Several families of refugees including Sri Lankans have left immigration camps on Nauru (Republic of Nauru) to be resettled in the United States (US), reports Colombo Page on March 4. The group of 29 persons, including eight children, who flew off the island nation on March 4, is the fifth cohort to leave Nauru under Australia’s refugee resettlement deal with the US, the Australian Associated Press reported. According to refugee advocates, the group included two Sri Lankan families, one Rohingyan family, one Afghan family and single men from Sri Lanka, Afghanistan and Pakistan. Under the deal Australia reached with the previous Obama administration - derided by the now US president, Donald Trump - the US agreed to take up to 1,250 refugees from the offshore detention centers.

Sri Lanka's Office for Missing Persons (OMP) has come under fire from the Nationalist Party backed by former President Mahinda Rajapaksa, alleging that some of its members have campaigned in favour of the Liberation Tigers of Tamil Eelam (LTTE), reports The New Indian Express on March 4. The OMP aims to bring in reparations to the victims of the nearly three-decade long armed conflict in the country. "This is nothing but a mechanism to try war heroes (soldiers who defeated the LTTE)," Udaya Gammanpila, a leading Joint Opposition supporter said on March 4. He said that President Maithripala Sirisena who pledged not to go ahead with the OMP had buckled under pressure from the West and the United Nations High Commissioner for Human Rights (UNHCHR) Zeid Raad Al Hussein. Last week, Sirisena appointed seven members to a special office set up for determining the status of all persons who went "missing" during the decade-long civil war against the LTTE. Under the Chairmanship of Saliya Peiris, a leading legal luminary, the Commissioners comprise of two members from the Tamil minority and a Muslim. "Look at their names, they are all characters from the dubious non-governmental organisations who have never raised their voices against the LTTE terrorism," Sarath Weerasekera, a former legislator said. "Some of them have campaigned for the LTTE against the state," Weerasekera added. The OMP is expected to bring solace to the tens of thousands of relative of the missing due to armed conflicts both in the south and the north of the country. The Government legislator Ajith Mannapperuma rubbished the accusation that OMP would lead to persecuting the members of the military.

Also, Sri Lanka's Leader of Opposition and the Leader of main Tamil party, Tamil National Alliance (TNA) R. Sampanthan seriously questioned the inaction of law enforcement authorities in response to the recent attacks on Muslim establishments in Ampara in the East and Digana area in the central hills, reports Colombo Page on March 7. Speaking in parliament on the chaotic situation in the Kandy area, the Opposition Leader said all these people who have engaged in these hostile activities seem to have been able to get away without being obstructed by the law enforcement authorities. He said such incidents are clearly unacceptable and is indicative of sense of impunity. "People seem to have the confidence that they can engage in such acts and that the arm of the law would not reach them; that the Rule of Law would not be enforced against them," Sampanthan said. He said it is not sufficient that some actions to be taken after the incident is over. The role of law enforcement authorities is called into serious question, he added.

On March 5, a mob set homes, shops and a mosque belonging to the local Muslim community alight in the Digana area of Kandy, in Central Province. This was the second serious incident of violence against a Muslim community in the country over the past week, following a similar attack in the eastern coastal district of Ampara on February 26. "It is important that the authorities take action against mobs who have incited hatred and carried out acts of violence against religious minorities," Biraj Patnaik, Amnesty's South Asia Director, said.

Maldives Opposition Party’s supporters on March 6 organised a rally in Sri Lanka against the Maldivian Government, urging to release the nine political prisoner and re-instate 12 Member of Parliaments (MPs) with immediate effect, reports Mihaaru. Around 100 protesters gathered at front gates of the Maldivian Embassy in Colombo, Sri Lanka, carrying placards, banners and posters in support of the political leaders and other administrative officers arrested during the ongoing State of Emergency (SoE). The protest in Sri Lanka has exposed the weakness and unpopularity of the Maldivian Democratic Party (MDP)—the Opposition party in Maldives. These issues are not implemented or resolved by the Embassy. Around 10,000 Maldivians are living in Sri Lanka and merely 100 Maldivians joined the protest. This highlights the unpopularity of MDP, said Maldivian Ambassador to Sri Lanka Mohamed Shareef.

Sri Lankan President Maithripala Sirisena on March 6 declared an island wide state of emergency for a period of week after communal clashes between majority Buddhists and members of the minority Muslim community in the central hills escalated, reports Colombo Page. On March 6 afternoon, acting in terms of section 2 of the Public Security Ordinance, President Maithripala Sirisena promulgated a state of emergency for a limited period of one week by bringing into force section 2 of the Public Security Ordinance. According to official statement, this state of emergency has been declared due to the following reasons: (1) Violent and criminal activities, which have taken place in certain parts of the country during the past two weeks, (2) Loss of lives and damage to property owing to those activities, (3) Tensions and discord among ethnic and religious groups arising from those criminal activities, (4) Attacks on religious places, property, transport facilities and damages caused by them, (5) Continuity of such criminal activities affecting the law and order. In some instances, these incidents have taken place in violent circumstances, and some of these criminal activities have been unleashed by organized groups. In such circumstances, it has been necessary to bring into force the Section II of the Public Security Ordinance as a measure to contain the situation, and restore normalcy. As such, the President has promulgated a state of emergency to restore normalcy and for the protection of the lives of people, maintenance of essential public services without interruption, and to restore peace, law and order. Regulations enacted by the promulgation of the state of emergency provide the Police and Tri-Forces with powers to bring the prevailing situation under control. The President has instructed the Police to impartially, comprehensively and promptly deal with those engaged in criminal activities and those causing or attempting to cause ethnic and religious tensions, irrespective of their ethnic or religious identities and political affiliations. The President has given special instructions the Police and the tri-forces to take action in terms of these regulations, in a lawful manner in good faith while ensuring minimum disturbance to the life and well-being of people, in conformity with Fundamental Human Rights of people.

As normalcy was returning fast, Lieutenant General Senanayake visited Kandy on March 8 and took stock of developments taking place in the aftermath of violence that sparked off in the general areas of Digana, Galaha, Katugastota, Menikhinna, Ambetenna, Akurana, Poojapitiya and a few other affected areas. Police Media Spokesman Superintendent of Police (SP) Ruwan Gunasekara on March 8 said that 81 suspects, who instigated communal clashes in the Kandy District in Central Province were arrested during the past few days, reports Colombo Page. Police Media Spokesman said that ten persons including the alleged mastermind of the attacks in the Kandy area were arrested by the Police Terrorism Investigation Division (TID) at Digana and Poojapiitiya on March 8. The main suspect, who initiated the anti-Muslim riots, Vidana Patharanage Amith Jeewan Weerasinghe was among the arrested persons, the Police Media Spokesman said. Main suspect's chief assistant Nasnaram Pattiyage Sureda Suraweera was also arrested, the spokesman added. Extremist Sinhala Buddhist groups attacked Muslim establishments, including mosques and residences after a Buddhist man was attacked by a group of Muslims during an altercation and later died. As a result of the communal clashes two people died and more than 200 Muslim-owned shops and properties were destroyed. Four Muslim places of worship have been attacked. About 45 incidents of attacks have been reported and the Police are conducting investigations, the Spokesman said. Meanwhile curfew will be imposed today [March 8] at 06.00 pm until 6.00 am Friday [March 9] in the area, the Police said.

The suspects, who were apprehended for violating the curfew imposed in Kandy will be produced before the court on the charges citing under the emergency regulations. Those who were proven to be guilty in court for their unruly behavior during the state of emergency could be given a seven-year prison sentence, the spokesman said. "The Office on Missing Persons has officially got underway," an official release said. President Maithripala Sirisena appointed seven members and the Chairperson of the OMP on February 28. "The main purpose of the OMP is to address the suffering of thousands of families living in all parts of the country whose loved ones have gone missing or disappeared during multiple conflicts in Sri Lanka," the release said. The OMP will search and trace missing persons, clarify the circumstances in which they have gone missing and their fate, make recommendations towards addressing incidents of missing persons, protect the rights and interests of missing persons among others. "Upon assessing the public safety situation, I instructed to revoke the State of Emergency from midnight yesterday [March 17]," the President said in a Twitter post. The relevant gazette notification was issued last night [March 17], the Government Press reported. The Gazette notification has been issued after President Sirisena returned to country on March 17 night after a six-day official visit to Japan. President Sirisena acting in terms of section 2 of the Public Security Ordinance, on March 6 declared an island wide state of emergency for a period of ten days after communal clashes between majority Buddhists and members of the minority Muslim community in the central hills escalated. The period of the emergency regulations in effect was scheduled to end on March 17.Two persons were killed and hundreds of Muslim-owned properties and more than 20 mosques were damaged in the communal clashes, media reported. Army troops have begun rebuilding and renovating all damaged properties in the affected areas.

The Permanent Representative of Sri Lanka to the UN in Geneva, Ravinatha Aryasinha said that progress has been made in the drafting of a new Counter Terrorism legislation. “We envisage a Counter Terrorism Act that conforms to human rights safeguards and other international standards and we expect the draft legislation to be gazetted for tabling in Parliament for consideration, once the established procedures including translation into local languages are completed, shortly,” he said. Aryasinha was speaking when the Universal Periodic Review (UPR) Report of Sri Lanka was adopted at the UNHRC in Geneva during the 37th annual session on March 19.Speaking further, Aryasinha said that the Cabinet of Ministers, on March 6, 2018, approved the formulation of legislation by the Legal Draftsman, for the establishment by law of an Office for Reparations. He said that once the draft legislation with translations into local languages is finalised, the draft Bill is expected to be gazetted. The Ambassador said that Sri Lanka has been and continues to engage actively with UN systems and procedures and across all agencies at all levels. He also drew reference to the recent incidents that took place in Kandy targeting members of the Muslim community who he says represent an integral part of the pluralistic society of Sri Lanka.

Accordingly, in February 2018 Sri Lanka was added to the European Commission's money laundering blacklist as a country at risk for acts of money-laundering. Taking into account the grave consequences of this action on country's economic and financial system, the Government has recognized the immediate need to amend the legislation in order to prevent money laundering and countering the financing of terrorism. Therefore it has been decided to made necessary amendments to the Companies act No.7 of 2007 to collect the details on shareholders who has more than 25 percent of company ownership of a company (excluding Limited Public Companies) or beneficiaries those who have active control of such company. It is also required to make measures to provide such information to the Registrar of Companies and other relevant authorities. Accordingly, the Cabinet of ministers has approved a proposal presented by the acting Minister of Industry and commerce Champika Premadasa to make the necessary amendments to the Companies act No.7 of 2007 and to instruct the legal draftsman to draft the amendments.

The UNHRC Deputy High Commissioner Kate Gilmore on March 21 presented an update on progress in promoting reconciliation, accountability and human rights in Sri Lanka (A/HRC/37/23) between March, 2017 and January, 2018 at the 37th session of the UNHRC in Geneva. Sri Lanka was last year granted 18 months by a UNHRC resolution in October 2015 to initiate a credible investigation into the nearly three-decades long civil war with the Liberation Tigers of Tamil Eelam (LTTE).Ms Gilmore said that it was much regrettable that progress in establishing transitional justice mechanisms were slow. "In the absence of concrete results or publicly available drafts of legislation, it seems doubtful that the transitional justice agenda committed to by the (Sri Lankan) government under this Council's resolution could be fully implemented before our next report in March 2019," Ms Gilmore said. The UNHRC Deputy Commissioner also said that there has been insufficient progress in returning land occupied by the military. "Trust will not be rebuilt, if land grabbing continues, nor without independent mechanisms established to determine fair compensations for land reserved for security reasons. "Furthermore, the authorities have yet to demonstrate with willingness or the capacity to address impunity for gross violations of international human rights and international humanitarian law," she said.Ms Gilmore also stressed on establishment of a specialised court to deal with serious crimes, supported by international practitioners."We are also seriously concerned about multiple incidents of inter-communal violence, attacks and hate speech against minorities observed last year a worry further exacerbated by recent developments that have occurred since the drafting of the report, including violence against Muslims in Kandy district that led to the proclamation of state of emergency for 12 days," the Deputy Commissioner said. Allegations of use of torture and continued reports of harassment or surveillance of human rights defenders are more than worrying, she added.
