Meanwhile, authorities on April 25 hanged four militants involved in attacks on civilians, police and troops after they were convicted by the country’s military courts, an army statement said, reports Daily Times. It said the four, who were hanged at a prison in Khyber Pakhtunkhwa, belonged to the Tehrik-i-Taliban Pakistan (TTP). Those executed were identified as Rehmanuddin, Mushtaq Khan, Zafar Iqbal and Obaidur Rehman. According to the Inter-Services Public Relations (ISPR) all the TTP militants had confessed to their involvement in murdering innocent persons and carrying out attacks on armed forces and law enforcement agencies. The Army Chief Qamar Javed Bajwa had confirmed death sentences passed by military courts on 30 militants, some of whom were involved in the country’s worst-ever extremist attack. The military courts – in which the army can try civilians on terror charges in secret, despite strong criticism from rights groups – were established in the wake of the 2014 attack, which traumatised the country. They were seen as an “exceptional” short-term measure to give the government time to reform the criminal justice system, as the military targeted militants in the tribal areas of the northwest. The law expired in January 2017, but was shortly extended for another two years.

After having been accused by Afghanistan of pushing a power-sharing formula involving the Taliban, the Foreign Office (FO) on July 1 defended Pakistan’s role in Afghanistan and said it always tried to make a positive contribution, reports Dawn. “Pakistan wants to see a peaceful, united, prosperous and stable Afghanistan. To that end Pakistan has been making constructive contributions,” FO spokesman Aizaz Chaudhry said. During a meeting with Afghan Ambassador to Pakistan Umer Daudzai Foreign Affairs and National Security Adviser Sartaj Aziz had proposed a power-sharing formula involving the Taliban and other stakeholders in Afghanistan for ending the war there. The proposal did not go down well with the Afghan Government which was already critical of Pakistan’s involvement with the Taliban.

Karachi Anti-Terrorism Court (ATC) on August 7 indicted Muttahida Qaumi Movement-Pakistan (MQM-P) leader Amir Khan and two others in a case pertaining to providing shelter to alleged terrorists, reports Dawn.The senior deputy convener of the MQM-P, former in-charge of security of the now sealed MQM headquarters Nine Zero Minhaj Qazi and Raees, alias Mama, with their absconding accomplices have been charged with allegedly providing shelter to wanted criminals at Nine Zero in Azizabad and using them for terrorist activities.The ATC-XVII judge, who is conducting the trial at the judicial complex inside the Karachi Central Prison, read out charges against the accused. However, they pleaded not guilty and opted to contest the case.The court directed the prosecution to produce its witnesses for evidence on Aug 21.Earlier, the court had indicted Amir Khan and Minhaj Qazi in the same case in November 2017. However, after Raees, alias Mama, one of the absconders, was arrested the court framed an amended charge on them.

A Karachi Anti-terrorism Court (ATC) on September 5 handed down a collective imprisonment of 29 years to a former student on charges of terrorism, possessing explosives and illicit arms, reports Dawn. Syed Rehan Zaidi alias Ali Budha was found guilty of possessing explosives and an illicit weapon, terrorism, encounter with law enforcers and attempting to murder in the remit of MochkoPolice Station on October 2, 2017.The ATCjudge, who conducted the trial in the judicial complex inside the Karachi central prison, pronounced his verdict after recording evidence and arguments from both sides.The judge also ordered the convict to pay PKR150,000 fine or serve an additional sentence of six months on default.

Peshawar anti-terrorism court (ATC) on September 11 indicted four persons for their involvement in the lynching of Mashal Khan, a student of Abdul Wali Khan University Mardan, on April 13, 2017 over the allegation of blasphemy, reports Dawn. The accused persons named Asad Katlang, Sabir Mayar, Arif Khan and Izharullah alias Johny, who had been absconding after the occurrence and were subsequently arrested, pleaded not guilty to the charge and decided to stand trial. The court fixed September 13 for next hearing and summoned some of the prosecution witnesses for that date. Mashal Khan, a 23-year-old student of department of mass communication at Abdul Wali Khan University was lynched by a mob over the allegation of blasphemy. An anti-terrorism court had on February 7, 2018, convicted 31 of the 57 accused persons in the lynching case, awarding death sentence to the prime accused Imran Khan, life imprisonment to five of them and three years’ imprisonment to 25 others.

The Supreme Court of Pakistan on September 12 rejected the Federal Government’s application against a Lahore High Court (LHC) interim order allowing Jamaat-ud-Dawa (JuD) and its affiliate Falah-e-Insaniat Foundation (FIF) to continue their ‘welfare activities’, reports Daily Times. The apex court’s two-judge bench, comprising Justice Manzoor Ahmad Malik and Justice Sardar Tariq Masood, took up the Interior Ministry’s plea. In it, the ministry sought the cancellation of the order passed by the LHC, allowing the JuD to proceed with its ‘welfare activities’ until a decision was reached in its petition challenging a Federal Government ban against the organisation. The Interior Ministry had contended that the interim order was creating a hindrance for Pakistan in complying with international and local legal requirements concerning terror financing. The SC bench observed that the LHC was still hearing the case, and dismissed the Government’s plea to set aside the interim order.

A man was sentenced to death and a PKR 50,000 fine by Additional District and Sessions Court Judge of Sahiwal, Raja Safder Iqbal, on September 13 in a blasphemy case registered with Yousafwala Police Station in 2015, reports Dawn. In case of default on fine payment, convict Arshad Sardar will undergo six months imprisonment. Complainant Hanif Athar said Arshad Sardar, a faith healer of village 93/9-L, uttered blasphemous words about sacred religious personalities. The case was registered on May 5, 2015.

Pakistani authorities released former Prime Minister Nawaz Sharif and his daughter Maryam from jail on September 19 after a court suspended prison sentences they got in July 2018 over the purchase of upscale apartments in London, Reuters reports on September 21, reports Fiji Times. “The prisoners have been set free,” Ishaq Cheema, an official at Adyala jail, told Reuters. Earlier in the day Islamabad High Court suspended the 10-year jail term of Nawaz Sharif. The court also freed Sharif’s daughter and political heir Maryam, who was jailed for seven years on corruption charges relating to the family’s acquisition of the London flats. “The prosecution has failed to show the properties belong to Nawaz Sharif,” Justice Athar Minallah told the court. The convictions are still under appeal with the same court, but the judge said they should be freed immediately while the case continues.

The convicts — Mohammad Nasir alias Khaji, and Mohammad Faheem alias Mirchi — were found guilty of committing crimes punishable under Section 5 of the Explosive Substances Act, 1908 read with Section 6(2) (ee) and 27-A of the Anti-Terrorism Act 1997 and Section 23(i)-A of the Sindh Arms Act, 2013. The Supreme Court on October 31 overturned the conviction of Asia Bibi, a Christian facing execution for blasphemy, reports Daily Times.A three-judge bench headed by Chief Justice Mian Saqib Nisar, with Justice Asif Saeed Khosa and Justice Mazhar Alam Khan Miankhel its members, had reserved its ruling on Asia Bibi’s final legal appeal against execution on October 8.“The appeal is allowed. She has been acquitted. The judgement of the high court as well as the trial court is reversed. Her conviction is set aside,” the Chief Justice said while announcing the verdict to a packed courtroom. “She is to be released forthwith if not required in any other case,” he added. The 56-page detailed judgement was authored by Chief Justice Mian Saqib Nisar, with a separate concurrent opinion note from Justice Khosa.“It is a well settled principle of law that one who makes an assertion has to prove it. Thus, the onus rests on the prosecution to prove guilt of the accused beyond reasonable doubt throughout the trial,” the order noted. “Presumption of innocence remains throughout the case until such time the prosecution on the evidence satisfies the court beyond reasonable doubt that the accused is guilty of the offence alleged against him,” it added.“Keeping in mind the evidence produced by the prosecution against the alleged blasphemy committed by the appellant, the prosecution has categorically failed to prove its case beyond reasonable doubt,” the verdict concluded. “It is not for the individuals, or a gathering (mob), to decide as to whether any act falling within the purview of Section 295-C has been committed or not, because as stated earlier, it is the mandate of the court to make such decision after conducting a fully qualified trial and on the basis of credible evidence brought before it,” it maintained.“Blasphemy is a serious offence but the insult of the appellant’s religion and religious sensibilities by the complainant party and then mixing truth with falsehood in the name of the Holy Prophet Muhammad (Peace Be Upon Him) was also not short of being blasphemous,” Justice Khosa said in his note.

The Supreme Court on November 2 suspended the release of 73 prisoners accused of involvement in terrorist activities, reports Daily Times.The Defence Ministry had filed an appeal against the Peshawar High Court verdict that set aside convictions of 73 persons convicted by military courts on terrorism charges, including suicide attacks and killing of law enforcers and civilians.In its plea, the Ministry maintained that the accused were involved in terrorist activities and sought a stay on their release. It is pertinent to note that the Peshawar High Courthas suspended the convictions awarded by military courts in various cases. The Chief of Army Staff had confirmed the death sentence of the convicts; however, the families of the convicts had challenged the order in the court and it had stayed their execution.

The photographs of Lashkar-e-Toiba (LeT) training camps in Sindh and motorboats used by the 10 terrorists who attacked Mumbai are among evidence presented to an anti-terrorism court on December 8 conducting the trial of seven Pakistanis charged with involvement in the 2008 strikes, reports The Hindu. Officials of the Federal Investigation Agency (FIA) presented the evidence to anti-terrorism court Judge Chaudhary Habib-ur-Rehman during a hearing conducted behind closed doors in Adiala Jail in Rawalpindi. The motorboats and other items, currently in the custody of the FIA custody, were recovered in January 2009. The articles presented by the FIA officials were made part of the judicial record after an initial examination by the judge. The FIA officials told the court that the terrorists involved in the attacks trained in the Arabian Sea on boats named Al-Hussaini, Al-Atta and Al-fouz. They also trained in LeT camps in Mirpur Sakro area of Thatta District in Sindh and Yousaf Goth and Landhi areas of Karachi, the officials said. These training camps covered an area ranging between 25 acres and 48 acres, the officials said. One of the seven suspects currently on trial, Hammad Amin Sadiq, had confessed that the 10 attackers had been kept in the training camps before being sent to Mumbai, the officials said. Sadiq acted as a facilitator for the attackers while they were in Sindh, the officials said. Among the seven Pakistani suspects is also Zakiur Rehman Lakhvi, the LeT's ‘operations commander’. Special Prosecutor Chaudhary Zulifqar Ali had told PTI that the FIA officials recorded their statements and provided details of 350 articles found in the LeT training camps, including life jackets and a "pink foam" or pink colored packaging material. The "pink foam" has emerged as a crucial piece of evidence in investigations of the Mumbai attacks on both sides of the border. Indian investigators found samples of the material at three sites where attackers planted bombs in Mumbai in November 2008.

The Chief of Army Staff (CoAS) General Qamar Javed Bajwa on December 28 ratified the death sentences awarded to 22 hardcore terrorists, reports Dawn. The Inter-Services Public Relations (ISPR) said in a statement that the convicts were reportedly involved in heinous terrorist offences, including attacks on armed forces, law enforcement agencies, explosions of vehicle-borne improvised explosive devices (IED) to carry out sectarian killings, destruction of communication infrastructure, police check posts, educational institutions, and killing of innocent civilians. The convicted terrorists were responsible for the deaths of a total of 176 people, including 19 armed forces personnel, 41 police and Levies officials and 116 civilians, and causing injuries to 217 others. Arms and explosives had also been recovered from their possession. Special military courts had awarded death sentences to these convicts. The courts also handed down imprisonments to 15 convicts and acquitted two accused after finding them not guilty. All 22 of the terrorists were found to be members of banned organisations. They confessed to their offences before a judicial magistrate and in their statements during their respective trials, according to the ISPR.
