A Delhi court on February 3, framed charges against a Pakistani national, a suspected Lashkar-e-Taiba (LeT) operative, Arshad Khan who was arrested along with others for allegedly conspiring to kidnap businessmen from various places to raise funds to carry out terror strikes in the capital, reports The Times of India. Additional Sessions Judge Reetesh Singh formally framed charges against Arshad Khan after he was produced before the court in Delhi through video conferencing from Kolkata Jail. Khan, who is lodged in Kolkata Jail in connection with shoe baron Partha Roy Burman kidnapping case of 2001, was not produced before the court here on January 19 when the judge had framed charges against four other co-accused in the case.After framing charges against Khan for alleged offences under section 120-B (criminal conspiracy) of the Indian Penal Code (IPC) and under sections 18 and 20 of the Unlawful Activities (Prevention) Act (UAPA), the court has now posted the matter for recording of prosecution evidence on April 1. Section 18 of UAPA pertains to punishment for conspiracy, while section 20 relates to punishment for being a member of terrorist organisation.

Eleven suspected Islamic State (IS) operatives, who were arrested from across the country for allegedly recruiting and financing people to join the terror group, were remanded in seven days National Investigation Agency (NIA) custody by a Delhi court on February 5, reports The Times of India. The NIA said in its remand application that the accused have disclosed during their interrogation "their involvement in this case about recruiting and financing persons willing to join the Caliphate of ISIS at Syria"."They were also found to be in communication with some active members through chatting applications 'Signal', 'Trillion' and 'Skype' in order to motivate them to join ISIS in furtherance of activities of its ideologies, thereby luring youths to join this proscribed terrorist organisation. "The identity and role of such associates is being ascertained," NIA said.The eleven accused who were remanded in seven days NIA custody are Mohd Aleem, Mohd Obaidullah Khan, Nafees Khan, Mohd Shareef Moinuddin Khan, Asif Ali, Najmul Huda, Mudabbir Mushtaq Shaikh, Mohd Abdul Ahad, Suhail Ahmed, Syed Mujahid and Mohd Hussain Khan. Besides these 11 accused, four other co-accused -- Mohd Afzal, Imran, Abu Anas and Nasser Packeer -- were also produced before the court which remanded them in judicial custody. Except Nasser, who was in judicial custody, all the other 14 accused were produced before the court after expiry of their NIA custody.

Earlier, on January 30, 2016, the court had sent them to the National Investigation Agency’s (NIA) custody for 10 days. The investigating agency alleged that the accused, Adnan Hussain, Mohammad Farhan and Sheikh Azhar Al Islam, hailing from Karnataka, Maharashtra and Jammu and Kashmir respectively were allegedly on a mission to carry out terror attacks in India and some other countries.

According to the investigating agency, during the custodial interrogation, the suspects supposedly revealed that are "active supporters" of the IS. They claimed that they were in "close contact with several members of the IS and confessed to a larger conspiracy" to identify, promote and recruit persons to further their ideology.

Delhi High Courtrefused to grant bail to one of the five accused arrested for allegedly supplying sensitive documents to Inter-State Intelligence (ISI) operatives of Pakistan, saying allegations against him were "very serious in nature", Asian Age reports on March 7. Justice P S Teji denied relief at this stage to accused Fareed Khan, an Army Constable who allegedly shared secret information with other co-accused who used to forward them to Pakistan based intelligence operatives for monetary gains."In light of the facts and circumstances, this court is of the view that the allegations against the petitioner are very serious in nature, he is involved with other co-accused in supplying the information relating to Indian national security to Pakistani intelligence agency ISI...In the kind of cases in which petitioner's involvement is disclosed by the main accused and recovery of documents from the petitioner, in the considered opinion of this court the submission of Additional Public Prosecutor ... regarding misuse of liberty of bail either by fleeing from justice or by tampering with evidence or by indulging again in anti-national activities, cannot be ruled out at this stage, especially when the trial is at an initial stage," the court said.It said after careful scrutiny of the case and examining the contents of the petition and the FIR, "this court observes that the name of the petitioner is disclosed by the main accused Kaifaitullah Khan, who was the ISI Agent." All the five accused were arrested in connection with alleged supply of secret Indian documents to an operative of Pakistan's ISI.

A Delhi court on April 12, extended by a month the period of detention of four suspected Islamic State (IS) operatives after the National Investigation Agency (NIA) submitted that the larger conspiracy of the outfit in India and abroad, including recruitment of resident and non-resident Indians, was yet to be ascertained reports Zee News.District Judge Amarnath extended the period of detention of accused, Mohammad Azeemusan, Mohammad Osama, Akhlakur Rehman and Mohammad Mehraz, beyond 90 days till May 12, 2016 on a plea of NIA which said that probe into the case was spread in different parts of the country and abroad. According to the sources, during an in-chamber hearing, NIA also submitted the report of the probe before the court in a sealed cover. "During the course of investigation, larger conspiracy of IS activities in India and abroad including recruitment of resident and non-resident Indians by the IS is yet to be ascertained...The investigation in the instant case is spread in different parts of country and abroad," the NIA said.

The Supreme Court (SC) on April 29 refused to hear a petition filed by Malegaon blasts (2006, Maharashtra) accused Lieutenant Colonel Prasad Shrikant Purohit seeking a stay on the National Investigation Agency (NIA) court proceedings to frame charges against him on the basis of a charge sheet filed by the Anti-Terrorism Squad (ATS) of Maharashtra in 2009, reports The Hindu. A Bench of Justice S.A. Bobde and Arun Mishra asked Purohit to approach the High Court (HC) concerned and allowed him to withdraw.

Three suspected JaisheMohammed (JeM) militants, identified as Mohammad Sajid, Shakir and Sameer arrested for allegedly planning an attack in the national capital, were on May 4 remanded to 10day Police custody by a court as the investigators said their custodial interrogation was needed to crack their Delhi module, reports NDTV.During the proceedings, Police told the judge that Mohammad Sajid was arrested and Improvised Explosive Device (IED) was recovered from him, adding that his hand was also burned while making explosives. The agency while seeking 15day custody told the court that the two other accused Shakir and Sameer were later arrested and some literature related to the terror organisation were recovered from them. Their movement was being continuously monitored by the central intelligence agencies and special cell of the Delhi Police for last one year, sources said, adding the trio had got indoctrinated through the internet. While Sajid and Sameer hail from Delhi, Ansari is a resident of Deoband in Uttar Pradesh (UP). Nearly 23 years after a series of bomb blast in various Rajdhani Express trains, the Supreme Court has upheld the conviction and life term of as many as 10 accused in the cases while setting free four others, Times of India reports on May 14. A bench of justices FMI Kalifulla and UU Lalit said the prosecution has been successful in establishing its case against 10 accused for their varying roles in the 1993 serial blasts in trains. The verdict came on appeals filed by 14 of the total 16 convicts under the now-repealed Terrorist and Disruptive Activities (Prevention) Act, against the judgement passed by designated TADA court at Ajmer in 2004. The trial court had held 14 people guilty under various provisions of the TADA and the IPC. One of the 16 accused Irfan Ahmad had escaped from custody during the trial while another claimed juvenelity which led to separation of his trial.

A special court in New Delhi on June 3 sent Indian Mujahideen's (IM) alleged key operative, Abdul Wahid Siddibapa to judicial custody till July 1 after National Investigating Agency (NIA) submitted that his further custodial interrogation was not required in the case, reports DNA. Siddibapa, a resident of Bhatkal in Karnataka, was produced before Special Judge Rakesh Pandit on expiry of his seven-day NIA custody. Siddibapa, cousin of IM co-founder Yasin Bhatkal, was arrested at Indira Gandhi International Airport on May 20 after his arrival from Dubai.Earlier while seeking his further remand by 15 days, the NIA had told the court that during the interrogation, the accused said that he was the handler in several transactions through hawala for terror activities. It had submitted that after the disclosure made by Siddibapa, a number of teams have been sent to several spots for verification of fund transactions in places like Mumbai. It had also told the court that several other places, including Dubai, also needed to be verified in connection with fund transaction and teams will be sent to these places soon. NIA had alleged that Siddibapa played an active role as the main conduit in the chain of fund supply from Pakistan via Dubai to other IM operatives based in India for commission of terrorist acts.

Six months after Mohammed Asif was arrested by Delhi's Special Cell unit, Delhi Police submitted its chargesheet accusing 17 operatives, out of which, 12 are absconding, for allegedly conspiring, recruiting Indian youths and establishing a base of terror outfit Al Qaeda in Indian Subcontinent (AQIS), dnaindia.com reports o June 11. Through its investigation in the past six months, the probe agency alleged that AQIS through its 'chief' Sanaul Haq was trying to set up base in India. In the more than a thousand-page charge sheet filed before Additional Sessions Judge (ASJ) Reetesh Singh at Patiala Court, Delhi Police charged the five arrested accused -- Mohammad Asif, Zafar Masood, Mohammad Abdul Rehman, Syed Anzar Shah and Abdul Sami, for alleged offences under the provisions of Unlawful Activities (Prevention) Act (UAPA). The five accused were arrested between December 2015 and January 2016 from various parts of the country.Besides these five, Police have also charged 12 others who are absconding and have a non-bailable warrant (NBW) issued against them by the court. The absconding accused are AQIS 'chief' Sanaul Haq, Syed Akhtar and Usman, who are believed to be working directly for Haq and others that include Mohammad Sharjeel Akhtar, Mohammad Rehan, Abu Sufiyan, Syed Mohammad Arshiyan, Syed Mohammad Zishan Ali, Sabeel Ahmed, Mohammad Shahid Faisal, Farhatullah Ghori and Mohammad Umar.In the charge sheet, Delhi Police have outlined Asif's journey from working in a building materials supply shop in Western Uttar Pradesh's Sambhal district to becoming the head of the Indian Chapter of AQIS. Based on Asif's interrogation and testimony, authorities apprehended Masood, Rehman and Shah from various parts of the country. Through its investigation in the past six months, the probe agency alleged that AQIS through its 'chief' Haq was trying to set up base in India. Asif, also from Sambhal like Haq, was one the main propagators. In order to set up a module in India, in the first decade of the 21st century, Asif traveled to Waziristan, Pakistan, through Iran and Turkey where he received Deeni (religious training), though, he was exempt from rigorous Askari (battle and weapons training) due to his advanced stage.There he met leaders of various other banned terror outfits including leaders from Indian Mujahideen (IM), Harkat-ul-Mujahideen (HuM), Jaish-e-Mohammed (JeM), Lashkar-e-Taiba (LeT) and others. It has been alleged that the accused were in touch with each other through email, Skype and various other social media platforms. During the investigation, experts from the Cyber Forensic Division, CERT-In (Indian Computer Emergency Response Team) and Department of Electronics & Information Technology were called to verify the data - the report of which would be found in the supplementary charge sheet.Asif's account of his travels and his communication have been verified through airline tickets, emails and a note by the Ministry of External Affairs (MEA) that confirms Asif had applied for an emergency passport at the Indian Mission in Istanbul, Turkey claiming he was a tourist and had lost his passport. Of the 17 accused, six hail from Sambhal District of Uttar Pradesh (UP) and are known to be either childhood friends or neighbours.The Hindu adds that out of the 17, one Abdul Rehman, had met Jamat-ud-Dawa (JuD) 'chief' Hafiz Saeed in Lahore, Pakistan in 2015. An investigator told that Abdul Rehman, who was a teacher at a madrasa (Islamic Seminary) in Odisha’s Cuttack prior to his arrest on December 17, 2015 had met both Saeed and Zaki-ur-Rehman Lakhvi while on an illegal visit to Pakistan in the early part of 2015. “Two other AQIS members Farhatullah Gauri and Rashid had taken Rehman to Rawalpindi jail where he met Zaki-ur-Rehman Lakhvi, the chief of Lashker-e-Taiba’s armed wing. During his discussions, Lakhvi mooted the idea that since Abdul Rehman is a religious preacher, he should create an organisation like JuD in India and invite more Muslims to take part in jihad,” said the Delhi Police Special Cell source.He said all monetary assistance was promised by Lakhvi who also asked Rehman to stay in touch with Sajid Mir alias Kasim, another key figure behind the 26/11 (November 26, 2008) Mumbai attacks

A court in Delhi on November 21, framed terror charges against five Islamic State (IS) suspects accused of conspiring to target the Ardh Kumbh Mela in Haridwar besides strategic locations in Delhi, reports Zee News. According to court sources, District Judge Amar Nath, during in-camera proceedings, framed the charges dealing with criminal conspiracy and under the Unlawful Activities (Prevention) Act- UAPA and Explosive Substances Act. The suspects are Mohammad Azeemushan, Osama, Akhlakur Rehman alias Akhlaq, Meraj alias Monu and Mohsin Ibrahim Sayyed. After the accused pleaded not guilty and claimed trial, the court set December 15 for recording the statement of prosecution witnesses. Sayyed was arrested on February 5, 2016 while the other four were arrested on January 19, 2016.
