The Bombay High Court (BHC) on January 14 cleared the way for a Islamabad’s Judicial Commission to visit Mumbai in connection with November 26, 2088 (also known as 26/11) terror strikes probe in the first week of February, reported The Times of India. The Court informed the Centre that the in-principle approval for the Commission's trip has been given and they could come in the first week of February. "India will in a day or two convey the High Court's view and availability of dates to Pakistan. The exact date will, however, be decided by Islamabad depending on convenience of the panel," said an official. The Commission is supposed to take statements of officers linked to the 26\11 probe, including additional chief metropolitan magistrate R V Sawant Waghule and Investigating Officer Ramesh Mahale, and also the doctors who carried out the post-mortem of the terrorists killed during the attack. The delegation will include Khalid Qureshi, the head of the Federal Investigation Agency's Special Investigation Group and two main prosecutors Muhammad Azhar Chaudhry and Chaudhry Zulifqar. Since representatives of the defence lawyers too would be part of the Commission, five counsel of seven Pakistani suspects charged with involvement in the 26\11 attacks had informed the Anti-Terrorism Court there that they were prepared to go to India.

The life sentences awarded to six Harkat-ul Jihad-al-Islami (HuJI) cadres, including three Pakistani, by a trial court for plotting to abduct cricketers Sachin Tendulkar and Saurav Ganguly in 2002, were reduced to eight years each by the Delhi High Court on January 23, reports Times of India. While upholding the trial court's 2010 judgement, a bench of justices S Ravindra Bhat and S P Garg, however, modified the order on their sentence and reduced the life term awarded to them to eight years on the ground of parity. The high court reduced the sentence, acceding to the pleas of the HuJI militants that three other key accused, who had earlier confessed to their crime, were awarded 8 years' jail term in 2007 under the Prevention of Terrorist Activities (POTA) Act. The court's verdict came on appeals by three Pakistani convicts Tariq Mehmood, Arshad Khan and Ishaq Ahmed and their three Indian accomplices, Ghulam Mohammed Dar, Ghulam Qadir Bhat and Mufti Mohammed Israr, who had been convicted under the provisions of the POTA, the IPC and the Arms Act.

A fast track court Coimbatore (Tamil Nadu) on February 29 found five activists - Shajahan, S Shameem Ul Islam, A Syed Muhammed, Syed Abdul Raheem and Khader Bhawa - of banned Students Islamic Movement of India (SIMI) guilty of publishing an article against the unity and integrity of the country in the tabloid Seithi Madal way back in 1999. Another accused, Abu Tahir was exonerated. Though they had been sentenced to three years of imprisonment and a fine of INR 10,000, they had to be released as they already served their prison term during the course of the trial. The tabloid carried an article by SIMI activist SHM Moideen (who succumbed to illness before arrest) comparing the then social situation in Kashmir with strife torn Kosovo and targeted the Indian Army and territorial integrity of India. Police found that the content threatened the federal structure and unity of the country.

The Madras High Court on April 11 reserved orders on petitions seeking of lifting the ban on Liberation Tigers of Tamil Eelam (LTTE) in India, reports The Times of India. The Government of India banned the LTTE by an order dated May 14, 2010, and the matter was referred to a statutory panel headed by a High Court judge, Justice Vikramjit Sen for ratification. In November 2010, the tribunal rejected the pleas of Marumalarchi Dravida Munnetra Kazhagam (MDMK) leader Vaiko Gopalaswamy and others, on the ground that no member of the banned organization had challenged the ban. Justice Sen had said: "Indian soil is being used for unlawful activities propelled by the remnant cadres of the LTTE. There is sufficient material to declare the LTTE as unlawful association as contemplated under the Prevention of Unlawful Activities Act. Illegal immigration of LTTE cadres through coastal areas, smuggling of narcotics to raise funds and supply of fuel and explosives from the Indian soil are all evidence of the active presence of LTTE in India." The present petitions were directed against the tribunal's finding.

The NIA special court on May 21, declared accused Junaid Akram Malik, Amir Kamal and Shakir Hussain Sheikh alias Chhota Hafiz from Kishtwar District as proclaimed offenders in the case. This means that despite repeated orders from the court, the accused failed to appear before it and therefore the investigating agency has the right to attach their properties. The development, however, is unlikely to have any impact on the case or on the chances of the agency apprehending the accused. While Junaid is feared dead, Army, whose help has been sought to apprehend the other two, has already told NIA that they are unlikely to be caught alive.

Investigators probing the July 13, 2011 (13/7) triple blasts have learnt that Delhi-based hawala (illegal money transfer) operator Kanwalnayan Pathrija not only transferred funds for the bombings, but also used three SIM cards obtained on fake documents as reported by The Times of India on June 6, 2012. The SIM cards were from a set of cards provided to operatives of Indian Mujahideen (IM). According to the chargesheet filed by the anti-terrorism squad (ATS), suspected Pakistani bombers Waqqas Shaikh and Tabrez alias Danish, arrested accused Naquee Ahmed and Nadeem Akhtar and wanted accused Tehseen Shaikh and Muzaffar Kola had used SIM cards which were obtained using forged documents. "Pathrija (42) used three such SIM cards," said an ATS officer. "We have obtained the call detail records of these SIMs." The ATS chargesheet in the 13/7 case also mentions that the DNA of a woman was found in Byculla's Habib Mansion, the building where the suspected bombers stayed. "We had sent several seized items to the state forensic science laboratory for analysis. The forensic reports state that one of the three toothbrushes seized by the police from the room contains a woman's DNA," said an ATS officer. "It is likely that a family stayed in the room before the bombers rented it. Our probe has not reaveled the involvement of a woman, but we are probing all angles," the officer added.

The centre on June 6, 2012 told the Supreme Court that a red corner notice has been issued against Indian Mujahideen (IM) operative Fasih Mehmood for his alleged role in various terrorist activities, but refuted his wife's claim that he was abducted in a joint operation by Indian and Saudi Police in Dubai, according to Hindustan Times. Additional Solicitor General Gaurab Banerjee also submitted to the bench of justices K.S. Radhakrishnan and J.S. Khehar, a copy of the "red corner notice (RCN)" which was issued through Interpol and carried a warning, that Fasih "may be armed, dangerous and violent." The notice stated that 30-year old Fasih, a resident of Bihar's Darbhanga district, was a member of the IM and responsible for the Pune German Bakery blast on February 13, 2010; Bangalore Chinnaswami Stadium blasts on April 17, 2010 and Delhi's Jama Masjid shootout and blast on September 19, 2010. During the course of investigation, 7 persons were arrested and interrogated. They voluntarily confessed that they along with Fasih Mehmood and other absconders belong to the banned outfit called IM. The absconding accused Fasih Mehmood is an active member of IM since 2003. At present the absconding accused is hiding himself in Kingdom of Saudi Arabia. It was submitted that several cases under various Indian Penal Code (IPC) sections like 120B (criminal conspiracy), 121 (waging or attempting to wage war against India), besides various provisions of the Explosives Substances Act and Prevention of Damage to Public Property Act have been lodged against Fasih. Further, the centre told the Supreme Court that its agencies had no role in alleged arrest of Fasih Mehmood on May 13, 2012, according to The Times of India. Responding to the court's notice, Gaurab Banerjee told a bench of Justices K S Radhakrishnan and J S Khehar that its investigating agencies neither accompanied Saudi Arabian Police in effecting the alleged arrest nor had he been brought to India. Banerjee said "The external affairs secretary and the home secretary have conveyed that neither Indian agencies nor its officials were part of any alleged action to arrest Fasih in Saudi Arabia. It is not correct to say that Indian police arrested him. He is not in India”.

The Special Maharashtra Control of Organised Crime Act (MCOCA) court, on June 11, postponed the recording of the statements of the accused in the July 11, 2006 Mumbai serial train blasts after the defence moved an application seeking to record the testimonies of two witnesses, according to Indian Express. One of the defence lawyers, Advocate Abdul Vahab Khan, moved an application seeking permission to examine a metropolitan magistrate, who had recorded statements of arrested accused under the Code of Criminal Procedure (CrPC). Special judge Yatin D. Shinde will decide on the application on Tuesday (today). The court, meanwhile, allowed another application seeking permission to recall a witness, who had already deposed before the court as a prosecution witness. “This witness is a sanctioning authority and sanctioned most cases between 2005-08 and has claimed that the banned organisation Indian Mujahideen (IM) was responsible for all the blasts between this period. We need to examine him on certain aspects, which he has earlier told the court,” said Advocate Khan. The Maharashtra Anti-Terrorism Squad (ATS) probing the case had arrested 13 accused claiming they were members of the banned organisation Student’s Islamic Movement of India (SIMI) and Lashkar-e-Toiba (LeT). The agency in its chargesheet had charged them under various sections of Indian Penal Code, MCOCA and Unlawful Activities (Prevention) Act.

A bench of Justices S Ravindra Bhat and S P Garg of Delhi High Court on August 5 upheld the acquittal of seven alleged terrorists on the ground they were nabbed after a “fake encounter" in 2005 and were falsely implicated, reports The Times of India . The bench upheld the acquittal, dismissing the Police appeal against the trial court's verdict. The court, however, modified the trial court's order for registration of an FIR against four Policemen for faking the encounter and giving false evidence. Police claimed that, acting on a tip-off that the accused, planning a strike in Delhi and its satellite towns, including Gurgaon, would be coming to the capital, arrested four of the seven accused after a shootout on the intervening night between July 1 and 2 in 2005 near Delhi-Gurgaon border, and seized a huge cache of arms and ammunition. The remaining three were arrested later. As the accused, later identified as Saqib Rehman, Nazir Ahmed Sofi, Gulam Moinuddin Dar and Bashir Ahmed Shah, did not stop their car, they were chased by a team led by Sub-Inspector Ravinder Tyagi, who fired from his service revolver in response to firing by Saqib, Police said. Police also claimed to have recovered one AK-47 rifle, two magazines, 130 live cartridges, 2 hand grenades and 3 UBGL grenades at the instance of Saqib and this crucial evidence was ignored by the trial court. The lower court had acquitted all the accused saying the alleged encounter did not take place at all and a false encounter was projected.

The National Investigation Agency (NIA) on August 9 filed a supplementary charge sheet in the 2007 Samjhauta Express blast case in a Panchkula (Haryana) court, reports Times of India. The charge sheet, second in the case, was filed against former Rashtriya Swayamsevak Sangh (RSS) activist Kamal Chauhan and Amit Chauhan alias Amit Totala and for the first time mentions Lokesh Sharma and Samunder alias Rajender Chaudhary as bomb planters along with Kamal and Amit. Sharma, who was arrested in 2010, is mentioned only as a conspirator in the previous charge-sheet in the case that was filed in June 2011 against him, Naba Kumar Sarkar alias Aseemanand, Ramji Kalsangra, Sandeep Dange and Sunil Joshi. While Joshi is dead, Dange, Kalsangra, Amit and Samunder are absconding. The charge sheet, however, makes no mention of RSS leader Indresh Kumar whose name had earlier come up as an alleged conspirator in various cases, including Samjhauta blast. NIA sources said the agency has not found any evidence against Indresh. On February 18, 2007, a series of blasts ripped through Samjhauta Express near Panipat, Haryana, leading to the death of 68 people, most of them Pakistani nationals.

Investigations have revealed that Indian Mujahideen (IM), has links with the international Islamic organization Hizb-ul-Tahrir (HuT) banned in Germany and Bangladesh, as reported on September 27, by The Times of India. In a charge sheet filed a few days ago, Delhi Police has claimed it found documents related to HuT from the hideout of an IM member named Shakeel. This is the first instance of an IM-HuT link being found in India. Further, Delhi Police had filed two charge sheets against IM members and the alleged handler in the November 26, 2008 (26/11) Mumbai (Maharashtra) attacks case, Syed Zabiuddin Ansari alias Abu Jundal. The first charge sheet is against IM militants Kafeel Akhtar, Kamaal Hasan alias Bilal and Mohammad Shakeel, related to the discovery of an arms factory in Meer Vihar, Delhi in 2011. A team led by Special Cell DCP Sanjeev Yadav reported that the factory was being run by Ahmad Zarar Siddibappa alias Yasin Bhatkal, the IM ‘chief’ in India. Sources say the suspects' questioning yielded details about HuT and its link with IM. With Interpol's help, Delhi Police found that IM's HuT links are active in Austria, Ankara (Turkey) and Beirut (Lebanon). The banned outfit has a presence in more than 40 countries, and about one million members. It even has a base in the UK and a growing presence in North America. In the second charge sheet, Jundal is accused of involvement in terror activities across India. "He, along with Lashkar-e-Toiba [LeT] chief Zaki-ur-Rehman alias Lakhvi, monitored the 26/11 attacks from a control room at Malir in Karachi [Pakistan]," says the charge sheet. It also names Fasih Mohammad as a suspect in the Bangalore and Delhi blasts. He has been detained in Saudi Arabia. In addition, September 26, Zee News reported that Delhi Police said this is in a supplementary charge sheet in the Jama Masjid blast case (September 19, 2010) in which 11 IM militants were charge sheeted earlier. The investigators said during the probe it became evident that Jundal was also involved in the Jama Masjid blast case. The charge sheet said Jundal stated that one of the LeT operatives, Asim alias Abu Kahajo, the main handler of 10 terrorists involved in Mumbai terror attack, blamed failure of intended operation in September 2008 on selection of wrong time and the bad situation of Moon. "All ten persons involved in the 26/11 attack were taught Hindi and Mumbai's local language for ten days at terrorist camp at Baitul, Muzafaraad by Jundal, who is himself a native of Beed District in Maharashtra. The ten terrorists who had executed the attack are Abu Akasha, Abu Umar, Ismail, Ajmal Kasab (lone surviving 26/11 terrorist), Abdul Rahman Big, Abdul Rahman Small, Abu Fahadulla, Musab, Umer and Ali. In his disclosure statement annexed with the charge sheet, Jundal said that a control room was set up by Zaki-ur-Rehman at one Yaqoob's office in Karachi for monitoring of the terror attack and that Jundal himself was speaking to Abu Akasha and Fahadulla from the control room. Besides Jundal and Lakhvi, those who were present in the control room were Abu Alkama, Abu Kahaja, Khalida alias Wasi, Zarar and Shahid alias Nadeem. The charge sheet also says that Jundal had in his disclosure statement revealed that a total of 12 persons had received training for the 26/11 attack but two of them Abdulla and Qasim left the operation. The Police has booked Jundal under section 471 (using as genuine a forged document), 489 B (using as genuine, forged or counterfeit currency), 489 C (possessing counterfeit currency) and 120 B (criminal conspiracy) of Indian Penal Code (IPC). And also under various provisions of the Explosive Substances Act, and the Unlawful Activities Prevention Act (UAPA), besides the Passport Act and Arms Act. The charge sheet said besides the Mumbai mayhem, Jundal also confessed to his involvement in various terror attacks across India including Aurangabad arms haul case, Chinnaswamy stadium blast case, the 2010 German bakery blast and the Nasik Academy attack case.

Yasin Bhatkal, ‘chief’ of Indian Mujahideen’s (IM) India operations, planted the bomb at Dadar in the July 13, 2011 (13/7) Mumbai (Maharashtra) serial blasts himself, according to the confessional statement of Nadeem Sheikh, a key accused in the triple blasts, reports The Hindustan Times on October 9. The Maharashtra Anti-Terrorism Squad (ATS) which is probing the case has also learnt that on July 7, 2011, six persons including Bhatkal, Ahmed, Waqas, Tabrez, Munnabhai and Sheikh had met at Habib building in Byculla to plan the serial blasts. According to Sheikh’s statement, Bhatkal’s main objective behind the terror act was to create communal disharmony in Mumbai. Sheikh’s statement, which runs into 25 pages, details the conspiracy, meetings, financial transactions and also information about how IM operatives went about executing the blasts. Money for the entire operation was sent through hawala (illegal money transfer) channel by Riyaz Bhatkal through Haroon Naik’s network of hawala operators. The conspiracy began in February, 2011 when Bhatkal came to Mumbai, and with the help of Naquee Ahmed and Sheikh, hired a room on rent at Habib building. Recorded before an additional chief metropolitan magistrate’s court in March, it was opened before the special Maharashtra Control of Organised Crime Act (MCOCA) court last week during the hearing of the bail plea of Kanwar Pathrija, an accused in 13/7 serial blasts for receiving and delivering terror money through the hawala channel.

Syed Afaque Iqbal has now been booked by the Special Investigation Team (SIT) for reviving banned Student Islamic Movement of India (SIMI) in Hyderabad (Andha Pradesh), reports twocircles.net on October 12. SIT has also claimed that Afaque Iqbal and Dr. Abu Faisal co-authored two books ‘Common destruction’ and ‘44 ways to participate in Jihad’ for advancing their goals. He was shown arrested from Vadodra Railway Station, while he was picked up from his rented room in Hyderabad. There are cases booked against him in Hyderabad since June, 2011, soon after his arrest, but was not disclosed till now. The Anti-Terrorism Squad (ATS) on November 3 filed a supplementary chargesheet in the special court against suspected Lashkar-e-Toiba (LeT) operative Zabihuddin Ansari alias Abu Jundal in the 2006 Aurangabad arms haul case, reports The Times of India. "The chargesheet names Jundal as the main conspirator along with co-accused Fayaz Kagzi," ATS Chief Rakesh Maria said. According to the ATS, one of its teams chased a Tata Sumo and an Indica on the Chandwad-Manmad Highway near Aurangabad on May 8, 2006, and arrested three suspects and seized 30 kilogrammes RDX, 10 AK-47 rifles and 3,200 bullets. Later, the police seized 13 kilogrammes RDX, six AK-47s, 50 grenades and two swords from other suspects. Those arrested reportedly told the Police that the consignment was brought by Jundal, who had fled along with Kazgi to Pakistan. Maria said the confession statements of 10 co-accused and the statements recorded under Section 164 of the Criminal Procedure Code are crucial evidence that highlight Jundal's complicity in the case.

Tahir Merchant alias Tahir Taklya, an accused in the March 12, 1993 Mumbai (Maharashtra) serial blasts case and a close aide (cashier) of Dawood Ibrahim, has told the National Investigation Agency (NIA) that the underworld don and his company were behind the operation of smuggling in Pakistan-manufactured Fake Indian Currency Note (FICN) worth several crores of INR to India since 2007, Daily Poineer reports on November 16. Taklya was left in the NIA’s custody for questioning in connection with the Karippur (Malappuram District of Kerala) counterfeit currency note case pertaining to the seizure of FICN worth INR 7.25 million from a passenger, Muhammad Alshad from Ras-al-Khaimah at the Kozhikode international airport at Karippur on August 16, 2008. Tahir have told the NIA that FICN were manufactured in Quetta (Balochistan, Pakistan) from where it was taken to Dubai and Abu Dhabi by an agent of the Pakistani Inter-Services Intelligence (ISI) for smuggling in to India for destabilising the country’s economy and for mobilising funds for extremist operations. According to Tahir, his source of Pakistan made FICN was one Imtiaz Ibrahim from Karachi (Sindh, Pakistan). Later Tahir would smuggle FICN into Kerala (mainly Kasaragood District) and other parts of India using passengers as couriers. He further said fake currencies worth INR 100,000 were being exchanged for actual Indian notes worth INR 45,000. INR 33,000 of this would go to the Dawood while the remaining INR 12,000 would be distributed among the agents working at various levels. He told the NIA that Dawood’s brother Anees, stationed in Pakistan, was one of the persons controlling the operation.

Mohammed Ajmal Amir Kasab, the lone surviving Lashkar-e-Toiba (LeT) terrorist from the November 26, 2008 (26/11) terror attack, was hanged to death at the Yerawada Prison in Pune (Maharashtra) at 7.30am on November 21 (today), reports The Times of India. Union Minister of Home Affairs Sushilkumar Shinde said, “Ajmal Kasab was hanged in Yerawada at 7:30 this morning. Pakistan has been informed but there is no demand for Kasab's body.” Kasab, who had been lodged in the Arthur Road Prison in Pune ever since he was arrested immediately after the attack in 2008, was convicted and given capital punishment by the trial court on May 6, 2010, which was upheld by the Bombay High Court on February 21, 2011. The Supreme Court subsequently upheld the sentence on August 29, 2012. Kasab then filed the mercy petition. The Union Home Ministry recommended rejection of Kasab's mercy petition on October 16, 2012, and forwarded the same to President Pranab Mukherjee. Mukherjee sent back the file, accepting the advice, on November 5, 2012. "I was out of the country then for the Interpol meet in Rome. I returned on November 7 and found the file on my table. I signed and sent it to Maharashtra Government on November 8," said Shinde. Kasab was shifted to Yerawada jail two days back. Kasab and nine other Pakistani terrorists had landed in south Mumbai on November 26, 2008, after travelling from Karachi (Pakistan) by sea and had gone on a shooting spree at various landmarks, killing 166 people, including foreigners. Police had succeeded in capturing Kasab alive after killing the remaining nine terrorists. In January 2010, nine of Kasab's associates were buried at an undisclosed location near Mumbai. The President [Pranab Mukherjee] had rejected Kasab's mercy plea on November 5. I signed it on the 6th and the Maharashtra Government signed it on the 8th. The same day, we decided that he will be hanged on the 21st…

The Delhi High Court on November 22, acquitted two death sentence convicts and commuted the capital punishment to life imprisonment for another in Lajpat Nagar (Delhi) bomb blast case (May 21, 1996), reports The Hindu. It, however, upheld the life term awarded to the fourth accused. All the four (alleged Jammu & Kashmir Islamic Front-JKIF militants) had been held guilty and sentenced by a lower court in 2010. A Division Bench, comprising Justices S. Ravindra Bhat and G.P. Mittal, said: “The nature of grave prosecution lapses, in regard to various issues such as lack of proof connecting some of the accused with the bomb incident, failure to hold TIP [Test Identification Parade] of articles and the accused, … [and] not recording the statements of vital witnesses…. underline not only its lapses and inefficiencies, but also throw up a question mark as to the nature and truthfulness of the evidence produced.”

The National Investigation Agency (NIA) on December 10, told the Supreme Court that bail should not be granted to persons engaged in circulating high value Fake Indian Currency Note (FICN) in Pakistan as it amounted to an act of terror intended to destabilize India's economy, reports The Times of India. NIA also equated FICN circulation as an offence under Section-15 of Unlawful Activities (Prevention) Act (UAPA), which means that grant of bail in such cases should be an exception rather than the rule. It said the network for smuggling FICN was seized from Chengamanadum Nadakkavu and Kochi (in Kerala), Bettiah and Raxaul (Bihar), Kolkata (West Bengal), Bhopal (Madhya Pradesh) and Nawanshehr (Punjab). An expert committee, which examined the fake currency, said, "The process of printing and paper make, both in FICN and legal tender of Pakistan, is same." The NIA said that the seized FICN was either smuggled directly from Pakistan or through transit routes like Nepal, Bangladesh and Dubai. The issue of distributing and smuggling of FICN is increasingly becoming a matter of grave concern for the investigating agencies.
