the construction of 22 school buildings to replace structures destroyed by militants in Swat should be completed by the end of January, Shakeel Qadir Khan, Managing Director, Provincial Disaster Management Authority (PDMA) said, reports Central Asia online. The completion of the school buildings would benefit thousands of Swat students whom militants have deprived of an education, Khan said. A total of 183 school buildings are being constructed across Swat, he said, with financial assistance provided by international donors. Most of those 183 buildings will be ready by the end of 2012, he added.

the United Nations High Commissioner for Refugees (UNHCR) asked the Afghan refugees residing in four camps of Lower Dir District to prepare for voluntarily repatriation to their home country by end of this year, reported Dawn. In this regard, an office of the UNHCR called Centre for Voluntary Repatriation (VCR) was inaugurated at Khiaima area of Timergara in Lower Dir. The function was attended by Khyber Pakhtunkhwa UNHCR chief Ahmad, Commissioner Afghan refugees Zaheerul Islam, Lower Dir DCO Mahmood Aslam and Afghan Commissionerate District Administrator Biradar Jan besides elders of refugees and local notables. Speaking on the occasion, the UNHCR provincial head praised Pakistan and Sudan for hosting a large number of Afghan refugees for over 30 years. He said that the refugees had to complete repatriation to their homeland by December 2012. “After the given time the Government of Pakistan will not be responsible for them,” Ahmad said, asking the refugees to ensure preparation for their voluntary repatriation to Afghanistan in an honorable way, informing that townships had been set up in nine provinces of Afghanistan for the refugees’ settlement.

Intelligence agencies and Security Forces (SFs) on January 18 denied the custody of Mohammad Hasnain, a missing official of Khyber Pakhtunkhwa’s Communication and Works (C&W) Department, reports Dawn. Deputy Attorney General Mohammad Iqbal Mohmand informed a Peshawar High Court bench consisting of Justice Mian Fasihul Mulk and Justice Azmatullah Malik that he had filed replies on behalf of the Interior and Defence Ministries and intelligence agencies that they had stated that Mohammad Hasnain, a road inspector in the C&W department, hadn’t been in their custody. Ghulam Nabi Khan, counsel for the missing official, accused intelligence agencies and SFs of taking away many people and said the number of missing persons was the highest in Khyber Pakhtunkhwa. The bench was hearing a habeas corpus petition filed by Mohammad Hussain, father of Hasnain. The petitioner claimed that his son was taken into custody by officials of an intelligence agency from a Khyber Bazaar hotel in Peshawar on January 24, 2011.

Peshawar High Court Chief Justice Dost Mohammad Khan said on January 19 that the cases of missing persons was a major issue of fundamental rights and because of their efforts around 700 such persons had been shifted to internment centres so far, reports Dawn. The Chief Justice said that they were here to defend the Constitution of Pakistan and fundamental rights of individuals and would not allow any of the state agencies to violate those rights. The chief justice said that the high court had drafted a law to set up mobile courts in the province and the same would now be submitted to the provincial Government for legislation. The establishment of mobile courts is aimed at providing speedy justice to people at their doorstep.

They added that all out assistance would be provided to security forces to eliminate saboteurs from the area. “The credit for maintaining sustainable peace and protecting lives and properties of people goes to SFs,” the speakers said. They called upon security forces to take elders into confidence before launching search operation in an area as it would help to tighten noose around miscreants and reduce hardships of local people.

The Provincial Government had decided to ask centre to involve Khyber Pakhtunkhwa during the course of the future tripartite dialogue for the repatriation of Afghan refugees, Minister for Information Mian Iftikhar Hussain said. Hussain said that Khyber Pakhtunkhwa had experienced a negative impact owing to presence of Afghan refugees. Hence, it should be involved for taking decisions in future regarding the return of refugees to their homeland, he added. Hussain further said that Home Secretary Azam Khan briefed the cabinet about the Afghan refugees, informing it that as per the decision of the tripartite dialogue, involving Pakistan, Afghanistan, and United Nations High Commissioner for Refugees (UNHCR) as parties, Afghan refugees had been set a cutoff date of December 31, 2011 for their repatriation. However, the move could not be implemented and the date had now been extended to December 30, 2012, he added. He said the cabinet was informed that the province had 1.6 million Afghan refugees of which some 400,000 were unregistered. The provincial cabinet, said the minister, expressed the hope that the province would be taken into confidence prior to any decision by the Federal Government in that regard.

The News reports that the Khyber Pakhtunkhwa cabinet was told that Kohat Central Jail and Lakki Marwat sub-jail had been handed over to Pakistan Army for conversion into detention centers where under-trail terrorists could be interrogated. Minister for Information Mian Iftikhar Hussain said that after proper identification and classification of the detainees arrested on terrorism charges and the under-trail prisoners would be shifted to detention centers in Kohat and Lakki Marwat Districts. “A list of hardcore militants has been handed over to Special Branch,” Hussain said, adding that some 107 prisoners had been shifted from Central Jail Peshawar to other jails of the province. The Minister said the Provincial Government had requested the Federal Government and the General Headquarters in Rawalpindi (Punjab) to obtain permission for installing jammers to block the use of mobile phones at the Central Prison Peshawar. Mian Iftikhar said the Khyber Pakhtunkhwa Police had arrested 6,236 terrorists and some 24,122 proclaimed offenders during 2011. He said that some 96 cases of kidnapping for ransom took place in 2011 while 242 kidnapping cases were reported in 2010.

He said the Government was optimistic that after new formula for NATO supply presented by Parliamentary Committee on National Security, the US might end drone attacks in Pakistani territory. “If the US wants to continue drone attacks on this side of border, then it (US) should respect our sovereignty and transfer the technology to Pakistan,” he added. The Minister said his Awami National Party (ANP) had suffered a lot in the war against terrorism and forced terrorists to flee from their strongholds. “We have lost around 750 ANP leaders, parliamentarians and workers to terrorism and militancy over four years but didn’t yield to our enemy,” he said. Mohammad Amin Shahidi, Deputy General Secretary of Wahdatul Muslimeen, a Shia organisation, informed the committee that more than 650 Shias in Quetta and 450 in Dera Ismail Khan were targeted and killed recently. He claimed that not a single person was arrested for the killings, adding that few people who were arrested in the aforementioned cases were released on bail. Shahidi said such incidents of lawlessness, hardships in getting justice created frustration among the Shia community, adding that the country’s law and order situation would further deteriorate if the desperate Shias took up arms. The NAHRC was also told that some ‘hidden forces’ were responsible for the killings of Shias in different parts of the country. The committee members agreed that there was no sectarian clash between the Shias and the Sunnis, observing that clerics of both sides agreed to restore peace in Gilgit-Baltistan, Dera Ismail Khan (Khyber Pakhtunkhwa) and Quetta (Balochistan). District Coordination Officer Siraj Ahmad Khan told a press conference that illegal Afghan nationals should leave the province by May 25 otherwise they would be treated according to the law of the land. “Police will arrest illegal Afghan nationals under 14 Foreign Act and they will be deported to their country after May 25,” said Mr Khan, who was accompanied by Commissioner for Afghan Refugees Zaheerul Islam. He said that the Government had decided to expel illegal Afghan nationals from the province and action would be started from Peshawar where approximately 400,000 undocumented Afghans were residing. Pakistan, sheltering the largest refugee population since early 1980s, Afghanistan and United Nations High Commissioner for Refugees had signed a tripartite agreement to legalise stay of registered Afghans till December next. The Government has been issuing such deadlines to illegal Afghans since 2001, but did not implement the same. However, Police had launched a crackdown against Afghan prayer leaders some time ago and deported many of them. Earlier on April 24, Afghan Deputy Refugees and Repatriation Minister Samad Hami said Afghanistan and Pakistan soon plan to sign an agreement that would let refugees stay in Pakistan until 2017, Afghanistan. The deal would protect refugees from forcible deportation from Pakistan, he said.

Mujeeb ur Rehman of the English Department and Sarfraz Khan of the area studies centre received death threats from the TTP on May 1 because of reports that controversial writer Salman Rushdie’s novels would be included in college curricula, campus police officer Abdus Salam Khalid told Central Asia Online May 16. Both professors wrote to KP Governor Masud Kausar, who is also chancellor of the university and to the home secretary requesting protection, he said. “We have issued directives to all the 12 checkpoints at the university to carry out stringent checking of the vehicles and the pedestrians and keep vigil on suspected people,” Khalid added. Khan claimed that unregistered Afghan nationals were leaving Peshawar voluntarily and a large number had gone back during the last couple of days via Torkham border. “Approximately 100,000 illegal Afghans have gone back to their homeland so far,” Siraj Khan told the media. He added that about 400,000 Afghans had been residing in the provincial capital illegally. He said that eviction of illegal Afghans would gain momentum in the coming days. However, a source said that International Agencies, monitoring cross border movement of registered and unregistered refugees between Pakistan and Afghanistan, did not report significant rush of Afghans at Torkham. “United Nations High Commissioner for Refugees (UNHCR) and Ministry of Refugees and Repatriation of Afghanistan did not report considerable increase in number of Afghans, returning to their country,” said the source, adding that the United Nations (UN) Agency and Afghan Government regularly checked cross border movement. The bodies of his three close friends and associates, Altaf Bacha, Haji Niaz Muhammad and Rahim Lala, were also found in the vehicle. Superintendent of Police Asif Iqbal said that personnel of the bomb disposal squad found the bodies after they had been informed about them at around 6.30am. He said the slain men might have been killed elsewhere and their bodies moved to the Ring Road. The chief of the Bazidkhel lashkar and his three associates sustained multiple bullet injuries to their heads and chests, he said. On June 12, two of his Police guards were killed in a suicide attack on his vehicle near his residence, but he survived simply because he was sitting in another car at the time. Meanwhile, both the Tehreek-e-Taliban Pakistan (TTP) and Lashkar-e-Islam (LI) have claimed responsibility for the murder of Mr Rehman and his three associates. “We killed Fahim and his comrades. They raised a militia against us and wanted to defeat us,” Ehsanullah Ehsan, the spokesman for the TTP, told journalists by phone. The report, which was launched during a special function organised by Society for the Protection of the Rights of the Child at the Peshawar Press Club, said a total of 710 schools had been destroyed or damaged by militants in Khyber Pakhtunkhwa. “A total of 640 schools were destroyed in Malakand, while 70 educational institutions were destroyed or damaged in various other districts across the province. In Swat, 121 schools were completely destroyed, while another 280 were partially damaged by militants over a span of two years,” it said. According to the report, almost 25 million children are currently out of school in the country and of them, seven million had yet to receive any form of primary schooling. About juvenile justice system, it said the number of juveniles detained in prisons increased from 1,225 in 2010 to 1,421 in 2011. The detainees included 1,256 under trial and 165 convicted juveniles. “In 2011, Punjab had the highest number of juvenile offenders (833), followed by Sindh (318), Khyber Pakhtunkhwa (241) and Balochistan (40),” it said. The report said progress on approving laws for establishment of borstals in Balochistan and Khyber Pakhtunkhwa remained stalled in 2011.

Hina Khan, a student of class 11, had publicly denounced militants’ atrocities in 2009. “I had left Swat with my family because the militants had threatened girls’ education there but now I feel I would not be able to go to school in Islamabad after these renewed threats,” she told Dawn. Hina held a press conference at the National Press Club in 2008 after her friends in Swat had told her that the militants were becoming more intolerant towards girls seeking education and started bombing schools. “I raised my voice publicly for the sake of their future,” she said.

Khyber Pakhtunkhwa Governor Masood Kausar, on November 7, said, no timeframe could be fixed for withdrawal of combat troops from Federally Administered Tribal Areas (FATA) to peacetime position, reports Dawn. “I can’t say anything about the timeframe to withdraw security forces from the fighting positions to peacetime positions as long as peace is not achieved in Afghanistan,” he told reporters at the conclusion of his two-day visit to Kurram Agency. The Governor said Security Forces would remain in FATA even after restoration of peace in tribal borderlands. He said there was instability in Afghanistan and its fallout was directly affecting nearby tribal areas. Pakistan has over 100,000 army and paramilitary troops in FATA fighting militancy. “I cannot give any date for the pull out of troops as well as return of the internally displaced persons to Fata,” he said. Mr Kausar said normalcy was returning to tribal agencies and IDPs were gradually returning home. He added that around two million people had been displaced in FATA. He expressed satisfaction over the prevailing situation in Kurram Agency and said no major incident of violence had happened during the last two years in the valley.

Addressing a news conference at the Police Club in Lahore Police on November 14 Inspector General (IG) of Punjab Police Haji Habibur Rehman claimed that five Tehreek-e-Taliban Pakistan (TTP) militants allegedly involved in terrorist activities in Punjab province were arrested in a joint operation by the Crime Investigation Agency (CIA) Police Multan and Makhdoom Rasheed Police, reports Dawn. IG Rehman said that the militants belonged to Miranshah, headquarter of North Waziristan Agency in Federally Administered Tribal Areas (FATA). The militants were arrested on information obtained from five others arrested earlier by Khyber Pakhtunkhwa Police. They had planned to carry out terrorism activities during the month of Muharram. Home Secretary Muhammad Azam Khan told the cabinet that the 4% conviction rate of terrorists was surprisingly low. Hussain said a large number of those arrested have been 13 or 14-year-old boys who benefit from being classified as minors under the law. He proposed not treating the minors involved in terrorist activities under the same law. He reiterated that the concerned departments were reviewing the situation to ascertain why terrorists were “escaping” due punishment.

KP Police Inspector General (IG) told the cabinet that although there has been an increase in terrorist acts this year, their effectiveness ratio has dwindled as compared to incidents since 2009. “However, incidents targeting police and politicians have increased overall,” said Hussain. The IG also said that due to increased planning and a more effective strategy in 2012, the number of police deaths at the hands of terrorists has decreased by 49% and civilian killings by 47%. The ratio of suicide attacks has decreased by 37%, while the ratio of foiling suicide attacks by law enforcement agencies improved by 29%, he added. In total, 73 police personnel have been killed and 218 civilians (108 in Peshawar) died of terrorist acts from January 1 this year till November 31.

"We have prepared a draft bill aiming to safeguard police, prosecutors and judges involved in terrorism cases," Secretary of Home and Tribal Affairs Azam Khan told Central Asia Online December 11. "The draft has been dispatched to the federal government to strengthen the Anti-Terrorism Court." "Presently, the conviction rate in anti-terrorism court is only 4%, which is surprisingly low," he said. "We are taking a number of measures, including strengthening (our) Forensic Science Laboratory to constitute solid and science-based cases against the terrorists and convict them in courts," he said. The new initiative also aims to remove the fear factor from the minds of judges, prosecutors and police involved in dealing with terrorists, Khan said: "We have also drafted steps to protect witnesses against terrorists," he said. Under the current system, the Taliban walk free from the court because of lack of solid evidence against them, he said, adding that the new law will improve the conviction rate in terrorism-related cases. As many as 914 terrorism-related cases were filed in the Swat courts during the last five years. Judges convicted the suspects in only nine of those cases, media reported.

Khyber Pakhtunkhwa Provincial Information Minister Mian Iftikhar Hussain on December 17 ruled out the need for a military operation against terrorists in Peshawar after attack on the Pakistan Air Force base inside Bacha Khan International Airport on December 15-16, saying the security situation in the district is under control, reports Dawn. “There is no need for the start of a military action in Peshawar because the law and order situation is under control. Police can take necessary steps against terrorism on their own if a need arises,” Mr Hussain told a news conference at Officers Mess in Peshawar.
