Principal Sessions Judge (Ramban District), M A Chowdhary on January 17 acquitted two alleged militants, identified as Mumtaz Ahmad alias Asif Commando and Manzoor Ahmad alias Furqan, in a double murder case stating that the entire case was investigated recklessly by the investigating agency, reports Daily Excelsior. The Court said, "This is how a case of double murder has been dealt with by irresponsible and incompetent police officers. There is no evidence with regard to the identity of the accused having been involved in the commission of offence. There is no clinching direct or circumstantial evidence to connect the accused with the commission of the offences for recording of their conviction". The two were accused of killing one Mohammad Saleem and his wife on June 11, 2007.

Principal Sessions Judge, (Ramban District), M. A. Chowdhary acquitted there alleged militants namely Manzoor Ahmad, Feroz Din and Raj Begum in a July 2007 case as prosecution failed to bring home the charge against the accused, reports Daily Excelsior on January 18. Manzoor Ahmed and Nasarullah Gazi were accused of taking Bashir Ahmed and others on gun point to the house of Mohammad Ayoob and that they were wearing Army uniform. Later, they were taken to a house where Raj Begum, wife of Manzoor and some other persons assaulted them seriously and took away their cell phones forcibly. Proceeding with the trial, the Court observed, "Prosecution has withheld the main and star witness of the case Mohammad Ayoob and his father Gul Mohammad besides the non-examination of doctor and Investigating Officers who had completed the investigation". Incoherency was also found between the statements of abductees.

The State Police on February 4 solved nearly 13 years old case, in which seven persons including four Village Defence Committee (VDC) members were massacred by Hizb-ul Mujahideen (HM) militants, when they arrested one Over Ground Worker (OWG) and three militants of the HM outfit at village Chakka Galiote under the jurisdiction of Panchairi Police Station in Udhampur District, reports Daily Excelsior. Additional Superintendent of Police, Udhampur, Benam Tosh said that a total of 12 militants and an OGW were involved in the massacre, eight of which have already died different deaths and remaining one is at large. The three militants arrested have been identified as Farooq Ahmad alias Nasir, son of Abdul Rehman Beig, resident of Salbala Gool area in Ramban District, Manzoor Ahmad alias Furqan, son of Ghulam Mohammad Nayak resident of village Dalwa of Ramban District and Abdul Latif alias Fayaz, son of Ghulam Nabi Sohil resident of Chhachhwa area in the same district. The OGW has been identified as Mohammad Din, son of Fazal Din Mir, resident of Sedua Tangar, Ramban District.

Principal Sessions Judge, Jammu, Kartar Singh acquitted alleged Hizb-ul-Mujahideen (HM) militant and his supporter as prosecution failed to prove its case against them, reports Daily Excelsior. “The prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt”, the Court said and acquitted the accused of the charges framed against them.The alleged HM militant, Asif Khan, son of Mohd Sharief Khan of Pakistan occupied Kashmir (PoK), and his supporter, Akhtar Hussain Malik, son of Qutab Din Malik of village Shiva in Doda District, were arrested on December 26, 2004, from Sungli area of Bhaderwah in Doda District along with arms ammunition and other incriminating material including election identity card under the seal and signature of Assistant Electoral Registration Officer Doda.

Principal Sessions Judge Jammu, Kartar Singh, rejected the bail application of Hizb-ul-Mujahideen (HM) militant and agent of Inter Services Intelligence (ISI) Tanveer Ahmed. The HM militant was arrested by Doda Police on May 14, 2011, along with one pistol, two magazines with 30 live cartridges, one wireless set, one satellite phone and two hand grenades. During investigation, offences under 7/25 Arms Act, 3 EAO and 6 IWT Act were found proved against him and final report was submitted for trial of the accused.

On May 17, a special court in Delhi released alleged Hizb-ul-Mujahideen (HM) militant Liyaqat Shah on bail, saying probe conducted by the National Investigation Agency (NIA) till now confirms there is "nothing substantial" to link him to the conspiracy to carry out terror attacks in Delhi, The Times of India reported. "No substantial evidence has come up against the present petitioner till date and the prosecution/NIA has failed to make out a prima facie case against the present petitioner/ accused till date," District Judge I S Mehta said while granting bail to Shah, despite NIA's opposition. "Further, the NIA investigation also confirms the same that there is no substantial linking against the petitioner/ accused being involved in conspiracy to commit terrorist attack on vital installations in Delhi till date," the court added. As reported earlier, Liyaqat was arrested on March 20 by the special cell of Delhi Police while crossing the Indo-Nepal border in Gorakhpur in Uttar Pradesh along with his family.

The trial of the Kashmir recruitment case, a case in which Keralite youths were taken to terrorist camp for training, has entered its final stage at the National Investigation Agency (NIA) Special Court, reports New Indian Express. The court has heard the statements of 160 witnesses in the case. There are 22 accused in the case, including suspected Lashkar-e-Toiba (LeT) ‘commander’ Thadiyantavide Nazeer. “The trial of the case has almost been completed and the court will pronounce the order after a few sittings. The NIA has filed chargesheet against 24 persons, including four Keralites, in connection with the case. The witnesses also include family members of the killed youths. Muhammad Sabir and Wali, the main link between the LeT and the Keralites, are absconding,” NIA officials said. Four youths from Kerala - Fayas, Abdul Rahim, Mohammed Yasin and Fayis - suspected to be involved in the case were killed in an encounter with the Security Forces (SFs). The youths, who were recruited in 2006, were given arms training to wage war against India.

The National Investigation Agency (NIA) has got a non-bailable warrant issued against former Kashmiri militant Liyaqat Ali Shah’s aide Sabir Khan Pathan in case related to Shah’s arrest, Hindustan Times reports on August 19. “Investigators suspect that a person named Sabir Khan Pathan, who had been seen in and around the Lodhi colony office of the special cell for the past eight years, planted arms and ammunition at a guest house in the Jama Masjid area. Witnesses have seen moving him around the special cell office and in the guest house. The NIA sleuths managed to find Sabir’s photograph from the album of a marriage he attended in Madhya Pradesh a few years back,” said an unnamed Union Ministry of Home Affairs official. “Sabir had given the special cell barrack as his address to obtain the mobile number. Investigators have tallied his movement by tracking the location of his mobile phone,” said the official. Sabir is missing ever since his name figured in the investigation. Liyaqat Ali Shah, who had been living in the Pakistan occupied Kashmir (PoK) for the past 17 years, was arrested by the Delhi Police special cell on March 20, 2013, from Sanauli in Uttar Pradesh on the Indo-Nepal border. The Delhi Police which arrested him on charges of plotting terror strikes had claimed that an associate of Liyaqat had left the arms and ammunition in the guest house. However, the NIA took over the investigations later and Shah got a bail on May 17, 2013, and is at present in his home in North Kashmir. Meanwhile, the NIA on August 19 examined Deputy Commissioner of Delhi Police Sanjeev Yadav and Assistant Commissioner of Police Manish Chandra in connection with the probe.

A US federal court has reduced the prison sentence of Kashmiri separatist and Inter Services Intelligence (ISI) agent Ghulam Nabi Fai by about four months in response to a petition from the US Government, reports Deccan Chronicle. In a petition filed on November 15, 2013, US Assistant Attorney Gordon Kromberg sought a reduction in Fai's prison term because he had cooperated in bringing to book other persons involved in transferring funds from the ISI to the US to serve the cause of Pakistan. "Upon consideration of the government's motion for reduction of sentence and the court, after reviewing the record and hearing the arguments of counsel and having found that the defendant has rendered substantial assistance to the government, it is accordingly ordered that the government's motion for reduction of sentence is granted," District Judge Liarn O'Gra said in an order issued on November 22. Fai, 63, was arrested on July 19, 2011, for concealing the transfer of USD 3.5 million from the ISI to fund his illegal lobbying efforts and to influence the US government on the Kashmir issue. Prosecutors said his actions violated the Foreign Agents Registration Act. In December 2011, Fai pleaded guilty to federal charges of acting on behalf of the ISI. He also acknowledged receiving money from ISI through clandestine routes and causing revenue losses. In March 2012, Fai was sentenced to two years in prison for "conspiracy to defraud the US" by concealing the transfer of the funds from the ISI. He was scheduled to be released in March 2014.

This and other methods of funding led to an inflow of INR 800 million into the coffers of HM in the past eight years, the chargesheet said. Filed against HM ‘chief’ Syed Salahuddin and nine others, the chargesheet was on December 3 taken cognizance of by the NIA special court in Delhi. Detailing methods of funding terror activities in the Valley, the chargesheet said HM terrorists, who crossed over to Pakistan in the garb of traders, were involved in trade across the Line of Control (LoC) and misused it to send money and weapons to the Indian side from Pakistan occupied Kashmir (PoK) and Pakistan. It said some truck drivers were also involved in it. The chargesheet further said HM's modus operandi was to "under invoice the goods sent from across PoK/Pakistan. Indian counterparts send an equivalent goods as per barter system and the extra money generated in this exchange is collected by HM from traders in India." NIA claimed to have evidence that "around 263 individuals based in PoK who are assigned the work of relief takers in Pakistan/PoK" are active terrorists of HM. These relief takers had obtained Rs 2.09 crore from Jammu and Kashmir Affectees Relief Trust (JKART), an overground NGO working as a front for HuM to fund terror, for further distribution among 673 beneficiaries. JKART also received funds from another trust 'Relief Organization for Kashmiri Muslims (ROKM)' founded for rehabilitation of migrant Kashmiri Muslims in Pakistan and PoK, it said, adding JKART and ROKM were primarily funded by Pakistan government and its agencies.

The National Investigation Agency (NIA) on November 30 charge sheeted chief of the Hizb-ul-Mujahideen (HM), Syed Salahudin, along with nine other top militant ‘commanders’ for funding militancy in Jammu and Kashmir, reports Daily Excelsior. The charge sheet was filed in the NIA Special Court, Patiala House, New Delhi, against ten accused persons belonging to the HM. The accused include chairman of Pakistan based Jammu and Kashmir Affectees Relief Trust (JKART), an organization used by HM to “finance militant activities in the State. The case regarding regular and systematic funding of HM for carrying out militant activities in the State was registered by the NIA against Salahudin and others in October 2011. The NIA investigations have established that under the cover of the JKART, the HM operatives based in Pakistan used to provide funds through different channels for militant activities in India. NIA sources said that permission had been received from the government to send letter rogatory (LR) to Pakistan asking the authorities to arrest Salahuddin, who has taken shelter in Pakistan since 1989, and seven others named as proclaimed offenders in the charge sheet, adds The Times of India. It is the first case in which Salahuddin has been declared a proclaimed offender, paving the way for authorities to send an LR for his arrest. "We have conclusively proven the flow of funds from across the border to the outfit and are sure of taking the case to its logical conclusion. Following the LR, we will also get an RCN issued against Salahuddin," said an unnamed senior NIA official.

This monthly remuneration has increased from Rs 2,000-3,000 per month in 1990s to Rs 10,000-12,000 per month in 2011," the probe agency said.
