A Mumbai court on January 1 extended till January 15 the judicial remand of Mohammed Afroz Razak, a suspected member of the Al Qaeda, who had planned to blow up targets in Britain and Australia. The accused did not plead for bail and also preferred not to engage any lawyer. Hence, no bail petition was moved on his behalf. Earlier, on December 18, 2001, Afroz had made a statement purported to be a confession about his links with the Al Qaeda and its plans to hit targets in foreign countries. However, the contents of his statement are not known, as it was recorded in-camera.

A court in Mumbai on January 15 extended till January 29, the judicial custody of Mohammed Afroz Abdul Razak, suspected member of Osama bin Laden's Al Qaeda terrorist network. Mohammed Razak is accused of having planned to blow up targets in UK and Australia. According to media reports, the accused did not plead for bail and also preferred not to engage any lawyer. As reported earlier, Afroz, on December 18, 2001, had reportedly made a confessional statement about his links with the Al Qaeda and its plans to air-dash targets in foreign countries. However, the contents of his statement before the court are not known, as it was recorded in-camera. Afroz was arrested from Mumbai on December 3, 2001 and had confessed to police that he frequently visited Australia, USA, UK, Hong Kong and China between 1997 and 2001. He had also disclosed that suicide squads had been formed by the Al Qaeda to carry out terrorist attacks on World Trade Centre, New York, British Parliament, London, Romal Tower, Australia and Parliament House, New Delhi.

A suspect, alleged to have provided funds to the conspirators of the December 13, 2001, terrorist attack on the Indian parliament, was arrested in New Delhi on January 15, 2002. A court in New Delhi on January 17 allowed the Enforcement Directorate (ED) to interrogate four Lashker-e-Toiba (LeT) terrorists and a hawala (illegal finance network) dealer arrested on January 15 in connection with a plan to disrupt the Repubic Day parade of January 26. A division bench of the Kolkata High Court on February 4, referred Purulia arms drop convict, British arms dealer Peter Bleach's appeal to Chief Justice A K Mathur with an observation that an appropriate bench could decide the discrimination point raised by Bleach. Besides his appeal against the order of a lower court awarding him life sentence, Bleach had filed another petition contending that he was a victim of discrimination as five Latvians, sentenced for similar grounds, had been released by the order of the President while he was languishing in jail. Bleach and the Latvians, who were sentenced to life imprisonment on February 2, 2000, in the Purulia Arms drop case of December, 1995, had appealed to the Calcutta High Court in March 2000. The Latvians were released under a Presidential order on July 22, 2000.

A Delhi Court has allowed West Bengal Police to take the custody of four terrorists of the Harkat-ul-Jehadi-e-Islami (HuJI), wanted in connection with the abduction of a businessman and for carrying out other subversive activities in the State. Granting transit remand of the four terrorists, arrested by Delhi Police on January 31 and February 6, the court asked the West Bengal police to produce them before the Sub-Divisional Judicial Magistrtae, 24 Pargana (south), in Kolkata before March 15, 2002. Earlier, the court had issued the production warrant for three Pakistani nationals and a Bangladeshi who were arrested for illegally entering the country to carry out subversive activities. The four terrorists were booked by the Delhi police under the Prevention of Terrorism Ordinance (POTO) and had confessed that they had entered India to carry out subversive activities.

A special Terrorist and Disruptive Activities (Prevention) TADA court in Mumbai, on March 4, issued a fresh non-bailable warrant against Abu Salem Abdul Qayoom Ansari alias Abu Salem, the absconding underworld don and an accused in the 1993-Mumbai serial bomb blast case. The warrant was issued on a submission made by the Central Bureau of Investigation (CBI) that efforts made to trace Abu Salem had turned futile. The CBI informed that the warrant issued in 1994 against Abu Salem had already been forwarded to their counterparts in the United Arab Emirates (UAE) but it had not been returned. The court, however, felt that in the interest of justice it was necessary for the CBI to produce Abu Salem before the court and, therefore, it would be fit and proper to issue a fresh non-bailable arrest warrant against him.

Singh was an accused in the 1993 car bomb attack, which targeted the then Youth Congress President M S Bitta. Nine persons were killed in that incident. The Court held that death penalty was “the most appropriate sentence” for Singh. He confessed “voluntarily” and his retraction was an “afterthought”, added the court.

Suspected Al Qaeda terrorist Mohammed Afroz Abdul Razak was released on April 9 from Byculla prison in Mumbai following bail granted by a special court even as the police filed a chargesheet against him, four months after his arrest in a case of sedition. Afroz has been charged with section 120 b (conspiracy), section 121 A (waging war against nation), section 126 (acts of depredation against countries friendly with India), section 420 (cheating) and section 467 (forgery) of the Indian Penal Code (IPC). Soon after his release, Afroze appeared before the designated Judge, who accepted the chargesheet and adjourned the case upto April 24. Afroze was released from the jail on the orders of the court, which granted him bail on April 5 as the police failed to file chargesheet within the stipulated 90 days after the arrest. The court allowed the police to investigate further but did not fix any time frame.

However, the court framed charges against two other JKIF terrorists Feroze Ahmad Mir and Mohammad Sayed Tantrik alias Yusuf under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guest house in Delhi and seized Rs 15 lakh from them. According to the prosecution, the police station received a packet addressed to P. Muthuraj, inspector, from Thrissur by courier on August 5, 2000. The ‘from address’ read as ‘Sakthivel Cottage Industries’', Vadakkancherry, Thrissur, and was booked at Thrissur on August 3, 2000. The inspector grew suspicious on seeing a cream biscuit packet and two packets of dates in a tampered condition. The packet was sent to Chennai for chemical examination. The city police were put on alert apprehending a bid by the Al-Umma militants to kill policemen. Special teams fanned out to Thrissur and the courier firm employee was interrogated. He said Akbar alias ‘Poison’ Akbar of GM Nagar in Ukkadam had booked the consignment. Akbar was arrested and a case of attempt to murder was registered against him.

The special judge recorded the statements of a computer, telecommunication and linguistic expert, who deposed as witness for Jaish-e-Mohammed (JeM) terrorist Shaukat Hussain Guru. The three defence witnesses tried to impress upon the court that the data collected from the computer allegedly recovered from the accused were fabricated, the SIM card seized from them could have been duplicated and hand written transcriptions not genuine. JeM terrorists Mohd Afzal, Shaukat Hussain Guru, his wife Navjot Sandhu alias Afsan Guru, and S A R Geenai are facing trial for the December 13, 2001- attack on India’s Parliament. Substantial evidence against them is based on intercepted messages to their mobile phones. The accused have been charged with threatening the unity, integrity, security and sovereignty of the country by waging war against it and committing several other offences under the Prevention of Terrorism Act (POTA), the Indian Penal Code (IPC), Explosive Substance Act and the Arms Act.

The Delhi High Court, on October 30, held that intercepted telephonic conversation between accused persons would not constitute as admissible evidence under the Prevention of Terrorism Act (POTA), as it had not been procured as per the procedure laid down under the Act. Setting aside an order of a Delhi Special Court which held that intercepted conversation between the accused in the December 13, 2001-Parliament attack case, S A R Geelani, terrorist Shaukat Hussain alias Guru and his wife Navjot Sandhu alias Afsan, was admissible under POTA, the Court said, "The admissibility of intercepted evidence for proving charges under POTA is specifically barred by Chapter-V of the Act," if not procured as per the laid down procedure. "Evidence of intercepted conversation sought to be produced and proved by the prosecution for proving offences under POTA, being in contravention of Chapter-V of the Act, is inadmissible," the Court said. The order came on appeals by the three accused against the Special Court's July 11-order rejecting their applications challenging the inclusion of intercepts as evidence under POTA.

Deputy Prime Minister L K Advani said, on November 12, the Union government would extend ‘full cooperation’ to the Jammu and Kashmir (J&K) State government to fight cross-border terrorism. He said, "basically, I am more concerned that the state government and the central government fully cooperate in dealing with cross-border terrorism which is a serious problem". He also observed that India’s fight against terrorism should not be weakened and suggested that the J&K government could appoint a duly empowered committee to screen cases before releasing detained persons. "If there are any charges against a person which the state government feels are not valid, it can be screened by a committee, duly empowered and qualified to decide on that issue", he added. The Deputy Premier also said that India’s premier investigating agency, the Central Bureau of Investigation (CBI), would be able to get the underworld don and main accused in the 1993-Mumbai bomb blast, Abu Salem, extradited from Portugal. According to media reports, a special court in Coimbatore, on December 20, convicted eight Al-Ulmma activists including Mohammed Ansari, president of Al Umma, and Sidhique Ali, son of S.A. Basha the outfit’s founder president. They were all accused in the murder of traffic constable Selveraj in November 1997, which triggered communal violence causing the death of 17 persons in Coimbatore. The special public prosecutor contended that the genesis of the serial bomb blasts that ravaged Coimbatore in 1998, lay in Selvaraj’s murder. The Al-Ulmma is an Islamist extremist Organisation that engineered the serial bomb blasts in Coimbatore. At least 33 people––including eight women and a child––died while 153 more were injured in a series of 12 bomb blasts in Coimbatore on February 14, 1998.

A Delhi court on December 21 discharged the leader of the proscribed Students Islamic Movement of India (SIMI), Mohammed Javed Iqbal, in a sedition and unlawful activities case and also dropped sedition charges against its president Shahid Badar and three others. While discharging Iqbal, the court granted bail to Badar and four others in the case. The court also dropped sedition charge against Badar in another case and granted him bail on a personal bond of Rs 5,000 and one surety. Discharging Iqbal, the court said there was no material evidence against him except his confessional statement.

They are the accused in the 1997-murder of police constable Selvaraj. "The accused were aware of the consequences and the consequences were their intentions'', the Judge said, noting "it was the gravest of grave and rarest of rare offences", while awarding the death penalty. The judge also sentenced three more accused in the case––, Siddiq Ali, Aslam alias Tada Aslam and Samsudeen––to rigorous imprisonment for a year for unlawful assembly and life term for murder. The eighth accused, Md.Ansari, was sentenced to life imprisonment and a fine of Rs. 25,000. Selvaraj was stabbed to death at Ukkadam, Coimbatore, on November 29, 1997. This led to the subsequent communal clashes and finally the February 14, 1998-serial bomb blasts, in which 59 persons were killed and 249 more wounded, besides damaging property worth Rs 17 crores.

According to media reports, four people––Abdul Mattin, Sayyed Khwaja, Mushammil Ahmed and Jahir Shaikh––detained in connection with the December 2-bomb blast in a bus near Ghatkopar, were arrested on December 26 and remanded to police custody till January 3. Seven more people, who were brought from Washim district in Vidarbha, have been detained, police said. As reported earlier, police teams have been sent to Aurangabad, Parbhani and Hyderabad as part of investigations into the incident. Police are yet to identify those who had actually palnted the explosives in the blasts reported on December 2 and another on December 6.

According to media reports, Tamil Nadu police, on December 30, filed the chargesheet against Marumalarchi Dravida Munnettra Kazhagam (MDMK) general secretary Vaiko and eight party colleagues, all arrested under the Prevention of Terrorism Act (POTA) for allegedly making speeches supporting the banned Liberation of Tamil Tigers Elam (LTTE). The chargesheet was filed nearly 180 days after Vaiko and his colleagues were taken into custody. POTA provisions do not allow an accused to be detained for more than 180 days in the absence of a chargesheet. While Vaiko was arrested on July 11, 2002, the others were arrested on July 9.
