A court in New Delhi on January 17 allowed the Enforcement Directorate (ED) to interrogate four Lashker-e-Toiba (LeT) terrorists and a hawala (illegal finance network) dealer arrested on January 15 in connection with a plan to disrupt the Repubic Day parade of January 26. As reported earlier, the four LeT terrorists were arrested from a private hostel in South Delhi and police sources said they had been tasked to carry out bomb explosions on the Republic Day parade route during rehearsals to force cancellation of the parade on January 26.

A Delhi Court has allowed West Bengal Police to take the custody of four terrorists of the Harkat-ul-Jehadi-e-Islami (HuJI), wanted in connection with the abduction of a businessman and for carrying out other subversive activities in the State. Granting transit remand of the four terrorists, arrested by Delhi Police on January 31 and February 6, the court asked the West Bengal police to produce them before the Sub-Divisional Judicial Magistrtae, 24 Pargana (south), in Kolkata before March 15, 2002. Earlier, the court had issued the production warrant for three Pakistani nationals and a Bangladeshi who were arrested for illegally entering the country to carry out subversive activities. The four terrorists were booked by the Delhi police under the Prevention of Terrorism Ordinance (POTO) and had confessed that they had entered India to carry out subversive activities.

The Supreme Court on April 2 upheld the death penalty awarded to a Khalistani terrorist Devender Pal Singh under the erstwhile Terrorist and Disruptive Activities (Prevention) Act (TADA) on the basis of a confessional statement to the police which he had later retracted. Singh was an accused in the 1993 car bomb attack, which targeted the then Youth Congress President M S Bitta. Nine persons were killed in that incident. The Court held that death penalty was “the most appropriate sentence” for Singh. He confessed “voluntarily” and his retraction was an “afterthought”, added the court.

A Delhi court on April 8 closed a 11-year old case filed under the Terrorist and Disruptive Activities (Prevention) Act, TADA, against the Akali Dal (Mann) leader and Member of Parliament Simranjit Singh Mann, saying the prosecution was not interested in his trial. The court observed, "The case is closed against Mann because this court feels that the prosecution is not interested in arresting him and sending him to face trial in the court". The court said despite warrants issued against Mann and another Akali leader Talib Singh Sandhu 11 years ago, the same had not been executed and these persons were ‘roaming freely’. A TADA case against Mann was filed in 1991 for alleged activities of sedition and delivering inflammatory speech at a Gurudwara in the capital where he had spoken about formation of Khalistan.

A Delhi court on April 18 discharged four out of six terrorists of the Jammu-Kashmir Islamic Front (JKIF) chargesheeted by the city police for allegedly waging war against the Government of India. The court acquitted the four for want of sanction from the Union government to prosecute them for waging war against the government of India as also for lack of evidence. However, the court framed charges against two other JKIF terrorists Feroze Ahmad Mir and Mohammad Sayed Tantrik alias Yusuf under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guest house in Delhi and seized Rs 15 lakh from them. Later rests of the accused were arrested on the basis of their statements.

A Delhi court on April 27 sentenced three Pakistani terrorists of the Harkat-ul-Ansar (HuA) to death in the case of abducting four foreign nationals in 1994, in which Omar Sheikh, a leader of the Jaish-e-Mohammed (JeM) was the main accused. The court awarded the death sentence to Nazir Khan, Abdul Rahim and Naser Mahmood Sadozi and gave life sentence to Mahmood, Mohammed Sayeed and Narul Amil A total of 11 persons were accused in the case registered under various sections of the Indian Penal Code, the Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Arms Act.

Aftab Ansari, prime accused in the January 22 terrorist attack on the American Centre in Kolkata, is to be produced before a Delhi court today, on May 6. Delhi police sources said that they would seek custody of Ansari to enable them to interrogate him in connection with a case relating to the destroying of a Pakistani Inter Services Intelligence (ISI) run network of terrorists and criminal gangs. Ansari was brought to Delhi from Kolkata by a special team of Delhi Police’s crime branch, which obtained transit remand of the accused till May 6 from a Kolkata court.

Rejecting the petition, the court observed, "Considering the seriousness of the charges this is not a case for release of the petitioner from jail". The three defence witnesses tried to impress upon the court that the data collected from the computer allegedly recovered from the accused were fabricated, the SIM card seized from them could have been duplicated and hand written transcriptions not genuine. JeM terrorists Mohd Afzal, Shaukat Hussain Guru, his wife Navjot Sandhu alias Afsan Guru, and S A R Geenai are facing trial for the December 13, 2001- attack on India’s Parliament. Setting aside an order of a Delhi Special Court which held that intercepted conversation between the accused in the December 13, 2001-Parliament attack case, S A R Geelani, terrorist Shaukat Hussain alias Guru and his wife Navjot Sandhu alias Afsan, was admissible under POTA, the Court said, "The admissibility of intercepted evidence for proving charges under POTA is specifically barred by Chapter-V of the Act," if not procured as per the laid down procedure. "Evidence of intercepted conversation sought to be produced and proved by the prosecution for proving offences under POTA, being in contravention of Chapter-V of the Act, is inadmissible," the Court said. The order came on appeals by the three accused against the Special Court's July 11-order rejecting their applications challenging the inclusion of intercepts as evidence under POTA.

Media reports said, a Delhi court is expected to pronounce its judgement today, December 11, in the December 13, 2001-Parliament attack case. Four people, including two alleged Jaish-e-Mohammed (JeM) terrorists and a suspended Delhi University lecturer––were tried under the Prevention of Terrorist Act (POTA) in the case. The accused have been charged with threatening the unity, integrity, security and sovereignty of the country by waging war against it and committing several other offences under POTA, Indian Penal Code (IPC), Explosive Substance Act and the Arms Act. A civilian and nine security force personnel were killed and 16 others injured when five Pakistani terrorists stormed the Parliament. All five terrorists, too, were killed in the incident

Reports said the Delhi High Court, on December 12, taking note of the sale of weapons seized by the Customs Department from smugglers to important persons, ruled they be sold at market price. The directive was issued while hearing of a petition filed by People for Animals, a voluntary organisation headed by former Union Minister Menaka Gandhi. Besides, The Court also asked the Union government to submit details of numbers of confiscated weapons subsequently supplied to the security forces, and details of their actual requirements.

A special court in De;lhi, on December 16, convicted four accused, including a woman, in the December 13, 2001-Parliament attacks case. Special Judge S N Dhingra held three of the accused—Jaish-e-Mohammed (JeM) terrorists Mohammad Afzal and Shaukat Hussain Guru and suspended Delhi University lecturer S A R Geelani—guilty of various offences under the Prevention of Terrorism Act (POTA), the Indian Penal Code (IPC) and the Explosive Substances Act. The fourth accused, Navjot Sandhu, alias Afsan Guru, was convicted under section 123 IPC for concealing information about ‘war against the state’. JeM chief Maulana Masood Azhar, the outfit's chief commander in Jammu and Kashmir (J&K) Ghazi Baba alias Abu Jehadi and Tariq Ahmed have been declared proclaimed offenders. The five terrorists who had been killed in the attack on Parliament have been convicted, too, for the crime.

A Delhi court on December 21 discharged the leader of the proscribed Students Islamic Movement of India (SIMI), Mohammed Javed Iqbal, in a sedition and unlawful activities case and also dropped sedition charges against its president Shahid Badar and three others. While discharging Iqbal, the court granted bail to Badar and four others in the case. The court also dropped sedition charge against Badar in another case and granted him bail on a personal bond of Rs 5,000 and one surety. Discharging Iqbal, the court said there was no material evidence against him except his confessional statement.

Iftikar Geelani is the Kashmir Times’ Delhi bureau chief and son-in-law of All Parties Huriyat Conference (APHC) leader Syed Ali Shah Geelani, and was arrested on June 9, 2002 under the Official Secrets Act for allegedly possessing documents compromising India’s national security.
