An anti-terrorism court judge on January 3 started the trial of Tehreek-e-Nafaz-e-Shariat-e-Mohammadi (TNSM) ‘chief’ Maulana Sufi Muhammad amid tight security in the Central Prison of Peshawar, the Provincial Capital of Khyber Pakhtunkhwa. Sufi Muhammad is facing charges of sedition, conspiring against the State and encouraging terrorism. Public Prosecutor Khurshid said that there were also a host of other charges against him, including those under Section 302 and 324 of the Pakistan Penal Code (PPC). He said Swat Anti-Terrorism Court Judge Asim Imam started the trial of TNSM ‘chief’ Maulana Sufi Muhammad by establishing a camp court in the prison. The proceedings lasted for five hours.

Judicial magistrates at the Karachi city courts on January 6 remanded seven suspected militants in Police custody in nine murder cases and extended their remand in 11 other cases till January 11, states Dawn. The Special Investigation Unit (SIU) of Police held the suspects in Gulshan-i-Iqbal and Gulistan-i-Jauhar area of Karachi in Sindh after a brief encounter and recovered unlicensed weapons and explosive material on January 2. Tanveer Abbas Rizvi alias Kashif, Abrar Hussain Rizvi, Syed Pervaiz Zaidi, Rifat Raza alias Jehangir, Hasnain Abbas alias Faisal, Syed Sikandar Rizvi and Syed Ali Mehdi said to be associated with Sipah-e-Muhammad Pakistan (SMP), have been booked in nine more cases by the Crime Investigation Department (CID) and different Police Stations. The CID obtained the physical remand of the suspects in three cases, including the murder case of Javed Shakoor who was gunned down on August 8, 2010.

A three-judge bench, comprising Justice Javed Iqbal, Justice Khilji Arif Hussain and Justice Anwar Zaheer Jamali, was hearing the missing persons’ case. During May 2’s hearing, Jahangir appeared before the court on behalf of the Human Rights Commission of Pakistan (HRCP) and stated that according to her information, a plan to amend the Anti-Terrorist Act to try terrorists in military courts was being considered. She asserted that such a recommendation had been given by three retired judges. Justice Javed Iqbal later said that the apex court did not interfere in the Government’s affairs and added that the courts had never encouraged mischief mongers, regretting that “criminals were released because Police in most of the cases failed to provide evidence”. He asked the interior minister not to take the directions of the apex court lightly. At the outset of the proceedings, Rehman Malik told the court that Balochistan was a victim of international terrorism. He maintained that first miscreants killed people in Punjab, Hazarwal, Sindh and now they wanted to create a law and order situation in Balochistan.

Two imams (prayer leaders) of Pakistani origin and a relative were arrested in Florida of United Sates (US) on May 14 for their alleged links to the Tehreek-e Taliban Pakistan (TTP), reports Dawn. Federal Bureau of Investigation (FBI) agents arrested Hafiz Mohammed Sher Ali Khan and his son Izhar Khan in South Florida. They will appear before a federal court in South Florida on May 16. The US FBI, which arrested them, is also looking for three other people who are believed to be in Pakistan. Another of Hafiz Khan’s sons, Irfan Khan, was arrested in Los Angeles and will appear in court there. Also charged are three Pakistani residents: Ali Rehman, Alam Zeb and Amina Khan. Ms Amina is Hafiz Khan’s daughter, and Alam Zeb is her son. The four-count indictment alleges that the three defendants arrested in the US planned to provide ‘material support’ to a conspiracy to kill, injure and kidnap people abroad. They also allegedly provided support to the TTP. Hafiz Khan is the imam at Flagler Mosque in Miami. Izhar Khan is an imam at the Jamaat Al Mu’mineen Mosque in Margate of Florida.

The report said that FC and Police exceeded their powers in taking action against the four Russian and one Tajik national. The tribunal, however, said that the foreigners were well-trained terrorists and had entered Pakistan illegally. The refusal was made in a reply submitted by the Foreign Affairs Ministry to the Lahore High Court (LHC) on a petition of Saeed, who had sought legal assistance from the Government. The reply said that the Government was defending the State institution, ISI, before the US court and that Saeed and his organisation were not a part of it. American national Rabbi Gavriel Noach Holtzberg and Rivka had been killed in 2008 Mumbai attacks. Rana Nisar Ahmed, who had been hearing the 26/11 Mumbai attacks case since he was appointed judge of Rawalpindi's Anti-Terrorist Court no III in November 2010, was transferred on June 11. Ahmed had also been conducting the trial of five suspects charged with involvement in the 2007 assassination of former premier Benazir Bhutto. According to a notification issued by the Lahore High Court, Ahmed was appointed as additional district and sessions judge in Shakargarh. The move came hours after Ahmed issued a permanent arrest warrant for former President Pervez Musharraf for failing to cooperate with investigators probing Bhutto's assassination.

Federal Bureau of Investigation (FBI) agents arrested Syed Ghulam Nabi Fai (62), in Virginia on charges that he failed to register as an agent of a foreign Government. Zaheer Ahmad (63) was also charged but is believed to be in Pakistan. Both are naturalized US citizens. Pakistan has spent at least USD four million since the mid-1990s lobbying the US Congress and the White House through Fai and the Kashmiri American Council, also known as the Kashmir Center, where Fai served as Executive Director, according to an FBI affidavit filed in US court. An FBI affidavit detailed the alleged scheme in which Fai’s organization received up to USD 700,000 annually from Pakistan to make campaign contributions to US politicians, sponsor conferences and other promotions. “Mr. Fai is accused of a decades-long scheme with one purpose – to hide Pakistan’s involvement behind his efforts to influence the US government’s position on Kashmir,” said Neil MacBride, US Attorney for Eastern Virginia. However, the Pakistan Embassy in Washington issued a statement denying any Government knowledge of such an arrangement. US prosecutors have charged Irfan Khan (37), along with his father and brother, who is also an imam at another Florida mosque, with conspiring to provide material support to terrorists. The three Pakistani-born US citizens were arrested in May 14 and are among six persons indicted on the charges that they conspired to transfer about USD 50,000 and provide other support for the TTP, which the US Government considers a terrorist organisation. In a ruling late August 5, Judge Adalberto Jordan denied bail for Khan, saying he represented a flight risk. The judge had already rejected bail requests by the other two men. Jordan said the evidence against Khan was “substantial” but not as strong as that against his father, Hafiz Muhammed Sher Ali Khan (76), who was an imam at the Miami Mosque at the time of his arrest. All three men have pleaded not guilty to the charges.

Chief Justice (CJ) Iftikhar Muhammad Chaudhry, heading a five-member bench, on August 26 observed that for the last one month situation in Karachi had been out of control and there was a complete breakdown of the government’s machinery, according to Daily Times. “People are being abducted for ransom; beheaded dead bodies of innocents with tied arms and legs, wrapped in sacks, are being recovered in large numbers daily and street crime is rampant,” the CJ observed. He said that target killings took place in other provinces as well, but for the last one month Karachi’s situation had worsened, adding, “It’s high time that someone should take responsibility of Karachi’s mayhem.” The CJ, while rejecting the federal and Sindh governments’ report regarding worsening law and order situation in Karachi, again sought comprehensive report from them on the subject after consultations with intelligence agencies. The apex court observed that it seemed that there was lack of coordination among intelligence agencies regarding sharing of information over law and order situation in Karachi. The Inspector General of Police (Karachi) was directed to proceed against the target killers across the board, irrespective of their party affiliations, and also provide detail of Police Stations and the crimes that take place in their jurisdiction and the manner people were being killed there. The IG was also directed to file details of injured persons, loss of properties and whether people had been arrested and responsibilities had been fixed. During the course of proceedings, Sindh government submitted a detailed report on the incidents of target killings, which have been taking place in Karachi for the last more than one month. According to the report, 300 people were murdered in incidents of target killings, as 232 cases were registered. The report stated that 117 target killers had been arrested and the challans of 179 accused were submitted in the court. Sindh Attorney General contended that judiciary could not resolve the issue of Karachi, as one target killer, who was involved in 100 cases of murder, had been acquitted by the court. Upon this, the CJ remarked that the court could not award punishment without evidences, and it was failure of the investigating agencies, which could not submit proofs to the courts.

A five-member special bench of the Supreme Court, headed by Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry directed that a committee be constituted under the Sindh High Court (LHC) chief justice (CJ), comprising the chief secretary and heads of the Law Enforcement Agencies to supervise and ensure a stern and ordered across the board action against the elements involved in causing disturbance in Karachi. The bench declared that recent violence in Karachi represents unimaginable brutalities, bloodshed, kidnapping and throwing away dead bodies and torsos in bags. The court noted that the Federal Government had also not protected the Sindh province against internal disturbance, thus the Provincial Government on this account, too, failed to carry out functions in accordance with Article 148(3) of the constitution. The court held that Karachi has to be cleansed from all kinds of weapons and Police be depoliticised and strengthened while there is a need for a fresh comprehensive law to eliminate and punish land grabbers and encroachers.

The Islamabad High Court (IHC) on October 11 stayed the execution of Mumtaz Qadri who was convicted of killing former Punjab Governor Salman Taseer, Dawn reported. An IHC bench comprising Chief Justice Iqbal Hameedur Rehman and Justice Mohammad Anwar Khan Kasi took up an appeal of Mumtaz Qadri against his conviction. It issued a notice to the state (prosecution) and ordered that till a decision on the plea the execution on the death sentence be stayed. A division bench of the Balochistan High Court (BHC) on October 12 sought the issuance of arrest warrants of former President Pervez Musharraf and other co-accused nominated in the August 26, 2006 murder case of the former Balochistan Governor Nawab Akbar Bugti, Daily Times reported. The division bench was informed that the statements of former Interior Minister Aftab Ahmed Sherpao and former Governor Owais Ahmed Ghani were recorded who claimed that Pakistan Army carried out the military operation and they came to know about it through electronic media. The court ordered the Deputy Attorney General to present all relevant documents to Turkey, USA and Saudi Arabia in order to seek custody of wanted persons presumably hiding in these countries. The Crime Branch Director informed the high court that he would try to secure the arrest warrants of Musharraf before November. Following his statement, the case was adjourned till November 1, 2011.

Khalid had met LaRose in an online chat room in 2009, when he was 15, according to the indictment and a person close to his family. The indictment released also names Ali Charaf Damache, 46, an Algerian who lived in Ireland and married another suspect in the case, Jamie Paulin-Ramirez of Colorado. Paulin-Ramirez pleaded guilty to providing material support to terrorists, the same charge now facing Khalid. Khalid had been the rare juvenile in federal custody since his July 6, 2011 arrest at his family’s home. “This case demonstrates that we must remain vigilant within our communities to make sure that we bring to justice those terrorists, of any age or background, who seek to do great harm to our citizens,” United States (US) Attorney Zane Memeger said.

The Federal Board or Revenue (FBR) has confessed before the Supreme Court that 3,300 NATO containers loaded with defence goods and equipment have disappeared while cases have been filed against the alleged culprits and they will soon be apprehended. The written reply revealed that the number of missing commercial containers was 28,802. Earlier, after the initial report on 7,922 missing containers, the Supreme Court had handed over the issue of investigation to the Federal Ombudsman, Dr Muhammad Shoaib Suddle. The economy of the country received a severe blow by losing PNR 500 billion as a result of disappearance of 28,802 containers and smuggling due to the inefficiency of FBR. On the other hand, considering it as a direct blow to national security and declaring the FBR as a sick institution, officials involved in investigating the missing Nato containers demanded to suspend the NATO supply immediately and reorganise the FBR.

The ATC acquitted the men after the police failed to present witnesses against them during the prosecution. The three men were earlier acquitted by the ATC in a different case due to insufficient proof. The men, however, are still in Police custody under 48 more charges, trials of which are underway in the ATC.

Younis and his brother in Pakistan were part of underground money transfer system known as Hawala, authorities said. When the Times Square attack was in the planning stages, Younis` brother sent him the cash that he delivered to Shahzad at a Long Island railroad station. Prosecutors in federal court in Manhattan acknowledged that Younis never knew about Shahzad’s plot. Deputy Attorney General Mohammad Iqbal Mohmand told the court that some internees handed over to the Provincial Government had been placed in the ‘black’ category. The bench directed him to produce details of the detainees given in the government`s custody and verify if any missing person whose case was being heard by the court had been among them. It also asked the Provincial Government to adopt tight security checks at detention centres, including prisons, which were notified as internment centres under the new law of Action (In Aid of Civil Power) Regulation-2011.

Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry on December 24 expressed dissatisfaction over the slow disposal of cases in anti-terrorism courts (ATC), delay in submission of charge sheets and frequent adjournments being sought and granted to prosecuting and defence counsel in trial courts, reports Dawn. According to a press release, the chief justice was presiding over a high-level meeting to monitor the performance of ATCs and the role of investigation and prosecution agencies at the Karachi Registry of the apex court. Chief Justice Iftikhar Mohammad Chaudhry said the Supreme Court set up a mechanism for monitoring the performance of the ATC for the quick disposal of the cases and such mechanism was meant to remove handicaps and irritants in the way of expeditious disposal of the cases. The CJ said the menace of terrorism and the situation in Karachi came up for consideration in the five-member SC bench that issued categorical directions to the provincial police and the director-general of Rangers for apprehending culprits and timely investigation in the cases and their effective prosecution so that those found guilty were sent behind the bar. Sindh High Court Chief Justice Mushir Alam and the in-charge judge of the ATCs presented the facts and figures in respect of ATCs. According to the report, 1,124 cases were pending before 11 ATCs in the province out of which some 323 cases are pending in Karachi alone. It said that the meeting was told that since 1998 some 30 convicts under the Anti Terrorism Act and four convicts under the ordinary laws were awaiting execution and on account of such unusual delay in execution, the deterrent effect of the law is missing. Sindh Inspector General (IG) Mushtaq Shah produced a record of the past five months from July24 till date submitting that total 240 cases were registered and 291 accused persons under the anti-terrorism law and 130 cases were charge-sheeted in the courts.
