The Election Commission (EC) on December 1 invited political parties that contested the Constituent Assembly (CA) election under the Proportional Representation (PR) electoral system to inform them about PR seats allocation on December 3, reports Republica. The commission took the decision to this effect after PR votes were verified by EC officials. According to the EC, a total of 9,463,862 votes were valid under the PR electoral system. As per the provision related to inclusiveness under the PR electoral system, the political parties that will have 30 percent PR seats should send males and women members each 50 percent. According to the EC, 31 out of 122 political parties, which have secured over 18,000 PR votes, will make it to the new CA. Out of the 31, seven political parties have secured over 200,000 PR votes.

The Unified Communist Party of Nepal-Maoist (UCPN-M) after the central committee meeting of the party at Kathmandu decided not to join the CA unless the EC orders an independent investigation into the accusations of ‘systematic rigging’ in the CA election, reports The Himalayan Times on December 2 (today). “None of the victorious UCPN-M candidates has received winner certificates and the party will also not submit the list of candidates for the allocated proportional representation seats unless the EC investigates into the poll rigging,” said party Spokesperson Agni Sapkota. Another leader of the party, Khim Lal Devkota, said, “If the parties wished to continue with the peace process they must join hands with us by accepting our proposals or else they will have to join hands with pro-monarchy leaders like Kamal Thapa.”

Communist Party of Nepal-Unified Marxists Leninist (CPN-UML) chairperson Jhalanath Khanal on December 2 said that a majority Government would be in place, if the efforts to form a consensus Government fail, reports Nepal News. "We are consulting with Nepali Congress and other political forces to form a consensus government," Khanal told a delegation of European Union's ambassadors to Nepal, as they visited Khanal at the CPN-UML headquarters at Balkhu, Kathmandu. "In the case of a consensus government not happening, a strong majority government will be formed," Khanal said. Khanal further said the Government will not be a feeble and unstable one as in the past.

General Secretary of the Nepali Congress (NC), Prakashman Singh, on December 2 said that the NC would now take leadership of the new Government as per the people's mandate received through the recent election to the CA, reports The Himalyan Times. Stressing on the need to promulgate a republican constitution to maintain political stability, he expressed the view that the new constitution could be promulgated within a year by institutionalizing the agreements reached among political parties in the first CA. Singh said that his party would play a key role to promulgate a new constitution on the basis of consensus by taking initiative to forge consensus on the disputed issues in the first CA and added that solution would be found out through election process otherwise.

The Election Commission (EC) has called an all-party meeting on December 3 (today) at 11am to announce the final number of votes in the Proportional Representation (PR) category and the allocation of PR seats in the Constituent Assembly (CA). However, Unified Communist Party of Nepal-Maoist (UCPN-M) and 15 other parties, on December 2 announced that they will not attend the meeting called by the EC, reports Nepal News. A meeting of the dissenting parties held at the UCPN-M's central office decided to boycott the meeting called by the EC until a high-level independent commission was formed to probe into the rigging taken place in the November 19 CA polls.

Senior CPN-UML leader Madhav Kumar Nepal on December 4 said that NC, the largest party in the CA, should come up with a proposal to share power, reports The Himalayan Times. He further said, “If the NC wants to see Dr Ram Baran Yadav as President, we have no problem but he should come through a constitutional process.” Stating that women should rather compete for an equal status and not seek reservation in every field, Nepal said, “We should empower women in such a way within a few years that they are encouraged to compete with men in every sector.” He stated that he wants to see 50 per cent women’s participation in the local bodies in coming days.

The Nepali Congress (NC) party on December 4 said it plans to lead a broad-based coalition after winning the most votes in last month's election, with agreement on a new constitution its top priority, reports Times of India. The NC, one of the country's oldest parties, won 196 of the 575 seats up for grabs in the November 19 polls, according to the final results. The Communist Party of Nepal-Unified Marxists Leninist (CPN-UML) party secured 175 seats in the Constituent Assembly (CA). The Unified Communist Party of Nepal-Maoist (UCPN-M), which swept Nepal's first post-civil war elections in 2008, were humiliated with a tally of 80 seats. Nepali Congress general secretary Prakash Man Singh said “Our first priority is to form a consensus (cross-party) Government. A consensus Government will make it easier for us to promulgate the constitution, which is our primary task."

UCPN-M making an “Executive Summary” of its report on election rigging public at its headquarters in Kathmandu on December 4 concluded that there was “procedural, structural and policy-level” cheating in the November 19 election, reports Nepal News. The party also hinted that there was involvement of State as well as the Election Commission (EC) in the rigging. The party also expressed serious reservation on the issue of transport of ballot boxes from the polling centers after the conclusion of the voting. Speaking on the occasion, UCPN-M chairman Pushpa Kamal Dahal said that his party would not participate in the CA until a high-level probe committee is formed to investigate massive election rigging and other fraudulent activities during the CA election.

The NA said its soldiers played their part with honesty, excellence and professionalism during the polls as per the Government’s policy of holding the polls in a free, fair and fearless manner. A meeting of the Standing Committee said the new mandate from the recently held Constituent Assembly (CA) election should be respected. “We have been raising this issue [of re-election to the President] right since the election results were known,” CPN-UML’s Bam Dev Gautam told media persons after the meeting. The party’s impending move comes as no surprise as it had led a CA poll boycott campaign of a 33-party alliance in the lead-up to the vote. More than 200 leaders, including 151 central committee members and 50 central advisers, will take part in the meeting for which the party will seek a suitable venue for want of space at the party’s Buddhanagar-based headquarters. According to CPN-Maoist leaders, party Chairman Mohan Baidhya will present a written proposal at the meeting proposing that the party should go for a struggle discarding the CA and declaring it illegal. This is the third time the election body extended the deadline for the same. An EC press release said, “A decision to extend the deadline to submit the names of PR candidates has been taken after eight political parties on December 24 made a written request to this effect for one last time.” However, Chief Election Commissioner Neel Kantha Uprety told that extending the deadline to submit the names of PR candidates was ‘against voters’ aspirations’ and that parties ‘must not seek repeated extension of the deadline’. “We have completed everything from our end. A meeting of the Nepali Congress (NC) leaders on December 26 at party president Sushil Koirala's residence in Maharajgunj village in Kapilvastu District ended without an agreement to nominate 91 PR candidates. Communist Party of Nepal-Unified Marxists Leninist (CPN-UML) headed off to Gokarna Resort in Kathmandu on December 25 to select its 84 PR candidates. Unified Communist Party of Nepal-Maoist (UCPN-M) held an informal meeting at the party’s office in Kathmandu on December 26. Speaking to the press after the meeting, party spokesperson Agni Sapkota said that the party will define a number of central committee members in the list and other will be selection on competition basis for the PR seats. A special Central Committee meeting of the Unified Communist Party of Nepal-Maoist (UCPN-M) on December 30 (today) entrusted the party’s central office to select the candidates for the PR list as per the criteria endorsed in the meeting, reports The Himalayan Times. The central office of the party includes former vice-chairmen duo Baburam Bhattarai and Narayan Kaji Shrestha, former general secretary Posta Bahadur Bogati, besides Chairman Pushpa Kamal Dahal. According to UCPN-M Spokesman Agni Sapkota, the Central Committee passed the five-point criteria to select the PR candidates. As per the criteria those who have already taken the positions of benefit, including membership of the legislature and Constituent Assembly (CA), will not be selected for the PR list. This means that the previous CA members and the members of the Interim Legislature will not be considered. Priority will be given to the family members of those killed, rendered disabled or forcibly disappeared by the state during the people’s war and those having special skills, dedication to the party and the people’s movement. The party will try to include representatives from different Districts as far as possible, and will ignore the leaders who had worked for the defeat of the party’s candidates.

The District level leaders and activists burnt important documents they seized from the office, vandalized office equipment, furniture and sign board and set them on fire while chanting slogans against the party leadership. Later, they padlocked the party office to show their dissatisfaction over party leadership’s unilateral decision while selecting the party’s list of final 54 PR candidates. Twenty-eight political parties, including the Nepali Congress (NC) and the Unified Communist Party of Nepal (UCPN-M) submitted their list of candidates under the Proportional Representation ( PR ) as the Election Commission (EC)’s third extended deadline ended on December 30, reports Kantipuronline. The submission of lists followed disputes and serious resentments within all political parties over the handing out of the PR seats. Leaders who did not figure in the final lists alleged their senior leaders of corruption, nepotism and favouritism. Madhesi Janadhikar Forum-Nepal (MJF-N) and Federal Socialist Party Nepal (FSP-N) are the only parties which could not submit their PR lists on December 30. Officials at the EC said they will endorse the names after verifying the parties’ compliance with the provision of inclusion set in the Interim Constitution and the election law. Any party found to have breached the election law will have three more days to make corrections to their lists. Asked what the EC would do if the parties submit the lists on Tuesday, Chief Election Commissioner Neel Kantha Uprety said they would not accept them but the seats will remain “safe”. “The existing provisions do not envisage such situation,” said Uprety. “We will deal with the issues based on how the situation evolves.”

The intra-party dispute took a new turn as dissident leaders said that the list was unacceptable. Senior leader of the party Bahadur Rayamajhi said "The list is unacceptable to us because it was prepared contrary to the criteria that were agreed upon at the party’s central committee meeting. We have already informed our party chairman that we will not accept the list." He claimed that they were forced to protest as some undeserving names were suggested although they were instructed to give priority to the kin of martyrs, family members of those who sustained serious injuries during the Maoist insurgency, and those who have made a big contribution to the party and the country.
