The Sri Lanka Monitoring Mission (SLMM), on October 1, demanded immediate access for Monitors and humanitarian agencies to the seven government soldiers detained by the Liberation Tigers of Tamil Eelam (LTTE) and the release of one of them on humanitarian grounds. The state-run Daily News said, on October 2, SLMM Chief Maj Gen (Retd) Trond Furuhovde made these demands when he met with LTTE political-wing leaders in Trincomalee. "The SLMM Chief visited the area where the soldiers were taken into custody and analysed the maps of the Security Forces and LTTE held areas," SLMM Spokesman Teitur Torkelsson said. He added, "There are different claims by both sides. The maps seem to be overlapping." The SLMM also said it had reason to believe that the LTTE would not reject its demand. Besides, reports said the LTTE would release the soldier and another as soon as two LTTE cadres in government detention are set free on bail.

The political-wing of the Liberation Tigers of Tamil Eelam (LTTE), reports said, urged the government, on October 3, to ‘urgently and immediately’ release Tamil political detainees, who have commenced a fast unto death since October 1 over their continued detention. The LTTE said in a statement that releasing the detainees would give fillip to the prevailing atmosphere of peace and goodwill. Reminding that the detainees had in the past launched protests but gave them up on assurances that they would be stet free, the LTTE said, "[They] are now frustrated and dismayed the… government has failed to take action to release them, even though a climate of peace, normalcy and goodwill prevails across the island." The LTTE opined the detainees were determined to press with their protest this time round, and said, "We urge the government of Ranil Wickremesinghe to take immediate and concrete steps to facilitate the release of all Tamil political prisoners without further delay." Further, the LTTE urged Human Rights Organisations as well as leaders of the Tamil National Alliance to work towards securing the release of the detainees.

Tilak reportedly said in his letter, "We consider this act as a violation of the cease-fire agreement intended to derail the present peace process. Hence, we request you to take immediate steps to stop the establishment of a new SLN camp in the area."

Media reports said the government has decided not to repeal the Prevention of Terrorism Act (PTA). However, it is studying the possibility of modifying and amending certain clauses in it. The Cabinet Spokesman Prof G.L. Peiris said, "The PTA exists in countries like Malaysia, India, United States and United Kingdom as well and it is not meant to be a permanent and everlasting legislation. Now that the peace process has commenced we thought it is timely to take a fresh look at it and alter certain clauses which need amendment". He also said that the government was not reviewing the legislation due to a demand by the Liberation Tigers of Tamil Eelam (LTTE) to repeal it.

A Ministerial delegation headed by Interior Minister John Amaratunga had also visited the troubled spot. The Government Agent for Tricomalee district would be chairing the Peace Committee. Religious leaders of Buddhist, Catholic, Muslim and Hindu faiths would form the other members of the Committee, while the SLMM would function as the coordinator of the Committee. Minister Amaratunga said, "Once normality returns we will invite the Trincomalee LTTE leader to be in the Peace Committee. This could help avoid future clashes." Media reports from Sri Lanka said the Rural and Community Development Solidarity, a voluntary agency, in a press release, on October 14, urged the Liberation Tigers of Tamil Eelam (LTTE) to set free the remaining security forces personnel and civilians, if any, in its custody. This would act as a confidence building measure to further strengthen the peace process, the agency said. At the same time, it also asked the government to immediately release all LTTE suspects against whom there are no charges or court cases, but are under detention under the Prevention of Terrorism Act (PTA). The release said, 'It is negotiable that this issue regarding prisoners on both sides had remained unresolved even after the lapse of [nine] months since the signing of the [permanent] cease-fire agreement. The truce agreement was signed in February 2002.

He said the clashes and protests showed how "fragile and sensitive the situation is at this time in the peace process. Tamil National Alliance (TNA) Member of Parliament R. Sampanthan wrote to Prime Minister Ranil Wickremasinghe, on October 15, that the lives of three Tamil civilians who died in the October 11-grenade attack in Trincomalee, could have been saved if the attackers had not prevented two ambulances from reaching the incident-site, reports said. He also alleged that "the deliberate inaction of the Police contributed to this tragedy." The TNA is a four-party coalition of Tamil parties and has the blessings of the Liberation Tigers of Tamil Eelam (LTTE). Stating that those killed were all Tamils and that no Sinhalese was either injured or killed, he said, "This conclusively establishes that violence was unleashed only against the Tamils." However, two police constables and a police officer sustained minor injuries during the violence. He said the media was hiding the facts and said grenades were hurled at Tamil civilians He said "This is unacceptable and could cause irreparable damage to the peace process". Arguing that the security forces were near totally Sinhalese and that they would not treat Tamils equally or justly, he demanded that "two hundred Tamil personnel be immediately recruited to the police and auxiliary forces to provide security to the Tamils in places like Thirukdaloor, Anpuvallipuram, Linganagar and other areas in the Trincomalee town and its suburbs. He further stated that he suspected that vested interests were trying to sabotage the peace process and said, "Effective action needs to be taken immediately to ensure that these evil elements do not succeed."

Reports said, the Supreme Court of Sri Lanka, on October 16, set-aside the conviction of an accused under the Prevention of Terrorism Act (PTA). Media sources claimed it was a landmark judgement. A High Court had originally convicted a person on charges of receiving arms training from the Liberation Tigers of Tamil Eelam (LTTE) and for aiding and abetting the LTTE. The Court of Appeals confirmed the conviction, and a seven-year prison term. However, a three-Judge Bench of the Supreme Court acquitted the accused, Nagamany Theivendran, charged in Colombo, in 1996, stating "… it is contrary to law to punish a person only on his confession without any corroborative evidence against him."

The Sri Lankan Cabinet, on October 16, decided tentatively seek the dissolution of Parliament and ask for fresh general elections, rather than call a referendum to decide on a few issues, notably the 19th amendment to the Constitution. This was the best course of action in the interest of political stability, which is vital for the success of the ongoing peace process, Cabinet spokesperson G L Peiris was quoted, on October 18, in the state-run Daily News as having said. A formal decision on the issue has yet not been taken. The decision has, ultimately, to be approved by a majority in Parliament. He further said, "It is the PM [Prime Minister] and not the President who enjoys the confidence of the majority of Parliament. Therefore, the government should have the freedom to implement its decisions with regard to all serious issues affecting the country chief of which is the peace process." He also threatened to ensure that Parliament would cut financial allocations to state institutions if the request for dissolution was declined by the President. Peiris said, "The Government has every authority to determine financial policies and allocate funds to state institutions. If necessary we will exercise this authority to the full."

Sri Lanka’s Speaker, on October 22, informed Members of Parliament of the decision of the Supreme Court on the proposed 18th and 19th Amendments to the Constitution of the country. The 18th Amendment deals with immunity to members of the Constitutional Council. The Apex Court said the Amendment in its entirety needed to be approved by a two-thirds majority in Parliament and subsequently ratified at a countrywide referendum. On the 19th Amendment, the Court said clause 6 on conscience voting was in violation of the provisions of the Constitution, and hence asked it to be dropped. However, the Court held that Amendment relating to the powers of the President to dissolve the House within a year of its constitution could be taken up for voting and needs a two-thirds majority in Parliament, followed by ratification at a referendum. The Amendment seeks to extend the permissible time period for dissolution to three years from the present one year.

The Sinhala chauvinist Janatha Vimukthi Peramuna (JVP) moved an adjournment motion in Parliament, on October 23, and said the United National Front government has failed to provide security and peace in East. Speaking during the debate on the motion, Tourism Minister Gamini Lokuge said the JVP was trying to create unrest in the country and added that no responsible political party would support the JVP’s attempts to sabotage the ongoing peace process. Taking strong objection to not being allotted time to speak on the motion, TNA MP Sampanthan said the motion related to incidents in the East from where the TNA has 15 MPS represent the people of the Northeast. "Therefore the TNA should have been allocated time by the leader of the opposition... The JVP’s refusal to give TNA time is tantamount to showing disrespect to the northeast people. It shows the hypocrisy of the JVP." All TNA MPs present in the House staged a walkout in protest and the debate continued in their absence.

Media reports from, Sri Lanka said President Chandrika Kumaratunga, on October 24, in a televised address to the country, said there was considerable hope that the ongoing peace process would result in a "final settlement" of the protracted ethnic conflict in the country. She called upon all political parties in the country to set aside differences and "petty political bickering", which she said has been the "bane of [the country’s] political culture". She said the government was implementing many positive measures to relax tensions that had been in existence for a long time, and added, "The Government is doing the maximum possible to implement its part of the cease-fire agreement signed by… Prime Minister [Ranil Wickremasinghe] and the [Liberation Tigers of Tamil Eelam [LTTE] leaders". She also opined that the only hurdle in the ongoing peace process "is the lack of an agreed agenda to discuss the core issues of the conflict". She also said, though indirectly, the "freedom" granted to the LTTE "has given rise to the suppression of the rights of the other groups. The civilian population, including the Tamils, is facing continued problems of extortion, kidnap, punishments meted out by an unlawful judicial system and recruitment by coercion into an illegal Police Force and an equally unlawful military force of the LTTE".

The second round of government-Liberation Tigers of Tamil Eelam (LTTE) peace talks due to begin on October 31, in Thailand, would focus on three issues. These are: forming the Joint Task Force (JTF), resettlement of displaced persons and strengthening the implementation of the ongoing ‘permanent cease-fire’ that came into force in the third week of February. The talks would be held at Rose Garden Holiday Resort, Nakompathon, 40km away from the Thai capital Bangkok. Declaring that the first round of peace talks held in September was an "enormous success beyond all expectations," cabinet spokesperson and government negotiating team leader G L Peiris disclosed the broad agenda of the second round. He also said Major General Shantha Kottegoda of the Sri Lankan Army would be among the three advisors to the government team at the talks. Peace Secretariat official John Gunaretna and Chanaka Jayasekara will be the other two advisors. The LTTE has already announced that ‘political-wing chief’ Thamiselvam and Amparai-Batticaloa ‘special commander’ Karuna would be the additional members of its delegation at the second round of talks. Reports said the presence of military members in the respective delegations would help sort out the irritants that arose from tensions in the East that witnessed clashes and casualties.

Liberation Tigers of Tamil Eelam (LTTE) chief negotiator Anton Balasingham, on October 30, said LTTE chief Velupillai Prabhakaran is determined not to re-launch war and has agreed that the ongoing peace process has laid the foundation for the development of the North. He declared the LTTE would continue the peace process with any political party in power, but said the LTTE would prefer to deal with Prime Minister Ranil Wickremasinghe whose initiative had kept the peace process alive. He said, "Therefore we would like to see stability in the Ranil administration". He also assured, "No one is thinking about war... LTTE leader Prabhakaran feels confident that they can move towards a peaceful resolution of the Tamil question." He further stated that the LTTE’s confidence in the government was rising since the first round of peace talks. Stating that the LTTE was not for separatism, he, however, said that would largely depend on the degree of self-governance offered to the Tamils by the government. "It is only through substantial devolution that we will be able to prevent the aspiration for separatism", Balasingham said.
