On September 1, Sri Lanka's Tamil-controlled Northern Provincial Council (NPC) unanimously called for an international probe into the alleged war crimes committed towards the end of the war with the Liberation Tigers of Tamil Eelam (LTTE), reports Colombo Page. The Chief Minister of the NPC C.V. Wigneswaran passed a resolution rejecting the domestic process being proposed by the United States (US) and other members of the international community. While acknowledging the "long standing efforts" of the US and India along with the international community in securing justice, the NPC dismissed a domestic mechanism backed by the US as Sri Lanka has had a "long and blighted history of human rights violations' which according to the NPC amounts to genocide. The NPC, which is controlled by the main Tamil party, Tamil National Alliance (TNA), said in its resolution that the trial of the alleged perpetrators should not take place through any mechanism instituted by the Sri Lankan Government as a State also incurs responsibility for the acts of its agents. "Under these circumstances, the trial of the perpetrators of international crimes by a domestic mechanism would be a travesty of justice as it would amount to the potentially guilty Government trying its own agents, thereby violating the prohibition in the maxim nemo iudex in sua causa," the resolution said.

On September 1, the Eighth Parliament of Sri Lanka came into being with President Maithripala Sirisena’s call for promoting reconciliation and co-existence and developing the political culture of consensus in the country, reports The Hindu. In his address to the Parliament, the President said the country had to take "bold political decisions" on the issue of reconciliation. "It is up to us to take the initiative in this regard," Sirisena said. The new government would give importance to the task of accomplishing expeditious economic progress in the conflict-hit regions of the Northern and the Eastern provinces, besides adjoining areas. In addition, addressing the opening session of Sri Lanka's 8th Parliament on September 1, Sirisena called on all political parties to end politics of conflict and extend a helping hand to strengthen the politics of consociation initiated by the government, reports Colombo Page. Pointing out that one major national party ruled the country for 35 years and the other main party ruled for 32 years, he urged all the Members of Parliament representing different political parties to cooperate with the government's determined initiative to usher in a new political culture of consociation.

"The Forever Victims? Tamil Women in Post-War Sri Lanka" stated the “situation remains particularly grave for Tamil women”, 6 years since the end of the armed conflict on the island. “Tamil women in Northern Sri Lanka still face the risk of rape and harassment by the security forces present throughout the region, but their lives are even more negatively impacted by the climate of fear and by a worrying uptick in violence against women within the Tamil community,” said the report. “The ever-present threat of violence by the military has led women to lead tightly circumscribed lives, limiting their daily activities in order to minimize their risk of sexual assault.”

Former minister John Amarathunga said the government will be compelled to hand over former chief international arms procurer for the Liberation Tigers of Tamil Eelam (LTTE) leader Kumaran Pathmanathan alias KP, if India wanted him in connection with the killing of former Indian Prime Minister Rajiv Gandhi, reports Daily Mirror on September 3. Amarathunga said it had now been revealed that all evidence against KP, who provided the funds to the LTTE and nourished it had been completely destroyed during the Mahinda Rajapaksa regime. Under these circumstances it had become impossible for the Attorney General to file a case against him, he said. Although evidence against KP had been destroyed in Sri Lanka he was the only suspect living now in the case of Rajiv Gandhi murder, he said.

The Campaign for Free and Fair Elections (CaFFE) called upon newly-elected Members of Parliament (MP)’s to repeal the Prevention of Terrorism Act (PTA), dubbed by human rights activists as draconian, in two months, reports The Hindu. In a statement on September 2, Rajith Keerthi Tennakoon, Executive Director CaFFE, termed the PTA as more dangerous than emergency laws and said the United National Front for Good Governance (UNFGG), which has formed the new government, consists of parties that were victims of the law in the past. Those who accepted good governance as a principle must agree to a repeal of the PTA, which, according to the CaFFE, leads to attacks on personal freedom including the freedom of expression and that of association.

Sampanthan was designated as the Opposition Leader of the eighth parliament on September 3, reports Colombo Page. Speaker Karu Jayasuriya named Sampanthan as the Opposition Leader when the parliament convened on September 3, after the inaugural session on Tuesday (September 1). Earlier both United People's Freedom Alliance (UPFA) and TNA were vying for the opposition leader position. However the Speaker said UPFA had not made any official request with regard to the post of opposition leader. Following the decision taken by the opposition Sri Lanka Freedom Party (SLFP), the main constituent party of the UPFA, to join the majority United National Party (UNP) to form a national government, TNA with its 16 seats in the parliament became the majority.

Propaganda Secretary of the National Freedom Front (NFF) Mohamed Muzammil on September 5, said, that by appointing Tamil National Alliance (TNA) parliamentarian R. Sampanthan as the Opposition leader, the government had given undue recognition to the separatists, reports The Island. Muzammil, addressing a news conference at the party head office at Battaramulla, Colombo, said: "The national government has removed the check point at Omanthai and the High Security Zone as well as the Sampur army camp while releasing the LTTE suspects who were in remand." Those who pretend to be patriots and defenders of the country on political platforms and in TV talk shows in the run-up to the election like Anura Kumara Dissanayake and Patali Champika Ranwaka were today silent about threats to national security, he alleged. Addressing a media briefing in Batticaloa District on September 6, former Chief Minister of Eastern Province and the Leader of Tamileela Makkal Viduthalai Pulikal (TMVP) Sivanesathurai Chandrakanthan alias Pillayan said that an international investigation into the alleged crimes committed during the 30-year war is not needed, reports Colombo Page. Pillayan said a domestic mechanism is appropriate as there is a change in the governance. "LTTE has also committed serious war crimes. The National Fisheries Solidarity (NAFSO) movement organised a roundtable in the Sri Lankan capital of Colombo on September 7, to discuss a report, titled “Let them come back to their places of origin in and with dignity”, the study centered on the situation in 38 refugee camps in 27 villages, reports Asia News. Completed in late August, the report indicated that about 35 camps have existed since the 1990s, but five of them were hitherto unknown. Some 1,536 families or 5,836 people live in the camps. However, about 30,000 people are still internally displaced on the Jaffna Peninsula. The island nation saw a brutal civil war between the government and Tamil Tigers [Liberation Tigers of Tamil Eelam, LTTE]. The latter sought to create an independent state in the predominantly Tamil provinces of northern and eastern Sri Lanka. These areas bore the brunt of 30 years of bloody civil war between the army and rebels, and the civil war ended with the rebels’ defeat. NAFSO coordinator Lavina Hasanthi told Asia News that the overall picture of the situation is still incomplete because many displaced people are not registered at refugee camps. Some in fact prefer to live in makeshift tents near their original home. NAFSO president Herman Kumara, a special guest from the World Forum for Fisher People (WFFP), told Asia News that 55 per cent of those living in the camps do not have electricity, and 70 per cent do not have access to clean water. He also noted that lavatories are almost non-existent, and where they do exist, they are off-limits at night. "As human rights activists, all we can hope for is for our fellow citizens to lead a life based on dignity,” he said. “We anticipate that displaced people will go back to a normal life, on their land, revive their culture so as to contribute to the country’s economy. In a statement published in the state-owned Daily News, Wijayatilake said in a Writ Application filed in the Court of Appeal, 193 cases of terrorism in which KP was allegedly involved were cited. Out of these 193 cases, 46 had been investigated and no evidence was found to implicate KP in them. This was told to the court. "The minister tells us to have confidence and trust them. But... he himself acknowledges that their track record is not good," said Suresh Premachandran from the Eelam People's Revolutionary Liberation Front (EPRLF). "That is why we say: have an internationally independent inquiry." Tamil legislator Dharmalingam Sithadthan also rejected the commission in favour of an international inquiry, adding that the ethnic minority was also seeking a greater share of political power. The government further said that it is encouraged by the High Commissioner's recognition of the efforts of the new government since he presidential election of 8 January 2015 in dealing with issues of concern for the people of Sri Lanka relating to human rights, rule of law, governance, justice, institutional and legal reform and reconciliation. Police have arrested about 50 suspects till now in 2015 for circulating FICN in Tamil Nadu and Chennai. “Around 25 cases have been registered and FICN worth INR 8,00,000 was seized from them,” said a Police source. Most of the suspects get the money in exchange for smuggling drugs, and sometimes even arms, into the country. “After this, they convert it into legal tender currency by buying goods,” a CB-CID officer said. “Only INR 52,000 was seized by us, but nearly INR 9,00,000 has already been circulated. What is worrying is that most of them are high-quality notes and it has been flowing into Tamil Nadu undetected through Sri Lanka for a long time. Such issues are being suppressed by different law enforcement agencies,” a Police source said. Apart from Sri Lanka, sources say that money exchangers outside Singapore and Malaysia airports are also pushing in some FICN into India, especially through Chennai. The Police have written to the Interpol seeking help to crack the network. “Some of the suspects said they had got currency from money exchangers outside the airport. We are coordinating with other agencies to collect details,” the officer added.

Former Commander of Sri Lanka Army Field Marshal Sarath Fonseka, who led the war against the Liberation Tigers of Tamil Eelam (LTTE), says the Army saved the Tamil civilians and it was LTTE which targeted the civilians and killed them, reports Colombo Page. "It was the LTTE which fired on civilians trying to flee to the army-controlled lines and killed them. The Lankan armed forces on the other hand had a policy of welcoming them and providing them safe shelter," Fonseka told Indian Express on September 21. "We were constantly telling the civilians to come out, assuring them that they will be well treated and looked after. With the result, people kept coming out," he said. According to Fonseka, civilians had begun heeding the army's call from 2008 onwards. "In the beginning, they came in trickles. Over time, 50,000 had crossed over. However, the mass exodus started in April 2009. On April 19, 150,000 had crossed over braving LTTE bullets. On May 14, 2009, 85,000 had quit the LTTE controlled zone. And on May 19, the war ended," Fonseka said.

On September 22, former President of Sri Lanka Mahinda Rajapaksa called upon the Government to reject the Report of the Office of the United Nations High Commissioner for Human Rights (OHCHR) Investigation on Sri Lanka, reports Colombo Page. In a statement to media, the former President and current parliamentarian said his government did not cooperate with the OHCHR investigation for many reasons, mostly because it was instituted outside the established procedure of the UN Human Rights Council (UNHRC). Rajapaksa elaborated that the usual procedure was for the President of the UNHRC to appoint a three-member independent panel to carry out the investigation after the relevant resolution is passed in the Council but the investigation on Sri Lanka was not carried out by an independent Commission of Inquiry but for the very first time, by the OHCHR.The report of the OHCHR investigation was presented to the UNHRC in Geneva by UN High Commissioner for Human Rights Zeid Ra'ad al Hussein on September 16th.

The Ministry of Rehabilitation, Resettlement and Hindu Affairs is mandated with the responsibility of resettlement of families and construction of houses for the conflict affected people in the war-ravaged provinces on a priority basis. The draft resolution, which is likely to pass unanimously next week, refers to the importance of having foreign experts involved in a potential investigation, but does not make the condition mandatory. The initiative was tabled at the UN Human Rights Council in Geneva on September 17, a week after the publication of a long-awaited UN report that laid bare the horrific barbarity committed by both the army and the Liberation Tigers of Tamil Eelam (LTTE) rebels in the bitter 37-year war. The report said Sri Lanka's criminal justice system was "not yet ready or equipped" to conduct an independent and credible investigation and called for a hybrid special court to include international judges, prosecutors, lawyers and investigators. But Sri Lanka has resisted a foreign inquiry, which many members of the island's Sinhalese majority consider an infringement of sovereignty. The main minority Tamil party the Tamil National Alliance (TNA) said the resolution, initiated by the United States and co-sponsored by Sri Lanka, was the "product of a difficult consensus". "We are acutely aware that some of the language used in the interests of a consensus will not satisfy all victims of the conflict whom we represent and who have reposed their trust in the TNA.”However, we are of the view that the draft provides a constructive starting point for what will inevitably be a long road to reconciliation," the TNA said in a statement.
