Kathmandu-based diplomatic missions including the United Nations (UN) have urged the Government to clarify to the public regarding its plans to take the transitional justice process forward in 2019, reports My Republica.In a press release on January 24, Kathmandu-based diplomatic missions of Australia, Germany, European Union, Finland, France, Norway, Switzerland, United Kingdom, United States of America, and United Nations said "Noting the looming expiration of the mandates of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP), as well as the upcoming fourth anniversary of the 2015 Supreme Court ruling that affirmed certain requirements for transitional justice processes, we encourage the government to clarify to the public its plans to take the transitional justice process forward in 2019." Further, saying that they support a number of principles for transitional justice in Nepal, the diplomatic missions stated "We support a Nepali-designed, Nepali-led process that is consistent with the 2007 and 2015 judgements of Nepal’s Supreme Court and the country’s obligations under international law."The international community have also stressed on the broad public trust in the transitional justice process. "Nepal will not be able to bring closure to the wounds and grievances that persist from the conflict era, nor be able to complete the peace process," the release said. The international community also urged the government to engage in broad-based, meaningful consultation with conflict victims, civil society and wider stakeholders that allows space and time to discuss and address issues raised before action is taken, and helps shape a course of further action that reflects the will of the people."These members of the international community are also united in the view that any solution should have the needs of victims at its heart," the release said.The diplomatic missions, in their release, are of the view that only the peace process move forward on a strong foundation if the needs of the victims are properly addressed."Supporting Nepal in establishing a credible transitional justice process and ensuring the stability and prosperity of Nepal remain priorities for the international community. We are committed to working with the Government of Nepal and all other stakeholders to advance a transitional justice process that engenders broad public confidence," the release stated.

A family member of Singh Prasad Gurung, who was killed in a blast outside Lalitpur-based Ncell office on February 22, wants the Government to act against the Netra Bikram Chand-led Communist Party of Nepal (CPN), which has owned up to the blast, reports The Himalayan Times on February 26. “My brother was killed for no fault of his. Unless the government reins in the Chand-led outfit, many more innocent people could lose their lives in such terrorist acts,” said the victim’s elder brother Shyam Prasad Gurung.Criminal lawyer Lav Kumar Mainali said CPN was spreading terror mainly because its cadres and leaders enjoyed political protection.“Home Minister Ram Bahadur Thapa’s admission that Chand-led faction was treated leniently in the past shows that the outfit enjoyed political protection,” Mainali added.Asked if the Government was preparing to declare CPN a terrorist organisation, Home Ministry Spokesperson Ram Krishna Subedi said there were enough laws to deal with acts of terror committed by the Chand-led outfit.

The Cabinet meeting held in Baluwatar on March 12, decided to ban the Netra Bikram Chand-led Communist Party of Nepal (CPN-Netra)and its ‘criminal’ activities, Home Minister Ram Bahadur Thapa said after the meeting, reports The Himalayan Times.According to him, the Government has concluded that the Chand-led group has been engaging in criminal activities by detonating bombs at infrastructure projects and disturbing peace and security.“Who have they been fighting for? Are they fighting against democratic federal republic or is there any regressive force?” the minister said.As the party has been indulging in terrorist activities, there is no way to deal with it politically, the minister added. “The government can’t accept their parallel structures,” he said, adding that the Chand-led party would have to surrender to the Government.

Prime Minister KP Sharma Oli, on March 24, warned Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) to surrender its weapons or get prepared for more crackdowns, reports My Republica. During an address to the parliament, PM Oli said that the Government has been waiting for the former rebel party to give up weapons within the given deadline which expires next week. Co-chair of ruling Nepal Communist Party (NCP) Pushpa Kamal Dahal on July 5 said Nepal’s peace process was one of the most successful of its kind in the world, but reactionary forces were not happy with that, reports The Himalayan Times. Referring to recent Europe visit of former child soldier Lenin Bista, without mentioning his name, Dahal said the reactionary forces were sponsoring Europe visits for some people in their desperate bid to derail Nepal’s peace process that had been established as a global success story. Dahal said derailing the peace process might benefit a section of people, but would be detrimental for national interest and national unity. “The reactionary forces are trying to revive wounds of conflicts that have already healed,” he said at an event at the NCP headquarters in Kathmandu.

But what have we got? We have been robbed of everything and rendered disabled.” Ram Kumar Bhandari, founder of National Network of the Families of the Disappeared and Missing in Nepal, accused the political leadership of living a luxurious life undermining sacrifices of those who were killed, disappeared and rendered disabled during the conflict. “Political leadership has become dishonest and the state unaccountable,” he said, adding they wanted to know the whereabouts of those who disappeared during the conflict. Former chairperson of Conflict Victims Common Platform Suman Adhikari said “The Truth and Reconciliation Commission and the Commission on Investigation of Enforced Disappeared Persons failed because of politicking and the commissioners’ incompetence, besides lack of necessary legislation.”

Former President Ram Baran Yadav inaugurating the first International Tamu Conference in Kathmandu on October 11 called for an amendment to the Constitution to address the grievances of different communities, reports Kathmandu Post. “The constitution should be amended to ensure its broader acceptance. The mistakes in the constitution should be corrected without delay. The delay in the amendment will give rise to more dissatisfaction. There could be complexities in the implementation of the constitution if there is a further delay in its amendment,” said Yadav. The victims of the decade-long insurgency on November 28 demanded an immediate dissolution of the recommendation committee formed to recommend office-bearers in the two transitional bodies, reports Kathmandu Post. Organising a press meet in the Capital Kathmandu, they asked the Government to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act 2014 first before starting a new selection process based on the revised Act. “It is evident that no competent people will get appointed in the transitional justice commissions unless the government and the political parties stop their interference. The current selection process should be immediately stalled,” said Suman Adhikari, founding chairperson of the Conflict Victims Common Platform (CVCM). Bhagi Ram Chaudhari, chairperson of the platform “No one can stop the conflict era cases from getting internationalised if the government and the parties don’t correct themselves.” He reminded the Government that around 9,000 cases related to severe human rights violations had been filed at the United Nations which could be tried in the international courts if Nepal fails to conclude the transitional justice process. Under the principle of universal jurisdiction, states may make it possible for their domestic criminal justice system to investigate and prosecute crimes such as torture, committed by any person, anywhere in the world.
