Prime Minister KP Sharma Oli addressing the inaugural session of the Asia Pacific Summit at Hotel Hyatt in Kathmandu on December 1 has said that Nepal’s peace process is exemplary, reports Republica. He said “My government enjoys robust mandate of the people with three-fourth support of the parliament, out of which my party alone constitutes two-third majority. The people of Nepal have voted for stability and economic transformation and as Prime Minister I am proud to dedicate myself to the great service of the nation and people. Equally successful has been our unique peace process, launched in 2006. It was a process invented, led, owned, managed and steered by ourselves. With courageous steps and bold decisions at various critical points of time, we have been able to fundamentally conclude the peace process and leave behind one of the most difficult periods in our history.”

The two-day Asia Pacific Summit 2018 concluded on December 2 by issuing a seven-point Kathmandu Declaration for Peace and Development, appealing to the world community to study Nepal’s peace process as a successful example to resolve armed conflicts elsewhere, reports Republica. The summit organized under the theme ‘Addressing Critical Challenges of Our Time: Interdependence, Mutual Prosperity and Universal Values’ by the Universal Peace Federation noted with concern the increasing threats to global security due to a variety of social, political, and economic causes and stressed the need for mutual tolerance, understanding, reconciliation and dialogue to resolve conflicts and ensure a more peaceful, equitable and inclusive world order. “In this regard, the summit appealed to the world community to study Nepal’s peace process where, after a decade of conflict and violence, armed militants handed over their weapons to the United Nations, and together with other democratic parties participated in constituent assembly elections, rewrote the constitution, integrated two armies, restructured the state, formed the federal democratic republic of Nepal—an unprecedented and historic achievement,” read the declaration.

CIEDP on December 3 organised a press conference to refute the charge of the Conflict Victims Common Platform (CVCP) that the transitional justice mechanism did not do anything and there was no relevance in giving them continuity, reports The Himalayan Times. CIEDP issued a press release saying that the CVCP charter adopted by its national conference held on November 20 and 21 was misleading. Member of the CIEDP Bishnu Pathak, who is also its spokesperson, said despite legal, financial and logistic constraints, CIEDP had completed preliminary investigation into 3,197 complaints. He said CIEDP had decided to conduct comprehensive investigation into 2,420 cases. He said CIEDP’s investigation found 19 people who either reunited with their families or were brought in contact with the families. “CIEDP’s teams have collected data from 56 districts and soon it will cover at least 65 districts,” he added. Chair of CIEDP Lokendra Mallick said the commission only had the mandate to investigate cases of enforced disappearance; the responsibility of prosecuting the offenders lay with the Office of the Attorney General. He said if CIEDP got six to seven years more, it could submit a report with the statements of both victims and perpetrators, but if it had to submit its report before February 10, it would be able to submit only the statements of victims.

Four constitutional bodies and the Prime Minister’s Office are embroiled in a dispute after the latter sought details of their unfinished tasks within 15 days, reports Kathmandu Post on December 3. Citing the “instruction” by Prime Minister KP Sharma Oli, the PM’s Office shot off separate letters on November 27 to the constitutional bodies and ministries, asking them to submit details of their projects and pending works within two weeks. Oli instructed officials to expedite them within the given time frame. Based on the PM’s order, his office wrote to the Commission for Investigation of Abuse of Authority, the Public Service Commission, the Election Commission and the Office of the Auditor General to share with it their lists of pending tasks. None of these bodies were invited for the assessment and evaluation led by Oli. Objecting to the call, a meeting of the heads and members of the four constitutional held at the CIAA on November 30 decided not to reply to the PMO as it would undermine their constitutional authority. “We’re not going to reply to the prime minister’s office,” said the head of a constitutional body on condition of anonymity. “Constitutional bodies do not fall under the jurisdiction of the PM’s Office.”

Rastriya Janata Party-Nepal (RJP-N) leader Laxman Lal Karna speaking at an interaction organised at the Reporters’ Club in Kathmandu on December 4 warned that his party would withdraw its support extended to the government after four days, reports Kathmandu Post. Karna said that there is no point in supporting the incumbent Government as no discussions have taken place regarding constitution amendment and withdrawal of cases filed against his party leaders and cadres during the Madhes movement, which were the basis of their support.

The Commission of Investigation on Enforced Disappeared Persons (CIEDP) has formed five committees in order to carry out various activities including providing identity cards to the conflict victim families and recommendation for action, reports Republica on December 4. These committees are the Suggestion Preparation Committee for Institutional Improvement for Prevention of Conflict in Future with Commission Chairperson Lokendra Mallik as coordinator, the Reparation Recommendation Criteria Preparation Committee under the coordination of Commission member Bijul BK Dulal, the Perpetrator Statement Work Procedure Preparation Committee under coordination of Commission's Spokesperson Prof Dr Bishnu Pathak, the Disappeared Victim Identity Card Distribution Work Procedure Preparation Committee under the coordination of Commission member Nar Kumari Gurung and the Action Recommendation Criteria Committee under coordination of Commission member Aai Bahadur Gurung. Commission's spokesperson Pathak said that the Commission has been working by forming five different committees in order to carry out its works on time. The Commission has carried out detailed study in 56 districts on the enforced disappeared persons. The Commission’s term expires on February 10, 2019.

Two transitional justice bodies have decided to wrap up by presenting a progress report and recorded complaints to the Government if the administration denies them another extension of their term, for looking into the insurgency-era cases of atrocities, reports Kathmandu Post on December 4.The term of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) expires on February 9, and the Government is still undecided whether to extend their term or to restructure them. As the conflict victims’ organisations are against their continuation in the present form, the Government has yet to decide the future course of the transitional justice process. The transitional justice Act needs to be amended through the federal parliament before February 2019 even if the Government wishes to give the commissions more time or to revamp them as demanded by the victims’ organisations. Making its charter public last month, the Conflict Victims Common Platform called for restructuring the two commissions, claiming that they had failed to make the required progress in probing the cases filed to them. Lila Udasi Khanal, a TRC member, said they were working on the reports to submit to the Prime Minister’s Office before their four-year term expires. “The report will incorporate the progress we have made and the reasons why we couldn’t produce the expected results,” said Khanal. The TRC, formed on February 9, 2015, together with the CIEDP has received around 63,000 complaints. It has completed preliminary investigation into hardly 3,000 cases so far. Khanal said the government had not consulted with them so they had no idea if it wants to continue with their term or replace the commission with a new one.

Communist Party of Nepal Chairman Rishi Ram Kattel on December 7 filed a writ petition at the Supreme Court (SC), demanding that the Election Commission (EC)’s decision recognising the name of the newly created party ‘Nepal Communist Party (NCP)’ be quashed, reports The Himalayan Times. The petitioner has named the EC, NCP and its co-chairs KP Sharma Oli and Pushpa Kamal Dahal as defendants. At a meeting held on December 9 at the residence of ruling NCP leader Barshaman Pun, the leaders of major political parties including main opposition Nepali Congress (NC), who in the past were involved in the army integration process, have reached an understanding to take ownership the CIEDP report and replace the existing TRC with an “independent and high-level commission”, reports Republica. AHRC said that Nepal saw a year of poor human rights protection in 2018 and the Government was instead seen to further restrict people’s rights by introducing harsh laws to control the functioning of human rights NGOs and INGOs with its National Integrity Policy (NIP). “As it stands, the NIP will create unnecessary hurdles for the NGOs and human rights community in Nepal. In fact, one of the key aims of the policy is to rein in the NGOs and INGOs working in Nepal. At a time when Nepal is implementing a new constitution with so many grievances from the vulnerable and marginalised communities, it is particularly important that human rights groups and civil society are given space to raise the voices of the vulnerable and marginalised,” it said.

Conflict victims, human rights activists and a section of civil society on December 14 submitted a letter to Swiss Ambassador to Nepal Elisabeth Bon Capeller, expressing their dissatisfaction with the ‘so-called Bangkok meeting on transitional justice’ sponsored by the Swiss Embassy in Nepal, reports The Himalayan Times. “It unfortunately undermined the basic norms of democracy, transparency, rule of law, human rights and justice. We are closely witnessing the ongoing political attempts to derail transitional justice process with an intention to ensure immunity for perpetrators from war crimes, crimes against humanity and other grave crimes. We, therefore, would like to sincerely request all member states of the United Nations, including Switzerland, to stand consistently for end to impunity and fulfilment of the victims’ right to truth, justice and reparation,” reads the letter undersigned by 17 individuals, including Human Rights Organisation of Nepal Chairperson Indra Prasad Aryal. The letter states that they would not endorse any activity supportive to perpetrators-driven transitional justice process, but were ready for genuine collaboration with any member of international community to promote, protect and ensure human rights and peace as per international standards.

It was the fourth day of their hunger strike. Sangrame Sarki, a former Maoist combatant injured in Arghakhanchi in September 2002, said “My legs have become numb. I can hardly feel anything. For me life is meaningless. I wish I better die here if the government does not address our demand.” Frustrated by the Government's negligence, Mangalsen Praja, who was injured during a clash with the security forces, said “I nearly lost my life in war. Shrapnels are still inside my chest. I feel it is better to die instead of seeing the miserable condition of my family.” “I have nowhere else to live except for the street as I have mortgaged my land to receive loan from a bank. I wish I could die here so that my kids would get relief from the government,” says Lilachand Kami, another injured ex-Maoist combatant. Worried over the increasing protests of injured ex-Maoist combatants, Police have already arrested Yubaraj BK, who was leading the protests. Co-chairmen Prime Minister KP Sharma Oli and Pushpa Kamal Dahal had presented the joint paper defending the activities of the party and the Government on the first day of the Standing Committee meeting on December 15. Ten Standing Committee members aired their views. Of them, Bamdev Gautam, Yubaraj Gyawali, Ghanashyam Bhusal, Beduram Bhusal, Agni Sapkota, Haribol Gajurel, Mukunda Neupane, Asta Laxmi Shakya and Ganesh Sah spoke against the document while Minister Shakti Basnet defended the Government. According to the Ministry of Home Affairs (MoHA) the price of peace in Nepal is NR 166 billion and still counting, reports Republica on December 21. Although work on one of the three building blocks of the peace process – transitional justice for conflict victims — is yet to begin in earnest, a rough calculation of the money spent so far has reached the astounding figure of over NR 166 billion. The two other building blocks of the peace process were promulgating a new constitution through an elected Constituent Assembly (CA) and management of the erstwhile Maoist combatants. According to figures prepared by the Government, a total of NR 117.74 billion was spent for promulgating a new constitution through an elected CA. Another major expense the country had to bear for the ongoing peace process is the relief provided to conflict-affected individuals. Although the amount provided to conflict victims during 2016/17 is yet to be tallied from district administration offices (DAOs) across the country, the amount released after 2006 under the head of relief for those affected by the Maoist insurgency has totalled NR 17.34 billion. According to the MoHA, which now oversees the distribution of relief to conflict victims, the money was distributed to the kin of those killed during the insurgency, to single women and the families of the disappeared, among others. Each family of those killed in the course of the insurgency was provided NR 1 million. The Government spent NR 9.796 billion separately for cantonment management, while an additional Rs 1.544 billion was spent for the development of infrastructure in the cantonments. Altogether 17,052 erstwhile Maoist combatants participated in the verification process of integration into the Nepal Army. While 15,642 ex-combatants chose rehabilitation into society, another 1,422 chose integration. The ex-combatants who opted for voluntary rehabilitation were provided a package of NR 500,000 to 800,000, depending on their rank in the Maoist armed outfit.
