The Delhi Court on February 6 has framed terror charges including conspiracy against Indian Mujahideen (IM) operative Yasin Bhatkal and other eight associates in a case of allegedly establishing an ‘illicit’ arms factory, reports The Tribune. The Additional Sessions Judge (ASJ) Sidharth Sharma framed the charges under Section 18, 20 of the Unlawful Activities (Prevention) Act [UA(P)A], 1967. Along with Yasin Bhatkal, other IM members including Zia-Ur- Rehman, Tehsin Akhtar, Mohd Waqar Azhar, Mohd Maroof, Mohd Saquib Ansari, Imteyaz Alam and Aijaz Shaikh, were also charged. The next hearing is schedule on March 7.

The National Investigation Agency (NIA) team arrested a hawala (illegal money transfers) operative named Abdul Samad in connection to the Lashkar-e-Taiba (LeT) activities in India from Haridwar in Haridwar District of Uttarakhand on February 6, reports Hindustan Times. Abdul Samad was produced before the designated court. The court sends him to the NIA custody of six days, said an unnamed NIA official. Allegedly, Abdul Samad is a prominent hawala operative whose activities area included Muzaffarnagar, Deoband, in Uttar Pradesh and Roorkee in Uttarakhand. He also acted as a channel for a LeT financer based in Saudi Arabia, said an unnamed NIA Spokesperson. In November 2017, Abdul Samad collected INR 5.50 Lakh from hawala operators in Muzaffarnagar (Uttar Pradesh) to deliver it to Shaikh/Sheikh Abdul Naeem/Nayeem, an active LeT member. Shaikh visited and established bases in Bihar, Odisha, Uttar Pradesh and Jammu and Kashmir (J&K) on the directions of his handler Abdul alias Rehan based in Pakistan, said an unnamed NIA official.

The National Investigation Agency’s (NIA) special court in Mumbai on February 7, found guilty an Indian Mujahideen (IM) operative—Haroon Naik in a case related to the Fake Indian Currency Notes (FICNs) and send him for a six-years imprisonment, reports The New Indian Express. Another accused of the same case—Asrar Tailor alias Sagari received the similar punishment. Whereas the NIA court acquitted Azhar ul-Islam Siddiqui alias Munna of all charges imposed on him in the same case. In 2011, the Maharashtra Anti-Terrorism Squad (ATS) raided a guest house in Wadala in Mumbai city District, Maharashtra and arrested Haroon Naik with Indian currency notes in denomination of INR 1,000 and INR 500 worth INR 9.75 Lakh.

A terrorist of Lashkar-e-Toiba (LeT) has been sentenced to seven years rigorous imprisonment by a local court of Bangalore (Karnataka) in a terror financing and money laundering case, on February 8, reports news18.com. Bilal Ahmed Quta alias Imran Jalal, who operated from Karnataka, has also been fined INR 50,000 by the court, they said. A special PMLA court of Judge Shivshankar Amarannavar pronounced the verdict. The case dates back to January, 2007 when the man was arrested with an AK series assault rifle, 200 bullets, five hand grenades and a satellite phone by the Karnataka Police while he was getting down from a bus in Bangalore. He was charged with "waging war" against Government of India, possession of arms and explosives and other sections of the Indian Penal Code (IPC). Quta was involved in these activities since 2001 and was a member of the LeT, they said. The Enforcement Directorate (ED) later booked Quta under the criminal provisions of the Prevention of Money Laundering Act (PMLA) in 2009, taking cognisance of the police charges and subsequent conviction by a local court.

The alleged Islamic State (IS) operative Areeb Majeed on February 8, forwarded his request seeking permission to ‘fight’ his case himself before the National Investigation Agency (NIA) Special Court and to discontinue the services of his appointed lawyer, reports Hindustan Times. Areeb Majeed is under judicial trial facing the various charges of the Unlawful Activities (Prevention) Act [UA (P) A] 1967 and Section 125 of the Indian Penal Code (IPC) for joining the banned terrorist organisation—IS. He had been appointed former Chief Public Prosecutor and NIA’s Special Public Prosecutor Rohini Salian to defend his case in the court of law. On February 8, the Prosecution was schedule to start the proceedings of the case but, Majeed forwarded his application before the designated Court. The court has adjourned the case for hearing on the application and Majeed have to obtain a ‘No Objection Certificate’ or NOC from his lawyer as per the legal procedure.

The Moga District and Sessions Judge Tarsem Mangal on August 7 has freed Jagtar Singh Hawara—a Babbar Khalsa International (BKI) member who was charged in an ‘attempt-to-murder’ case of 2005, reports The Times of India. Jagtar Singh Hawara was convicted for assassination of former Punjab Chief Minister (CM) Beant Singh. In attempt-to-murder case, Hawara was accused of firing at Head Constable Jasvir Singh at Lopon Village in Moga District on February 17, 2005. On August 7, the Defence Counsel urged that case did not hold any legal basis as the charges were not framed in that matter.

The Union Ministry of Home Affairs (UMHA) has assigned two ‘Karnataka’ cases of circulation of the Fake Indian Currency Notes (FICNs) to the National Investigation Agency (NIA), reports The New Indian Express on September 22. The NIA special court Judge—SiddalingaPrabhu passed the order to hand-over the custody of accused Gangadhar Kolkar for 15 days to the NIA-Mumbai. The accused was required for interrogation to ascertain the supply chain of counterfeit notes and also to trace other members of the FICN network involved in ‘damaging the monetary stability of India’. As per the definition of a ‘terrorist act’ as defined in the Unlawful Activities (Prevention) [UA(P)] Act— any action or omission in damaging the monetary stability of India amounts to the ‘terrorist activity’, read the order from NIA court.

A Rajasthan Court on September 29 sentenced one accused to death while awarding life term to six others in 1996 Rajasthan bus blast case, reports The Times of India on September 30. Abdul Hameed who was awarded death sentence belongs to Uttar Pradesh along with two other accused, the rest four belong to Jammu & Kashmir. Another accused was acquitted in the absence of solid evidences. On May 22, 1996, passengers travelling in a bus from Bikaner to Soron near Aligarh in Uttar Pradesh via Jaipur and Dausa were blown up while the bus was passing through Samleti village near Dausa District of Rajasthan. At least 14 persons were killed in the blast including some from Jaipur; a few from Bharatpur and some from Uttar Pradesh while 37 were left injured in the timer blast. Later, the conductor of the bus, who was injured, lodged an FIR at a Police Station in Mahwa in Dausa District. Thereafter, a caller who introduced himself from Jammu Kashmir Liberation Front (JKLF) called up and took the responsibility of the blast in Samleti. After considering the statements of nearly 100 witnesses including the bus passengers and scientific evidences, the Court pronounced the judgment.

The National Investigation Agency (NIA) Special Court in Patna, Bihar on October 11 has awarded life imprisonment to four men—Afroz Ansari, Sunny Kumar, Ishraful Alam, and Alamgir Sheikh in a Fake Indian Currency Note (FICN) case, reports India Today. Reportedly, all four men were charged of committing a terrorist act— “damaging the monetary stability of India through smuggling and circulation of the high quality FICNs under Sections 120-B, 489-B of the Indian Penal Code (IPC) and Sections 16, 18 & 20 of the Unlawful Activities (Prevention) Act [UA(P)A] 1967. The conviction is a result of NIA’s determination which has managed to get a life sentence for the four accused in a span of two years. Usually, life imprisonment is not given in FICN cases but NIA had strong evidences against the accused," said NIA’s Director-General (DG) Y.C. Modi.

The Bongaon Court of 24 North Parganas in West Bengal, on December 15 has announced capital punishment for a Lashkar-e-Taiba (LeT) operative--Sheikh Sameer, for his terrorist activities termed as ‘waging war against India’, reports The Asian Age. After the announcement of his death penalty, Sheikh Sameer claimed himself as an innocent. On April 3, 2007, Sameer and other two LeT operatives--Mohammad Yunuis, and Sheikh Abdullah (both Pakistan nationals) were arrested by the Border Security Force (BSF) officials after they crossed the India-Bangladesh Border. The BSF officials recovered fake Voter ID cards of India, fake Driving License, fake Passports and Visa, Indian and United State (US) currencies from them. The BSF handed-over their custody to the Police and further they were charged with the Sections 121 and 121A of the Indian Penal Code [IPC], with possession of arms, ammunitions and huge quantities of explosives. In 2014, Sameer managed to escape while taking over to Maharashtra for the investigation of another case. In 2017, the National Investigation Agency (NIA) officials arrested Sameer in Patiala in Punjab in a case (undisclosed).

The National Investigation Agency [NIA] on December 27 appealed to the NIA Court in Kochi, Kerala, seeking the custody of arrested Islamic State [IS] operative Habeeb Rahman [25] in a case of IS recruitment, reports The Times of India. Habeeb Rahman—an absconder alleged to join IS in Afghanistan, was arrested by the NIA officials on December 26 from Kalpetta of Wayanad District in Kerala. The NIA prosecutor filed an application before the NIA Court seeking five-day custody of the accused. The court remanded the accused in judicial custody for 30 days and shifted him to Ernakulam jail. The court will consider NIA’s custody application on December 31.

The National Investigation Agency [NIA] on December 27 produced the 10 arrested operatives of Islamic State [IS] inspired module—Harkat-ul-Harb-e-Islam [HuHI] before the Special Court in New Delhi, reports The Tribune. The Special Court allowed 12 days of remand of the accused to the NIA. The interrogation will focus on the details of how the group was formed nearly four months ago, the background of the arrested individuals who do not seem to have previous criminal antecedents, the possible source of procurement of weapons and explosive substances, and the specifics of the vital installations and persons they were planning to launch fidayeen attacks against. The NIA will now thoroughly interrogate the accused, said NIA Spokesperson Inspector-General [IG] of Police Alok Mittal.
