According to a State Home Ministry, dip in militancy-related incidents has resulted in 55 per cent decrease in casualties in Jammu and Kashmir in 2011, Indian Express reported on December 2. As many as 158 people, including 99 terrorists, killed this year up to November 15, there were 323 people killed in Jammu and Kashmir last year during the same period, showing a dip in killings by over 55 per cent, as per the statistics. Giving further details, it said as against 40 civilian killed up to November 15 last year, as many as 28 civilian died this year during the same period. Similarly, against 66 SF personnel killed in 2010, only 31 died this year and 99 militants were killed this year against 217 last year. "There has been a decrease in the killing of the civilians and security personnel in the militancy-related incidents in Jammu and Kashmir this year as compared to last year," an unnamed senior Police officer said. There has been nearly 50 per cent fall in militancy-related incidents this year in the State with no such activities taking place in three Districts and 13 others registering just single digit terrorism cases. "There was a fall in militancy-related incidents from 336 in 2010 to 179 this year up to November 15. It shows nearly 50 per cent dip," the official added. Of the 179 cases, Jammu region witnessed 27 incidents and Kashmir region witnessed 152. As per official statistics, 13 Districts have witnessed less than 10 militancy cases this year, while no such incident occurred in Reasi, Samba and Kathua Districts in Jammu region. In Kashmir valley, Budgam witnessed three terrorism cases followed by four in Kulgam, five in Anantnag and eight each in Shopian, Ganderbal and Bandipora. In Jammu region, Kishtwar witnessed eight such cases, Ramban (5), Doda (6), Poonch (4), Rajouri (2) and one each in Jammu and Udhampur districts. Attacks directed against SFs too saw a dip from 69 cases in 2010 to 36 up to November this year. There is around 50 per cent decrease in the grenade attacks, explosions and rocket attacks this year up to November 15 as compared to the corresponding figure last year. There were 11,961 grenade attacks and explosions in the past 20-year period, 6,242 hurling of grenade incidents and 5,719 IED explosions reported since January 1990, it said. Highest number of 821 grenade attacks were reported in 1994 and the highest number of 1,280 explosions took place in 1990.

The victim, identified as Ghulam Ahmad Lone, is the president of the Safa Kadal block in Srinagar. Islamic Movement of Kashmir, an unknown militant outfit, has owned responsibility for the attack. They have threatened to carry out such kind of targeted attacks in Kashmir. The security agencies said this might be a shadow outfit of either Lashkar-e-Toiba (LeT) or Hizb-ul-Mujahideen (HM). They crossed Indo-Nepal border and entered Gorakhpur in Uttar Pradesh. Later, they boarded Amarnath Express and reached Jammu. The militant, who was initially affiliated to HM but had later switched over to LeT, had crossed over from Kashmir to Pakistan occupied Kashmir (PoK) more than a decade ago and underwent arms training there.

Use of non-lethal weapons while dealing with demonstrators and stone-pelters in Kashmir Valley has reduced casualties to civilians and Security Force (SF), an unnamed Police official said, according to IBN Live. "Use of non-lethal equipments and body protectors by Police have resulted in zero death of civilian or security personnel and injuries to only 58 persons in law and order disturbances this year," an unnamed Police official said. The injured persons include 13 civilians and 45 Policemen, he said. Security personnel this year used grenades, modified plastic body tear smoke shell, dye-maker grenade (which dyes protesters), water cannons to deal with demonstrators and stone-pelters in down-town and Srinagar city, the official said. The State Police had approached the State Government and Ministry of Home Affairs, seeking non-lethal weapons and appropriate gear to avoid damage to life and property after the 2010 unrest, he said. In 2010, 112 civilians and Policemen died and 1,049 civilian and 4,000 SF personnel were injured in law and order disturbances in the Valley, he said, adding that of these 825 SFs suffered critical injuries due to stone pelting.

Pakistani troops fired at Indian posts in Karnah Sector near the Line of Control (LoC) in the Kupwara District in the night of December 4, official said on December 5, according to Daily Excelsior. The post where the firing took place is located close to the civilian area, the official added. The Army retailed the firing with small weapons and the exchange lasted for few minutes. "As soon as the Army started firing to thwart the infiltration attempt, Pakistan Army from their forwards posts of 816, Machi Morha and Jorha Darkhat fired rockets and then started firing targeting Indian posts of PU-I and PU-II in an apparent attempt to divert their attention and abet the ultras to cross into this side’’, sources said. "Firing by our troops was aimed at only eliminating or capturing the militants alive if they managed to intrude into this side. However, effective firing by the Army forced the militants to retrieve to Pakistan occupied Kashmir (PoK) from where they had been launched by their commanders’’, they said, adding that the intrusion bid was foiled by the troops. In the morning of December 6, troops conducted a search operation in forward areas but no trace of militants was found. There were no casualties or damage on Indian side in firing by the militants and Pakistan Army, sources said. In 2009-11, 117 cease-fire violations were reported along the LoC, of which 28 were in 2009, 44 in 2010 and 45 between January and November 2011. Nine Security Force personnel were killed and around 52 injured in various firing incidents reported in 2008-11 along the International Border. Besides, two civilian porters were killed in cross LoC firing during this period.

The US-based Kashmiri separatist leader and head of Kashmiri American Council (KAC) Syed Ghulam Nabi Fai on December 7 pleaded guilty to federal charges of spying for the Inter Services Intelligence (ISI) and illegally lobbying the Congress to influence the American policy on Kashmir, according to Daily Excelsior. Pleading before the US Eastern District Court of Virginia, Fai, pleaded guilty and agreed to the charges of federal prosecutors that he received at least USD 3.5 million from ISI between 1990 to 2011 causing revenue losses to the US Government to the tune of USD 200,000 to 400,000. Fai agreed before the court that he was in direct contact with the ISI officials including the head of its security directorate. He conceded receiving talking points from ISI regarding what to say and write. He agreed that he received directions from ISI with regard to which specific individuals to invite for KAC conferences. Fai has consented to forfeit all four bank accounts in his name or in the name of KAC totalling about USD 140,000. He also agreed before the court that he had send to the ISI annual budget of the KAC for approval. Fai continues to be under house arrest till the time of his sentencing. His sentencing is scheduled for March 9. Fai was arrested on spying charges on July 19 and then put under house arrest.

The use of non-lethal equipments and body protectors by Police in 2011 has resulted in zero death of civilians and security personnel. It has also resulted in less number of injuries during law and order disturbances in the State, Director General of Police (DGP) Kuldeep Khoda said. "The new equipments include Blast Dispersal Cartridges (BDC), Vehicle mounted tear-smoke devices and Stun-lac grenades," he said, adding, "The supply is underway in addition to the other equipments which are already being used by the police in the past." The items ordered also include body protectors, polycarbonate shields, polycarbonate lathis, helmets and visors, bullet proof bunkers, pump action guns, water canons, anti-riot rifles, rubber pellets and plastic pellets. In addition to this, the State Police has also set up exclusive five law and order battalions to deal with protestors in Jammu and Kashmir. The training imparted to the troopers and officers in using non-lethal equipments would help them in controlling the situations without causing any damage to the human lives.

Hindustan Times adds that the NIA has unearthed a hawala operation of front organisations of Pakistan-based terror outfits Lashkar-e-Toiba (LeT) and HM for providing money to families of terror operatives killed all over India. The NIA has detected in the last few years a well-oiled hawala operation to tune of around INR one Billion. According to sources in the NIA, a part of the money received by HM operatives goes to certain separatist leaders in Kashmir and another chunk is devoted to fuel militancy. The NIA has registered two FIRs based on the information gathered by it. “The funds received from Pakistan are transferred to Jammu & Kashmir, Delhi and other places in India through the hawala channel by a front organisation of HM which goes by the name of Jammu & Kashmir Affectees Relief Trust (JKART),” states one of the FIRs. The JKART, according to the FIR, has its head office in Rawalpindi and branch offices in Islamabad and Muzzafarabad in PoK. The sources in the NIA said that Delhi had emerged as a major hub for this operation. Once money reaches the national capital, it is disbursed through conduits based in Jama Masjid, Lajpat Nagar and Bhogal areas. The NIA suspects the use of normal banking channels to disburse the money once it reaches Delhi. “The HM is getting significant funding from Pakistan based Hizb-e-Islami which led by Masood Sarfaraz. In case of LeT, the money is coming from the Gulf too,” said an NIA source.

The agency, which registered an FIR under various sections of the Indian Penal Code (IPC) and Unlawful Activities (Prevention) Act (UAPA), named two Pakistani nationals who are heading the JKART. Chairman of the trust Mahboob-ul-Haq and general secretary Masroor Dar have been named by the NIA in the FIR. The two are reportedly close to HM chief Syed Salahuddin and are responsible for transfer of money to their cadres in the Valley and PoK. The agency is learnt to have picked up a conversation where the two named in the FIR can be heard allegedly directing cadres to provide logistical support and money to terrorists in the Valley. Investigators allege that JKART has pumped in more than INR 800 million into the Valley in the name of relief and rehabilitation work, diverted to finance terror. Founded in 1990, the JKART runs a refugees camp in PoK. According to NIA’s FIR, in October the NIA received credible information about illegal funding by HM in J&K to mujahideen who are fighting against the Indian Security Forces. “Investigation so far has revealed that apart from banking channels, terrorists across the border have used hawala [illegal money transfer] channel and human couriers,” said a NIA official.

It said of the 132 cases it has documented, militant groups were responsible for 24 cases of enforced disappearances compared to 22 by the SFs, including Police. "According to documented findings, out of 132 disappearance cases, 21 have been perpetrated by forces of the Indian army, 24 by different militant groups and one by the personnel of Jammu and Kashmir police," spokesman of APDP Yasin ul Hassan Malik said. In 43 other cases, the perpetrators were unidentified gunmen and in the remaining 43 cases, the victims disappeared in unknown circumstances. The APDP on December 10 submitted a list of 132 cases of enforced disappearances in remote Banihal area to the state human rights commission (SHRC). In the 24 cases of disappearances, as reported by the families of the victims, Hizb-ul-Mujahideen (HM) militant Nazir Ahmed Wani alias Papplu was blamed for 10 cases. Over the years, the separatists and human rights activists in Kashmir have been blaming security forces for the enforced disappearances, which APDP puts at 8,000, since militancy erupted in the State in 1990.

He said Kashmir was classified as a "disturbed" area by a Parliament resolution, which made the applicability of AFSPA possible in JK. "On the other hand, DAA is a state law which was meant to give more power to police." "DAA was supposed to be extended every year but last time it was extended in 1997. So DAA does not even exist today in Kashmir," Rao said. A Police statement issued in Srinagar, "Baramulla Police today presented a charge sheet against 20 persons in the competent court of law for setting ablaze government property worth crores of rupees at Tangmarg last year. The incident had happened on September 13, 2010, when an unruly mob wrought destruction and devastation at Tangmarg town by burning down different government buildings, including the tehsil office complex, animal husbandry department building, social welfare office building and Tyndale Biscoe School building among others". "Fifteen accused persons were presented before the court and charge sheeted along with five deceased persons for the crimes punishable under sections 307, 436, 147,148, 149 of the RPC," the statement said. This is the first time that Police have formally filed charges against someone in connection with arson and destruction of public property during the unrest.

Army opened firing to neutralize the militants. Exchange of firing continued for about 20 minutes after which the militants retrieved to Pakistan occupied Kashmir (PoK) taking cover of darkness. "There is danger of battle-hardened militants arriving in Kashmir if American Army leaves Afghanistan," he said. "For the last 10 years, we are seeing that what is happening in Afghanistan is definitely having an impact on Pakistan and on Kashmir. Our assessment for future, for 2012, will depend on what will be the situation in Afghanistan. In 1990 when Russians left Afghanistan many militants of that time entered the Valley. Possibility is there if American Army leaves Afghanistan, some terrorists will try to come here. Whenever there is turbulence, it has an impact on surrounding areas," Hasnain added. He said at present security developments in Afghanistan and Pakistan also suggest that by next year, militants fighting against NATO forces would find their way into Kashmir. "We will not lower our guard even when the infiltration routes are closed due to heavy snowfall," he said, adding that militants would now try to take other routes, including Uri, to sneak into this side during winter season. Militants may take advantage of the less snow and sneak from this sector.

A statement issued by the public relations office of the army here said: "Elimination of a large number of guerrillas in the hinterland this year has created a vacuum in the terrorist leadership and their effectiveness. Therefore, there is pressure on the terrorists in the training camps/launch pads in PoK [Pakistan occupied Kashmir] to infiltrate. This has been corroborated by intelligence inputs of various intelligence agencies which have indicated presence of an additional 100 militants across the LoC poised for infiltration. Traditionally, infiltration decreases with the onset of snow, but due to late winter, terrorists, as in the past, will make desperate attempts to infiltrate in the coming few months." The statement also said that attempts were being made by vested interests to upset the synergy between various Security Forces conducting counter-insurgency operations in Jammu and Kashmir. "There appears to be an attempt by inimical elements, probably from across the LoC, to drive a wedge between the army, other Security Forces and the State Government with a view to breaking the excellent synergy which has been generated throughout 2011," it added. Pakistan Army violated cease-fire while trying to give cover to these militants to sneak into Indian side. Troops from the forward posts in Krishna Ghati sector observed movement of three militants moving towards the LoC at 12.40am."Army allowed the militants to come close to the LoC. However, before the three militants could reach within the firing range, they hid themselves behind the bushes. Simultaneously, Pakistan Army started firing from their forward posts of Daaku, Kaddu and Yellow Bump targeting Indian posts of Kirpan-I, Kirpan-II, Kranti-I and Kranti-II’’, an Army official said, adding that troops from this side retaliated to neutralize the militants. About 700 to 800 rounds were fired from Pakistan side with medium to small fire arms till 2am. The infiltration attempt was foiled successfully. The Army official said there were no casualties or damage on Indian side in the firing but movement across the LoC on Pakistan side indicated that either one militant or an Army trooper was killed in retaliatory firing from this side.

Dar is an IT expert and has been working for HM militant network for about a year. Police are working out whether he was planted by the HM in the BSNL or he was trapped by them after he joined the BSNL. Superintendent of Police (Sopore) Imtiaz Ahmad Mir said that there are other people also who are involved in helping the HM militants to get BSNL SIM cards. "However, they have not been arrested yet. Two HM militants who traveled on Pakistani passports to Nepal from Pakistan on their way to the Bandipora District were arrested in the outskirts of Bandipora town on December 22. Two Pakistani passports, Nepal visa, PKR 6,000 and few SIM cards were recovered from their possession. The arrested militants were identified as Tariq Ahmad Malla and Sajad Ahmed Mir. During questioning the two militants revealed that they received arms training for three months in 2003 at militant training camps in Abbottabad, bordering Pakistan occupied Kashmir (PoK), in the same area where Osama Bin Laden was killed by US Navy Seals on May 1-2. The duo then left the camp and were working there as labourers. The duo revealed that they entered India via Nepal on Pakistani passport on December 21. So far Bandipora Police have arrested six militants with Pakistani passports in past three months. All the arrestees had used Nepal route for entering into India on their way to Bandipora. The report further said that nine of militants have returned to their homes along with their wives and children from PoK during the past one year via Nepal or after crossing the LoC. Majority of them surrendered before Police after their return.

According to the official data of Jammu and Kashmir (J&K) Home Department, militants have triggered as many as 11,970 blasts to target security personnel and civilians in the state since 1990, reports Greater Kashmir. A total of 1,766 people were killed and 15,685 others injured in these blasts, it mentioned. Of the total number of blasts, 5,722 were triggered using (Improvised Explosive Device) IEDs while the remaining 6,248 by hurling grenades, the data said. Further, it stated, the highest number of blasts took place in 1990 (1,522), followed by 1,005 explosions in 1993. While the maximum number of casualties were reported in 1995 (153 deaths, 1,021 injured), the year 2001 came a close second with 133 deaths and 1,443 injured, the report said. However, there has been a fall in grenade attacks during the past two years as only 39 and 65 blasts were reported in 2011 and 2010 respectively as compared to 79 and 170 blasts in the preceding two years.

Troops replied the firing effectively across the Line of Control (LoC). Firing continued for more than 50 minutes. This was 42nd ceasefire violation by Pakistan Army during2011, an Army official said. He added that Pakistan Army started heavy firing with Machine and Pika Guns at Loona Wali in South of Haji Peer at Sabjian in Poonch District at 1.20 pm. Initially, Pakistan Army fired with Machine and Pika guns but later used Rocket Projectile Guns (RPGs) targeting Indian posts. He further added, "We also fired in retaliation to silence Pakistani guns. Firing from both sides stopped at 2.10 pm’’. Describing ceasefire violation by Pakistan Army as totally unprovoked, the Army official said no infiltration attempt was visible during firing from across the LoC. He added that Pakistan Army fired 300 rounds of Machine Gun, 200 rounds of Pika Gun and seven rounds of RPG.

"As many as 4,080 terrorists, including 276 self-styled commanders, have surrendered before Security Forces and Police during the past 22 years in JK," the data up to November 30 stated. While 19 militants surrendered in 2011 year till November, 20 militants surrendered in 2010, it said. 15 militants surrendered in 2009, while 38 in 2008, 122 in 2007, 190 in 2006, 64 in 2005, 137 in 2004, 119 in 2003, 159 in 2002, 85 in 2001 and 104 in 2000, the data said. The highest number of 655 terrorists had surrendered in 1996, followed by 612 in 1991, 601 in 1995, 444 in 1992, 270 in 1997, 187 in 1998, 109 in 1999, 98 in 1993 and 32 in 1994. The State Government has formulated a rehabilitation policy for the surrendered militants under which 2,876 of them have been provided INR 300000 as fixed deposit for three years and a monthly relief of INR 3,000. Reports indicate that 900 to 1,000 militants are ready to sneak in from Pakistan Occupied Kashmir (PoK), reports Daily Pioneer. This figure is double the number of militants who were poised to infiltrate in 2010. Sources said while 500 to 660 militants were poised to infiltrate in October 2010, the figure 2011 stood at 900 to 1000. In November 2010, the figure stood at 350-400 and in 2011 in the corresponding period it was 750-850. The 15 Corps chief, Lieutenant General Syed Ata Hasnain said, “There has not been any major effort (of infiltration) or contact (with militants) during the past two or two and a half months. But this doesn’t mean that no attempts would be made in future. There have been attempts in January and February also,” he said. He said the terrorists and their launch pads were intact across the Line of Control (LoC) and the infiltrators have shifted their focus from the traditional routes. “The infiltrators are focusing on Uri and Lipa sectors rather than the traditional Gurez, Macchil and Keran sectors,” he added.

Although the exact number of Peoples Liberation Army (PLA) men and engineers engaged in building infrastructure across the Line of Control (LoC) is not known, their number has increased in recent months, he added. "Our intelligence reports about the presence of PLA (men and engineers) have been authenticated now, and their number is on the rise," he stated. The Indian Army had the knowledge of the deepening Chinese presence in PoK, especially after the 2005 quake, when many construction works were given to Chinese companies. Stating that there are inputs that militants from across the border could be planning some action in the country and they have identified some targets, Union Home Minister P Chidambaram said, "This morning, we have taken a decision to increase level of alertness in states bordering Pakistan and that includes Punjab". Asked whether there was any terror threat to upcoming polls in Punjab, he said due to the "very strong continuing flow of information" the directive has been issued for alertness in bordering States, including Punjab and Jammu and Kashmir. He said with elections coming up in Punjab, the Government has to remain at a high level of alertness in the state. "What we gathered, we review every day... We alert the states who are targets... Apart from the jehadi groups, there is BKI (Babar Khalsa International) and some other Khalistani groups. We did bust a BKI module a few days ago. So, we have to remain in high alert in Punjab. We are working with the Government of Punjab and we will continue to remain high alert," he added. Asked whether there was revival of Khalistan movement in Punjab, he said, "There is no revival. These are remnant elements from old groups. Many of them have fled the country, many of them have taken refuge in foreign countries. These are remnant groups. There is no revival of Khalistan movement".

"As far as talks with the separatist groups in Jammu and Kashmir is concerned, we are always open to talk to them. It is not that the channels of communication with some of them have entirely cut off. These channels are still open and it is possible that some of them in 2012 will agree to come forward for talks. If they are ready for talks, we are ready for talks," Union Home Minister P Chidambaram said. He was replying to a question on the possibility of peace talks with Jammu and Kashmir-based separatist groups in 2012. Asked about the report of the three Interlocutors on Kashmir, Chidambaram said the Cabinet Committee on Security has been briefed once on the Interlocutors report. "They have asked for a fuller, longer briefing for which we have to find time. I hope that, that will take place in early January and I hope that once the CCS is briefed, Interlocutors report will be published. There is no hesitation in making it public," he said. The Interlocutors submitted their report to Chidambaram in October 2011.
