The Himalayan Times reports that leaders of the hard-line faction of the Unified Communist Party of Nepal-Maoist (UCPN-M) on January 16 reiterated that Prime Minister Baburam Bhattarai should tender his resignation to pave the way for a national unity Government, claiming that it would expedite the remaining tasks of peace and constitution-drafting processes. The “People’s Government” formed by Maoists during the decade-long insurgency had certified some 5,000 land transactions in the Salyan District alone, and the incumbent United Communist Party of Nepal-Maoist (UCPN-M) led Government is all set to implement it legally, reports Himalayan Times. At a time when opposition parties have been demanding Government to pull out the decision to legalize war time transactions, UCPN-M Secretary, Tikaram Oli warned that if the legal recognition of the deal is not implemented, the farmers will rebel. Most of war time transactions were conducted in Bafukhola, Shivarath and Bame Village Development Councils (VDCs) as they were Maoist base-areas during the conflict. Republica reports that the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Chairman, Jhalanath Khanal on January 18 warned the (UCPN-M) of dire consequences if the Government’s decision of legalizing the transactions of properties during the conflict period is not revoked. Khanal urged the Maoist to look for alternative of the incumbent Government and to focus on the seven-point deal. Khanal also opined that the current Government can never be a national consensus government and that it has a status of a caretaker Government.

Nepal News reports that opposition parties NC and CPN-UML said they will continue with their protest programs including planned boycott of House session until the Government scraps its recent decision to legalize land and property transactions carried out by parallel governments (called “people’s government”) run by the UCPN-M party during the decade-long insurgency. A meeting of the second and third largest party in the Constituent Assembly (CA) concluded that the decision was against the interim constitution, Comprehensive Peace Accord (CPA) including the law of the land and urged the Government not to enforce it. A meeting of the Constitutional Committee (CC) failed to arrive at any agreement with UCPN-M faction remaining adamant on incorporating a provision for mandatory military training to citizens above 18 years in the new constitution, reports Himalayan Times. The meeting was supposed to endorse the sub-committee’s decisions that a Nepali citizen above 18 years of age would not require to undergo compulsory military training as the state can call upon its citizens to serve the nation as and when required; nothing needs to be mentioned about rehabilitation, management and integration of Maoist combatants in the new constitution; law with retrospective effect will be enacted in the new constitution; law will be enacted to fix ceiling on land holding and the country shall pursue a system of federal democratic republic. The United Kingdom has agreed to provide NPR 2.5 billion (20 million Pound Sterling) to Nepal Peace Trust Fund (NPTF) to support the ongoing peace process, reports Nepal News. Andrew Mitchell, the International Development Secretary of the UK pledged such assistance during the meeting with Prime Minister Baburam Bhattarai at Dhulikhel in Kavre Kistrict on January 18.

Republica reports that the Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman, Pushpa Kamal Dahal aka Prachanda conceded at a closed-door party meeting on January 19 that he made a mistake in compromising with the parliamentary parties on the issues of peace and constitution, and pledged he would no longer enter into any such consensus against the party´s fundamental principles. "The parliamentary parties humiliated us and tried to force their way through the peace and constitution drafting process, knowing full well that we were deeply divided. And that´s why we have taken a tough stance now," a Maoist leader quoted Dahal as saying during the cadre orientation program. Dahal said that after the Nepali Congress (NC) and Communist party of Nepal-Unified Marxist Leninist (CPN-UML) pushed hard on Peoples Liberation army (PLA) integration and constitution drafting issues and sought compromises one after another, he asked party leaders including Janardan Sharma and Nanada Kishor Pun to speak up for "dignified integration" and a directly-elected presidential system of governance.

Prime Minister Baburam Bhattarai at a meeting with Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leaders on the sidelines of the CA’s Constitutional Committee meeting on the same day floated the proposal but the NC and UML leaders turned it down. The departure of 7,365 combatants choosing voluntary retirement could start next week, according to Government and Maoist sources. “There is no dispute in our party in releasing the combatants opting for retirement,” UCPN-M Politburo member, Janardan Sharma said. As pressure from hardliners in the party mounts, UCPN-M chairman, Pushpa Kamal Dahal aka Prachanda, on January 26 refused to take back the Government's decision to legalise conflict-era property transactions without first finding an alternative arrangement. The transactions were made by the parallel government during the Maoist insurgency. Dahal also urged Nepali Congress (NC) and Communist party of Nepal-Unified Marxist Leninist (CPN-UML) leaders to recommend an alternative to address problems faced by people who made such deals through the "People's Government." "There won't be any more talks with the Maoists now. We will not allow the House to function until the decision is withdrawn," said Nepal Congress (NC) General Secretary, Krishna Prasad Sitaula. He, however, also said that Dahal did not expressly tell the meeting that the decision will not be withdrawn, as the Maoist party decided earlier in the day. "Dahal did not say that the decision will not be withdrawn. He only urged us to look for an agreeable solution to address the issue." Himalayan Times reports that a cabinet meeting on January 26 decided to extend the term of the State Restructuring Commission (SRC) by one week.

Unified Communist Party of Nepal-Maoist (UCPN-M) chairman Pushpa Kamal Dahal aka Prachanda told party's central committee member that the elected President will exercise more executive rights than the Prime Minister who will be elected from the parliament, reports Nepal News. Six weeks after Nepal’ Constituent Assembly (CA) expired without delivering a constitution, Nepal’s last monarch Gyanendra Shah has said he wants to be the king again, reports The Hindu on July 10. Shah expressed his desire in an interview to a private television channel. The CA had abolished the monarchy at its first sitting in May 2008. Shah’s claim rests on what he says was a private agreement with the leaders of political parties on April 24, 2006 — the final day of the People’s Movement. On that night, after 19 days of street protests, the king conceded that sovereignty lay with the people, not the crown, and accepted the roadmap of the political parties to bring about peace and democracy. Meanwhile Prime Minister Baburam Bhattarai said, “The former king does not seem to have learnt any lessons. He will lose whatever facility he is getting.” Nepali Congress general secretary Krishna Prasad Sitaula, a key negotiator during the final days of the People’s Movement, rejected the contention that there was any “agreement” with the king. “This is a lie. His remarks are outrageous and objectionable and I challenge him to provide proof of any deal. He is dreaming.”

NC president Sushil Koirala has said his party could agree on reinstatement of the dissolved CA once there is a NC-led consensus government. Koirala said the recent national gathering of NC’s district presidents advised against CA reinstatement, but the party was ready to go for any option including CA's reinstatement provided the party got to lead the unity government. “The political deadlock is not going to end unless there is a NC-led government," he said, adding that Baburam Bhattarai’s resignation was a prerequisite for creating an atmosphere for consensus. According to Koirala, the NC would apply all the methods to unseat Bhattarai including a request to the President [to oust him], negotiations as well as street protests. The NC president also informed that his party would not name its prime ministerial candidate until Bhattarai resigned. “But, we will pick the candidate as soon as he steps down,” said he.

Prime Minister (PM) Baburam Bhattarai on August 6 said he believed that President Ram Baran Yadav would not make any "unconstitutional move", according to Nepal News. "I believe that as the custodian of the constitution the President will not make any unconstitutional move," Bhattarai said. PM Bhattarai insisted that the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) were posing hurdles for consensus by refusing to talk to the Government. "Is it that the NC and the UML want consensus by refusing to sit for talks with Maoists and the Madhesi parties?" he questioned. Bhattarai said that the Government was compelled to run the nation through ordinances. He also said he would step down as soon as the parties arrived at a package agreement on formation of national unity government and the elections or reinstatement of the Constituent Assembly (CA) to introduce the constitution.

Reacting to Prime Minister (PM) Baburam Bhattarai’s "foreign intervention" remark, Communist Party of Nepal- Unified Marxist Leninist (CPN-UML) chairman Jhala Nath Khanal on August 6 asked the PM to clarify his remarks, according to Nepal News. "The Prime Minister must explain who holds the key. If he cannot do that he has no right to be in the chair of Prime Minister even for a minute," Khanal said. "He has made an irresponsible remark. People have the right to know what it is all about," Khanal said. On August 3, PM Bhattarai had spoken extensively about "foreign intervention", indirectly admitting that intervention in the country's internal affairs was growing of late. He had said that the "key to run the country is somewhere else". "You already know about regional and international dynamics. It is not easy to get things done the way one would like," Bhattarai had said. In another context Khanal said that his party would not accept ethnic federalism abandoning CPN-UML’s official line of multi-ethnic federalism, reports Kantipuronline. Instead, his party “is ready for fresh polls” after the formation of a national consensus government. “We will not participate in any election under the leadership of the incumbent government,” said Khanal. Reiterating that the present government should quit, he said a consensus government is the only way out of the present political crisis. “The incumbent coalition of the Maoists [Unified Communist Party of Nepal-Maoist (UCPN-M)] and Madhesh-based parties cost the country dear. The country cannot find an outlet without an end to this coalition.” He warned that the government would be forcibly removed through protests if the UCPN-M did not come forward for consensus. the UCPN-M said that there is no meaning in demanding resignation of the PM as the government has already turned into a caretaker. Hinting at the Nepali Congress (NC) and the CPN-UML, the party also said that there is a “serious conspiracy” to impose the parliamentary system in the country, sabotaging the agenda of the Constituent Assembly (CA). Newly appointed UCPN-M spokesperson Agni Sapkota said, “After political parties forge consensus on a candidate, the President can appoint him/her prime minister, removing any difficulties.” He also said that the five-point agreement signed by the parties on May 3, 2012, was no longer relevant with the dissolution of the CA on May 27. Accordingly, the NC alone could not claim leadership of the government but that it was open to all parties, including the Maoists. Sapkota said the Maoist party was open to either revival of the CA or fresh elections. “However, our bottom-line is that a new constitution should be drafted through the CA,” said Sapkota. He said that there should be an agreement on contentious issues of the new constitution. Opposition parties, however, are saying that they are not ready to discuss other issues without Bhattarai’s resignation

The Unified Communist Party of Nepal-Maoist (UCPN-M) Chairman Pushpa Kamal Dahal aka Prachanda has stepped up efforts to strike a "working alliance" with the Mohan Baidya led Communist Party of Nepal-Maoist (CPN-Maoist, Baidya), Kantipuronline reported on August 7. “Dahal is working to build an alliance with the CPN-Maoist to boost his strength in national politics," said leader Khajaraj Bhatta. Leaders close to Dahal said that he has already held talks with Baidya and urged him to maintain a working alliance. Dahal believes that there are many common issues that the two parties can work on in tandem despite ideological differences. According to leaders, issues related to a new constitution such as ethnic federalism, right to self-determination and forms of government are where the two parties have similar positions. Dahal reportedly told Baidya that the “bargaining power” of both the sides will increase if they strike the alliance. “A working alliance is possible on national issues that are agreed upon," said Pampha Bhusal, the CPN-Maoist spokesperson. Leaders from both the parties claim such an alliance will prepare ground for party unity in the future. Dahal is also planning to "re-strengthen" relations with Madheshi parties and Janajati constituencies, according to sources. Dahal also plans to enhance strategic alliance with the Samyukta Loktantrik Madhesi Morcha (SLMM) so that their power to bargain with the Nepali Congress (NC) and the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) gets a boost. The current alliance between the UCPN-M and the Madhesi Morcha began with the signing of a four-point deal on August 28 2011, which paved way for the formation of the Baburam Bhattarai-led government. “The basis of unity among the Maoists and the Madhesi Morcha is the four-point agreement. The alliance could be at risk if the Maoists renege on the accord,” said spokesperson of the Tarai Madhes Loktantrik Party (TMLP) Sarvendra Nath Shukla. Dahal is also holding talks with different Janajati outfits and Janajati leaders, including CPN-UML vice chairman Ashok Rai, from various parties to forge an alliance. According to one leader, Prachanda is taking such a step to ensure ethnic federalism.

The Communist Part of Nepal-Unified Marxist Leninist (CPN--UML) leader Prithivi Subba Gurung on August 8 said that Janajatis were left with no option but to form their own party as major political parties Nepali Congress (NC) and the CPN-UML turned a blind eye to the issues concerning the indigenous nationalities, report Nepal News. He said there was pressing need for a separate party of the indigenous nationalities to ensure their rights. A national gathering of Nepal Federation of Indigenous Nationalities (NEFIN) held in the first week of July had decided to form a new party on August 9 (today). CPN-UML has already relieved Gurung and other senior Janajati leaders off crucial responsibilities inside the party to punish them for criticizing the party for its stand against identity-based federalism.

Janajati (indigenous people) leaders and intellectuals on August 9 announced the proposed name and the manifesto of the proposed party, the day the country marked the International Day of Indigenous People, reports Kantipuronline. The proposed ‘Social Democratic Pluri-National Party’ will aim to include people from all social, political and ethnic backgrounds, leaders said. The manifesto aims to form a “national alternative political force” that would accommodate people of every background, irrespective of caste, class, culture, location and creed. It has included a provision of group leadership so as to avoid a possible power tussle within the party. The group leadership will be rotated to give equal opportunity to all, leaders said. “This is not an ethnic party but a mainstream party that can challenge the existing national parties in length and breadth,” Chaitanya Subba, one of the leaders who drafted the manifesto said. Chaitanya said the new party will be finally formed within three months after they collate public opinion from across the country. A 101-member taskforce has been formed to collect public opinion. The leaders’ plan to announce the party formation was postponed at the behest of some influential leaders like Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) vice chairman Ashok Rai. The leaders cited lack of groundwork in forming a new party. “Everything, including the name and the manifesto of the party, can be changed on the basis of feedback from the general people. As it will be a party of the common people, it will accommodate their views and opinions,” said one leader Aang Kaji Sherpa. The CPN-UML had in July relieved around a dozen Janajati and Madheshi leaders of their responsibilities in the party for not complying with the party’s policies, mainly on federalism. The leaders include Vice-chairman Ashok Rai, Politburo member Prithivi Subba Gurung, Rajendra Shrestha, Bijay Subba, Kiran Gurung, Rakam Chemjong, Ajambar Rai Kangmang and Aangkaji Sherpa. They are still in a dilemma on whether to quit the party or continue their intra-party struggle.

Kantipuronline quoted CPN-UML General Secretary Ishwor Pokharel as saying that his party has no greed to take the government leadership but is ready to take charge if NC backs out. He urged the NC leaders to solve their internal conflicts if they want to lead the government. Claiming that the Baburam Bhattarai-led government is degrading every day, Pokharel said that the President is becoming more active to compensate for the same. “Prime Minister Bhattarai does not listen even to the president,” said Pokharel. Pokharel further claimed that his party (CPN-UML) has concluded that the constitution should be drafted through a fresh mandate. Claiming that the CA has completed 90 percent of the works for the new constitution, Pokharel claimed that it can be continued. However, he said that there could be some technical difficulties for the same. Therefore, to take it smoothly, the new parliament should complete the rest of the process. Furthermore, Pokharel claimed that the states cannot be divided on the basis of caste or ethnicity. Claiming that CPN-UML is not anti-federalist, Pokharel said that party supports multi-identity based federalism. In a different context, Pokharel accused the UCPN-M of trying to impose authoritarian rule. Pokharel claimed that UCPN-M Chairman Pushpa Kamal Dahal aka Prachanda had two cards up his sleeves. Pokhrel said that Dahal’s first card of ‘People’s War’ and ‘People’s Liberation Army’ has fallen and now he wants to deal his second card of an ethnic-based federalism.

Special Envoy for Human Rights, Minister Mahinda Samarasinghe said on August 10 that the Sri Lankan government will seek a 'fair and impartial hearing' on its human rights review when it is presented to the Universal Periodic Review (UPR) on human rights process at the United Nations Human Rights Council (UNHRC) in Geneva in November. He said Sri Lanka will share the progress it has made in all aspects of the promotion and protection of human rights before the international human rights forum. Sharing some of the measures taken by the Sri Lankan government to achieve national reconciliation, Minister Samarasinghe said significant progress towards this goal has been made during the last nine months. A significant achievement that is critical to the success of the government's post- armed conflict recovery and peace-building initiatives was the endorsement of the National Action Plan for the Promotion and Protection of Human Rights (NHRAP), which was in the making from 2008, by the Cabinet for implementation in December 2011. The other event was to table the report of the Lessons Learnt and Reconciliation Commission (LLRC) in Parliament in the same month. These two documents form important components of the national reconciliation effort, the Minister said.

Former Peoples’ Liberation Army (PLA) combatants under the seventh PLA camp in Kailali have left their cantonments in droves, Kantipuronline reported on August 14. They said they can no longer lead a cloistered life waiting for the integration work to make headway. “We feel that we are being kept in the dark as our commanders have all left the camp,” said Aakash, a combatant. A few combatants remain in the Talband-based main camp while two other satellite camps are vacant, Nepal Army (NA) Colonel Arjun Khadka said on August 13. He said the satellite camps at Masuritya and Chisapani are vacant since August 12. He said their commanders have stopped communicating with the camp. “After the commanders stared leaving the camp, the juniors followed suit. About 25 combatants who remained under the two satellite camps also left on Sunday,” Khadka said. The combatants are unhappy with camp life as they have not received ration and salary for the Nepali month of Srawan, according to Khadka. “They left saying that they have nothing to eat. Only five combatants remain now in the main camp at Talband,” said the Colonel. Indra Bhakta Maharjan, the PLA deputy brigade commander of the camp, however, said the combatants are out of their cantonments due to some personal reasons and that they will report back. “No one is leaving the camp or the integration programme,” he assured. There are 319 combatants under the seventh division camp.

Three major parties – the Unified Communist Party of Nepal-Maoist (UCPN-M), Nepali Congress (NC), and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) – met and agreed to intensify their dialogue to find an agreement, reports The Hindu. The meeting decided to delegate the responsibility of arriving at a deal to the top leaders. NC negotiator Minendra Rijal, who attended the talks, told The Hindu, “We decided that for the next five to seven days, talks will focus on finding a settlement on constitutional issues. If that happens, we can reinstate the CA and promulgate the statute. If we are convinced that there can be no agreement on constitution, then we will reach a deal on fresh elections.” He added that his party was open to both options. When asked if the resumption of negotiations indicated a change in NC’s position that the Prime Minister (PM) had to resign first, Rijal said, “Our stand on the PM has not changed. But we will get to that point through talks. The resignation will have to be a part of any deal.” He said that the talks were a result of ‘back-channel efforts’ and a ‘positive environment’ had now been created. “But nothing has been agreed upon so far.” Khimlal Devkota, a UCPN-M leader claimed that the opposition had run out of options. “They kept prodding the president to do something but the constitution does not allow it. Their attempts to organize a street movement against the government failed. The constitutional position is such that there is no basis to form an alternative government either.”
