combatants in the new constitution; law with retrospective effect will be enacted in the new constitution; law will be enacted to fix ceiling on land holding and the country shall pursue a system of federal democratic republic. A farewell programme for former Unified Communist Party of Nepal-Maoist (UCPN- Maoist) combatants opting for voluntary retirement is all set to begin amid the protracted stalemate in the peace process and constitution-drafting processes, reports Kantipuronline. The departure of 7,365 combatants choosing voluntary retirement could start next week, according to Government and Maoist sources. “There is no dispute in our party in releasing the combatants opting for retirement,” UCPN-M Politburo member, Janardan Sharma said. The November-1 deal commits for integrating a maximum of 6,500 combatants by forming a new directorate in the NA. Commanders of the Maoist army have demanded that they be provided one major general, two brigadier general, eight colonel, 16 lieutenant colonel, 64 major, 120 captain, 96 lieutenant and 120 second lieutenant posts in the new directorate.

The transactions were made by the parallel government during the Maoist insurgency. Dahal also urged Nepali Congress (NC) and Communist party of Nepal-Unified Marxist Leninist (CPN-UML) leaders to recommend an alternative to address problems faced by people who made such deals through the "People's Government." "There won't be any more talks with the Maoists now. We will not allow the House to function until the decision is withdrawn," said Nepal Congress (NC) General Secretary, Krishna Prasad Sitaula. He, however, also said that Dahal did not expressly tell the meeting that the decision will not be withdrawn, as the Maoist party decided earlier in the day. "Dahal did not say that the decision will not be withdrawn. He only urged us to look for an agreeable solution to address the issue." Kantipuronline reports that the Government on January 27 registered an appeal against the Supreme Court (SC) administration’s refusal to review its earlier decision of November 25 that put a final six-month cap on the extension of the Constituent Assembly (CA) tenure. The application filed by Prime Minister Baburam Bhattarai has cited three major precedents which show that the court can review even final decisions of its full bench. Bhattarai has also warned that the court’s refusal to review its ‘intrusive’ decision would jeopardise the balance of power among the judiciary, executive and the parliament and, thus, create disharmony. The apex court had on December 27 refused to register review applications filed separately by the Government and the Parliament, arguing that “the final verdict given by the full bench” cannot be reviewed. The Government has also argued that as per Article 107 (4) of the Interim Constitution, the apex court can review its own order or a final order, provided that it is heard by a different group of judges than those that issued the order. The constitution drafting process has run into serious crisis yet again as Constitutional Committee (CC) of the Constituent Assembly (CA) failed to resolve the major contentious issues even as the latest deadline given to the CC is expiring on January 29, reports Republica. Worse, the leaders closely involved in the constitution writing process say they see no solution in sight. As per the latest calendar of events of the CA, the CC was supposed to resolve all the remaining disputes by January 4 but the timeline was later extended to January 29 after leaders at the CC sought more time. But the last three weeks were wasted as not a single thorny issue was resolved. Signs of a major rift in the State Restructuring Commission (SRC) have surfaced, with two main opposition parties warning that they will not accept a report of the SRC due next week reports Kantipuronline. The parties have accused the ruling parties of ignoring their members in the commission in the decision-making process. Kantipuronline reports that the Prime Minister-led special committee is all set to initiate the process to bid farewell to those Unified Communist Party of Nepal-Maoist (UCPN-M) combatants who opted for voluntary retirement during the regrouping process within three days. During the meeting held on January 27, Prime Minister, Baburam Bhattarai, directed his secretariat to initiate the process at the earliest to bid farewell to the combatants. Last week, the Cabinet had released NPR 1.97 billion to the Peace Ministry to make the first installation payment to the combatants. Apart from the first instalment of the cash package of NPR 500,000 to NPR 800,000, the Special Committee has decided to also provide cash allowances to the departing combatants.

Committee Chairman, Nilambar Acharya, expressed hope that the parties would expedite discussions and be able to forge consensus within the new deadline. Supreme Court on January 31 stayed the Government´s decision to legalize the land deals arbitrated by the Unified Communist Party of Nepal-Maoist (UCPN-M) cadres during the insurgency, until next order. Acting on a writ petition filed by Democratic Lawyers’ Association, an Supreme Court full bench comprising justices Damodar Prasad Sharma, Kalyan Shrestha and Tahir Ali Anasari decided to give continuity to a January 25 stay order issued by Chief Justice Khil Raj Regmi. With this fresh stay order, the decision will not be implemented until the court gives a final decision on the writ petition. The State Restructuring Commission (SRC) on January 31 submitted its report to the Government, proposing an 11-State federal model based on ethnicity and language, reports Nepal News. However, the SRC could not reach consensus on its recommendation with three members contesting the report of the majority of the members.
