The sessions court in Gangtok remanded National Democratic Front of Bodoland (NDFB) 'vice president' Dhiren Boro to a 12-day police custody, on January 2. Police had arrested him along with his wife, two children and two associates identified as Prabin Basumatary and Babloo Swargiary the previous day. Sikkinm police said Dhiren Boro, his wife and associates have been booked under the Prevention of Terrorism Act (POTA). The NDFB leader reportedly told police during interrogation that no other NDFB cadre was in Sikkim. He also said he had been staying in Tadung locality, from where he was arrested, in a rented house for the past one year.

According to media reports, Syed Khwaja Yunus Khwaja Ayub, an accused in the December 2-Ghatkopar bomb blast in a Bombay Electric Supply and Transport (BEST) bus, escaped from police custody on January 7-morning, while he was being taken to Aurangabad for inquiry. Ayub, a resident of Parbhani in Marathwada region, was arrested on December 26 in Washim under the Prevention of Terrorism Act (POTA). Two persons were killed and 34 more injured in the blast.

February 4, 2003 has been fixed as the date for commencement of trial, reports added. The court framed charges against LeT terrorists and Pakistani national Ashfaq, his wife Rahmana Yusuf Farooqi, Babar Mohsin Bhagwala, Devender Singh, Shahnshah Alam, Rajiv Kumar Malhotra, Moolchand Sharma, Matlub Alam, Farooq Ahmed Qasid and Nazir Ahmed Qasid for attacking the Red Fort. On December 22, 2000, a Lashkar-e-Toiba (LeT) suicide squad attacked the Red Fort in New Delhi, killing two Army personnel and a civilian.

Media reports said a Delhi court on January 8 postponed to January 17 the hearing on the bail application of Iftikhar Geelani, pending completion of proceedings in the lower court. The court said, since the government has rejected the opinion of the Military Intelligence on the sensitivity of documents seized from Iftikar, the hearing was adjourned to await the outcome of the lower court. The lower court has summoned Director-General Military Intelligence (DGMI) Lt. Gen O. S. Lochab and Joint Commissioner of Police Neeraj Kumar. On December 23, 2002, Lochab appeared before the Chief Metropolitan Magistrate and said documents recovered from Iftikar did not contain any classified information. Iftikar Geelani, a journalist and son-in-law of All Parties Hurriyat Conference (APHC) leader S A S Geelaniu, was arrested on June 9, 2002 under the Official Secrets Act for allegedly possessing documents compromising national security.

According to media reports, prime accused in the January 22- Kolkata American Center attack and Parthapratim Roy Burman abduction Aftab Ansari and seven others were chargesheeted on January 9, for allegedly assaulting a warden of Presidency Jail in November 8, 2002. The Chief Metropolitan Magistrate (CMM) ordered police to produce all eight in the court on January 22. Four security personnel were killed and 17 persons, including civilians, injured in the terrorist attack on the American Center.

Media reports said, Imran Rehman Khan, main accused in the December 2-Ghatkopar bomb blast case, who was deported from Dubai was arrested under the Prevention of Terrorist Act (POTA), on January 9-night. He was remanded to police custody till January 17. Imran had allegedly masterminded the December 2 bomb blast in a bus in Ghatkopar, Mumbai, in which two persons were killed and 31 injured. The judge also directed public prosecutor to file a report on the efforts made by the police to trace absconding accused Khwaja Yunus Sayeed, who had escaped from custody on January 7 while he was being taken to Aurangabad.

According to media reports, on January 12, the Portuguese government handed over India's request for the extradition of Mafia don and key accused in the 1993-Mumbai serial bomb blasts Abu Salem to the chief prosecutor for examination. The move came after authorities there cancelled Salem’s resident work permit, which he had procured after marrying a Portuguese woman on forged documents. The extradition request, which gave an executive assurance to Portuguese authorities of not awarding capital punishment to Salem, if convicted, highlighted his role in the conspiracy leading to the Mumbai-serial blasts. Salem was arrested in Lisbon on September 18, 2002.

He was released as the government withdrew charges against him. Iftikar Geelani’s counsel said a case for compensation and probe into the ‘‘conspiracy’’ to level allegations against him would be filed soon. Iftikar Geelani said he was victimised by certain people in the Intelligence Bureau (IB) and some bureaucrats, but did not mane them. Basha is also the prime accused in the 1998-Coimbatore serial bomb blast case. The Court also convicted 22 others, including two women- Arifa Begum and Ayesha alias Sangeetha, in the case relating to the seizure of arms and explosives from various parts in Chennai in 1998, after the Coimbatore blasts, sources said. The Judge has fixed January 27 for awarding sentences to the convicted persons, after hearing representations from them. Except for Basha, the other accused are charged with criminal conspiracy, violating the Explosives Substances Act (ESA) and Criminal Law (Amendment) Act by supporting the Al-Umma, causing riot with deadly weapons and preventing officers from performing their duty. Basha had been arrested in Chennai on the day of the Coimbatore blasts and the others some time later.

Media reports said, on February 18 Mohammed Altaf, an accused in the December 2, 2002-bomb blast inside a bus in Ghatkopar, Mumbai, informed a special Prevention of Terrorism Act (POTA) Court that police had forcibly obtained his signature on a version of his confession. He said that confession was not what he made, on February 17. Subsequently, a Magistrate had, on February 18, recorded his confession. Altaf confirmed its contents before the POTA Court and said it was voluntary. He said in his confession before the Magistrate, "Myself, Abdul Mattin, Yunus Khwaja, Muzzamil Ahmed and Zahir Shaikh are innocent and not involved in Ghatkopar bomb blast or in the conspiracy to trigger the explosion… We do not believe in jihad. Jihad is not wanted in India. It may be relevant in Palestine, but not in India. We also do not believe in fundamentalist activities," he added. The POTA Court remanded Altaf and the other accused to further custody till February 28. Altaf was deported from Dubai on January 26, 2003 and arrested under POTA.

The Portuguese authorities also produced Salem in a Court in Lisbon to extend his judicial remand, which expires on March 18, today. The Central Bureau of Investigation (CBI) received Letters Rogatory (LR) from Portugal asking for details about some of the documents procured by Salem from India, which facilitated him in obtaining a fake passport on forged documents in Portugal, report said. As reported earlier, the CBI had put up a request for his extradition and forwarded certain documents to support their claim that Salem is wanted in India for serious offences. Salem was arrested in Lisbon on September 18, 2002, on forgery charges.

The CBI alleged that Pathan had sent co-accused Manoj Kumar Bhanwarilal Gupta alias Munna, Ethesham, Shahnawaz Khan, Akbar Abu Sama Khan and Karimulla to help Tiger Memon in landing arms and ammunition at the nearby Raigar coast. Pathan and co-accused Gupta, as well as Mohammed Dawood Yusuf Khan, had allegedly carried a bag containing three AK-56 rifles and nine magazines and kept it at the residence of Mohammed Dawood. It is, however, "of the view that the speech delivered by Vaiko on June 29, 2001, if properly interpreted and read in the entire context of the speech and the surrounding circumstances, does not attract the provisions of POTA." The original affidavit said Vaiko’s speech was supportive of the proscribed Sri Lanka-based Liberation Tigers of Tamil Eelam (LTTE) and was "an act of terrorism." Vaiko and other Marumalarchi Dravida Munnettra Kazhagam (MDMK) leaders were arrested under POTA on July 11, 2002. They have been charge-sheeted under Prevention of Terrorism Act (POTA) for allegedly funding terrorist activities in the country. Police sources said Gilani and Bhat had been kept in column number two of the charge-sheet meant for persons not sent for trial. While Gilani enjoys diplomatic immunity, there was not enough evidence against Bhat who was questioned by the Delhi Police in March 2003. Dar was arrested on February 6, 2003 in Delhi for allegedly receiving funds from Pakistan High Commission for passing them on to terrorist groups in Jammu and Kashmir.

A designated court in Delhi on August 7 sentenced a Lashkar-e-Toiba (LeT) terrorist and his two associates under the Prevention of Terrorism Act (POTA). All of them hail from Kashmir. While the LeT terrorist, Feroz Ahmed Sheikh was sentenced to 10 years of imprisonment, his associates Sheikh Sajjad and Mehrajuddin Peer were sentenced to five years of imprisonment. The police also seized 205 gelatine sticks, 20 detonators, 12 alarm clocks with timer, electric wires, soldering machine, clipper machine, polyester yarn, white metal clipper machine and some crackers from their possession. The arrested persons, identified as Arshad Shafique Ansari, Sayyed Mohammed Abdul Rahim, latter’s wife Fahimida Sayyed, and their daughter Fahreen Sayeed were later booked under the Prevention of Terrorism Act (POTA). The police also suspect their involvement in the July 29 Ghatkopar bomb blast case in which three persons were killed.

According to a media report, on September 10, Inderjit Singh Reyat, a key accused in the Kanishka passenger aircraft bombing case, testified before a Vancouver Court in Canada. Reyat reportedly said that Talwinder Singh Parmar, then head of the Babbar Khalsa (BK), a Sikh terrorist outfit, had paid a visit to his home in Duncan on Vancouver Island in June 1985 and discussed about making an explosive device to be used in India. In February 2003, Reyat had pleaded guilty to manslaughter and was sentenced to five years in prison. 329 passengers were killed when the aircraft was blown up over the Atlantic Ocean on June 23, 1985.

The Delhi High Court on October 29 dismissed the appeals of Mohammed Afzal and Shaukat Hussain Guru, against their conviction under the Prevention of Terrorism Act (POTA) in the December 13, 2001 Parliament attack case and awarded death sentences to them. However the court acquitted two other accused in the same case, S.A.R. Geelani, a Delhi University lecturer and Afsan Guru, wife of Shaukat Hussain Guru, on the basis of insufficient evidence. Both the accused were earlier sentenced to death by a special court on charges of conspiring in the attack.

Salem was charged on three counts by the Sixth Penal Court of Lisbon which sentenced him to three years prison term for forgery and continued use of forged documents; two years for resisting arrest and assaulting a police officer on duty; and one year for perjury on account of willful and deliberate false depositions before a competent court there on his identity as Arsalan Mohsin Ali, a Pakistani national. Although under Portuguese law, the terms of imprisonment add up to six years, the court sentenced him to a prison term of four and a half years. His associate and film actor Monica Bedi was found guilty on charges of forgery and continued use of forged documents. However, the court sentenced her to a lesser term of two years, as Salem reportedly confessed to having secured a passport for her in the name of Sana Malik Kamal. Both were arrested in Lisbon, capital of Portugal, on September 18, 2002, on an Interpol ‘red corner’ notice.

Dismissing a batch of writ petitions on December 16, the Supreme Court upheld the constitutional validity of the Prevention of Terrorism Act, 2002 (POTA), observing, that "terrorism is affecting the security and sovereignty of the nation. It is not State-specific but trans-national." The court clarified that people who merely supported a terrorist organisation without aiding its activities could not be booked under the anti-terrorist law, unless the accused had criminal intention. The apex court also upheld the validity of Section 14 of POTA, which says that individuals - including journalists and lawyers - or organisations were obliged to provide information about terrorist activities to the police. The Court also held that Parliament, and not the State Legislatures, was competent to enact such a law to counter terrorism. However, the Court also held that an accused under POTA could seek bail under Section 49 (7) even before the expiry of the one-year period. And, on the expiry of the detention period under POTA, the accused could be released on bail under the ordinary law without the rigor of Section 49 (7).
