According to Pakistani media reports, there is speculation in Islamabad that the Interior Ministry, the key Federal agency on internal security issues, had no knowledge of the arrests of two top terrorist leaders of the Jaish-e-Mohammed (JeM) and the Lashkar-e-Toiba (LeT), and had heard of their arrest through the media. However, Interior Secretary Tasneem Noorani, while denying such reports, said the Ministry was always taken into confidence in matters pertaining to internal security. He elucidated that such reports, of the Ministry not being aware of the arrests, might have emanated because crucial decisions were not reflected in writing on the files. Noorani reportedly said he knew in advance about certain recent high profile arrests.

"This support will continue at the moral, political and diplomatic level," he said, responding to a question whether the crackdown against the leaders of terrorist outfits meant withdrawal of Pakistan’s support to the people of Kashmir. The Pakistan High Commission in New Delhi was, on January 1, handed over a list of 20 "fugitives of law" reportedly residing in Pakistan with the request that they be apprehended and handed over to India. He said the arrests were made in Karachi, Islamabad, Sukkur, Rahim Yar Khan, Multan and Bahawalpur. He said at some places the district administration sealed the JD’s offices and confiscated office records. He opined that it was unfair that the JD was being victimised in the wake of Indian allegations against the LeT. He claimed that the LeT had wound up its activities and offices in Pakistan and was confining itself to Kashmir on both sides of the Line of Control (LoC). Official sources have indicated that the arrests would continue in Punjab and their scope could be expanded to the North West Frontier Province (NWFP).

In continuing crackdown on terrorist outfits, Punjab police on January 1 arrested 100 more terrorists of the Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) from Lahore and other cities in southern Punjab. "Police and security forces in a crackdown on Lashkar-i-Taiba and Jaish-i-Mohammad have picked up around 100 members and leaders of both the parties," said LeT spokesperson Yahya Mujahid. Criticising the crackdown, he said, "We are against all acts of terrorism and we have repeatedly said we are not involved in the December 13 attack on the Indian parliament." Mujahid said the LeT had already halted its activities in Pakistan and shifted its offices to Pakistan occupied Kashmir (PoK). "There is no Lashkar setup now in Pakistan," he declared.

Justice Karamat Nazir Bhandari of the Lahore High Court allowed, on January 1, a petitioner-lawyer to amend his petition against the ban on the Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) to confine it to the detention of their chiefs. Advocate M D Tahir pointed the importance of Jehad in Islam in his arguments against the ban. The Judge observed that he had disjoined a number of aspects and had sought a variety of relief measures, which could only be considered separately. While demanding withdrawal of the ban imposed on the two Pakistan-based terrorist outfits, the petitioner had sought disbandment of India's Rashtriya Swayamsevak Sangh (RSS) and the Shiv Sena and the trial of their leaders.

Reportedly, the government has formally informed some of the Taliban’s senior leaders and diplomats, including former Taliban Ambassador in Pakistan Mullah Abdul Salam, that they and their families would not be granted political asylum. The government is reportedly of the view that bestowing asylum to Taliban leaders and diplomats could create a law and order situation in the country. As reported earlier, former Taliban Ambassador to Pakistan Zaeef and senior leader Maulvi Rehmat Ullah Kakazada are among the top Taliban leaders who had sought asylum. "We can consider the extradition of these persons only after India fulfils all the legal requirements", he said. According to media reports, cadres of the Lashkar-e-Toiba (LeT) and Jaish –e-Mohammed (JeM), are being arrested though the law enforcement agencies have been asked to crackdown on all terrorist and sectarian outfits. However, LeT spokesperson Yahya Mujahid said only one cadre of his outfit was arrested. The police denied reports that they had raided mosques and madrassas (religious institutions). Elaborating, a police officer said, "We have acted upon secretly received information and raided the homes of suspects to pick them up." According to media reports, police arrested approximately 45 cadres of the Jaish-e-Mohammed (JeM) and Lashkar-e-Toiba (LeT) in raids on January 6. "In all some 45 of their members were picked up in raids late on Saturday and early on Sunday. At least 32 Jaish members were among the detainees", said Hassan Burki, spokesperson for the JeM. He said police in several southern districts of Punjab raided mosques, homes and offices searching for cadres and weapons. "Police entered our homes, insulting our elders and women. They searched our homes for weapons and messed everything up," Burki said. He added that the Jaish would challenge the arrests of its cadres in the courts. "The law provides protection even to criminals. We will challenge the arrests of our cadres and the government will have to tell what was their offence. If we did not get justice through the legal course, it would mean that state terrorism is being meted out to us," he said. The spokesperson claimed that Pakistan was bowing to pressure from India and the international community. "All this is being done to please India and Blair," he said, adding these detentions would not make any difference to the outfit.

The Federal government has reportedly directed the administrators of more than 1,750 madrassas (seminaries) in the North West Frontier Province (NWFP) to stop admitting Afghan children and elders and other foreigners, failing which they would face closure. News reports have mentioned that the Jamaat-Ulema-e-Islam (JuI-Fazlur Rahman faction) directly controls 75 per cent of the seminaries in which majority of the students are Afghans. There was earlier no restriction on admission of refugees to the seminaries, but in the wake of reported entry of Taliban and Al Qaeda cadres from across the border into Pakistan, the government has imposed a ban on their admissions. Reports submitted to the government warned that madrassa students, who went to Afghanistan for Jehad, might return to become a potential threat to the internal security of the country. The Federal government is also expected to close down all madrassas which had maintained any kind of link with terrorist activities and sectarian violence. According to media reports, there are approximately 300,000 students in these seminaries.

"It was not for the first time that India has done so against me… India has been calling me terrorist but its real purpose is to prevent me from advocating my ideology of an independent Kashmir." Amanullah told a news conference in Islamabad following reports that his name was on the list of 20 men India wanted extradited from Pakistan. He called on India to approach the ICJ where he indicated he would challenge the allegations of terrorism and the Indian stand on Kashmir. He observed, "If the world court gave the verdict that I am a terrorist or my demand for a independent Kashmir is not justified, I would hand myself over to Indians." According to media reports, the military regime has been told that a ban on the Sipah-e-Sahaba Pakistan (SSP) and the Tehreek-e-Jaferia Pakistan (TJP) would be a violation of the fundamental rights protected in the 1973 Constitution. SSP and TJP, the two sectarian outfits, are reportedly facing threats of a possible ban by the government apparently to address the issue of sectarian terrorism. As reported earlier, two sectarian terrorist outfits – the Laskhar-e-Jhangvi (LeJ) and the Sipah-e-Mohammed Pakistan (SMP) of the SSP and TJP respectively -- have been banned since August 14, 2001 in order to curb sectarianism. Reports said, at a high-level meeting convened to discuss the issue of banning the SSP and the TJP, President Musharraf was apprised of the fact that proscription of any political party unilaterally by the government would be a violation of the fundamental rights enshrined in and protected by the Constitution. The government has been told that a political party, registered as such under Political Parties Act, can only be banned by the Supreme Court of Pakistan, only if the apex court is convinced of the reasons given by the government. Sources in the Law Ministry indicated that the government could not ban any political party on its own. Both the SSP and TJP are registered as political parties and have also been participating in electoral politics. The Law Ministry sources said Article 17 of the Constitution on "Freedom of Association" protects the political parties from any extreme action by the government.

Senior police officials in Sindh said 200 activists of various outfits were arrested. As the President concluded his address, orders were issued to seal offices and places being used by various religious, sectarian or politico-religious parties and terrorist groups, or their leaders, to prevent any possible reaction. The arrested included 58 cadres of the Sipah-e-Sahaba Pakistan (SSP) and 16 activists of the Tehreek-e-Jaferia Pakistan (TJP). Reports from Hyderabad, Sindh, indicated, approximately 200 activists and some leaders of various terrorist outfits and sectarian groups were arrested there. Around 50 persons of different religious parties were arrested in Sukkur and Larkana divisions. 50 local leaders and activists of the TJP and SSP were arrested in the Jacobabad district. President Musharraf banned two outfits active in Jammu and Kashmir, the Jaish-e-Mohammed (JeM) and Lashkar-e-Toiba (LeT). Sectarian outfits Sipah-e-Sahaba Pakistan (SSP), Tehreek-e-Jaferia Pakistan (TJP) and Tehreek-e-Nifaz-e-Shariat-e-Mohammadi (TNSM) were also proscribed. Those to be found involved in inciting people to commit violence, either in the external or internal context, would face punitive action, he added. He also stated that, in the year 2001, 400 persons had been killed in violent activities. He also announced future rules of behaviour for madrassas (seminaries) and mosques. He indicated that any mosque and new religious schools could be established only with the permission of the government. He also restricted the use of loudspeakers and all parties were disallowed the use of mosques or madrassas for political purpose, fanning sectarian hatred or anything that challenged the writ of the government. The President also said Pakistani religious leaders should not involve themselves in conflicts outside Pakistan. The President said Pakistan would not hand over any Pakistani national to India, though India has sent a list of 20 people it wants for terrorist and criminal activities committed in India. While condemning the terrorist attacks of September 11, October I and December 13 of year 2001, he added, if evidence was produced to Pakistan against these people, they would be proceeded against under Pakistani laws.

Interior Ministry sources have observed that all the five organisations banned by the government had been receiving extensive financial aid from some countries in the name of Islam and welfare-oriented works. Reports added that prior to the imposition of the ban, the Interior Ministry is reported to have written letters to the fund providing countries and held meetings with their Ambassadors in the country asking them to discontinue assistance. The Ministry is also reported to have provided credible and satisfactory evidences to the Ambassadors. The proscribed outfits were allegedly securing funds from Saudi Arabia, Iran, Kuwait and Iraq.

They will be required to submit all accounts of their income and expenditure for their political and social welfare activities and disclose all funding sources to the Federal government. These outfits are reportedly being given the right to file a review petition within 30 days to explain their position to the Federal government. The government is expected to appoint a review committee to determine all review applications under the Anti-Terrorism Act under which the ban has been imposed. The government is also bound by law to take a decision on such review applications within 90 days. In case the government turns down their review application, these organisations may file an appeal to the High Court within 30 days of the refusal of the review application.

Also sought are the names and addresses of the prayer leader of the mosque or administrator of the madrassa, their educational qualification and other activities; study rooms of the madrassa, number of teachers and students; and the details of the religious education imparted at the madrassa. This countrywide exercise is considered to be part of the implementation process of certain measures announced by President Pervez Musharraf on January 12. Speaking at a joint press conference along with Canadian Deputy Prime Minister John Manley at the Foreign Office, he said, "We have names on our list and we will forward the list to the Indian government in due course of time so that the exchange of criminals is done on reciprocal basis." However, Sattar did not disclose the names or the number of terrorists who had reportedly fled to India after committing acts of terrorism in Pakistan. Commenting on the Indian demand of extraditing 20 Pakistan-based terrorists, Sattar said among those wanted by New Delhi included six Pakistanis and there was no question of handing them over to India. According to him, "As far as extradition of non-Pakistanis is concerned, it involves a complex legal and political procedure." He said the government was tracing these criminals as it had not yet ascertained as to how many of them were in official custody. Speaking during a media briefing in Islamabad on January 31, Pakistan’s military regime spokesperson, Maj. Gen. Rashid Qureshi said that there was an Indian link in the abduction of US-based Wall Street Journal journalist, Daniel Pearl. The abductors of the journalist have threatened to execute him by February 1 if their demands are not met. Major Qureshi however declined to give details of the alleged Indian link and said that "we hope that this does not surface into something which has been stage managed by the Indian agencies to defame Pakistan," Separately, commenting on the news report of an First Information Report (FIR) being filed against Indian Home Minister, L K Advani, he said that the government had noted the report and was investigating the matter.

The Federal government on January 31 reconstituted the Anti-Terrorist Courts (ATC) by including a senior military officer as one of the three-members in each court with a civilian judge heading them. With the reconstitution of ATCs, a new aspect of civil-military courts has emerged, with two civilian judges and a military officer to jointly try a case relating to terrorism. Under Section 4 of the new law, ATCs will be established in cantonment areas or jail premises, reportedly regarded as safe areas for the judges. Of the three members in each ATC, one would be a judge of a high court or is or has been a sessions judge or an additional sessions judge, to be nominated by the Chief Justice of the High Court concerned; the second would be a judicial magistrate first class vested with powers under section 30 of the code to be nominated by a provincial high court concerned; and the third, a military officer from Pakistan Army not below the rank of Lieutenant Colonel to be nominated by the federal government.
