February 4, 2003 has been fixed as the date for commencement of trial, reports added. The court framed charges against LeT terrorists and Pakistani national Ashfaq, his wife Rahmana Yusuf Farooqi, Babar Mohsin Bhagwala, Devender Singh, Shahnshah Alam, Rajiv Kumar Malhotra, Moolchand Sharma, Matlub Alam, Farooq Ahmed Qasid and Nazir Ahmed Qasid for attacking the Red Fort. On December 22, 2000, a Lashkar-e-Toiba (LeT) suicide squad attacked the Red Fort in New Delhi, killing two Army personnel and a civilian.

Media reports said a Delhi court on January 8 postponed to January 17 the hearing on the bail application of Iftikhar Geelani, pending completion of proceedings in the lower court. The court said, since the government has rejected the opinion of the Military Intelligence on the sensitivity of documents seized from Iftikar, the hearing was adjourned to await the outcome of the lower court. The lower court has summoned Director-General Military Intelligence (DGMI) Lt. Gen O. S. Lochab and Joint Commissioner of Police Neeraj Kumar. On December 23, 2002, Lochab appeared before the Chief Metropolitan Magistrate and said documents recovered from Iftikar did not contain any classified information. Iftikar Geelani, a journalist and son-in-law of All Parties Hurriyat Conference (APHC) leader S A S Geelaniu, was arrested on June 9, 2002 under the Official Secrets Act for allegedly possessing documents compromising national security.

According to media reports, a Delhi Court, on January 13, released Syed Iftikar Geelani, seven months after he was arrested for alleged violation of the Official Secrets Act. He was released as the government withdrew charges against him. Iftikar Geelani’s counsel said a case for compensation and probe into the ‘‘conspiracy’’ to level allegations against him would be filed soon. Iftikar Geelani said he was victimised by certain people in the Intelligence Bureau (IB) and some bureaucrats, but did not mane them. Iftikar Geelani, Kashmir Times New Delhi bureau chief and son-in-law of All Parties Huriyat Conference (APHC) leader Syed Ali Shah Geelani, was arrested on June 9, 2002 for allegedly possessing documents compromising national security.

Media reports said the Supreme Court, on January 13, admitted a batch of petitions challenging the Prevention of Terrorism Act (POTA). Among the petitions filed was one by Marumalarchi Dravida Munnettra Kazhagam (MDMK) leader Vaiko, detained under POTA in Tamil Nadu since July 11, 2002, for allegedly making statements in support of the proscribed Liberation of Tamil Tigers Elam (LTTE). While admitting the petitions and fixing the matter for final disposal in March, the Bench said it was an important issue and needed to be heard in detail. Besides Vaiko, the People's Union for Civil Liberties (PUCL) and All India Human Rights and Justice Front (AIHRJF) have challenged POTA on the grounds that its provisions were draconian and violated fundamental rights guaranteed in the Constitution.

Geelani was sentenced to death, while Afsan Guru was awarded five years rigorous imprisonment. Both the convicts, in their appeal to the Delhi High Court, on January 14, sought discharge in the case claiming that there was no evidence against them, reports said. Two other accused––Mohammad Afzal and Shaukat Hussain Guru, with links to the Jaish-e-Mohammed (JeM)––were sentenced to death, too. They too are expected to challenge their conviction.

According to media reports, the Delhi High Court, on January 16, admitted the appeal of former Delhi University lecturer S A R Geelani, who was, on December 18, 2002, sentenced to death in the December 2001-Parliament Attack Case, by a special Prevention of Terrorism Act (POTA) Court. In its order the HC also directed the Tihar jail authorities to produce Afzal before it on February 3, when the reference for confirming the death sentences imposed on three convicts would be heard. The appeal of other convicts in the case–– another JeM terrorist Shaukat Hussain Guru, his wife Navjot Sandhu alias Afsan Guru and S A R Geelani have already been admitted by the Court on January 15, 16 and 22 respectively. According to media reports, a Delhi Court, on February 22, framed charges against Shiromani Akali Dal (Mann) president and Member of Parliament Simranjit Singh Mann under the Terrorist and Disruptive Activities (Prevention) Act (TADA) and the Indian Penal Code (IPC). He is accused of instigating people at a religious place in Delhi, on April 7, 1991, to create an independent, sovereign Khalistan. Mann pleaded not guilty and said he would stand trial. The case was earlier closed down on April 8, 2002, saying police was not interested in presenting him, and another accused Talib Singh, in the court to stand trial. The case was reopened in September 2002, following an order of the Supreme Court. At the height of the secessionist, terrorist movement in Punjab in the early 1990s, Mann had started a campaign for the creation of Khalistan.

They were sentenced under section 120-b of the Indian Penal Code (IPC) and various provisions of the Arms Act and Explosives Substances Act. Delhi police, on May 23, charge-sheeted two leaders of the All Parties Hurriyat Conference (APHC), including its Delhi-based spokesman Shabir Dar while naming former Deputy High Commissioner of Pakistan to India Jaleel Abbas Gilani and Hurriyat Chairman Abdul Gani Bhat as accused who could not be sent for trial. They have been charge-sheeted under Prevention of Terrorism Act (POTA) for allegedly funding terrorist activities in the country. Police sources said Gilani and Bhat had been kept in column number two of the charge-sheet meant for persons not sent for trial. While Gilani enjoys diplomatic immunity, there was not enough evidence against Bhat who was questioned by the Delhi Police in March 2003. Dar was arrested on February 6, 2003 in Delhi for allegedly receiving funds from Pakistan High Commission for passing them on to terrorist groups in Jammu and Kashmir.
