Even as the SFs shot dead one of them in retaliatory firing, the other terrorist escaped and remained untraced till last reports came in. It is not State-specific but trans-national." The court clarified that people who merely supported a terrorist organisation without aiding its activities could not be booked under the anti-terrorist law, unless the accused had criminal intention. The apex court also upheld the validity of Section 14 of POTA, which says that individuals - including journalists and lawyers - or organisations were obliged to provide information about terrorist activities to the police. The Court also held that Parliament, and not the State Legislatures, was competent to enact such a law to counter terrorism. However, the Court also held that an accused under POTA could seek bail under Section 49 (7) even before the expiry of the one-year period. And, on the expiry of the detention period under POTA, the accused could be released on bail under the ordinary law without the rigor of Section 49 (7).

At least 40 soldiers and three civilians were injured when suspected Hizb-ul-Mujahideen (HM) terrorists ambushed an army convoy at Lawaypora on the outskirts of capital Srinagar on December 30. According to eye-witness accounts, the terrorists caused a powerful blast inside a shop on the highway at Lawaypora targeting a 100-vehicle convoy of the army, which was en route to Baramulla from Srinagar. The bomb exploded when a 40-seater private passenger bus, hired by the army, was seconds away from the shop. At least 20 vehicles of the convoy had reportedly driven past the point while another 70 were following when the blast was triggered, plausibly with a remote control device. Traffic was disrupted for several hours on the major roads leading to Gulmarg, Uri, Sopore, Kupwara and Handwara.

The officials have also recovered some sensitive defence documents from their possession. The arrested agents were residents of Pakistan who ran a Hawala (Illegal money transaction) operation in India. During the encounter one of his associates ran away and disappeared in the densely populated Chewdara village. One AK-56 rifle, one pistol and a tape-recorder were recovered from the possession of the slain terrorist. Later on, SFs conducted a search operation in the village but failed to apprehend Habshi’s associate. Habshi was reportedly wanted in 18 First Information Reports (FIRs) at different Police Stations in the Budgam district as he was believed to be responsible for over 50 civilian killings in addition to at least 30 attacks on security forces.
